NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 1.
Citation
PART I-PRELIMINARY
1. These Regulations may be cited as the Navigation (Crew Accommodation) Regulations.*1*

NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 3.
InterpretationSub-reg. (1) amended by 1963 No. 97 r. 2; 1977 No. 31 rr. 2 and 48; 1977 No. 190 r. 1; 1979 No. 201 r. 1
3. (1) In these Regulations, unless the contrary intention appears-
"apprentice" includes a cadet;
"approved" means approved by the Minister or by the Committee;
"crew" means seamen and apprentices;
"crew accommodation" includes sleeping rooms, mess rooms, recreation rooms and facilities, store rooms, sanitary and lavatory accommodation, hospital accommodation, officer accommodation and catering accommodation provided for the use of seamen and apprentices, not being accommodation which is also used by, or provided for the use of, passengers;
"existing ship" means a ship the keel of which was laid or the construction of which otherwise commenced before regulation 4A came into operation;
"new ship" means a ship other than an existing ship;
"passenger ship" means a ship in respect of which-
(a) a passenger ship safety certificate issued in accordance with the provisions of the International Convention for the Safety of Life at Sea, 1960;
(b) a passenger ship short voyage safety certificate issued in accordance with the provisions of the International Convention for the Safety of Life at Sea, 1960; or
(c) a passenger certificate issued under sub-section 194 (4) of the Act,
is in force;
"petty officer" means a rating who-
(a) is serving in a supervisory position or a position of special responsibility; and
(b) is classed as a petty officer-
(i) by custom; or
(ii) with the approval of the Minister;
"rating" means a seaman other than an officer;
"re-registered" means re-registered on the occasion of a simultaneous change in both the place of registration and the ownership of the ship;
"River Murray" includes any tributary of that river and-
(a) any affluent or effluent creek;
(b) any ana-branch or extension; and
(c) any lake or lagoon,
connected with that river or tributary;
"surveyor" means a person appointed under section 190 of the Act;
"the Act" means the Navigation Act 1912;
"the catering department" means the cooks' and stewards' sections;
"the Committee" means the Crew Accommodation Committee appointed by the Minister under the Act.
(2) A reference in these Regulations to the tonnage of a ship is a reference to the gross registered tonnage of that ship.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 4.
Application of RegulationsAmended by 1977 No. 31 r. 3
4. Except as is otherwise expressly provided by these Regulations, these Regulations apply to and in relation to all ships, other than ships employed exclusively in trading or going between places on the River Murray, registered in Australia or engaged in the coasting trade.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 4A.
Requirements for existing shipsInserted by 1977 No. 31 r. 4
4A. The requirements to be complied with in respect of the accommodation in existing ships shall, subject to any contrary requirement of these Regulations expressed to apply to an existing ship, be the requirements of these Regulations as in force immediately before the commencement of this regulation.

Power to exempt new ships from requirement of RegulationsSub-reg. (1) amended by 1963 No. 97 r. 2; 1977 No. 31 r. 5
5. (1) Where the Minister is of opinion that, by reason of the size, type or intended service of a particular new ship, the requirements of these Regulations, or any of them, are unreasonable or impracticable in the case of that ship, the Minister may refer the matter to the Committee and the Committee may, not inconsistently with the provisions of International Labour Organization Conventions No. 92 and No. 133, exempt the ship from such of those requirements as the Committee considers unreasonable or impracticable in the case of that ship.

(2) Where-
(a) a ship has been exempted from all or any of the requirements of these Regulations under sub-regulation (1); and
(b) there is a change in the ownership of, or the nature of the service provided by, the ship,
the Committee may vary or revoke the exemption.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 6.
Exemptions from, and modifications of, requirements in case of existing shipsSub-reg.(1) amended by 1963 No. 97 r. 2; 1977 No. 31 r. 6
6. (1) The Minister may, not inconsistently with the provisions of International Labour Organization Conventions No. 92 and No. 133, if he is satisfied that the standard of the crew accommodation in an existing ship, considered as a whole, reasonably complies with the standard required by these Regulations, exempt that ship from the requirements of these Regulations, or any of them, and may at any time vary or revoke the exemption.

