REGULATIONS UNDER THE NAVIGATION ACT 1912-1935.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912-1935.

NAVIGATION (SURVEY AND EQUIPMENT) REGULATIONS.

Part I.—Preliminary.

Short title.

1. These Regulations may be cited as the Navigation (Survey and Equipment) Regulations.

Parts.

2. These Regulations are divided into Parts, as follows:—

Commencement.

3. These Regulations shall come into operation on the thirty-first day of October, 1935.

Repeal.

4. The Navigation (Survey and Equipment) Regulations, being Statutory Rules 1927, No. 93, as amended by Statutory Rules 1928, No. 9; 1930, No. 83; and 1931, No. 69, are hereby repealed.

Definitions.

5.—(1.) In these Regulations, unless the contrary intention appears—

“Board of Trade” means the Board of Trade of the United Kingdom;

“cargo ship” means a ship which does not carry, or which is not certified to carry, more than twelve passengers;

“classed,” in relation to a ship,, means classed in a corporation or association for the survey and registry of ships approved by the Governor-General under section 204 of the Navigation Act, and holding a valid certificate, as prescribed, issued by such corporation or association;

“passenger steamship” means a steamship which carries or is certified to carry more than twelve passengers;

“surveyor” means a person appointed by the Governor-General to be a surveyor of ships;

“the Act” or “the Navigation Act” means the Navigation Act 1912-1935 and includes that Act as amended from time to time;

“unclassed,” in relation to a ship, means a ship other than a classed ship.

(2.) In these Regulations, any reference to a Form shall be read as a reference to a Form in Schedule I. to these Regulations.

Application.

6.—(1.) Subject to the provisions of the Act and of the next succeeding sub-regulation, and except where otherwise expressed, these Regulations shall apply as follows:—

(a) In the case of—

(i) ships registered in Australia;

(ii) ships (British or foreign) engaged in the coasting trade;

(iii) ships (British or foreign) regularly employed in trading in or from the Commonwealth, and managed or controlled in the Commonwealth; and

(iv) passenger ships (British or foreign) engaged in carrying passengers to or from Australia—

the whole of the Regulations shall apply;

(b)In the case of all ships (British or foreign)—

(i) detained as unseaworthy; or

(ii) which, having sustained damage to their hulls, machinery, or equipment, are re-conditioned or repaired in Australia; or

(iii) in connexion with which any survey or inspection has been performed for which a charge or fee is specified in Schedule II. to these Regulations—

regulation 38 and Schedule II. to these Regulations shall apply; and

(c) In the case of all British ships while within the limits of Australia or the territorial waters thereof—regulations 35, 36 and 37 shall apply.

(2.) Except where otherwise expressed, these Regulations shall not apply to—

(a) Pleasure yachts; or

(b)Ships trading exclusively within the limits of a single State.

Part II.—Survey of Ships.

Classification certificates exempting from survey.

7. A classification certificate of the following classes, namely, 100a of Lloyd’s or B.S. of the British Corporation, being a certificate granted by a corporation or association for the survey and registry of ships

 

approved by the Governor-General, shall, while it remains in force, be accepted, under and subject to the provisions of section 204 of the Act, as exempting from survey under the Act and these Regulations for a Certificate of Survey a cargo steamship in respect of which it has been granted.

Ships to be surveyed annually.

8.—(1.) The owner of every ship required by the Act and these Regulations to be surveyed shall cause the ship to be surveyed at least once in every twelve months by a surveyor of ships under the Act.

(2.) The survey of the outside of the bottom of the hull, and of the rudder, bearings of the screw shaft, and the various openings, valves and bolt-heads in the bottom, is to be carried out only while the vessel is in dry dock or on slip, after the bottom has been cleaned and before it has been painted:

Provided that, where the Deputy Director is satisfied that the survey of a small vessel can be carried out while the vessel is laid over on a beach or bank left dry at low tide in as efficient a manner as if the vessel were in dry dock or on slip, he may approve of the survey of the bottom of such vessel being made by a surveyor while the vessel is so laid over.

Application for survey of ship or of equipment.

9.—(1.) An application for the survey of a ship, or of her equipment only, shall be made by or on behalf of the owner in accordance with Form S. and E.—1.

(2.) Subject to the next succeeding sub-regulation, the application shall be lodged with the Deputy Director of the State in which it is desired that the survey be made, the period of notice before the survey is desired being as follows:—

(a) Where the ship or her equipment was last surveyed in some other State, 10 days’ notice; and

(b) In other cases, 48 hours’ notice:

Provided that in special circumstances the Deputy Director may, at his discretion, either require a longer period of notice, or may accept a shorter period of notice, than that herein specified.

