Navigation (Distressed Seamen) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

Commencement

1. These Regulations shall come into operation on 26 January 1982.

Interpretation

2. Regulation 2 of the Navigation (Distressed Seamen) Regulations is amended by omitting "''Navigation Act 1912-1966" from the definition of "the Act" in sub-regulation (1) and substituting "''Navigation Act 1912".

Passage on ships other than Australian ships

3. Regulation 11 of the Navigation (Distressed Seamen) Regulations is amended by omitting sub-regulation (1) and substituting the following sub-regulation:

"(1) If it is not possible to arrange for a passage for a distressed seaman on a ship registered in Australia, a proper authority may, subject to these Regulations, arrange for a passage for the seaman on any other ship to which Part II of the Act applies or, if a passage cannot be arranged on such a ship, on any other ship.".

Recovery of expenses incurred by the Commonwealth

4. Regulation 18 of the Navigation (Distressed Seamen) Regulations is amended by omitting from paragraph (6) (b) "to a person not being a British subject".

The Schedule

5. The Schedule to the Navigation (Distressed Seamen) Regulations is amended—

(a) by omitting from Form 1 "Port of registry" and substituting "Home port";

(b) by omitting from Form 3 "Port of Registry" and substituting "Home port";

(c) by omitting from Form 3 "Port of registry" and substituting "Home port or Port of registry"; and

(d) by omitting from Form 4 "Port of Registry" and substituting "Home port".
