said work : B e i t therefore enacted by the Queen ' s Most Exce l l en t Majesty, by and wi th t h e advice and consent of t h e Legislat ive Council ami Legislat ive Assembly of N e w South Wales in P a r l i a m e n t assembled, and by t h e au thor i ty of t h e same, as follows :—•

described in t h e Schedule to this Act ) is he reby sanctioned ; and the Secretary for Pub l i c W o r k s , or t h e M e m b e r of the Execu t ive Council for t he t ime being per forming the duties of t he said Secretary, is hereby authorised to u n d e r t a k e and carry out t he said work subject to the provisions of this Act , and for t h a t purpose shall be, and shall have the powers and dut ies of, a Cons t ruc t ing A u t h o r i t y wi th in t he mean ing of t he Pub l ic W o r k s A c t of 1888 : Provided t h a t the said works shall no t be commenced to be const ructed unless t he pr iva te lands requi red for t he const ruct ion of t he l ine have been contracted by i n s t r u m e n t in wr i t ing to bo conveyed by deed of gift or t ransfer from t h e owners to t he Crown, or t he re has been paid to t he Cons t ruc t ing A u t h o r i t y a s u m equa l to or greater t h a n the a m o u n t es t imated by the

SCHEDULE.
| Nevertire | to Warren | Railway. |
This line begins by a junction with the Great Western Railway at about three hundred and forty-one miles twenty chains and thirty links from Sydney, at the north western end of Nevertire Station ; and at about three and a half miles from the junction it joins the main road to Warren, and follows the same for the most part till it roaches the latter township, where it ends in Reserve No. 4,479, at the north end of the town of Warren, being a total length of twelve miles thirteen chains, and subject to such deviations and modifications as may be considered desirable by the Constructing Authority.