(3.) Where application is made for the survey of a ship for a Safety Certificate or a Certificate of Survey, and the ship has not been built under survey of the Board of Trade, the application shall be lodged with the Director, and shall be accompanied by—

(a)such information, plans, data and the like as would be required under the Instructions as to the Survey of Passenger Steamships issued by the Board of Trade in 1928, as amended to the date of the commencement of these Regulations*; and

(b)such further information with respect to the ship as the Director, in the circumstances of the case, considers necessary.

(4.) Unless otherwise directed by the Director, plans, data and the like lodged with applications in pursuance of sub-regulation (3.) of this regulation shall be retained in his office for the purposes of information and record.

* Note.—These Instructions may be procured through the principal booksellers in Australia. The forms B.H.1, B.H.1A, B.H.2, and B.H.2A, prescribed in the Instructions for tabulating special data required in connexion with the computation of the subdivision loadline, will, upon application to the Director, he supplied to applicants for the survey of ships.

Surveyor’s report and declaration.

10. The report of a surveyor and his declaration of survey in pursuance of the Act shall be in accordance with Form S. & E.—2, 3, 4, 5, 6, 7, 8 or 9, as the case requires.

Declaration for reduced number of passengers.

11. When the number of passengers to be allowed is reduced owing to the rule as to gross tonnage (as laid down in the Merchant Shipping Act), or because the life-saving appliances are not sufficient for the full number, or for any other reason, the surveyor shall enter in his declaration the number of passengers actually allowed for each class.

Passenger steamships—accommodation, &c., for passengers.

12.—(1.) The Regulations contained in the official Instructions as to the Survey of Passenger Steamships, issued by the Board of Trade under the provisions of the Merchant Shipping Act for the guidance of their surveyors in surveying passenger steamers, shall be the regulations to be complied with, in the case of passenger steamers surveyed under these Regulations for a Certificate of Survey, in respect of the following matters:—

(a) the number of passengers to be carried;

(b) passengers’ accommodation; and

(c) sanitary matters.

(2.) A Certificate of Survey shall not be granted to any foreign-going, Australian-trade or limited coast-trade passenger steamship unless the requirements of this regulation have first been complied with.

Except where prescribed Board of Trade Regulations to apply.

13.—(1.) Except insofar as other provision is made by these Regulations, anything required to be done by *Regulations or Instructions made and issued by the Board of Trade under the provisions of the Merchant Shipping Act, as a condition precedent to the grant of Safety Certificates or Certificates of Survey to passenger steamers, shall be deemed to be a thing necessary to be done before a Safety Certificate or a Certificate of Survey may be granted in respect of any passenger steamer under these Regulations.

(2.) The requirements of the last preceding sub-regulation shall also be taken as applying, in so far as they can be read as applicable, to the surveys of cargo steamers and sailing vessels for Safety Certificates, Certificates of Survey or Certificates of Equipment.

Owner’s representative may accompany surveyor.

14. A surveyor, when making a survey of a ship or of her equipment, shall, if the owner of the ship so requests, be accompanied on the survey by some person appointed by the owner.

Appeal to Court of Marine Inquiry.

15. An owner of a ship aggrieved by a refusal to grant any Safety Certificate or Certificate of Survey or Certificate of Equipment may appeal to a Court of Marine Inquiry in the manner prescribed in the Navigation (Courts of Marine Inquiry) Regulations made under the Act.

Certificates of survey.

16. A Certificate of Survey granted under these Regulations shall be in accordance with Form S. & E.—10, 11, 12, 13, 14, 15 or 16, as the case requires.

Certificates of equipment.

17. A Certificate of Equipment granted under these Regulations shall be in accordance with Form S. & E.—17.

Safety Convention certificates.

18.—(1.) A general Safety Certificate and a short voyage Safety Certificate shall be in accordance with Form 18.

(2.) A qualified Safety Certificate shall be in accordance with Form 18, with such modifications as are necessary to show in what respects the steamship in respect of which the certificate is issued complies with the requirements of the Safety Convention.

(3.) An Exemption Certificate shall be in accordance with Form 19.

Period of validity.

19. The certificates mentioned in these Regulations shall, unless sooner cancelled or suspended, be valid from the date of issue until the expiration of the term specified therein, which shall be not more than twelve months in the case of ships other than ships engaged on an international voyage and not less than three months in the case of ships engaged on an international voyage.

Issue of certificates.

20.—(1.) The certificates mentioned in regulations 17 and 18 of these Regulations shall be issued in duplicate.

(2.) The owner, master or agent of the ship shall cause one copy of each certificate, marked “Ship’s Copy”, to be posted in some conspicuous place on board the ship so as to be easily visible to all persons on board. The other copy, marked “Owner’s Copy”, shall be retained, during the period of its currency, by the owner, master or agent of the ship.

