NAVIGATION (HEALTH) REGULATIONS - SECT. 1.
Citation

1. These Regulations may be cited as the Navigation (Health) Regulations.*1*


See notes to first article of this Chapter.

NAVIGATION (HEALTH) REGULATIONS - SECT. 2.
Repeal

2. The Navigation (Health) Regulations (comprising Statutory Rules 1935, Nos. 13 and 76; Statutory Rules 1936, No. 42; Statutory Rules 1953, No. 29; and Statutory Rules 1955, No. 62) are repealed.

NAVIGATION (HEALTH) REGULATIONS - SECT. 3.
Interpretation

Substituted by 1974 No. 215 r. 3 3. In these Regulations a reference to the Ship Captain's Medical Guide shall be read as a reference to the latest edition for the time being of the book of that name published by Her Majesty's Stationery Office, London, or, if that edition has been added to or amended, that edition as affected by the additions or amendments.

NAVIGATION (HEALTH) REGULATIONS - SECT. 4.
Prescribed fees for medical examinations

Sub-reg. (1) amended by 1967 No. 63 r. 1; 1976 No. 279 r. 2; 1977 No. 227 r. 1; 1977 No. 268 r. 2; 1979 No. 194 r. 2 4. (1) For the purpose of sub-section (2) of section 123 of the Navigation Act 1912-1961, the prescribed fee payable by a person at whose request an examination referred to in that sub-section is made is-

(a) where the examination is made at a time when the Mercantile Marine Office is open for general business-$20;

(b) where the examination is made at a time when the Mercantile Marine Office is not open for general business-$50; and

(c) subject to the next succeeding sub-regulation, for each kilometre or part of a kilometre necessarily travelled by a Medical Inspector of Seamen for the purpose of making the examination and returning to his surgery after making the examination-$4.


(2) The fee prescribed by paragraph (c) of the last preceding sub-regulation is not payable in respect of an examination made by a Medical Inspector of Seamen who is an officer or employee within the meaning of the Public Service Act 1922-1960.


(3) The fees prescribed by this regulation are payable to the superintendent at the port at which the examination is made.


(4) For the purposes of sub-regulation (1) of this regulation, "the Mercantile Marine Office" means-

(a) in relation to an examination made at a port at which a Mercantile Marine Office has been established under section 13 of the Navigation Act 1912-1961-that Mercantile Marine Office; and

(b) in relation to an examination made at a port at which a Mercantile Marine Office has not been so established-the office of the Collector at that port.

NAVIGATION (HEALTH) REGULATIONS - SECT. 5.
Medical examination of masters, seamen and apprentices

Amended by 1974 No. 215 r. 10 5. A Medical Inspector of Seamen shall, on application by the owner or master of a ship, or by a superintendent-

(a) medically examine the master, or any seaman or apprentice, employed in the ship, or any person proposing to engage in employment as a master or seaman, or to become an apprentice, in the ship; and

(b) give to the superintendent a report of the examination in accordance with Form 1 in Schedule 1.

NAVIGATION (HEALTH) REGULATIONS - SECT. 6.
Certificate of fitness of persons under age of eighteen years

Sub-reg. (1) amended by 1974 No. 215 r. 10 6. (1) Where a Medical Inspector of Seamen has medically examined a person under the age of eighteen years in accordance with the last preceding regulation and the Medical Inspector of Seamen is satisfied that the person examined is medically fit for employment in the ship as a seaman or apprentice, as the case may be, he shall, if requested by the person, issue to the person a certificate of fitness in accordance with Form 2 in Schedule 1.


(2) A certificate of fitness issued under the last preceding sub-regulation remains in force for a period of twelve months but may be renewed by a Medical Inspector of Seamen, in each case after a further medical examination of the holder of the certificate by that Medical Inspector of Seamen, for successive periods of twelve months.