(2) The Committee shall, at the request of the Minister, determine, not inconsistently with the provisions of International Labour Organization Conventions No. 92 and No. 133, in a particular case the modifications (if any) with which these Regulations shall apply to an existing ship not exempted from the requirements of these Regulations in pursuance of sub-regulation (1), and those requirements shall, from and including such date as the Committee directs, apply to that ship with the modifications so determined.

(3) Where-
(a) a ship in relation to which the Committee has, in pursuance of sub-regulation (2), determined modifications of these Regulations-
(i) undergoes substantial structural alterations or major repairs, not being alterations or repairs in consequence of accident or emergency; or
(ii) is re-registered; and
(b) the Minister is of opinion that the modifications should be reviewed,
the Committee shall reconsider those modifications and determine, not inconsistently with the provisions of International Labour Organization Conventions No. 92 and No. 133, the modifications (if any) with which the requirements of these Regulations shall apply to that ship, and those requirements shall, from and including such date as the Committee directs, apply accordingly.

Meetings of Committee

7. (1) Meetings of the Committee shall be convened by the Chairman or by a member authorized by the Chairman to convene meetings, by notice in writing to each member specifying the time and place of the meeting.
(2) At a meeting of the Committee a quorum is constituted by one-half of the members of the Committee or, if there is not an even number of members, by a majority of members.
(3) Any question to be decided at a meeting of the Committee shall be decided by a majority of the votes of the members present.
(4) The Chairman shall preside at all meetings of the Committee at which he is present and has a casting, as well as a deliberative, vote.

(5) If the Chairman or the deputy of the Chairman is not present at a meeting the members present may elect one of their number to preside at the meeting and, subject to sub-regulation (6), the member so elected has and may exercise and perform, during the absence of the Chairman or the deputy of the Chairman, all the powers and functions of the Chairman.

(6) A member elected to preside at a meeting in pursuance of sub-regulation (5) does not have a casting vote.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 8.

8. (1) The Committee shall have a seal that shall be oval in shape with the words "Crew Accommodation Committee" surrounded by a band bearing the words "Commonwealth Navigation Act ", the whole being surmounted by a crown.
(2) The Chairman of the Committee or, in relation to orders made by the Committee during the absence of the Chairman, the deputy of the Chairman or the member elected to preside at the meeting of the Committee at which the orders were made, shall cause each order of the Committee to be sealed with the seal of the Committee.

9. An order purporting to have been signed by the Chairman of the Committee, the deputy of the Chairman or a member elected to preside at a meeting of the Committee and to have been sealed with the seal of the Committee shall be deemed to have been made by the Committee, unless the contrary is shown.

NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 11.
Plans to be submitted
PART III-CREW ACCOMMODATION
Division 1-Submission of Plans
Sub-reg. (1) amended by 1963 No. 97 r. 2; 1977 No. 31 r. 48
11. (1) A person to whose order a ship which-
(a) is intended to be registered in Australia; or
(b) is intended to engage in the coasting trade,
is being constructed shall, before the construction of the ship commences, cause to be submitted to the Minister for approval a plan of the ship, on a scale not smaller than 1 in 100, showing clearly the proposed arrangement of the crew accommodation in the ship and its proposed position in relation to other spaces in the ship.

(2) Every such person shall, before the construction of any part of the crew accommodation is commenced, cause to be submitted to the Minister for approval plans of the proposed crew accommodation, on a scale not smaller than 1 in 50, showing clearly-
(a) the purpose for which each space in the accommodation is to be appropriated and the proposed disposition of the furnishings, fittings and obstructions in the accommodation; and
(b) the proposed arrangements for supplying water to the crew accommodation and for heating, lighting and ventilating the accommodation.

(3) Subject to sub-regulation (4), the owner of a ship shall, before an alteration or reconstruction is carried out in the crew accommodation of the ship, cause to be submitted to the Minister for approval plans on the scales and showing the information referred to in sub-regulations (1) and (2), and relating to the crew accommodation as proposed to be altered or reconstructed.