(3.) In the case of a ship engaged on an international voyage, a third copy of the certificate, marked “Master’s Copy”, may also be issued, if desired by the owner or the master.

Insertion of particulars.

21. The particulars inserted by hand in any certificate under these Regulations or in copies thereof shall be inserted in Roman characters and Arabic figures.

Part III.—Equipment of Ships.

Ships to be provided with certain equipment.

22.—(1.) In addition to compliance with any other requirements of the Act or of other regulations under the Act as regards equipment to be carried, every ship to which these Regulations apply shall be provided, to the satisfaction of the surveyor, with equipment as prescribed by the regulations included in this Part.

(2.) The master of a ship shall not take her to sea, and the owner of a ship shall not knowingly or unknowingly suffer or permit her to go to sea, unless she carries equipment as required by this regulation.

Penalty. Fifty pounds.

Chronometers.

23. Every ship (except limited coast-trade ships under 300 tons gross register, limited coast-trade ships under 1,600 tons gross register trading exclusively within limits of not more than 10 degrees of longitude, and river and bay ships) shall be provided with one or more chronometers in good working order as follows:—

(a)If proceeding to any place north of the equator, or beyond the limits of 60 degrees East longitude or 135 degrees West longitude, and not being provided with a wireless telegraph installation in charge of a duly certificated operator, with at least two chronometers; and

(b)In other cases, with at least one chronometer.

Barometers.

24. Every sea-going ship shall be provided with at least one barometer in good working order.

Morse lamp and signalling flags.

25.—(1.) Every ship over 100 tons gross register (other than a ship referred to in section 191b of the Act) shall be provided with a Morse signalling lamp for night signalling, and a semaphore or a pair of hand flags for signalling by day.

(2.) Every sea-going ship shall be provided with a set of flags of the International Code and a Code book corrected to date.

Signals of distress.

26.—(1.) Every ship (except river and bay ships) shall be provided, to the satisfaction of the surveyor, with means of making signals of distress of the kind and number specified in the following Table:—

Provided that ships over 50 but not exceeding 500 tons may, at the option of the owner, carry six blue lights, additional to those required under regulation 27, in lieu of the two deck flares specified in the above Table.

(2.) The sockets for use in firing the explosive socket signals shall be of a type approved by the surveyor as safe and suitable for use in connexion with the particular make of socket signals carried, and shall be placed as follows:—

(a) In the case of ships over 500 tons gross register, one forward on one side of the ship, and the other aft on the other side of the ship; and

(b) In the case of ships not exceeding 500 tons gross register, as approved by the surveyor.

(3.) The deck flares shall be self-igniting in water and capable of burning clearly for at least 40 minutes.

(4.) The rocket signals shall be rockets or shells throwing stars (of any colour or description) and each containing at least twelve ounces of composition.

(5.) A suitable firing tube, of a type approved by the surveyor, and fitted to his satisfaction, shall be provided for firing rocket signals.

Blue lights.

27. Every ship (except river and bay ships) shall be provided, to the satisfaction of the surveyor, with blue lights as follows:—

(a) In the case of ships of more than 15 but not more than 500 tons gross register—six blue lights; and

(b)in the case of other ships—twelve blue lights.

Magazines for pyrotechnic signals.

28.—(1.) The socket signals, deck flares, rocket signals, and blue lights required by the last two preceding regulations to be provided shall be carried in magazines or receptacles approved by the surveyor.

(2.) The outer magazine containing the distress signals shall have painted on the outside thereof in conspicuous and bold lettering, the words “Distress Signal Magazine”

(3.) The socket signals, firing tubes and lanyard, shall be contained in a special magazine on the outside of which the word “Dangerous” shall be painted in bold lettering.

Dates on pyrotechnic signals not to be altered or defaced.

29. No person shall deface or alter or attempt to deface or alter the date of manufacture on any pyrotechnic signal required under these Regulations.

Penalty: Fifty pounds.

Gangways or accommodation ladders.

30.—(1.) Every passenger steamship of 500 tons gross register and upwards to which these Regulations apply shall be provided with—

(a)at least one efficient and properly constructed gangway or accommodation ladder capable of being fitted on either side of the vessel; and

(b)a portable gangway approved by the surveyor as suitable for use in emergency from some convenient part of the vessel.

(2.) Every passenger steamship under 500 tons gross register shall be provided with at least one portable gangway, or accommodation ladder, fitted to the satisfaction of the surveyor.

