REGULATIONS UNDER THE NAVIGATION ACT 1912-1950.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912-1950.

AMENDMENTS OF THE NAVIGATION (LOAD LINES) REGULATIONS. 

Definitions.

1. Regulation 4 of the Navigation (Load Lines) Regulations is amended—

(a) by omitting from the definition of “freeboard deck” the words “Board of Trade Rules” (twice occurring) and inserting in their stead the words “Load Line Rules”;

(b) by omitting from the definition of “special steamer freeboard” the words “Board of Trade Rules” and inserting in their stead the words “Load Line Rules”;

(c) by omitting from the definition of “tanker freeboard” the words “Board of Trade Rules” and inserting in their stead the words “Load Line Rules”;

(d) by omitting the definition of “the Board of Trade Rules” and inserting in its stead the following definition:—

“the Load Line Rules’ means the Load Line Rules, 1941, made by the Minister of War Transport of the United Kingdom on the twenty-second day of August, 1941; the Load Line (Amendment) Rules, 1946, made by the Minister of Transport of the United Kingdom on the eighth day of November, 1946; the Load Line (Amendment) Rules, 1947, made by the Minister of Transport of the United Kingdom on the twenty-third day of April, 1947; and the Load Line (Amendment) Rules, 1948, made by the Minister of Transport of the United Kingdom on the eleventh day of March, 1948;”;

(e) by omitting from the definition of “timber freeboard” the words “Board of Trade Rules” and inserting in their stead the words “Load Line Rules”; and

(f) by omitting from the definition of “timber ship” the words “Board of Trade Rules” and inserting in their stead the words “Load Line Rules”.

2. Regulation 6 of the Navigation (Load Lines) Regulations is amended by omitting the words “Board of Trade Rules” (twice; occurring) and inserting in their stead the words “Load Line Rules”.

Load line survey.

3. Regulation 7 of the Navigation (Load Lines) Regulations is amended by omitting the words “Board of Trade Rules” (wherever occurring) and inserting in their stead the words “Load Line Rules”.

Timber load lines.

4. Regulation 12 of the Navigation (Load Lines) Regulations is amended by omitting the words “Board of Trade Rules” and inserting in their stead the words “Load Line Rules”.

Marks on tankers and special type steamers.

5. Regulation 13 of the Navigation (Load Lines) Regulations is amended by omitting the words “Board of Trade Rules” (twice occurring) and inserting in their stead the words “Load Line Rules”.

Load lines, zones and seasonal areas.

6. Regulation 24 of the Navigation (Load Lines) Regulations is amended by omitting the words “Board of Trade Rules” and inserting in their stead the words “Load Line Rules”.

Fees.

7. Regulation 25 of the Navigation (Load Lines) Regulations is amended—

(a) by omitting from paragraph (a) of the proviso to sub-regulation (1.) the words “section 443 of the Merchant Shipping Act, 1894” and inserting in their stead the words “section 47 of the Merchant Shipping (Safety and Load Line Conventions) Act, 1932;

(b) by omitting paragraph (b) of that proviso and inserting in its stead the following paragraphs:—

“(b) where the annual survey of a ship (classed or unclassed) is not completed at one time—an additional fee of Two pounds shall be payable for every partial survey needed to complete the annual survey;

“(ba) an additional fee of Two pounds shall be payable if, for the purpose of the annual survey, or of a partial survey needed to complete the annual survey, of a ship over 500 tons (classed or unclassed), more than one visit was paid to the ship by the Surveyor;”; and

(c) by omitting from sub-regulation (4.) the words “charged by the Board of Trade of the United Kingdom” and inserting in their stead the words “prescribed by the Load Line Rules”.

8. Regulation 26 of the Navigation (Load Lines) Regulations is repealed and the following regulation inserted in its stead:—

Application of Load Line Rules.

“26. The provisions of the Load Line Rules apply, mutatis mutandis, in respect of any matter not covered by these Regulations.”.

Fourth Schedule.

9. The Fourth Schedule to the Navigation (Load Lines) Regulations is repealed and the following Schedule inserted in its stead:—