(4) Where an alteration or reconstruction is carried out at a place outside Australia in consequence of an emergency or an accident to the ship the owner of the ship shall cause the plans referred to in sub-regulation (3) to be submitted to the Minister as soon as is practicable.
Penalty: $100.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 12.
Location of crew accommodation
Division 2-General Requirements in respect of Crew Accommodation

12. (1) Subject to sub-regulation (2), crew accommodation shall be situated amidships or aft, above the winter load line marked on the ship in pursuance of the provisions of the Navigations (Load Lines) Regulations.

(2) In the case of a passenger ship or a ship of less than 500 tons, the crew accommodation may, if the Committee approves, be situated in the fore part of the ship, but shall not in any case be situated forward of the collision bulkhead in a new ship of not less than 200 tons.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 13.
Protection against weather and sea, &c.Amended by 1977 No. 31 r. 9
13. The crew accommodation and the means of access to, and egress from, that accommodation shall be so arranged and constructed, and situated in such a position, as to ensure-
(a) the protection of the crew against injury to the greatest practicable extent;
(b) the protection of the crew accommodation against the weather and the sea;
(c) the insulation of the crew accommodation from heat and cold;
(d) the protection of the crew accommodation against moisture due to condensation;
(e) the exclusion from the crew accommodation of effluvia (including exhaust gases from any area containing sanitary or lavatory equipment) originating in other spaces in the ship;
(f) the exclusion from the crew accommodation, to the greatest practicable extent, of noise originating in other spaces in the ship; and
(g) if the ship trades regularly to mosquito-infested ports and the crew accommodation is not ventilated by a temperature-controlled mechanical ventilation system, the exclusion from the crew accommodation of mosquitoes by the fitting of screens to side scuttles, ventilators and doors.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 14.
Accessibility, &c., of accommodation
14. (1) The crew accommodation shall be accessible at all times from the open deck.
(2) An opening from an open deck into the crew accommodation shall be protected against the weather and the sea.
(3) Approved means of enabling the crew to enter and leave their accommodation shall be provided.

15. (1) The height of the crew accommodation, measured from the top of the floor beams to the top of the crown beams, shall be not less than 2.29 metres.

(2) The height at any point in the crew accommodation, being a point available for free movement, measured from the top surface of the deck or of any floor covering fixed to the deck to the bottom of any overhead fitting or fixture, shall be not less than 1.98 metres.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 16.
Construction of bulkheadsSub-reg. (1) amended by 1977 No. 31 r. 11
16. (1) Bulkheads enclosing or within any part of the crew accommodation shall be properly constructed of steel or other suitable fire-proof material.
(2) Any such bulkheads that are exposed to the weather shall be so constructed as to be watertight and gastight, and means of closure shall be provided for all openings in them so as to enable them to be made weathertight.
(3) Bulkheads separating a part of the crew accommodation (other than a recreation deck space) and a space used as-
(a) a permanent coal bunker;
(b) an oil fuel bunker;
(c) a cargo or machinery space;
(d) a lamp room or paint room;
(e) a store room not forming part of the crew accommodation (other than a dry provision store room);
(f) a chain locker; or
(g) a cofferdam,
shall be so constructed as to be gastight and, where necessary to protect the crew accommodation, watertight.
(4) A bulkhead that separates a part of the crew accommodation from a dry provision store room (whether or not that store room forms part of the crew accommodation) shall be gastight.

(5) Subject to sub-regulation (7), a bulkhead that separates a part of the crew accommodation from sanitary accommodation or from a laundry or drying room, galley or cold store room (whether or not that sanitary accommodation, laundry, drying room, galley or cold store room forms part of the crew accommodation) shall be gastight, and shall be watertight to such height as is necessary to prevent the passage of water into the adjoining space.

(6) Subject to sub-regulation (7), a bulkhead that separates sanitary accommodation from another part of the crew accommodation shall, except in a doorway, be watertight to a height of not less than 230 millimetres above the floor of the sanitary accommodation.

