REGULATIONS UNDER THE NAVIGATION ACT 1912-1968.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912-1968.

Amendments of the Navigation (Examination of Engineers) Regulations 1964

Interpretation.

1. Regulation 4 of the Navigation (Examination of Engineers) Regulations 1964 is amended by inserting in sub-regulation (1.), after the definition of “certificate”, the following definitions:—

“‘certificate of efficiency as lifeboatman’ means a certificate issued after examination according to the syllabus for examination for a certificate of efficiency as lifeboatman specified in the Tenth Schedule to the Navigation (Examination of Masters and Mates) Regulations or an examination that, in the opinion of the Principal Examiner, is equivalent to that examination;

“‘certificate of proficiency in first aid’ means a certificate of proficiency in first aid issued after examination by a body approved for the purposes of these Regulations by the Minister;”.

Application for examination.

2. Regulation 34 of the Navigation (Examination of Engineers) Regulations 1964 is amended—

(a) by omitting from paragraph (e) of sub-regulation (2.) the word “and”; and

(b) by inserting after paragraph (f) of sub-regulation (2.) the following word and paragraph:—

“; and (g)the certificate of proficiency in first aid (if any) last obtained by the candidate.”.

3. After regulation 51 of the Navigation (Examination of Engineers) Regulations 1964 the following regulation is inserted:—

Certificate of efficiency as lifeboatman.

“51a.—(1.) A person who is a candidate for an examination for a second class certificate or a first class certificate and does not already hold a certificate of efficiency as lifeboatman may, with the approval of an examiner appointed under the Navigation (Examination of Masters and Mates) Regulations, present himself at an examination for a certificate of efficiency as lifeboatman held under those Regulations.

“(2.) If the person passes the examination, a certificate of efficiency as life-boatman in accordance with Form 2 in the Twelfth Schedule to the Navigation (Examination of Masters and Mates) Regulations shall be issued to him.

“(3.) If the Minister is satisfied that a certificate of efficiency as lifeboat-man issued to a person under the last preceding sub-regulation has been lost or destroyed he may issue to that person a certified copy of the certificate.”.

Prescribed qualifications for the bolder of a first or second class certificate.

4. After regulation 53 of the Navigation (Examination of Engineers) Regulations 1964 the following regulation is inserted:—

“54. For the purposes of sub-section (1.) of section 18 of the Act, the prescribed qualifications for the holder of a second class certificate or a first class certificate include the holding of—

(a) a certificate of efficiency as lifeboatman; and

(b) a certificate of proficiency in first aid, being a certificate the examination for which was passed by the applicant not earlier than three years before the date on which he passed the examination under these Regulations for the certificate of competency.”.

Fee for duplicate-certificate or permit.

5. Regulation 55 of the Navigation (Examination of Engineers) Regulations 1964 is amended by inserting after the word “Act” the words “,or with a certified copy of a certificate of efficiency as lifeboatman under sub-regulation (3.) of regulation 51a of these Regulations,”.

Amendment of First Schedule.

6. The First Schedule to the Navigation (Examination of Engineers) Regulations 1964 is amended by omitting from Form 3 the words “Merchant Service” and inserting in their stead the words “Merchant Navy”.

Application of amendment.

7. The amendment made by regulation 4 of these Regulations does not apply in relation to a person who—

(a) applies before the expiration of three months after the date of commencement of these Regulations to have a second class certificate or a first class certificate delivered to him; and

(b) is, apart from the provisions of that regulation, qualified to have that certificate delivered to him.
