REGULATIONS UNDER THE NAVIGATION ACT 1912-1920.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912-1920, to come into operation forthwith, unless otherwise specified therein.

Amendment of Navigation (Examination of Engineers) Regulations.

(Statutory Rules 1923, No. 88.)

1. Regulation 3 of the Navigation (Examination of Engineers) Regulations is amended by omitting the definition of “on regular watch,” and inserting in its stead the following definition:—

“‘Service on regular watch’ means officers’ watch-keeping service on main propelling machinery for at least eight hours each day, but does not include time spent on clerical work, or on fitting or overhauling machinery, either on regular watch or on day work.”

2. Regulation 12 of the Navigation (Examination of Engineers) Regulations is amended by omitting sub-regulations (3) and (4), and inserting in their stead the following sub-regulations:—

“(3) Every applicant should produce testimonials in respect of the qualifying period of his service signed, in each case, by the Chief Engineer under whom his services have been performed, stating his actual rank on watch, the nature of the duties performed by him, and the number of engineers simultaneously on watch on the main propelling machinery.

“(4) Each testimonial should be endorsed by the Master of the vessel or by the Superintendent Engineer.”

3. Regulation 13 of the Navigation (Examination of Engineers) Regulations is repealed, and the following regulation inserted in its stead:—

“13. (1) Where, for any sufficient reason, a testimonial by a Chief Engineer cannot be submitted, a testimonial (if obtainable) by the Superintendent Engineer of the company, or person owning the vessel, and any other documentary proof of service available, should accompany the application.

(2) The acceptance or rejection of testimonials submitted under this regulation shall be at the discretion of the Principal Examiner.”

4. Regulation 18 of the Navigation (Examination of Engineers) Regulations is amended by omitting sub-regulation (1) and inserting in its stead the following sub-regulations:—

“(1) Subject to the next succeeding sub-regulation, ordinary certificates of competency shall not entitle the holders to act as engineers in ships propelled by internal combustion engines, unless endorsed for that purpose, as provided for in regulation 31 of these Regulations.

“(1a) The holder of an ordinary certificate of competency may act as engineer in a ship propelled by internal combustion engines if he also holds a temporary permit issued by the Director of Navigation under regulation 18a of these Regulations, or by the Board of Trade of the United Kingdom, or by some other authority recognized by the Minister.”

5. (1) After regulation 18 of the Navigation (Examination of Engineers) Regulations, the following regulation is inserted:—

Temporary permit to act as engineer in motor ship.

“(18a) (l) The Director of Navigation may issue a temporary permit to the holder of an ordinary certificate of competency to act as engineer on a motor ship, subject to compliance with the following conditions:—

(i) An application for the permit shall be made by the owner of the ship concerned to a Deputy Director of Navigation at least two weeks before the permit is required.

(ii) The application shall state:—

(a) As regards the ship, the name, official number (if registered), or, if not registered, the builder’s number; and

(b)As regards the engineer, his name, the rank in which he is to serve, the grade and number of his certificate of competency, and a statement giving the general extent of his workshop and sea service on both steam and internal combustion engines, and, in particular, the nature and amountof his experience (whether in the works or at sea) of the type of internal combustion engines installed in the ship.

“(2) A permit issued under this regulation shall continue in force for a period of twelve months actual sea service.*If, at the end of that period, the engineer has not obtained a motor endorsement of his ordinary certificate of competency, the permit shall lapse:

Provided that the Director may, in special circumstances, extend the permit for any period he considers desirable.”

(2) This regulation shall be deemed to have come into operation on the 1st day of June, 1924.

6. Regulation 19 of the Navigation (Examination of Engineers) Regulations is repealed.

 

*Note.—This will enable an engineer to complete the nine months’ service in a motor ship necessary to qualify for examination for motor endorsement.

7. Regulation 24 of the Navigation (Examination of Engineers) Regulations is amended—

(a) by omitting from sub-regulation (1) the letter “O,” and inserting in its stead the letter “R” and

(b)by omitting from sub-regulation (1) the word “Superintendent”, and inserting in its stead the words “Deputy Director”.