Amended by 1974 No. 215 r. 10 (3) A renewal of a certificate of fitness shall be effected by an indorsement on the certificate in accordance with the form of indorsement specified on Form 2 in Schedule 1.


(4) An indorsement of a renewal of a certificate of fitness shall be made before the expiration of the certificate, or of the last renewal, as the case may be, and the renewal shall take effect upon the expiration of the certificate or of that last renewal.


(5) A person shall not engage or re-engage a person under the age of eighteen years as a seaman, or take an apprentice under that age to sea, unless the person to be engaged or re-engaged, or the apprentice, is the holder of a certificate of fitness that is in force issued by a Medical Inspector of Seamen under sub-regulation (1) of this regulation.

NAVIGATION (HEALTH) REGULATIONS - SECT. 7.
Medicines, &c., to be carried on ships

Sub-reg. (1) amended by 1967 No. 63 r. 2; 1974 No. 215 r. 3 7. (1) Subject to sub-regulations (3D) and (3E), the medicines, medical and surgical stores and appliances and anti-scorbutics and the instructions for dispensing and using medicines, medical and surgical stores and appliances with which a ship to which this regulation applies shall be provided are the medicines, medical and surgical stores and appliances and anti-scorbutics and instruction specified-

(a) in the case of a ship on an international voyage, being a ship carrying or certified to carry, as a full complement of passengers and crew, 100 or more persons-in Schedule 2;

(b) in the case of a ship-

(i) on an international voyage, being a ship carrying or certified to carry, as a full complement of passengers and crew, more than 50 but less than 100 persons; or

(ii) on a voyage other than an international voyage, being a ship carrying or certified to carry, as a full complement of passengers and crew, 100 or more persons-

in Schedule 3;

(c) in the case of a ship-

(i) on an international voyage, being a ship carrying or certified to carry, as a full complement of passengers and crew, not more than 50 persons; or

(ii) on a voyage other than an international voyage, being a ship carrying or certified to carry, as a full complement of passengers and crew, more than 25 but less than 100 persons-

in Schedule 4; and

(d) in the case of a ship on a voyage other than an international voyage, being a ship carrying or certified to carry, as a full complement of passengers and crew, not more than 25 persons-in Schedule 5.


Substituted by 1974 No. 215 r. 3 (2) Where a ship is required in pursuance of a Schedule to be provided with a medicine-

(a) the medicine is to be in a pack containing the medicine in the number of articles or other quantity specified in respect of the medicine in the second column of Part I of Schedule 2, Part I of Schedule 3, Part I of Schedule 4 or Part II or III of Schedule 5, as the case may be;

(b) the ship is to be provided with the medicine in the number of packs or other quantity specified in respect of the medicine in the third column of Part I of Schedule 2, Part I of Schedule 3, Part I of Schedule 4 or Part II or III of Schedule 5, as the case may be;

(c) each pack of the medicine is to have written on it or on a label attached to it the instructions (if any) specified in respect of the medicine in the fourth column of Part I of Schedule 2;

(d) if the reference to the medicine in the first column of Part I of Schedule 2 is marked *-the medicine is not to be a medicine the date appearing on the label on which in accordance with paragraph (f) of sub-clause (3) of clause 2 of Schedule 6 will occur on a voyage; and

(e) the medicine is to comply with the requirements specified in Schedule 6.


Substituted by 1974 No. 215 r. 3 (3) Where a ship is required in pursuance of Schedule 2, 4 or 5 to be provided with a store or appliance, being a store or appliance referred to in the first column of Division 1 of Part II of Schedule 2, Part II of Schedule 4 or Part II or III of Schedule 5, as the case may be, the ship is to be provided with the store or appliance in the quantity specified in respect of the store or appliance in whichever of the columns in Division 1 of Part II of Schedule 2, Part II of Schedule 4 or Part II or III of Schedule 5, as the case may be, has the heading "Quantity ".