(3.) Every cargo steamship of 100 tons gross register and upwards to which these Regulations apply shall be provided, to the satisfaction of the surveyor, with at least one efficient and properly fitted gangway or accommodation ladder on each side of the ship or capable of being used on either side of the ship.

(4.) Every cargo steamship of not more than 100 tons gross register and every sailing ship to which these Regulations apply shall be provided, to the satisfaction of the surveyor, with at least one gangway, or some safe and efficient equivalent, for the use of persons going aboard or coming from the ship when alongside a wharf or pier.

(5.) A gangway net of a pattern and strength approved by the surveyor shall be provided on every ship required under this regulation to be provided with a gangway or accommodation ladder.

Anchors, chain cables, hawsers, and warps.

31.—(1.) Every ship to which these Regulations apply shall be provided with three bower anchors and one stream anchor, and also, in the case of steamships of more than 300 but not more than 1,500 tons gross register and of sailing ships of 50 tons gross register and over, with one kedge anchor, and with chain cables, hawsers, and warps:

Provided that in the case of a steamship under 350 tons gross register or of a sailing ship under 200 tons gross register, the Deputy Director may if, in his opinion, three bower anchors are not necessary to the safety of the ship, approve of the carrying of two bower anchors instead of the three bower anchors prescribed in this regulation.

(2.) The anchors shall be of such weights, and the chain cables, hawsers and warps shall be of such lengths, sizes, and materials, as, in the judgment of the surveyor, are sufficient for the size of the ship.

Sounding equipment.

32. Every British ship (except river and bay ships and limited coast-trade ships not exceeding 15 tons gross register), in respect of which a Certificate of Survey or a Certificate of Equipment under these

 

Regulations has been granted and is in force, shall be provided with equipment for taking soundings as follows:—

(a) In the case of a passenger ship of over 1,000 tons gross register or a foreign-going or Australian-trade cargo ship of over 2,000 tons gross register, with—

(i) an efficient mechanical deep-sea sounding machine of a type approved by the Director, complete with necessary attachments including at least 300 fathoms of wire, two leads each of at least 28 lb. weight and either an automatic spring depth recording device or a sufficient supply of glass depth recording tubes with scale; or

(ii) an echo sounding apparatus of an approved type; and, in either case,

(iii) at least one deep-sea hemp lead-line of a length of at least 120 fathoms with two leads each of at least 28 lb. weight and a suitable reel; and

(iv) at least two hand lead-lines each of a length of at least 25 fathoms with two leads, each of at least 7 lb. weight:

Provided that if the mechanical sounding machine is provided with a second, or spare, drum carrying not less than 300 fathoms of wire, the hemp deep-sea lead-line and its attachments may be dispensed with;

(b) In the case of a foreign-going or Australian-trade passenger ship not exceeding 1,000 tons gross register or a foreign-going or Australian-trade cargo ship over 100 tons gross register, but not exceeding 2,000 tons gross register, with—

(i) at least two deep-sea hemp lead-lines each of a length of at least 120 fathoms with two leads each of at least 28 lb. weight and a suitable reel; and

(ii) at least two hand lead-lines each of a length of at least 25 fathoms with two leads, each of at least 7 lb. weight:

Provided that where a ship is equipped with an efficient sounding machine, one of the deep-sea lead-lines and leads may be dispensed with; and if a second, or spare, drum for the sounding machine, with an extra 300 fathoms of wire, is provided, both deep-sea lead-lines and leads may be dispensed with;

(c) In the case of a foreign-going or Australian-trade cargo ship not exceeding 100 tons gross register, or a limited coast-trade passenger ship over 100 tons gross register but not exceeding 1,000 tons gross register, or a limited coast-trade cargo ship over 100 tons gross register with—

(i) at least one deep-sea hemp lead-line of a length of at least 120 fathoms with one lead of at least 28 lb. weight and a suitable reel; and

(ii) at least two hand lead-lines each of a length of at least 25 fathoms with two leads each of at least 7 lb. weight; and

 

(d)In the case of a limited coast-trade ship of over 15 tons gross register but not exceeding 100 tons gross register, with at least one hand lead-line of a length of at least 25 fathoms with one lead of at least 7 lb. weight.

Double bottoms.

33.—(1.) Every passenger steamship (other than a river and bay steamship or a ship whose keel was laid before the first day of January, 1916) to which these Regulations apply, which is 200 feet or over in length, shall be fitted with a double bottom in accordance with the requirements set forth in the *Regulations or Instructions made and issued by the Board of Trade and prescribed as a condition precedent to the grant of Certificates of Survey to foreign-going passenger steamers.