8. Regulation 28 of the Navigation (Examination of Engineers) Regulations is amended—

(a)by inserting in sub-regulation (1), after the word “Act,” the words “or by any State authority”; and

(b)by omitting from sub-regulation (2) the words “these Regulations and inserting in their stead the words “the Act or by any State authority.”

9. Regulation 30 of the Navigation (Examination of Engineers) Regulations is amended by omitting sub-regulation (3).

10. Regulation 32 of the Navigation (Examination of Engineers) Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (2) the word “steamship”, and inserting in its stead the word “motorship”; and

(b) by omitting from paragraph (b)of sub-regulation (2) the word “motorship”, and inserting in its stead the word “steamship”.

11. Regulation 41 of the Navigation (Examination of Engineers) Regulations is amended by omitting from paragraph (g)the words “results to”, and inserting in their stead the words “effect on”.

12. (1) Regulation 47 of the Navigation (Examination of Engineers) Regulations is amended by adding at the end of sub-regulation (5) the following paragraph:—

“(d)A candidate holding a first class marine engine-driver’s certificate, endorsed in the steam engines division, may have his certificate endorsed to entitle him to take charge of the non-condensing engines, boilers and machinery of a steamship of not more than 65 nominal horse-power plying exclusively upon the River Murray and its tributaries.”

(2) This regulation shall be deemed to have come into operation on the 1st day of June, 1924.

13. (1) Regulation 52 of the Navigation (Examination of Engineers) Regulations is amended by adding at the end of sub-regulation (2) the following paragraph:—

“The holder of such certificate may take charge of a steamship fitted with non-condensing engines of not more than 65 nominal horse-power plying upon the River Murray and its tributaries, if the certificate is endorsed in that behalf.”

(2) This regulation shall be deemed to have come into operation on the 1st day of June, 1924.

14.Regulation 54 of the Navigation (Examination of Engineers) Regulations is amended by adding at the end of sub-regulation (6) the following words:—

“and does not apply to service at works where the repairs of engines, boilers, and the like is merely incidental to the running

 

of plant, however large, used for the production of power for other machinery.”*

15.Regulation 59 of the Navigation (Examination of Engineers) Regulations is repealed, and the following regulation inserted in its stead:—

Nominal horse-power and qualifying sea service.

“59. (1) The nominal horse-power, as given on the vessel’s Certificate of Registry may, in all cases, be accepted by the examiners, or it may be determined by the following formula:—

Where H = heating surface of main boilers, in square feet, measured down to the level of the fire-bars, but excluding the front tube plate.

D2 = square of diameter of low pressure cylinder, or sum of squares of diameters of cylinders in non-compound engines, measured in inches.

S = Length of stroke of engines in inches.

P = Pressure of main boilers in pounds per square inch.

“(2) Service in the limited coast trade shall be deemed to be equivalent to two-thirds of the same period of time served in the foreign or Australian trade, except where other allowances are specified.

“(3) In the case of applicants for first-class certificates, qualifying service is service on regular watch as senior engineer in charge of the entire watch on the main propelling machinery, but service in charge of a boiler-room only may be regarded as qualifying up to a maximum of twelve months. Service on regular watch as second in seniority in the engine-room of a vessel propelled by two or more sets of engines may also be accepted without restriction, but service in the engine-room as assistant engineer below this rank may only be accepted at half the actual time value Service to qualify shall be performed while in possession of a second-class certificate, except in the case for which provision is made in regulation 30 of these Regulations. Candidates who qualify by service as second in seniority in the engine-room or as assistant engineer below that rank will be subjected to a more searching examination than those who have performed the required amount of service while in charge of a full watch.

“(4) In the case of applicants for second class ordinary certificates, qualifying service is service on regular watch on main engines and boilers, not less than six months being spent on each of those two sections, if the service is not performed simultaneously on both.”

16. Appendix L to the Navigation (Examination of Engineers) Regulations is repealed.
