REGULATIONS
UNDER THE NAVIGATION ACT 1912*

THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice
of the Federal Executive Council, hereby make the following Regulations under
the Navigation Act 1912.

AMENDMENTS OF THE NAVIGATION
(MANNING AND COASTING TRADE) REGULATIONS
Parts
1. Regulation 2 of the
Navigation (Manning and Coasting Trade) Regulations is repealed.
Interpretation
2. Regulation 4 of the
Navigation (Manning and Coasting Trade) Regulations is amended—
(a)
by inserting in sub-regulation (1) before the definition of “ Manning Committee
” the following definition:
“
‘ authorized officer ’ means a person holding, or for the time being performing
the duties of, an office in the Department of Transport that is specified for
the purposes of this definition by the Minister by instrument in writing;”; and
(b)
by omitting from sub-regulation (1) the definition of “ Regional Controller ”.

3. Regulation 25 of the
Navigation (Manning and Coasting Trade) Regulations is amended by omitting from
sub-regulation (1) “ the Regional Controller for the State ” and substituting “
an authorized officer ”.

for exemption under section 422a of
the Act
4. Regulation 26 of the
Navigation (Manning and Coasting Trade) Regulations is amended—
(a)
by omitting from sub-regulation (1) “ a Regional Controller ” and substituting “
an authorized officer ”;
(b)
by omitting from sub-regulation (1) “ the Regional Controller ” and
substituting “ the authorized officer ”; and
(c)
by omitting from sub-regulation (2) “ a Regional Controller ” and substituting “
an authorized officer ”.

5. Regulation 27 of the
Navigation (Manning and Coasting Trade) Regulations is amended by omitting from
sub-regulation (1) “ a Regional Controller ” and substituting “ an authorized
officer ”.

28 of the Navigation (Manning and Coasting Trade) Regulations is amended by
omitting “ a Regional Controller ” and substituting “ an authorized officer ”.

7. Regulation 29 of the
Navigation (Manning and Coasting Trade) Regulations is amended by omitting “ a
Regional Controller ” and substituting “ an authorized officer ”.
Evidence
of payment of Australian rate of wages
8. Regulation 35 of the
Navigation (Manning and Coasting Trade) Regulations is amended by omitting “ a
Regional Controller ” and substituting “ an authorized, officer ”.
First
Schedule
9. The First Schedule to
the Navigation (Manning and Coasting Trade) Regulations is amended by omitting
from forms M.A.C.T.— 6 and M.A.C.T.—9 “ Regional Controller ” and substituting “
Authorized officer ”.
Savings
10. Nothing in these
Regulations affects the validity or efficacy of a certificate issued, an
application made or a statement produced under the Navigation (Manning and
Coasting Trade) Regulations as in force before the commencement of these
Regulations and, for the purposes of the application to such a certificate,
application or statement of the Navigation (Manning and Coasting Trade)
Regulations as amended by these Regulations, a reference in the certificate,
application or statement to “ Regional Controller ” shall be read as a
reference to “ authorized officer ” as defined by those Regulations as so
amended.