Inserted by 1974 No. 215 r. 3 (3A) Where a ship is required in pursuance of Schedule 2 or 3 to be provided with a store or appliance referred to in Division 2 or Division 3 of Part II of Schedule 2 or Part II or III of Schedule 3, as the case may be, the ship is to be provided with the store or appliance in the quantity specified in respect of the store or appliance in the second column of Division 2 or Division 3 of Part II of Schedule 2 or Part II or III of Schedule 3, as the case may be.


Inserted by 1974 No. 215 r. 3 (3B) Where a ship is required in pursuance of Schedule 2 or Schedule 3 to be provided with a disinfectant, the disinfectant shall comply with the requirements specified in Schedules 6 and 7.


Inserted by 1974 No. 215 r. 3 (3C) Where the reference to a medicine in a Schedule is followed by the words "(malarious areas only)" a ship is only required to be provided with that medicine in waters between latitude 20 degrees North and latitude 20 degrees South.


Inserted by 1974 No. 215 r. 3 (3D) A midwifery instrument is not required to be provided on a ship on which there are no women.


Inserted by 1974 No. 215 r. 3 (3E) Where a ship is required in pursuance of a Schedule to be provided with goods that are goods for therapeutic use within the meaning of the Therapeutic Goods Act 1966-1973, the goods shall-

(a) conform to the specific standards, within the meaning of that Act, applicable to the goods; and

(b) conform to the general standards, within the meaning of that Act, applicable to the goods.


Inserted by 1974 No. 215 r. 3 (3F) Where, by virtue of sub-regulation (1), a ship is required to be provided with a provision, being a medicine, store or appliance, the Minister may allow any other provision to be provided on the ship as compliance with the requirement if he is satisfied that the other provision so allowed is at least as effective as the provision required by the sub-regulation for the purposes for which the provision is required to be provided.


Added by 1967 No. 63 r. 2 (4) This regulation applies to a ship-

(a) to which sub-section (1) of section 125 of the Navigation Act 1912-1966 applies; and

(b) to which section 270 of that Act applies, not being a ship referred to in the last preceding paragraph.

NAVIGATION (HEALTH) REGULATIONS - SECT. 7AA.
Ships to which section 270 of Act applies not to be taken to sea without
medicines, &c.

Inserted by 1967 No. 63 r. 3 7AA. (1) The master of a ship to which section 270 of the Navigation Act 1912-1966 applies, not being a ship to which sub-section (1) of section 125 of that Act applies, shall not take the ship to sea, and the owner or agent of the ship shall not permit the ship to be taken to sea, unless the ship is provided, in accordance with the last preceding regulation, with medicines, medical and surgical stores and appliances and anti-scorbutics and such other items as it is required to carry by virtue of that regulation.


Penalty: Two hundred dollars.


(2) It is a defence to a prosecution for an offence against the last preceding sub-regulation if the person charged with the offence satisfies the court in which the prosecution is brought that his failure to comply with the sub-regulation was not due to any act or default on his part.

NAVIGATION (HEALTH) REGULATIONS - SECT. 7AB.
Items to be carried in medical cabinet

Inserted by 1974 No. 215 r. 4 7AB. Subject to regulation 7AC, the medicines, medical and surgical stores and appliances and anti-scorbutics and instructions specified in Schedules 2, 3 and 4 and Part III of Schedule 5 with which a ship is to be provided under regulation 7 shall, as far as space allows, be kept in the medical cabinet referred to in regulation 7A.

NAVIGATION (HEALTH) REGULATIONS - SECT. 7AC.
Items to be carried in inner cupboard of medical cabinet

Inserted by 1974 No. 215 r. 4 7AC. The medicines, medical and surgical stores and appliances and anti-scorbutics specified in Schedules 2, 3 and 4 and Part III of Schedule 5 which are marked with the symbol + shall be stored in the locked inner cupboard of the medical cabinet referred to in paragraph 7A (2) (b).

