I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and pursuant to section 4 of the Acts Interpretation Act 1901, hereby make the following Regulations under the Navigation Act 1912.

Principal Regulations

 1. In these Regulations, “Principal Regulations” means the Navigation (Master and Seamen) Regulations.

Maximum age for employment at sea

 2. Regulation 8A of the Principal Regulations is amended by omitting from subregulation (1) “sub-section 48A (1)” and substituting “section 48A”.

 3. Regulation 8B of the Principal Regulations is repealed and the following regulation substituted:

Details of crew-subsection 52 (1) of the Act

“8B.

(1) For the purposes of subsection 52 (1) of the Act, a proper authority is a prescribed person.

“(2)

For the purposes of subsection 52 (1) of the Act, the following details are prescribed:

  • (a)

    in respect of the crew of the ship-the full name and usual residential address of each seaman engaged to serve on the ship and the capacity in which each such seaman is engaged;

  • (b)

    in respect of changes in the crew of the ship-the date on which and the place at which any seaman was engaged to serve on the ship because of any such change.”.

Entries in log-book relating to money and effects of deceased seaman

 4. Regulation 19 of the Principal Regulations is amended by omitting “or apprentice”.

 5. Schedule 2 to the Principal Regulations is amended:

  • (a)

    by omitting Form 3 and substituting the following form:

  • (e)

    by omitting from Form 12 “Regulations 11 and 22” and substituting “Regulation 22”;

    by omitting Part II in Form 12;

  • (g)

    by omitting each of the following forms:

     Forms 1, 4, 6 and 9.

Repeals

 6. The following provisions of the Principal Regulations are repealed:

 Regulations 4, 5, 8, 9, 11, 14 and 27 to 33 (inclusive).

Transitional

 7. An agreement in relation to a seaman belonging to a ship entered into before the commencement of these Regulations shall, on and after that commencement, continue in force for the duration of the agreement as if these Regulations had not been made.
