NDA

v

THE STATE OF WESTERN AUSTRALIA

[2023] HCASL 124
P11/2023

  1. The applicant requires an extension of time within which to seek special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Western Australia (Buss P, Beech and Hall JJA) dismissing the applicant's application for leave to appeal against convictions on two counts of procuring a child of or over the age of 13 and under the age of 16 years to do an indecent act, contrary to s 321(5) of the Criminal Code (WA).

  2. None of the applicant's proposed grounds of appeal enjoys any prospects of success to warrant the grant of special leave to appeal. It would therefore be futile to grant the extension that is sought. Special leave should be refused.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
