Navigation (Load Lines) Regulations (Amendment) (Cth)
REGULATIONS UNDER THE NAVIGATION ACT 1912.*
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

Amendments of the Navigation (Load Lines) Regulations
(a) by omitting the word “ structure ” and substituting the words “ structure and to give him guidance with respect to the stability of the ship under varying conditions of service ”; and
(b) by adding at the end thereof the following sub-regulations:—
“ (2) Where no alteration has been made to a ship that materially affects the stability of the ship, the information referred to in sub-regulation (1) relating to the stability of the ship shall be based on—
(a) the elements of the stability of the ship determined by submitting the ship to an inclining test carried out in the presence of a surveyor or, if the Minister or a person authorized by the Minister for the purposes of this regulation is satisfied that reliable information with respect to the stability of the ship

can be obtained from the elements of the stability of a sister ship determined when the sister ship was submitted to an inclining test carried out in the presence of a surveyor, the elements of the stability, so determined, of the sister ship; or
(b) in the case of a ship specially designed for the carriage of liquids or ore in bulk, the elements of the stability of the ship determined by submitting the ship to an inclining test carried out in the presence of a surveyor or, if the Minister or a person authorized by the Minister for the purposes of this regulation is satisfied that, having regard to the ship’s proportions and arrangements and the elements of the stability of ships of similar proportions and arrangements determined when those ships were submitted to an inclining test carried out in the presence of a surveyor, sufficient metacentric height will be maintained no matter how the ship is loaded, the elements of the stability, so determined, of those similar ships.
“ (3) Where an alteration has been made to a ship that materially affects the stability of the ship, the information referred to in sub-regulation (1) relating to the stability of the ship shall be based on—
(a) the elements of the stability of the ship or of another ship or other ships determined as provided in paragraph (2) (a) or (2) (b) as affected by the alterations made to the ship; or
(b) the elements of the stability of the ship as altered determined by submitting the ship as so altered to an inclining test carried out in the presence of a surveyor.
“ (4) Where a surveyor employed in the Department of Transport conducts a survey of a ship and, for the purposes of that survey, attends at an inclining test of the ship carried out for the purposes of this regulation, a fee of $38 is payable.”.
“ 40a. A copy of the information supplied in respect of a ship in accordance with sub-regulation 40 (1) shall be furnished to the Minister and, where an application for the issue of a load line certificate is made in respect of the ship to a survey authority, to the survey authority.
“ 40b. Before the keel of a ship is laid or the construction of the ship otherwise commences, full information regarding the proposed ship shall, for the purpose of determining if the ship can comply with the requirements of these Regulations, be supplied to the Minister or to a person authorized by him for the purposes of this regulation.”.
(a) by omitting from paragraph (b) the words “ conditions of ”; and
(b) by inserting, after paragraph (b), the following paragraph:—
“ (ba) a copy of the information referred to in sub-regulation 40 (1) was not carried on the ship at the time at which a periodical inspection of the ship was made in accordance with regulation 80;”.
“ 94a. For the purposes of sub-section 171 (1) of the Act, the following are the prescribed entries to be made, or caused to be made, in the official log-book of a ship, other than a river and bay ship:—
(a) an entry giving particulars of the freeboards assigned to the ship under regulation 47 and of the positions of the deck line and load lines specified in the load line certificate for the ship;
(b) an entry giving particulars of the draught of water shown on—
(i) the scale at the stem of the ship; and
(ii) the scale at the stern of the ship,
when it is loaded so that—
(iii) the upper edge of the summer load line marked on the side of the ship in accordance with Part VII is level with the water line of the ship; and
(iv) the ship is upright and on an even keel;
(c) an entry giving details of the draught of water shown on—
(i) the scale at the stem of the ship; and
(ii) the scale at the stern of the ship,
before each voyage when the ship is ready to be taken to sea;
(d) an entry giving, where the load line indicating the maximum depth to which the ship may be loaded in salt water is submerged, the density of water in which the ship was lying at the time the details referred to in paragraph (c) were ascertained;
(e) an entry giving, where the load line indicating the maximum depth to which the ship may be loaded in salt water is submerged, details of any allowances made before each voyage in calculating the mean freeboard which the ship will have when she leaves inland waters on that voyage in respect of—
(i) the density of water referred to in paragraph (d); and
(ii) the fuel and other materials to be consumed in traversing those inland waters;
(f) an entry giving, where the load line indicating the maximum depth to which the ship may be loaded in salt water is submerged, the mean draught of water, and the mean freeboard, which the ship will have In salt water calculated after making any allowances referred to in paragraph (e).
“ 94b. (1) A ship registered in Australia shall at all times carry the information referred to in sub-regulation 40 (1).
“ (2) A ship registered in a country other than Australia shall at all times while in Australian waters carry the information approved for the purposes of this sub-regulation by notice published in the Gazette for the purpose of enabling the master of the ship to arrange for the loading and unloading of the ship in such a way as to avoid the creation of any unacceptable stresses in the ship’s structure and giving him guidance with respect to the stability of the ship under varying conditions of service.
“ (3) Where sub-regulation (1) or (2) has not been complied with in relation to a ship, the owner and the master of the ship are each guilty of an offence against this sub-regulation and are liable, upon conviction, to a penalty not exceeding $200.”.

“ (b) Aden, Berbera and Saigon shall be deemed to be on the boundary line of the Tropical Zone and the Seasonal Tropical Area; and
(c) Coquimbo and Santos shall be deemed to be on the boundary line of the Tropical Zone and the Summer Zone.”.