(7) The provisions of sub-regulations (5) and (6) do not apply to bulkheads that separate-
(a) sanitary accommodation from other sanitary accommodation;
(b) a laundry or drying room from another laundry or drying room;
(c) a galley from another galley or from a pantry;
(d) a cold store room from another cold store room;
(e) sanitary accommodation which may be directly entered from a sleeping room from that sleeping room, being a sleeping room appropriated for the exclusive use of one person, where the sanitary accommodation is appropriated for the exclusive use of the occupant of that sleeping room; or
(f) sanitary accommodation which may be directly entered from each of 2 sleeping rooms from those sleeping rooms, being sleeping rooms each of which is appropriated for the exclusive use of one person, where the sanitary accommodation is appropriated for use only by the occupants of those sleeping rooms.

(8) Subject to sub-regulation (8A), inside panelling in the crew accommodation shall be constructed of plywood or other suitable material with a surface that can easily be kept clean.

(8A) The provisions of sub-regulation (8) do not apply to the side of a bulkhead which forms the wall of any washing accommodation.
(9) Bulkheads or panelling shall not be constructed of tongued and grooved boarding or in a manner, or of material, likely to harbour vermin.
(10) In this regulation "sanitary accommodation" includes washing accommodation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 17.
Insulation for bulkheads, &c.
17. (1) The boundary bulkheads and the parts of the ship's sides and overhead decks which adjoin or form part of the crew accommodation shall-
(a) be insulated in a manner that will prevent overheating of the accommodation; and
(b) if likely to cause condensation of moisture, be covered with an approved protective covering.
(2) Bulkheads and decks separating the crew accommodation from other spaces in the ship in which heat or cold may be generated shall be insulated in a manner that will prevent the crew accommodation being so affected by the heat or cold or by condensation as to prejudice the health or comfort of the crew.

Lining of sleeping, mess and recreation roomsInserted by 1977 No. 31 r. 12
17A. Bulkheads enclosing rooms used as sleeping rooms, mess rooms or recreation rooms for the crew of a ship shall be lined on the side of those bulkheads with those rooms.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 18.
Direct opening between crew accommodation and certain other spaces forbidden
18. (1) There shall not be a direct opening between the crew accommodation (other than recreation deck spaces) and spaces used as-
(a) permanent coal bunkers;
(b) oil fuel bunkers;
(c) cargo or machinery spaces;
(d) lamp rooms or paint rooms;
(e) store rooms not forming part of the crew accommodation;
(f) chain lockers; or
(g) cofferdams.

(2) Except as provided by sub-regulations 55 (3), 57 (7) and 74 (3), there shall not be a direct opening between the crew accommodation (other than recreation deck spaces or passageways) and any sanitary accommodation, laundry or drying room (whether or not that sanitary accommodation, laundry or drying room forms part of the crew accommodation).

(3) Sub-regulation (2) does not prohibit a direct opening between spaces forming part of sanitary accommodation or between spaces appropriated for use as laundries or drying rooms.
(4) There shall not be a direct opening between a sleeping room and a galley.
(5) In this regulation "sanitary accommodation" includes washing accommodation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 19.

19. (1) Ships, other than ships the crew accommodation of which is ventilated by a temperature-controlled mechanical ventilation system, trading regularly to the tropics shall be provided with awnings or sun-decks which will cover-
(a) exposed decks and house-tops situated immediately above a part of the crew accommodation; and
(b) exposed sides of galleys situated on an open deck.
(2) The awnings shall be properly fitted with stanchions or other approved means of support.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 20.
Steam pipes not to pass through certain crew accommodation
20. (1) Steam supply and exhaust pipes to steam steering gear, winches and like equipment shall not pass through the crew accommodation except open deck alleyways.
(2) Where steam supply pipes pass through open deck alleyways forming part of the crew accommodation, they shall be-
(a) constructed of solid drawn steel or other approved material;
(b) of a scantling sufficient to withstand the maximum pressure from the ship's boiler system;
(c) connected by faced flanges properly jointed;
(d) suitably insulated and encased; and
(e) fitted with adequate drainage arrangements.
(3) Steam pipes and hot water pipes leading to radiators in or serving the crew accommodation shall be properly protected or encased.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 21.
Hawse pipes
21. Hawse pipes shall not be situated in the crew accommodation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 22.
Chain pipes and ventilation
22. Chain pipes and ventilators to cargo spaces shall, where they pass through the crew accommodation, be constructed of approved materials and shall be watertight and gastight.

