REGULATIONS UNDER THE NAVIGATION ACT 1912*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

AMENDMENTS OF THE NAVIGATION (EXAMINATION OF ENGINEERS) REGULATIONS 1926 

Parts

1. Regulation 2 of the Navigation (Examination of Engineers) Regulations 1926 is repealed.

Interpretation

2. Regulation 3 of the Navigation (Examination of Engineers) Regulations 1926 is amended—

(a) by inserting before the definition of “ Boilers and machinery ” the following definition;

“ ‘ authorized officer ’ means a person holding, or for the time being performing the duties of, an office in the Department of Transport that is specified for the purposes of this definition by the Minister by instrument in writing;”; and

(b) by omitting the definition of “ Regional Controller ”.

Temporary permit

3. Regulation 19 of the Navigation (Examination of Engineers) Regulations 1926 is amended—

(a) by omitting from paragraph (i) of sub-regulation (1) “ a Regional Controller ” and substituting “ an authorized officer ”; and

(b) by omitting from paragraph (iii) of sub-regulation (1) “ Regional Controller ” and substituting “ authorized officer ”.

Authority for issue of certificates

4. Regulation 23 of the Navigation (Examination of Engineers) Regulations 1926 is amended by omitting from sub-regulation (1) “ Regional Controller ” and substituting “ authorized officer ”.

Marine Engine-driver’s examination

5. Regulation 89 of the Navigation (Examination of Engineers) Regulations 1926 is amended by omitting from paragraph (b) of sub-regulation (7) “ a Regional Controller ” and substituting “ an authorized officer ”.

Tenth Schedule

6. The Tenth Schedule to the Navigation (Examination of Engineers) Regulations 1926 is amended by omitting from paragraph (2) “ a Regional Controller ” and substituting “ an authorized officer ”.

Savings

7. Nothing in these Regulations affects the validity or efficacy of an application, authority or endorsement or a notice or report made or given under the Navigation (Examination of Engineers) Regulations 1926
