REGULATIONS UNDER THE NAVIGATION ACT 1912-1970.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912-1970.

Amendments of the Navigation (Examination of Masters and Mates) Regulations 

1. Regulation 35 of the Navigation (Examination of Masters and Mates) Regulations is repealed and the following regulation inserted in its stead:—

Qualifying sea service.

“35.—(1.) Subject to the next succeeding sub-regulation, a candidate shall have served a period of not less than three years’ qualifying sea service.

“(2.) Where a candidate is a candidate for a certificate of competency of a sub-grade of the grade ‘mate of a river and bay ship’, being a sub-grade limited to the River Murray and its tributaries—

(a) the candidate shall have served a period of not less than three years’ qualifying sea service; or

(b) the candidate shall hold a certificate issued by the Principal Examiner certifying that, having regard to the nature of the qualifying sea service that the candidate has had and the capacity in which he has performed that service, the candidate has served for an adequate period of qualifying sea service for candidates for a certificate of that sub-grade.”.

Qualifying sea service.

2. Regulation 38 of the Navigation (Examination of Masters and Mates) Regulations is repealed and the following regulation inserted in its stead:—

“38.—(1.) Subject to the next succeeding sub-regulation, a candidate shall have served a period of not less than four years’ qualifying sea service, including a period of not less than one year’s qualifying sea service in the particular river and bay limits to which the sub-grade of the certificate of competency for which he is a candidate relates.

“(2.) Where a candidate is a candidate for a certificate of competency of a sub-grade of the grade ‘master of a river and bay ship’, being a sub-grade limited to the River Murray and its tributaries—

(a) the candidate shall have served a period of not less than four years’ qualifying sea service, including a period of not less than one year’s qualifying sea service in the limits of the River Murray and its tributaries; or

(b) the candidate—

(i) shall have served a period of not less than one year’s qualifying sea service in the limits of the River Murray and its tributaries; and

(ii) shall hold a certificate issued by the Principal Examiner certifying that, having regard to the nature of the qualifying sea service that the candidate has had and the capacity in which he has performed that service, the candidate has served for an adequate period of qualifying sea service for candidates for a certificate of that sub-grade.”.

Sub-grades and values of grades of certificates of competency.

3. Regulation 52 of the Navigation (Examination of Masters and Mates) Regulations is amended by adding at the end thereof the following sub-regulations:—

“(3.) The holder of a certificate of competency as master of a limited coast-trade ship is, for the purposes of sub-section (2.) of section 15 of the Act, deemed to be the holder of a certificate of competency of each of the sub-grades of the grade ‘master of a river and bay ship’ that are limited to the River Murray and ils tributaries.

“(4.) The holder of a certificate of competency as first mate or second mate of a limited coast-trade ship is for the purposes of sub-section (2.) of section 15 of the Act, deemed to be the holder of a certificate of competency of each of the sub-grades of the grade ‘mate of a river and bay ship’ that are limited to the River Murray and its tributaries.”.

Third Schedule.

4. The Third Schedule to the Navigation (Examination of Masters and Mates) Regulations is amended by omitting from Part I., Part II. and Part III. the words “Half of the period of the course with a maximum of 1 week” (in the third column) appearing opposite to the words “Radar Observer course at a school approved by the Minister” (in the first column) and inserting in their stead the figure and word “2 weeks”.