Batteries not to be located in crew accommodation
23. Batteries shall not be located in the crew accommodation, and precautions shall be taken to ensure that fumes from batteries do not discharge into any part of the crew accommodation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 24.
Decks and sheathings
24. (1) In the case of a ship constructed of steel or other metal, decks which-
(a) form the crown of the crew accommodation; and
(b) are exposed to the weather,
shall be constructed of steel or other approved material.

(2) Except as provided by sub-regulation (3), where a deck referred to in sub-regulation (1) is constructed of steel or other metal, the upper side of the deck shall be sheathed with wood or other approved material.

(3) If the underside of a metal deck is insulated with an approved material which is so fitted as to avoid condensation, absorption of water, transmission of noise and harbouring of dirt and vermin, it shall not be necessary to sheathe the upper side of the deck.
(4) Wooden decks forming the crown of the crew accommodation and wooden sheathings on decks forming the crown of the crew accommodation shall be properly laid and caulked with approved materials.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 25.
Decks constituting floorsSub-reg. (1) amended by 1977 No. 31 r. 15
25. (1) Decks which form the floors in the crew accommodation shall be properly constructed and shall be covered with a material which-
(a) is impervious to water;
(aa) is capable of reducing the level of noise in the crew accommodation;
(b) is capable of being easily kept clean; and
(c) provides a good foothold.
(2) Where a composition or other like material is used to cover a metal deck, the composition or other material shall, unless linoleum or like material is superimposed on it, be furnished with a coving.

Drainage
26. (1) Efficient drainage shall be provided for every part of the crew accommodation situated on weather decks.
(2) The means of draining wash deck water or water shipped from the sea, whether drained directly overboard or through bulkheads to other spaces, shall be of an approved size and type.
(3) There shall be no drainage from any source into wash places or sanitary accommodation forming part of the crew accommodation, which shall each be drained separately and independently of other spaces.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 27.
Surface finishing
27. (1) The interior sides and ceilings of the crew accommodation shall be covered with enamel, paint or other suitable material.
(2) The enamel, paint or other materials shall be of good quality and white or light in colour.
(3) Lime wash or paint containing nitro-cellulose shall not be applied in the crew accommodation.
(4) The wooden parts of the furniture and fittings in the crew accommodation shall be finished externally with paint or varnish or by other suitable means.
(5) All paint, varnish or other finishes in the crew accommodation shall be capable of being easily kept clean and shall be maintained in good condition.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 28.

28. (1) Except in the case of ships engaged exclusively in the tropics, sleeping rooms, mess rooms, recreation rooms, offices, wash places and hospital accommodation forming part of the crew accommodation shall be provided with a heating system which shall-
(a) be permanently installed; and
(b) be capable of ensuring that, when the ventilation system provided for those rooms and that accommodation in accordance with these Regulations is working so as to furnish to each of those rooms or to that accommodation not less than 0.42 cubic metre of fresh air per minute for each person whom that room or that accommodation is designed to accommodate at the one time and when the temperature in the open air is minus one degree Celsius, the temperature in those rooms and that accommodation can be maintained at 16 degrees Celsius.
(2) The heating system may be operated by steam, hot water or electricity or may be a system supplying warm air.
(3) The heating equipment shall be so constructed, installed and, if necessary, shielded as to avoid the risk of fire and not to constitute a source of danger or discomfort to the crew.

(4) Subject to sub-regulation (5), the heating system shall be in operation at all times when any members of the crew are living or working on board the ship and conditions require its use.
(5) The heating system shall not be required to be in operation while the ship is in port if efficient temporary means of heating are provided for such parts of the crew accommodation as are in use.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 29.
Lighting
29. (1) Subject to this regulation, every part of the crew accommodation other than drying rooms, lockers and store rooms shall be properly lighted by natural light.