NAVIGATION (HEALTH) REGULATIONS - SECT. 7A.
Medical cabinets

Inserted by 1965 No. 106 r. 1 Sub-reg. (1) amended by 1967 No. 63 r. 4 7A. (1) A medical cabinet of a size, design and construction suitable for storing the medicines, medical and surgical stores and anti-scorbutics and the instructions for dispensing and using medicines, medical and surgical stores and appliances with which a ship to which sub-section (1) of section 125 or section 270 of the Navigation Act 1912-1966 applies is required to be provided under regulation 7 of these Regulations shall be provided in a separate compartment adjacent to the hospital accommodation provided in the ship or, if hospital accommodation is not required to be provided in the ship, in a part of the ship adjacent to the accommodation provided for the ship's officers.


Amended by 1974 No. 215 r. 5 (2) The medical cabinet shall be provided with-

(a) an outer door fitted with an efficient lock;

(b) an inner cupboard, capable of being locked independently, for the purpose of storing the medicines, medical and surgical stores and appliances and anti-scorbutics referred to in regulation 7AC;

(c) shelves so constructed as to facilitate identification of the articles stored on them;

(d) a dispensing counter or dispensing table in either case with a surface which can be easily kept clean;

(e) at least two drawers suitable for the storage of articles; and

(f) a rack suitable for holding devices for measuring medicines.


Inserted by 1974 No. 215 r. 5 (2A) Each key carried by a ship capable of unlocking the cupboard provided on the ship in compliance with paragraph (b) of sub-regulation (2) shall be kept in the custody of the master or an officer.


(3) The medical cabinet shall not be kept in a recreation room, sleeping room, mess room, wash place or other space provided as accommodation for the crew if it reduces the area of available space in the room, place or space to less than the minimum area required by the Navigation (Crew Accommodation) Regulations to be provided in that room, place or space.


(4) The medical cabinet shall be lighted by an electric light which shall be inside or immediately outside the cabinet and which will enable all the contents of the cabinet to be clearly seen in the absence of light from another source.


(5) The medical cabinet and the place in which it is fitted shall be so ventilated as to avoid deterioration of its contents.


Added by 1974 No. 215 r. 5 (6) The medical cabinet and its contents shall be inspected annually by a Medical Inspector of Seamen.

NAVIGATION (HEALTH) REGULATIONS - SECT. 8.
Certificate of recovery of seaman from illness or injury

Amended by 1974 No. 215 r. 10 8. A certificate as to the recovery of a seaman from illness, hurt or injury given in pursuance of section 132 of the Navigation Act 1912-1961 shall be in accordance with Form 3 in Schedule 1.

NAVIGATION (HEALTH) REGULATIONS - SECT. 9.
Distances beyond which certain ships to carry medical practitioners

Amended by 1974 No. 215 r. 10 9. The prescribed distance for the purpose of paragraph (b) of sub-section (1) of section 133 of the Navigation Act 1912-1961 is the distance of six hundred and fifty international nautical miles.

NAVIGATION (HEALTH) REGULATIONS - SECT. 10.
Distances beyond which certain ships to carry first aid attendants

Amended by 1974 No. 215 r. 10 10. The prescribed distance for the purpose of paragraph (b) of sub-section (2) of section 133 of the Navigation Act 1912-1961 is the distance of six hundred and fifty international nautical miles.

NAVIGATION (HEALTH) REGULATIONS - SECT. 11.
Authorities authorized to issue certificates to first aid attendants

Substituted by 1974 No. 215 r. 6 11. Each of the authorities specified in Schedule 8 is a prescribed authority for the purposes of sub-section (2) of section 133 of the Navigation Act 1912-1973.

NAVIGATION (HEALTH) REGULATIONS - SECT. 12.
Power of exemption

Inserted by 1974 No. 215 r. 7 12. (1) Subject to sub-regulation (2), where the Minister is satisfied that there is no danger to a person or that there are exceptional circumstances, the Minister may, by writing under his hand, exempt a ship from the requirements of regulation 7 subject to such conditions or restrictions as may be specified in the exemption.