(2.) Every cargo steamship (other than a river and bay steamship or a steamship whose keel was laid before the first day of January, 1925) to which these Regulations apply, which is 200 feet or over in length, shall be fitted with a double bottom in accordance with the following requirements:—

(a) In the case of steamships 200 feet and under 249 feet in length, the double bottom shall extend from the machinery space to the forepeak bulkhead, or as near thereto as practicable.

(b)In the case of steamships 249 feet and under 330 feet in length, the double bottom shall extend from the outside of the machinery space to the fore and after peak bulkheads respectively, or as near thereto as practicable.

(c) In the case of steamships 330 feet and over in length, the double bottom shall be fitted amidships and shall extend to the fore and after peak bulkheads respectively, or as near thereto as practicable.

(d)Where double bottoms are required to be fitted, the inner bottom shall be continued out to the ship’s side in such manner as to protect the bottom to the turn of bilge.

Such protection will be deemed satisfactory if the line of intersection of the outer edge of the margin plate with the bilge plating is not lower at any part than a horizontal plane passing through the point of intersection with the frame line amidships of a transverse diagonal line inclined at 25° to the base line and cutting it at a point one-half the ship’s moulded breadth from the middle line.

(e) Wells constructed in the double bottom in connexion with the drainage arrangements (except a well at the after end of the shaft tunnel of a screw ship) shall not extend downwards from the inner bottom more than necessary, nor shall they be less than 18 inches from the outer bottom or from the inner edge of the margin plate.

Hatches to be branded with ship’s name.

34. The weather deck hatches of every ship under 1,000 tons gross register to which these Regulations apply shall be indelibly stamped, either with the ship’s name in full or with the four letters forming the signal letters of the ship.

Part IV.—Miscellaneous.

Report of accidents, &c.

35. Where any (British) ship (including any ship trading exclusively within the limits of a single State), during her voyage to any port in Australia, or when within the limits of Australia or the territorial waters thereof, (or any foreign ship carrying passengers between ports in Australia—)

(a)has sustained or caused any accident occasioning loss of life or any serious injury to any person;

(b)has received any damage likely to render her unseaworthy, or her boilers or machinery inefficient,

(c) has been in any position of great peril either from the action of some other ship or from danger of wreck or collision;

(d)has been stranded or wrecked, or has collided with any derelict, wreckage or other obstruction or with any wharf, jetty, dock, breakwater or other fixed obstruction;

(e) having left any port in Australia, has put back to that port; or

(f) has fouled or done any damage to any lightship, buoy, beacon, sea mark, or submarine telegraph cable—

the owner or master shall report the same, on Form S. & E.—20*, within twenty-four hours after the happening of the event or, if the latter occurs at sea, after the next arrival of the ship at any principal port in Australia, to the Deputy Director, or, in the case of a ship lying at, or arriving at, an outport, to the Superintendent, Mercantile Marine Office, at that port.

Certificates of ships damaged, &c, to be delivered up.

36.—(1.) Where any British ship in respect of which a Safety Certificate, a Certificate of Survey or a Certificate of Equipment has been granted (whether under the Navigation Act or otherwise) sustains damage from accident or other cause affecting, or likely in the opinion of the Deputy Director to affect, her seaworthiness or efficiency, the Deputy-Director may require the delivery up to him of the Safety Certificate, Certificate of Survey or Certificate of Equipment, and may retain the same in his possession until he is satisfied that the ship is again seaworthy and efficient.

(2.) The master or owner of the ship shall, when required by the Deputy Director, deliver up to him the Safety Certificate, the Certificate of Survey or the Certificate of Equipment of the ship.

Penalty: Twenty pounds.

(3.) When the Deputy Director has required, in accordance with this Regulation, that a Safety Certificate, Certificate of Survey or Certificate of Equipment shall be delivered up to him, the Certificate or Certificates (as the case may be) shall be deemed to be suspended, and shall remain so suspended until returned to the master or owner by the Deputy Director.

Alteration of ships after certificate granted.

37. Where any ship, British or foreign, in respect of which any Safety Certificate, Certificate of Survey, or Passenger Steamship Exemption Certificate has been granted under the Navigation Act, and is in force, is altered in respect of her hull, equipment or machinery in a manner which affects her efficiency or sea-worthiness, the owner or master shall, as soon as possible after the alteration is made, give notice thereof, in accordance with Form S. & E.—21, to the Deputy Director.

Fees and charges.

38.—(1.) The fees and charges for services in connexion with the surveys of ships and of their equipment shall be in accordance with the scale set out in Schedule II. to these Regulations (and shall be paid to the persons specified in that Schedule.)

(2.) The amount of the fee for any service shall be paid at the time of making application for that service, and the amount of the charges incurred in connexion with the service shall be paid before the Safety Certificate, Certificate of Survey or Certificate of Equipment is issued.