(2) The natural lighting of a sleeping room, mess room, recreation room, office or hospital accommodation forming part of the crew accommodation shall not be deemed to be proper for the purposes of sub-regulation (1) unless it is sufficient to enable an ordinary newspaper to be read by a person of normal vision at any point in that part of the accommodation, being a point available for free movement, during day time and in clear weather.

(3) Where the Minister, or a person authorized by the Minister for the purposes of this sub-regulation, is satisfied that compliance with the requirements of sub-regulations (1) and (2) is unreasonable or impracticable-
(a) in relation to sanitary accommodation, washing accommodation, galleys or passageways in a ship; or
(b) in the case of a passenger ship,
an approved system of artificial lighting shall be provided in that accommodation or that ship, as the case requires, and shall be available at all times.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 30.
Electric lighting
30. (1) An efficient electrical system capable of providing adequate lighting in every part of the crew accommodation shall be provided.

(2) The electric lights shall be so arranged as to give the maximum benefit to the crew.

(2A) An electric light shall be fitted at the head of each berth, being an electric light-
(a) capable of being switched on and off from the berth;
(b) the direction of the beam of which shall be capable of being adjusted without the use of tools; and
(c) capable of emitting sufficient light to enable a person of normal vision to read in the berth.

(2B) Where a desk is provided in the crew accommodation, that desk shall be fitted with an electric light enabling a person of normal vision to read while seated at the desk.

(3) A lamp capable of emitting at least 200 lumens shall be fitted in each such reading light in a sleeping room and a lamp capable of emitting at least 400 lumens shall be fitted in each such reading light in hospital accommodation.

(4) The electric lighting of a space shall be deemed to provide adequate lighting for the purposes of these Regulations if the lighting complies with the requirements of Australian Standards 1150-1972 as in force at the commencement of this sub-regulation.

(5) An electric light fitted at the head of a berth in accordance with sub-regulation (2A) shall, for the purposes of these Regulations, be taken into account for the purposes of determining the illumination of a space comprising sleeping accommodation intended to accommodate one person.

(5A) An electric light fitted to a desk in accordance with sub-regulation (2B) shall be taken into account for the purposes of determining the illumination of a space for the purposes of these Regulations.
(6) An efficient alternative system of lighting or source of electric power shall be kept available at all times for lighting the crew accommodation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 31.

31. (1) This regulation applies to-
(a) new ships;
(b) existing ships of not less than 3000 tons; and
(c) existing ships of not less than 1000 tons, being ships trading regularly in or to the tropics.

(2) Subject to sub-regulation (2A), the enclosed parts of the crew accommodation of a ship to which this regulation applies shall be ventilated-
(a) in the case of a new ship-by a temperature-controlled mechanical ventilation system; or
(b) in the case of an existing ship-by a mechanical ventilation system,
capable of maintaining the air in those parts in a state of purity adequate for the health and comfort of the crew.

(2A) Each of the following enclosed parts of the crew accommodation of a ship to which this regulation applies shall be ventilated by a temperature-controlled mechanical ventilation system or a mechanical ventilation system:
(a) galleys;
(b) laundries;

(3) The mechanical ventilation system shall be so constructed that-
(a) the velocity of air at each exhaust opening cannot exceed 305 metres per minute when the system is in operation;

(d) the trunking forming part of the system is provided with non-return flaps where necessary for the exclusion of effluvia and the preservation of the health of the crew.
(4) The ventilation system may, if approved for the purpose, also provide the means of heating the crew accommodation.
(5) If the circulation of heated air by the ventilation system is the sole means provided for heating the crew accommodation, the system shall be sub-divided into sections which can be separately controlled to the extent necessary to enable a comfortable temperature to be maintained in all parts of the crew accommodation.
(6) The mechanical ventilation system shall be such as to maintain the following air changes per hour under all conditions of weather and climate to which the ship is likely to be subjected during the voyages on which she is intended to be engaged:

NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 32.
Natural ventilation system
32. (1) Every enclosed space forming part of the crew accommodation of a ship, being a space not ventilated by a mechanical ventilation system, shall be provided with a natural system of inlet and exhaust ventilation.