(2) No ship shall be permitted to carry less than the quantity of medicines, medical and surgical stores and appliances specified in Parts I and II of Schedule 5.

NAVIGATION (HEALTH) REGULATIONS - SECT. 13.
Record of use, loss or theft of certain drugs, &c.

Inserted by 1974 No. 215 r. 7 13. (1) The master of a ship to which these Regulations apply shall enter, or cause to be entered, in the official log book of the ship, a record of the use on board the ship of Morphine Sulphate Injections, Pentazocine Injections and Omnopon Tubunic.


(2) The record of use referred to in sub-regulation (1) shall contain the following particulars:

(a) the full name and address of the person to whom a drug referred to in that sub-regulation is administered;

(b) the reason for administering the drug;

(c) the date on which the drug was administered;

(d) the quantity of the drug administered; and

(e) the name and rank of the person who administered the drug.


(3) The master of a ship to which these Regulations apply shall-

(a) enter, or cause to be entered, in the official log book of the ship, a record of any loss or theft of Morphine Sulphate Injections, Pentazocine Injections or Omnopon Tubunic; and

(b) notify the proper authority-

(i) where the loss or theft is discovered at sea-at the next port of call; or

(ii) where the loss or theft is discovered in port-at that port,

as soon as practicable after the discovery having regard to the means of communication available to him.

Regulation 7
REQUIREMENTS FOR DRUGS, MEDICINAL PREPARATIONS AND DISINFECTANTS TO BE
CARRIED ON SHIPS

1. A drug or medicinal preparation is to be obtained from a supplier who,
before or at the time the drug or medicinal preparation is ordered, has been
given a copy of these Regulations as in force at the time when the drug or
medicinal preparation is ordered.

2. Labelling.
(1) A drug or medicinal preparation shall be plainly labelled in the English
language.
(2) The label must be durable and of such nature as to be clearly readable for the normal life of the contents of the container to which such label is
attached.
(3) The label shall bear-
(a) the approved name of the drug or medicinal preparation, the strength
and the quantity present in the package;
(b) the form of the drug or medicinal preparation (capsule, tablet,
injection, etc.) including the synonym (if any) used in the column "Medicines
to be carried" of Part I of Schedule 2;
(c) the normal adult dose of those for internal use and otherwise adequate directions for use;
(d) the name and address of the supplier;
(e) such other information as is required by the laws of the State or
country in which the supply is made;
(f) if the label is on a medicine the reference to which in the first
column of Part I of Schedule 2 is marked *-the date, expressed by month and
year, after which the preparation should not be used by reason of a possible
decrease in its effectiveness or of its decomposition.

3. Containers.
A drug or medicinal preparation shall be packed in such containers as conform
to the requirements of the laws of the State or country in which they are
supplied, provided that cork closures shall not be used.

4. Storage.
Storage should be in a cool place i.e. below 25 degrees C
if possible, except that the
following shall be stored within the temperature range 2 degrees C to 8 degrees
C:

Insulin Heparin Injection
Procaine Penicillin Injection Streptomycin Sulphate Injection
Oxytocin

(Such temperatures are attainable in a domestic type refrigerator-these MUST NOT BE FROZEN).

Regulation 7
REQUIREMENTS FOR DISINFECTANTS TO BE CARRIED ON SHIPS

I. GENERAL PURPOSE DISINFECTANT DEODORANT; SUDOL (SOLUTION OF
ALKYLPHENOLS IN A SAPONACEOUS SOLVENT).

II. ANTISEPTIC SOLUTION CONTAINING CETRIMIDE 3% AND CHLORHEXIDINE
GLUCONATE 0.3% IN A SUITABLE AQUEOUS VEHICLE.

III. STABILIZED CHLORIDE OF LIME (IN 100 GRAM TINS) PREPARED FOR
STERILIZING DRINKING WATER.

1. The chloride of lime must contain not less than 24 per centum, and not more than 26 per centum, of available chlorine.

