REGULATIONS UNDER THE NAVIGATION ACT 1912-1956.*

advice of the Federal Executive Council, hereby make the following Regulations
under the

(2.) The Navigation (Safety Convention Certificates Validity) Regulations (being Statutory Rules 1936, No. 120) are repealed.
"classed cargo ship" means a cargo ship in respect of which there is in force a classification certificate;
"the Act" means the
Navigation Act 1912-1956.
(2.) Where a word or phrase used in these Regulations is defined in section 187a of the Act, that word or phrase as so used shall, unless the contrary intention appears, have the meaning given to it in that section.
(3.) A reference in these Regulations to a form by number shall be read as a reference to the form so numbered in the First Schedule to these Regulations.

Part II.—Surveys.
(2.) Unless the Director or the Deputy Director in a special case otherwise directs, the application shall be lodged—
(
a )where the ship or the part of the ship, or the equipment or the part of the equipment, as the case, may be, was last surveyed in the State in which the survey is required, not less than two days before the day on which the survey is required; and(
b )in any other case, not less than four days before the day on which the survey is required.
(3.) Subject to the next succeeding sub-regulation, where an application is made for the survey of the hull of a new ship, or of a ship which has not previously been surveyed for the purpose of issuing a certificate of survey or a certificate referred to in section 206c of the Act, the application shall be accompanied by the following plans, information and data:—

h ) such further plans, information and data as the Director considers necessary and requests.
(4.) The Director may exempt an applicant in whole or in part from the requirements of the last preceding sub-regulation.
(5.) The plans, information and data lodged in accordance with sub-regulation (3.) of this regulation may be retained by the Director for the purposes of information and record.
(
a ) the structure of the ship, including the outside of the bottom of the hull and the rudder and bearings of the screw shaft (if any);
(
(
(
(i) electrical installations;
(ii) radio equipment;
(iii) lifesaving appliances; and
(iv) fire appliances.
(2.) The survey of a ship that is—
(
(
shall include a complete inspection of the equipment of the ship including—
(
(
(
(3.) The survey of a passenger steamship before the ship is put into service and, if the surveyor so requires, the annual survey of a passenger steamship, shall include an inspection of the inside and outside of the boilers of the ship and the testing of the ability of the boilers to withstand hydraulic pressure.
(
(
(2.) Where the ship is lying at or arrives at a port other than Sydney, Melbourne, Brisbane, Port Adelaide, Fremantle or Hobart, the notice may be given to the superintendent at the port.
Part III.—Certificates.
(
(
b )if a safety certificate is also in force in respect of the ship— shall be in accordance with Form 5 and shall be annexed to the safety certificate.
(
a ) in what respects the ship is exempt from the requirements of the Act and regulations under the Act; and(
b ) the conditions (if any) subject to which the ship is exempt.
(
a ) in what respects the ship is exempt from the requirements of the Act and regulations under the Act; and(
b )the conditions (if any) subject to which the ship is exempt.
(2.) A qualified safety radiotelegraphy certificate shall be in accordance with Form 12, with such modifications as are necessary to show—
(
a ) in what respects the ship is exempt from the requirements of the Act and regulations under the Act; and(
b )the conditions (if any) subject to which the ship is exempt.
(3.) A qualified safety radiotelephony certificate shall be in accordance with Form 13, with such modifications as are necessary to show—
(
a ) in what respects the ship is exempt from the requirements of the Act and regulations under the Act; and(
b )the conditions (if any) subject to which, the ship is exempt.
(2.) A certificate issued under the last preceding sub-regulation remains in force for a period of one year after the date of issue.
(3.) Where, in pursuance of the Navigation (Radio) Regulations, a ship referred to in sub-regulation (1.) of this regulation is exempted from all or any of the requirements of Division 6a of Part IV. of the Act or of the Navigation (Radio) Regulations, the Minister may issue in respect of the ship a certificate of exemption in accordance with Form 15.
(4.) A certificate issued under the last preceding sub-regulation remains in force for a period of one year after the date of issue or for such shorter period as is specified in the certificate.
(5.) The master of a ship in respect of which a certificate has been issued under this regulation shall, while the certificate remains in force, cause a copy of the certificate to be kept displayed in a prominent and accessible place in the ship, where it may be read by all persons on board.
(
a )in the case of a ship registered in Australia or engaged in the coasting trade—one year; and
(
(2.) On the application of the owner or master of a ship, an additional copy of the certificate issued in respect of the ship may be issued.
(
a ) The certificate shall be in accordance with the appropriate form of certificate specified in the Appendix to the Safety Convention;(
b )The certificate shall be applicable to the voyage in respect of which a certificate of clearance is demanded;
(
(
d )The certificate shall show that it was issued under the authority or at the request of the Government of the country in which the ship is registered;
(
Part IV.—Miscellaneous.
(2.) Subject to the next succeeding sub-regulation, the report shall be made to a Deputy Director.
(3.) Where the ship is lying at or arrives at a port other than Sydney, Melbourne, Brisbane, Port Adelaide, Fremantle or Hobart, the report shall be made to the superintendent at that port.
(2.) Where a fee payable under the last preceding sub-regulation in respect of a ship is not paid, the Commonwealth may recover the fee as a debt due to the Commonwealth from the owner, charterer, agent or master of the ship.