(2) The sectional area of natural inlet and exhaust ventilators shall be at least 3870 square millimetres for each person for whose use at any one time the space served by the ventilators is appropriated, and shall not be less than 12260 square millimetres in all at any one place.

(3) The effective area of natural air inlet ventilators serving each space shall be capable of being adjusted from fully open to a minimum of 1935 square millimetres for each person likely to use the space at any one time.
(4) Natural air inlet ventilators shall be so placed that, as far as practicable, they are not screened from the wind in any direction and shall not be placed directly over a doorway, stairway or exhaust opening.
(5) Ventilation openings shall not be placed over or close to a berth unless it is impracticable to avoid so placing them, and where an opening is so placed, a duct shall be placed beneath it to conduct the air away from the berth.
(6) Ventilators, other than those fitted on a mechanical ventilation system, shall be of a cowl or other approved type.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 33.

33. An electric fan shall be fitted in each sleeping room, mess room, recreation room, office, galley and pantry forming part of the crew accommodation of an existing ship not required by regulation 31 to be fitted with a temperature-controlled or other mechanical ventilation system, or which has been exempted from the requirements of that regulation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 34.
Sleeping accommodation
34. (1) A separate sleeping room shall be provided for the master.

(2) Each of the following classes of persons shall be provided with sleeping rooms separate from those provided for the other classes:
(a) officers in their respective departments;
(b) petty officers in their respective departments;
(c) apprentices;
(d) ratings of the deck department, other than petty officers;
(e) ratings of the engine room department, other than petty officers;
(f) ratings of the catering department, other than petty officers.
(3) Wherever practicable-
(a) sleeping rooms provided for cooks shall be separate from those provided for stewards;
(b) watchkeepers on separate watches shall be berthed in separate rooms; and
(c) watchkeepers shall not be berthed in the same room as day men.
(4) Deck boys shall not be berthed in the same room as adult ratings.

Officers and petty officers to have individual sleeping rooms
35. Each officer and each petty officer shall be provided with a separate sleeping room.

may, with the approval of the Committee, be accommodated in a sleeping room.
(5) The provisions of this regulation apply to an existing ship to such extent as, in the opinion of the Committee, is reasonable and practicable having regard to the age of the ship and the purpose for which the ship is used or is intended to be used.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 37.

37. (1) Subject to sub-regulation (2), the minimum floor area provided for each person in a sleeping room forming part of the crew accommodation shall be-
(a) in the case of a ship of less than 400 tons-4.20 square metres;
(b) in the case of a ship of not less than 400 tons but less than 800 tons-5.11 square metres; and
(c) in the case of a ship of not less than 800 tons-6.05 square metres.

(2) Where 2 deck ratings, 2 engine room ratings or 2 cooks share a sleeping room, the minimum floor area of that room shall be 9.05 square metres.

(2D) Where a separate sitting room or day room is not appropriated for the exclusive use of an officer, the minimum floor area of the sleeping room of that officer shall be 7.55 square metres.
(3) For the purposes of this regulation-
(a) floor space occupied by berths, lockers, seats and chests of drawers shall be included in the measurement of floor area; and
(b) small or irregularly shaped floor spaces which cannot be used for installing furniture and which do not contribute to the space available for free movement shall be excluded from that measurement.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 38.
Berths
38. (1) Each sleeping room in the crew accommodation shall be fitted with a separate berth for each person accommodated in the room.
(2) The framework of each berth shall be constructed of metal or other material which is hard and smooth and unlikely to become corroded and if a berth is constructed with tubular frames, the frames shall be completely sealed and without perforations.

(3) There shall be unobstructed access to at least one side of each berth and, if the adjacent sides of 2 berths in the same room are parallel to each other or when projected make an angle of less than 90 degrees with each other, the distance between those sides at any point shall not be less than 915 millimetres.
(4) Where berths abut upon each other they shall be separated by screens made of wood or other suitable material.