2. It must contain not less than 14 per centum of free quick lime (CaO).

3. The total water existing in all forms consisting largely, if not entirely,
of the water in combination in the form of calcium hydroxide must not exceed 7.5 per centum.

4. It shall be of such stability that, after passing four weeks in an oven
kept at 60 degrees
Celsius (' 1 degree), the percentage of available chlorine shall not
decrease more than 2 per centum.

5. The powder to be put up in 100 gram tins, the date of issue by the
manufacturer to be stamped on the base of each tin.

6. Each tin and contents (except the measure, which may be used again),
whether partially used or not, to be renewed within one year following the date
stamped on the tin.

7. Each tin to contain a measure, made of a material resistant to chlorine, to contain 4 grams of the powder, when full, that is to say, sufficient to
chlorinate approximately 1000 litres of water.

8. Instructions for use are those set out in the Ship Captain's Medical Guide.

IV. CRUDE STABILIZED CHLORIDE OF LIME IN 4.5 KILOGRAM TINS.

If it is so desired, the quantity of general purpose disinfectant deodorant
may be reduced by not more than 50 per centum if the amount so reduced is


replaced by an equal mass of stabilized chloride of lime (1 litre of general
purpose disinfectant deodorant to equal 1 kilogram of chloride of lime).

The chloride of lime must be dry and suitably stabilized yielding not less
than 30 per centum by mass of available chlorine and must be put up in tins of
not more than 4.5 kilograms per tin, the date of issue by the manufacturer being stamped on each tin. Each tin and contents, whether partly used or not, must be
renewed within one year of the date stamped on the tin. Full instructions for
the use of the powder for cleansing decks, bulkheads, urinals and lavatory
basins must be given on a label attached to each tin. Samples for test shall be
taken from time to time. This material shall not be used for the sterilization
of drinking water, or for the sterilization of dejecta, soiled utensils or
apparel of persons suffering from a contagious or infectious disease.

V. STABILIZED SODIUM HYPOCHLORITE SOLUTION.

If a stabilized solution of hypochlorite of soda is preferred to chloride of
lime, this preparation may be carried in place of the chloride of lime if the
total quantity of available chlorine is the same. If it is so desired, the
amount of general purpose disinfectant deodorant carried may then be reduced by
not more than 50 per centum if the quantity so omitted is replaced by three
times its mass of stabilized hypochlorite solution. The conditions and
restrictions as to its purpose and use are the same as for chloride of lime. The hypochlorite solution must yield at least 10 per centum of available chlorine.
If at any time the solution decreases in strength so that the available chlorine falls to less than 8 per centum, it shall be replaced as soon as possible. The
liquid is to be stored in stoneware jars or other containers, of not less than
10 litres or more than 50 litres capacity, not liable to cause a diminution of
the strength of the solution. The jars shall be sealed either with stoneware
stoppers or with stoppers which have no appreciable action in diminishing the
strength of the solution. Unless it can be shown that the strength of the
solution is unaltered, the disinfectant shall be renewed at least once a year.
The date of sealing the containers and directions for use must be stated on a
label adhering firmly to the jar. In a ship in which a sea-water electrolizer is installed, being an electrolizer that is capable of giving an unlimited quantity of sodium hypochlorite solution containing not less than 0.1 per centum of
available chlorine, the quantity of general purpose disinfectant deodorant
carried may be reduced by not more than 50 per centum. The type of electrolizer
must be subject to inspection from time to time by a Medical Inspector of
Seamen. A sample of electrolite will occasionally be taken for testing the
chlorine content. The conditions and restrictions as to its purpose and use are
the same as those for chloride of lime specified in clause IV or hypochlorite
solution.