(3.) An application for an overtime survey shall be in accordance with Form S. & E.—22.

Power to exempt in special cases.

39. Where, in regard to any ship, the Minister is satisfied that special circumstances or the nature of the trade in which the ship is employed render compliance with the requirements of any of these Regulations unnecessary or impracticable, he may, by writing under his hand, exempt the ship from any or all of those requirements.

Certificate for less than twelve months.

2. When a Certificate of Survey for less than twelve months is applied for, the fee shall be in proportion to the period of the certificate, at the rate of one-twelfth of the full fee for each month or part of a month, but in no case shall the fee be less than three-twelfths of a twelve months’ fee, nor, except as provided in paragraph 5 of this Schedule, less than £4, whatever may be the tonnage of the vessel or the period for which the certificate is required.

Vessels coming under survey for the first time.

3. The full twelve months’ fee shall be paid for the survey of a new ship, or of a steamer coming under survey for a passenger certificate for the first time, even though a certificate for twelve months may not be required.

When duration of certificate limited.

4. In any case in which the duration of the certificate has been limited by the surveyor’s declaration, owing to special reasons rendering one or more further surveys necessary within the ensuing twelve months, the total fees paid for certificates covering a period of twelve consecutive months, including the period so limited, shall not exceed that payable for a twelve months’ certificate. The surveyor’s expenses shall, however, be paid in connexion with each survey made during the twelve months.

Schedule II.—continued.

Survey of life-saving equipment on sailing vessels not exceeding 50 tons.

5. The fee for the survey of the life-saving and fire-extinguishing appliances and of any internal combustion engine on a sailing vessel not exceeding 50 tons gross register shall be £1.

Fee for machinery survey, certificate for additional limits, &c.

6. If any additional machinery, apparatus or equipment which is liable to survey is fitted on board a vessel during the currency of her Certificate of Survey, or the vessel is removed to a plying district other than that for which the Certificate of Survey was issued, the fee for surveying the machinery, apparatus or equipment or issuing a certificate for the new plying district shall be £1. If a certificate is required for limits additional to those dealt with at the main survey, but in the same plying district, the fee for issuing a certificate shall be £1. Provided that no fee shall be charged in the case of vessels not exceeding 50 tons gross register.

Passenger accommodationaltered.

7. If the passenger accommodation is altered while a certificate is in force, the fee for survey shall be £1, provided, however, that if the number of passengers is increased by more than 200, the fee shall be £1 for every additional 200 passengers or part thereof.

Fee paid covers any number of visits.

8. The fee paid in accordance with paragraphs 1 and 2 of this Schedule for the survey of a ship for a Certificate of Survey covers any number of visits that it shall be necessary for a surveyor to make before making his Report of Survey, and covers the inspection of the hull in dry dock, the survey of the boilers and propelling machinery, and the inspection of the equipment of the vessel, including the lights and sound signals.

Survey for Safety Convention certificates.

9. The fee paid in accordance with paragraphs 1, 2, 3 and 4 of this Schedule for the survey of a ship for a Certificate of Survey shall, on payment of an additional fee of 35s. for the survey of the wireless equipment in the case of a passenger steamship, cover the survey for the certificates required under section 206c of the Act by a passenger steamship engaged on an international voyage.

Combined survey for certificates of survey and load line.

10. Where a survey for a Certificate of Survey is made at the same time as a survey by a surveyor appointed under the Act for the issue or renewal of a Load tine Certificate, the fee payable for the combined service shall be as follows:—

(a) In the case of a classed ship, the fee for survey for a Certificate of Survey as specified in this Schedule shall cover the combined survey for both certificates; and

(b) In the case of an unclassed ship, the fee payable for the combined survey shall be one-half the fee appropriate to a full survey for issue or renewal of the Load Line Certificate plus the fee for survey for a Certificate of Survey as specified in this Schedule.

Survey of equipment only.

11. The fee for the survey for a 12 months’ Certificate of Equipment for a cargo ship exempt from survey under these Regulations, by reason of holding a classification certificate granted by a corporation or association for the survey and registry of ships approved by the Governor-General under section 204 of the Act, shall be one-fourth of the amount specified in the Tables contained in paragraph 1 of this Schedule for the survey of a vessel of the same class and gross registered tonnage:

Provided that where a Certificate of Equipment for less than 12 months is applied for, the fee shall be in proportion to the period of the certificate, but in no case less than £1.

Fee for docking certificates.

12.—(1.) For the survey, in dry dock (otherwise than in connexion with the complete survey of the vessel), of the hull of a ship holding a survey certificate issued or recognized under the Act or these Regulations, and for the issue of a Dry Docking Certificate(if required) the following fee shall be charged:—

(2.) In the case of ships not holding a survey certificate as above mentioned, the fee shall be double the amount specified in the above scale.

Fee for extension of currency of certificate.

13. The fees payable in connexion with any extension by the Minister of the currency of a Safety Convention Certificate under the provisions of sub-section (2.) of section 206G of the Act, or of a Certificate of Survey or a Certificate of Equipment under the provisions of section 201 of the Act shall be in accordance with the following scale:—

Certificate to carry a few more passengers.

14. When application is made, in an exceptional case, for a vessel not holding a Passenger Certificate to be allowed to carry a few more than twelve passengers without undergoing a full passenger certificate survey, or for a British or foreign vessel to carry a few more than 50 steerage passengers (or their equivalent) without undergoing full emigration survey, and when, in connexion therewith, the accommodation, life-saving appliances, and sanitary arrangements are inspected, an inclusive fee of £3 shall be charged, in addition to the surveyor’s expenses:

Provided that in cases where the Deputy Director is satisfied that the accommodation, life-saving appliances, and sanitary accommodation have been recently surveyed and approved, no fee shall be charged.

Survey of emigrant ships.

15.—(1.) For the survey, as an emigrant ship, under the provisions of the Merchant Shipping Act, of a ship holding a valid Certificate of Survey, and for the survey of distilling and other equipment, and of the provisions, water and medical stores, prescribed to be carried by emigrant ships, the fees shall be as fixed by the Board of Trade under the powers conferred by the Merchant Shipping Acts.

(2.) Fees for the survey of emigrant ships do not cover survey for a Certificate of Survey, measurement for tonnage, inspection of crew spaces, or survey for a Load Line Certificate.

Survey of ships alleged to be unseaworthy.

16. When a ship is finally detained as being unseaworthy, or when it appears that a ship provisionally detained was at the time of that detention unseaworthy, the following fees shall be charged, viz.:—

(a)If the vessel has been detained on account of over-loading, improper loading, insufficient ventilation of coal cargo, undermanning, or defective equipment, the fee shall be according to the following scale:—

(b) If the vessel has been detained on account of defective hull or machinery, the fee shall be that prescribed in paragraph 1 of this Schedule for a survey for a twelve months’ Certificate of Survey.

Lights and sound signals.

17. The fee for a separate survey of lights and sound (fog) signals, whether made on the application of the owner or when the lights and/or sound signals have been found to be defective, shall be:—

The fee for the inspection of lights and sound signals covers the issue of a copy of the report of the inspection.

The inspection of lights and sound signals is covered by the fee paid for the survey of a ship for a Certificate of Survey or a Certificate of Equipment.

Surveyor’s expenses.

18.—(1.) Unless otherwise approved by the Minister in writing, the travelling and subsistence expenses of a surveyor incurred in connexion with a survey shall be charged to the owners of the ship in all cases where the surveyor is required to proceed to some place outside the limits of the port, and to be absent for not less than ten hours or over night.

(2.) Surveyor’s expenses incurred in connexion with an inspection, after casualty, of a ship which has sustained damage shall be charged to the owners of the vessel.

Overtime charges.

19.—(1.) All surveys shall be carried out in official hours whenever possible. When it is desired, for the convenience of the owner, and for some reason satisfactory to the Deputy Director, that a survey or part of a survey shall be carried out before or after official hours, application for approval may be made in Form S. and E.—22.

(2.) Overtime shall not be worked on Christmas Day, Good Friday, or Eight Hours Day, except by permission of the Director.

(3.) In addition to any fee prescribed in this Schedule, the following charges shall be made for the services of each surveyor employed in connexion with surveys (other than of deck cargoes or livestock) performed before or after official hours:—

(4.) In addition to any fee prescribed in this Schedule, a charge of £1 per visit shall be made for each visit of the surveyor necessarily made before or after official hours in connexion with the inspection, under the provisions of the Navigation Deck Cargo and Live Stock) Regulations, at any of the following ports, namely, Sydney, Newcastle, Melbourne, Brisbane, Townsville, Hobart, Port Adelaide and Fremantle, of a deck cargo or of livestock loaded at that port:

Provided that in no case shall the charge for such overtime service exceed £3.

Waiting time.

20. Where the services of a surveyor are required in connexion with the survey of a ship or of her equipment, and owing to any failure on the part of the owner or master to make proper arrangements for the survey to be commenced and carried out without delay, the surveyor is delayed in the execution of his duties, or where, by reason of any failure on the part of the owner or master to make suitable arrangements in the matter, the surveyor, after completing his duties, is unable to leave the ship, there shall be paid by the owner, in addition to the fees and charges prescribed in this Schedule, a charge for all waiting time, in excess of a total of half an hour, at the rate of £1 per hour or part of an hour.

