Navigation (Tonnage Measurement) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

Commencement

1. These Regulations shall come into operation on 1 October 1986.

Fees

2. (1) Schedule 6 to the Navigation (Tonnage Measurement) Regulations is amended—

(a) by omitting sub-item 4 (1) and substituting the following sub-item:

"(1) Where, as a result of a request made by the owner, builder, master or agent of a ship, a surveyor engages in measurement or remeasurement of the tonnage of the ship when the office of the Department is not open for public business, there is payable by virtue of this sub-item, in addition to any other fee payable—

(a) in a case in which such measurement or remeasurement by the surveyor during such a period immediately precedes, or immediately follows, measurement or remeasurement by the surveyor of the tonnage of that ship at a time when the office of the Department is open for public business—a fee calculated at the rate of $35 for each whole hour or part of an hour falling within that period during which the surveyor so engages in measurement or remeasurement; or

(b) in any other case—a fee calculated at the rate of $35 for each whole hour or part of an hour falling within that period during which the surveyor so engages in measurement or remeasurement, or a fee of $105, whichever is the greater.";

(b) by omitting from sub-item 4 (2) all the words after "there is payable" and substituting "in respect of the cancellation, a fee of $108";

(c) by omitting from sub-item 4 (4) all the words after "the rate of and substituting "$70 for each hour, or part of an hour, of the excess is payable by virtue of this sub-item in respect of that measurement or remeasurement."; and

(d) by omitting from sub-item 4 (6) "$110" and substituting "$70".

(2) Schedule 6 to the Navigation (Tonnage Measurement) Regulations is further amended as set out in the following table:
