REGULATIONS UNDER THE NAVIGATION ACT 1912-1973.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Navigation Act 1912-1973.

Amendments of the Navigation (Life-saving Appliances) Regulations 

Parts.

1. Regulation 2 of the Navigation (Life-saving Appliances) Regulations is repealed.

Application to existing ships.

2. Regulation 4 of the Navigation (Life-saving Appliances) Regulations is repealed.

Number of liferafts to be carried on Class I. ships.

3.Regulation 29 of the Navigation (Life-saving Appliances) Regulations is amended—

(a) by omitting from sub-regulation (1) the words “a liferaft or”;

(b) by omitting from sub-regulation (1) the words “twenty-five per centum of”;

(c) by omitting from sub-regulation (2) the words “the liferaft or life-rafts specified under the last preceding sub-regulation” and substituting the words “the liferafts having an aggregate carrying capacity sufficient to accommodate 25 per centum of the total number of persons that the ship is certified to carry”; and

(d) by omitting sub-regulation (3) and substituting the following sub-regulation:—

“(3) In determining whether the aggregate carrying capacity of the liferafts with which a Class I. ship is furnished is sufficient to constitute compliance with this regulation, the aggregate carrying capacity of any liferafts with which the ship is furnished in pursuance of sub-paragraph 8 (b) (ii) shall be taken into account.”.

4.Regulation 30 of the Navigation (Life-saving Appliances) Regulations is repealed and the following regulation substituted:—

Number of liferafts to be curried on Class 11. ships.

“30. (1) Subject to sub-regulation (2), a Class II. ship shall be furnished with liferafts having an aggregate carrying capacity sufficient to accommodate the total number of persons that the ship is certified to carry.

“(2) Sub-regulation (1) does not apply to a Class II. ship of less than 36.6 metres in length if the ship is furnished with liferafts and portable radio-telegraphy equipment in pursuance of paragraph 9 (4) (b).

“(3) A Class II. ship of 150 metres or more in length and with no superstructure amidships shall, in addition to the liferafts with which it is required to be furnished in pursuance of sub-regulation (1), be furnished with a liferaft having a carrying capacity sufficient to accommodate at least 6 persons.”.

Stowage liferafts— Class II. ships.

5. Regulation 34 of the Navigation (Life-saving Appliances) Regulations is amended—

(a) by inserting in sub-regulation (3), after the word “ship” (first occurring), the words “, other than the liferaft (if any) provided in pursuance of sub-regulation 30 (3),”; and

(b) by adding at the end thereof the following sub-regulation:—

“(4) The liferaft (if any) provided in a Class II. ship in pursuance of sub-regulation 30 (3) shall be stowed as far forward in the ship as is practicable.”.

Inspection and testing of inflatable liferafis.

6. Regulation 37 of the Navigation (Life-saving Appliances) Regulations is repealed and the following regulation substituted:—

“37. (1) The owner and master of a ship are each guilty of an offence if a period of more than 12 months has elapsed since an inflatable liferaft on board the ship was inspected and tested in accordance with this regulation, and each is, on conviction, punishable by a fine not exceeding $200.

“(2) An inspection and testing of an inflatable liferaft shall be carried out by a person authorized in writing by the manufacturer of the inflatable liferaft as a person competent to inspect and test inflatable liferafts manufactured by that manufacturer.

“(3) An inspection and testing of an inflatable liferaft shall be carried out at the place at which it was manufactured or at an approved place.

“(4) The person by whom an inspection and testing of an inflatable liferaft is carried out shall furnish to the owner and to the master of the ship on which the inflatable liferaft is carried a report in writing of the result of the inspection and testing of the inflatable liferaft and of any repairs and adjustments necessary to ensure that the inflatable liferaft complies with the requirements of these Regulations and including, if the inflatable liferaft is in such a condition that it would be impracticable to repair or adjust it, a statement to that effect.”.

Construction of lifejackets.

7. Regulation 55 of the Navigation (Life-saving Appliances) Regulations is amended—

(a) by omitting from paragraph (f) of sub-regulation (2) the word “and”; and

(b) by inserting after paragraph (f) of sub-regulation (2) the following paragraph:—

“(fa) if the material with which the lifejacket is covered is not an approved retro-reflective material, the lifejacket is fitted with retro-reflective tapes of an approved type (each tape

 

being not less than 100 millimetres long and not less than 50 millimetres wide) placed as high up on the lifejacket as possible—

(i) in not less than 6 places on the outside; and

(ii) in not less than 6 places on the inside, of the lifejacket; and ".

Line-throwing appliances.

8. Regulation 57 of the Navigation (Life-saving Appliances) Regulations is amended by omitting sub-regulations (3) and (4).

Rocket signals and flares.

9. Regulation 58 of the Navigation (Life-saving Appliances) Regulations is amended by omitting paragraph (b) of sub-regulation (3).

Portable radiotelegraphy equipment to be carried in a ship.

10. Regulation 61 of the Navigation (Life-saving Appliances) Regulations is amended—

(a) by omitting sub-regulation (3) and substituting the following sub-regulation:—

“(3) Subject to sub-regulations (4) and (5), the portable radio-telegraphy equipment with which a ship is required to be furnished in pursuance of sub-regulation (1) shall be kept in such a place that the equipment is readily accessible from the open deck of the ship and is ready to be moved into a lifeboat or liferaft in the event of an emergency.”;

(b) by omitting from sub-regulation (4) the words “The portable” and substituting the words “Subject to sub-regulation (5), the portable”;

(c) by omitting from sub-regulation (4) all words from and including the word “kept” and substituting the following words and paragraphs:—

“kept in such a place that the equipment is—

(c) near the lifeboats that are stowed furthest away from the ship’s main radiotelegraphy equipment; and

(d) readily accessible from the open deck of the ship."; and

(d) by adding at the end thereof the following sub-regulation:—

“(5) The portable radiotelegraphy equipment with which a ship is required to be furnished in pursuance of sub-regulation (1) shall not be kept in the radiotelegraphy room of the ship.”.

Ladders.

11. Regulation 65 of the Navigation (Life-saving Appliances) Regulations is amended—

(a) by omitting from sub-regulation (1) the words “the next succeeding sub-regulation,” and substituting the words “this regulation,”; and

(b) by adding at the end thereof the following sub-regulation:—

“(3) A knotted lifeline that is long enough to reach the water may, instead of a ladder, be provided to facilitate embarkation into the liferaft (if any) provided in pursuance of sub-regulation 30 (3) when that liferaft is waterborne.”.

Hand lamp or hand torch for additional forward liferaft.

12. After regulation 71 of the Navigation (Life-saving Appliances) Regulations the following regulation is inserted in Division 6 of Part II:—

“71a. A Class II. ship of 150 metres or more in length and with no superstructure amidships shall, in addition to the other appliances with which it is required to be provided in pursuance of any of the preceding provisions of this

Division, be furnished with a battery operated hand torch or battery operated hand lamp, placed as near as practicable to the place where the liferaft provided in pursuance of sub-regulation 30 (3) is stowed.”.

Third Schedule.

13. The Third Schedule to the Navigation (Life-saving Appliances) Regulations is amended—

(a) by omitting paragraph (i) of item 1 of Part I and substituting the following paragraph:—

“(ha) 2 watertight containers, each container—

(i) being furnished with a waterproof match striker as part of, or attached to, the container; and

(ii) holding not less than 25 matches of a type that is not readily extinguish able by wind;”;

(b) by adding at the end of paragraph (x) of item 1 of Part I the words “, being a cover of a type that does not, when rigged, obscure the retro-reflective tapes fitted on the outside of the lifeboat”;

(c) by adding at the end of Part I the following items:—

“4. A lifeboat shall be fitted with retro-reflective tapes of an approved type (each tape being not less than 300 millimetres long and not less than 50 millimetres wide) —

(a) on top of the gunwale of the lifeboat; and

(b) on the outside of the lifeboat as near to the gunwale as possible,

spaced so that the distance between the centre of a tape and the centre of the tape next in line is not greater than 500 millimetres.

“5. The top of the cover with which a lifeboat is equipped shall be fitted with retro-reflective tapes of an approved type (each tape being not less than 300 millimetres long and not less than 50 millimetres wide)—

(a) placed in such a way that 2 tapes form a cross; and

(b) spaced so that the distance between the centre of a cross and the centre of the cross next in line is not greater than 500 millimetres.";

(d) by omitting item 7 of Part V and substituting the following item:—

“7. The rocket shall be individually packed in a hermetically sealed waterproof container.”;

(e) by inserting in item 8 of Part V, after the word “and”, the words “, unless the container in which the rocket is packed is transparent,”;

(f) by adding at the end of Part V the following item:—

“9. Clear and concise instructions for use shall be printed indelibly on the rocket.”;

(g) by omitting item 2 of Part VI and substituting the following item:—

“2. Where the flare is carried in a liferaft, it shall be so constructed that, when the flare is ignited, no burning composition which might cause damage to the liferaft can fall from the flare.”;

(h) by omitting item 6 of Part VI and substituting the following item:—

“6. The date on which the flare is filled shall be stamped indelibly on the flare and, unless the container in which the flare is packed is transparent, on the container.”; and

 

(i) by adding at the end of Part VI the following item:—

“8. The flare shall be individually packed in a hermetically sealed waterproof container.”.

Sixth Schedule.

14. The Sixth Schedule to the Navigation (life-saving Appliances) Regulations is amended—

(a) by omitting from Part III the words “A liferaft shall” and substituting the words “1. A liferaft shall”;

(b) by omitting paragraph (b) of Part III and substituting the following paragraph:—

“(b) 1 sponge for each person included in the carrying capacity of the liferaft;”;

(c) by inserting in Part III, after paragraph (h), the following paragraph:—

“(ha) 6 chemiluminescent lights of an approved type;”;

(d) by omitting paragraph (m) of Part III and substituting the following paragraph:—

“(m) 500 grams of—

(i) barley sugar; or

(ii) other non-thirst-provoking food, containing no protein or fat and providing at least 1,500 kilojoules per 100 gram weight for each person included in the carrying capacity of the liferaft (being barley sugar or other food that has been in the liferaft for a period not exceeding 2 years);”;

(e) by omitting from paragraph (t) of Part III the word “and” (last occurring); and

(f) by adding at the end of Part III the following paragraphs and item:—

“(v) an approved emergency position-indicating radio beacon;

“(w) an approved survival bag for each person included in the carrying capacity of the liferaft;

“(x) a watertight container—

(i) being furnished with a waterproof match striker as part of, or attached to, the container; and

(ii) holding not less than 25 matches of a type that is not readily extinguishable by wind; and

“(y) in the case of an inflatable liferaft, 2 retro-reflective tapes of an approved type placed on the underside of the floor of the liferaft in such a way that the tapes form a cross at the centre of the floor, the tapes being not less than 50 millimetres wide and—

(i) in the case of a circular inflatable liferaft—of a length that is not less than half the diameter of the liferaft; or

(ii) in the case of any other inflatable liferaft—of lengths that are not less than half the length and width, respectively, of the liferaft.

 

“2. The cover, or each of the covers, with which a liferaft is equipped shall be fitted with retro-reflective tapes of an approved type in such a way that—

(a) tapes are spaced around the cover so that the distance between the centre of a tape and the centre of the tape next in line is not greater than 500 millimetres and the distance between the lower edge of a tape and the lower edge of the cover is not less than half the height of the cover; and

(b) 2 tapes form a cross at the centre of the top of the cover, the tapes being not less than 50 millimetres wide and—

(c) in the case of the 2 tapes placed on top of the cover—

(i) on a circular liferaft—of a length that is not less than half the diameter of the liferaft; or

(ii) on any other liferaft—of lengths that are not less than half the length and width, respectively, of the liferaft; or

(d) in the case of the other tapes—not less than 300 millimetres long.”.

Seventh Schedule.

15. The Seventh Schedule to the Navigation (Life-saving Appliances) Regulations is amended by inserting after paragraph (g) the following paragraph:—

“(ga) the buoyant apparatus shall be fitted with retro-reflective tapes of an approved type (each tape being not less than 300 millimetres long and not less than 50 millimetres wide) on the top and bottom of the buoyant apparatus, spaced around the perimeter of the buoyant apparatus so that the distance between the centre of a tape and the centre of the tape next in line is not greater than 500 millimetres;”.

Eighth Schedule.

16. The Eighth Schedule to the Navigation (Life-saving Appliances) Regulations is amended by adding at the end thereof the following item:—

“11. A lifebuoy shall be fitted with retro-reflective tapes of an approved type (each tape being not less than 50 millimetres wide) around, or on both sides of, the lifebuoy at 4 equidistant points.”.

Ninth Schedule.

17. The Ninth Schedule to the Navigation (Life-saving Appliances) Regulations is amended by omitting Part II.

Tenth Schedule.

18. The Tenth Schedule to the Navigation (Life-saving Appliances) Regulations is amended—

(a) by omitting item 8 and substituting the following item:—

“8. The rocket shall be individually packed in a hermetically sealed waterproof container.”;

(b) by inserting in item 9, after the word “and”, the words “, unless the container in which the rocket is packed is transparent,”; and

(c) by adding at the end thereof the following item:—

“10. Clear and concise instructions for use shall be printed indelibly on the rocket.”.