Fee for survey of repairs.

21. The fee for the survey of repairs or alterations to any part—

(a)of the hull, machinery or equipment of a vessel, holding a Certificate of Survey under the Act, which is included in the ordinary survey for a Certificate of Survey;

(b) of the equipment of a vessel, holding a Certificate of Equipment under the Act, which is included in the ordinary survey for a Certificate of Equipment; or

(c)if made on the application of the owner, of the hull, machinery or equipment not included in sub-paragraph(a) or(b) of this paragraph,

shall, where not provided for elsewhere in this Schedule, be in accordance with the following scale:—

Provided that—

(a) the total charge shall not in any case exceed the fee chargeable under paragraph 16 of this Schedule in respect of a vessel detained as unseaworthy; and

(b) in special cases, where, in the opinion of the Deputy Director, the damage is only of a minor nature, he may by writing under his hand direct that no charge be made for such further survey, if performed during official hours.

Fee for survey of vessel for grain cargo.

22.—(1.) The fee payable for the services of a surveyor in connexion with the survey or inspection of a vessel in respect of which a notice of intention to load a grain cargo is required to be given under the Navigation (Grain, Coal and Ballast) Regulations, shall, in addition to travelling expenses, be in accordance with the following scale:—

(2.) The fee specified in the last preceding sub-paragraph will cover not more than three visits of the surveyor, made during official hours. The fee for each additional visit during official hours deemed necessary by the Deputy Director shall be £1. For any visit or visits of the surveyor required to be made outside official hours, whether for the convenience of the owner or for any other reason satisfactory to the Deputy Director, an overtime charge shall be made as prescribed in paragraph 19 of this Schedule.

Fee for survey of magazine for explosives.

23. The fee for the survey of a magazine for the accommodation of explosives on a ship and the issue of a certificate, if required, shall be as follows:—

(a)When constructed temporarily, to the satisfaction of the surveyor, of cargo approved by him as suitable for the purpose—No charge.

(b) When constructed of other material (either temporarily or as a permanent structure or fitting), £1 1s. for each visit necessarily made by a surveyor: Provided that no fee shall be charged for the inspection of a fixed permanent magazine which has previously been surveyed and approved by a surveyor under these Regulations, and which has not been structurally altered since.

Fee for survey of hold ventilation, &c.

24. The fee for the survey of the ventilation, &c., of a hold or holds of a vessel for the carriage of coal or inflammable liquids shall be as follows:—

(a) Where the ventilation is found to be satisfactory, and allother requirements complied with—No charge;

(b)Where the ventilation is found to be defective, or other requirements not properly complied with—For each visit(including the first) necessarily made by the surveyor,£ l 1s.;

(c)Where a special survey is made at the request of the owner, master, or agent of the ship—For each visit of the surveyor, £ 1 1s.

Fee for testing materials and buoyancy of life-jackets.

25. The fee for a test, in accordance with the Board of Trade requirements, of the materials and buoyancy of a “standard” Board of Trade pattern life-jacket shall be £l. This fee will cover the issue of a certificate of approval in cases where the results of the test are satisfactory.

Fee for inspection and stamping of life-jackets.

26. The fee for the inspection and stamping of life-jackets at a maker’s works shall be Five shillings, or at the rate of one penny for each jacket inspected, whichever amount is the greater.

Fee for inspection of deck cargo or livestock.

27. The fee for inspection by a surveyor, under the provisions of the Navigation (Deck Cargo and Live Stock) Regulations, of a deck cargo or of livestock loaded at any of the following ports, namely, Sydney, Newcastle, Melbourne, Brisbane, Townsville, Hobart, Port Adelaide and Fremantle, shall be as follows:—

Fee for additional copies of certificate.

28.For each copy of a certificate of any survey made under these Regulations, required in addition to the free copy or copies provided for herein, and for each certified copy of any such certificate, the fee shall be Five shillings.

Fees for other services.

29.The fee for any service in connexion with the survey of a ship or of her equipment, or of any material or manufactured article to be used in the construction or repair of a ship, and which is not specified in this Schedule, or in regulations under the Navigation Act appropriate to the matter, shall be the same as that charged by the Board of Trade for a similar service.

Payment of fees and charges.

30. Fees and charges under these Regulations shall be paid to the following persons:—

At Sydney, Brisbane, Port Adelaide, Fremantle and Hobart—to the Deputy Director or the Collector of Customs.

At Melbourne and outports—to the Superintendent, MercantileMarine Office.

At Newcastle—to the Sub-Collector of Customs.
