513 O Xt C f5laxtI ANNO VICESIMO QUARTO ELIZABETHAE SECUNDAE REGINAE No. 43 of 1975 An Act to validate the erection of a building in New Farm Park in the City of Brisbane and the use of the building and part of the park for library purposes [ASSENTED TO 9TH OCTOBER, 1975 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title . This Act may be cited as the New Farm Library Validation Act 1975. 2. Validation of use and erection . The use for library purposes as a function of local government of Brisbane City Council of the land described in the Schedule and the erection and use for library purposes as such a function of any building or other structure on that land are hereby declared to be lawful and that erection shall be deemed always to have been lawful notwithstanding- (a) the City of Brisbane Town Planning Act 1964-1975 or the provisions of the Town Plan for the City of Brisbane continued in force by that Act or approved under that Act and in force at any material time; or (b) the omission by Brisbane City Council to comply with the provisions of any such Town Plan.

In this Act the term " erection " includes the repair, maintenance, alteration and re-erection of a building or other structure and the making of additions to a building or other structure. SCHEDULE [s. 2] An area of about 3 192 square metres being part of Eastern Suburban Allotment 28 and part of Resubdivisioa 2 of Subdivision C of Eastern Suburban Allotment 29, Parish of North Brisbane, County of Stanley, the boundaries of which commence at a point being the western comer of Reserve 1105 (Park Reserve) and run thence by the south-western boundary of that reserve for a distance of 38 metres, thence by a line bearing 211° 55' for a distance of 68 metres, thence by a line bearing 261 ° 45' for a distance of 49.729 metres, and thence by a line bearing 31° 55' for a distance of 100 metres to the point of commencement, being part of the land contained in Certificate of Title 299276 Volume 1636 Folio 16 which land is known as New Farm Park.
