Application to extend the Kids Paradise Service Representatives – Employee Collective Agreement 2006
New Directions Community Church Inc t/a Tailrace Centre has made an application to extend the default period for the Kids Paradise Service Representatives – Employee Collective Agreement 2006. The application indicated the application was made pursuant to Item 30(4) of Sch 7 to the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (Transitional Act). Sch 7 of the Transitional Act deals with Agreements made during the bridging period. The Agreement was made under the Workplace Relations Act 2006, not during the bridging period. The application should have referred to item 20A of Sch 3 of the Transitional Act. We will consider the application as having been made under Sch 3.
The application seeks an extension from 6 December 2023, the date the Agreement would have expired in accordance with item 20A(1) of Sch 3, until 9 January 2024 to allow arrangements to finalise a replacement agreement. We consider it reasonable to grant the extension.
Pursuant to item 20A(6) of Sch 3 to the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (Cth), we order that the Kids Paradise Service Representatives – Employee Collective Agreement 2006 (the Agreement), is extended until 9 January 2024.
The Agreement is published, in accordance with subitem 20A(10A)(c), on the Fair Work Commission’s website.