FEES.
1.—(1.) Subject to the next succeeding sub-paragraph, the fee for the survey of a ship for the purpose of obtaining a certificate of survey, a qualified safety certificate, a qualified short voyage safety certificate, a safety certificate or a short voyage safety certificate is the fee determined in accordance with the following table:—

(2.) Where a survey, other than a survey of a new ship or a ship which has not previously been surveyed in Australia, is made for the purpose of obtaining a certificate of survey, a qualified safety certificate, a qualified short voyage safety certificate, a safety certificate or a short voyage safety certificate for a period of less than eleven months, the fee for the survey is—

a ) an amount, assessed at the rate of one-twelfth of the fee otherwise payable for the survey, for each month or part of a month in the period;(
b ) an amount equal to one-quarter of the fee otherwise payable for the survey; or
(
c ) Ten pounds,
whichever is the greater.
2. The fee for a survey for the purpose of obtaining a certificate of equipment, a qualified safety equipment certificate or a safety equipment certificate in respect of a cargo ship in relation to which a classification certificate is in force is—
(
a ) an amount equal to one-quarter of the fee for the survey of a cargo ship for a certificate of survey; or(
b ) Four pounds,
whichever is the greater.
3.—(1.) Subject to the next succeeding subparagraph, the fee for the survey in dry dock of the hull of a ship, other than a survey as part of a complete survey of the ship, is the fee determined in accordance with the following table:—

(2.) Where a survey in dry dock of the hull of a ship, other than a survey as part of a complete survey of the ship, is made in respect of a ship in relation to which there is in force a certificate of survey, a qualified safety certificate, a qualified short voyage safety certificate, a safety certificate or a short voyage safety certificate, the fee for the survey is an amount equal to one-half of the fee otherwise payable for the survey.
4. Where, on the application of the owner or master of a ship, an additional copy of a certificate issued under Division 2b of Part IV. of the Act or under these Regulations is issued, the fee for the issue of that copy is One pound.
5.—(1.) The fee for an extension of the currency of a certificate of survey under section 201 of the Act, or for an extension of a qualified safety certificate, a qualified short voyage safety certificate, a safety certificate or a short voyage safety certificate under section 206k of the Act, is the fee determined in accordance with the following table:—

Second Schedule—
(2.) The fee for an extension of the currency of a certificate of equipment under section 201 of the Act, or for an extension of a qualified safety equipment certificate or a safety equipment certificate under section 206k of the Act, is—
(
a ) one quarter of the fee which would be payable if the certificate were a certificate referred to in the last preceding sub-paragraph; or(
b ) Three pounds,
whichever is the greater.
6. The fee for the survey of a ship in respect of which an order for provisional or final detention has been made under section 210 of the Act is—
(
a )where the ship has been detained on account of over loading, improper loading, insufficient ventilation of coal cargo or bunkers or defective equipment—the fee determined in accordance with the following table:—

7.—(1.) The fee for the survey of a ship which is carried out in respect of repairs or alterations to a part of the hull, machinery or equipment of the ship is, if the survey is not a survey in respect of which a fee is specified in another provision of this Part of this Schedule, the fee, or the aggregate of the fees, as the case may be, determined in accordance with the following table.:—

(2.) The fee, or the aggregate of the fees, payable by virtue of the last preceding sub-paragraph shall not exceed the fee which would be payable for a survey of the ship of a kind referred to in the last preceding paragraph.
8. The fee for the survey of a radio installation is Eight pounds.
9. The fee for a service rendered by a surveyor in connexion with a survey, inspection or test under the Act or regulations made under the Act is, if the service is not a service in respect of which a fee is otherwise specified in these Regulations or specified in other regulations made under the Act, such amount as the Minister directs with respect to services of that kind.
Second Schedule—
10.—(1.) Where, as a result of a request made by the owner, agent or master of a ship, a surveyor carries out a survey or inspection in respect of the ship or its equipment during any period when the Deputy Director's office in the State where the survey" or inspection is made is not open for public business, the fee for the survey or inspection otherwise payable under this Schedule shall be increased—
(
a )if the surveyor commences or ceases to be so engaged on a day when the Deputy Director's office is not at any time open for public business—by Five pounds five shillings; gad(
b ) in any other case—by Two pounds two shillings or, if the surveyor commences to be so engaged before 6 a.m. or ceases to be so engaged after 11 p.m., by Four pounds four shillings.(2.) This paragraph applies in respect of each surveyor engaged on a survey or inspection during a period when the Deputy Director's office is not open for public business.
11. Where—
(
a )a surveyor is available at the time and place appointed for a survey or inspection in respect of a ship or its equipment but, for any reason outside the control of the surveyor, he is compelled to wait for a period after that time before he can commence the survey or inspection;(
b ) a surveyor is carrying out a survey or inspection in respect of a ship or its equipment and, for any reason outside his control, the survey or inspection is interrupted and he is compelled to wait for 3 period before he can continue the survey or inspection; or(
c ) a surveyor carrying out a survey or inspection in respect of a ship orits equipment is compelled, for any reason outside his control, to wait on the ship after the completion of the survey or inspection,
the fee for the survey or inspection otherwise payable under this Schedule shall be increased by an amount of Two pounds for each hour, or part of an hour, of the waiting time in excess of half an hour.
12. Where, as the result of a request made by the owner, agent or master of a ship, a surveyor proceeds to a place outside the limits of the port at which he is ordinarily stationed for the purpose of carrying out a survey or inspection in respect of the ship or its equipment, the fee for the survey or inspection otherwise payable under this Schedule shall be increased by an amount equal to the travelling and subsistence expenses necessarily incurred by the surveyor.