(5) A berth shall not be placed-
(a) within 100 millimetres of a ventilation trunk which may be used for circulating hot air; or
(b) within 65 millimetres of a bulkhead or ship's side unless the bed is so supported and the room so constructed as to avoid harbouring dirt or vermin in or near the berth and to enable the bedding to be kept dry and clean.

(6) Berths shall not be arranged in tiers of more than 2, and berths-
(a) in new ships; or
(b) which are placed along a ship's side,
shall be in single tier.

(7) The bottom of a berth shall not be less than 460 millimetres from the floor of the room.

(8) In a double tier where the height of the sleeping room is not less than 2.29 metres, the bottom of the lower berth shall be not less than 840 millimetres below the bottom of the upper berth.

(9) The bottom of the upper berth in a double tier shall not be less than 760 millimetres below the lower side of the crown beams or other obstructions.

(10) The minimum dimensions of berths shall be 1.98 metres by 800 millimetres, the measurements being taken inside the lee-boards or lee-rails, if any, and at right angles to each other.
(11) Each berth shall be fitted with-
(a) a spring bottom or other bottom suitable for use with a mattress; and
(b) a mattress made of approved material which will resist damp and is unlikely to harbour vermin,
and where berths are arranged in a double tier a bottom of wood, canvas or other dust-proof material shall be fitted to the underside of the upper berth.
(12) Lee-boards fitted to berths shall be constructed of hardwood or other approved material and shall be so made as not to be likely to harbour vermin.

(13) Curtains shall be fitted to berths if there are 2 or more berths in a room.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 39.

39. (1) A sleeping room for an officer shall be provided with-
(a) a reasonable drawer accommodation;
(b) a writing desk with drawers;
(c) a chair with arm rests;
(d) a wardrobe not less than 1.68 metres in height and 0.30 square metre in internal sectional area;
(e) a settee not less than 1.83 metres in length;
(f) a carpet runner of reasonable size;
(g) a wash-basin of vitreous china or other equally hygienic and durable material, fitted with an efficient and hygienic discharge overside;
(h) a splash plate or other means of protection for the wall above the wash-basin, if any;
(i) a tumbler and drinking water bottle and a rack suitable for holding them;
(j) a cabinet for toilet requisites;
(k) a mirror suitable for toilet purposes;
(l) at least 2 coat-hooks in addition to coat-hooks fitted in the wardrobe; and
(m) curtains, blinds or jalousies fitted to each side scuttle.

(2) A book case shall be provided in a sleeping room which accommodates the master, first mate, chief engineer or second engineer and, in the case of a passenger ship, the first radio officer, and a book case or book rack shall be provided in a sleeping room which accommodates any other officer.

(3) Where an officer is provided with a day-room, any of the furniture required by the preceding provisions of this regulation to be provided in a sleeping room may be placed in the day-room, and where an officer is provided with direct access from his sleeping room to a wash-room, the wash-basin and other toilet fittings specified in sub-regulation (1) may be placed in the wash-room.

40. (1) A sleeping room for an apprentice shall, so far as is, in the opinion of the Minister or a person authorized by the Minister for the purposes of this sub-regulation, reasonable and practicable, be provided with the furniture and fittings specified in regulation 39.

(2) If more than one apprentice is accommodated in a sleeping room, one additional wardrobe, 2 additional coat-hooks and one additional tumbler shall be provided for each apprentice in excess of one accommodated in the room.

41. (1) A sleeping room for ratings not being petty officers shall be provided with-
(a) 2 drawers, each having a capacity of not less than 0.06 cubic metre, for each person accommodated in the room;
(b) a table or desk being either of the fixed or drop-leaf type or fitted as a sliding top to a chest of drawers;
(c) comfortable seats sufficient to accommodate at one time all the persons accommodated in the room;
(d) one clothes locker or suitable design for each person accommodated in the room;
(e) unless drinking water is available at a convenient distance from the room, a drinking water bottle for each 2 persons accommodated in the room and a tumbler for each such person, and a rack suitable for holding the bottle and tumblers;
(f) a mirror suitable for toilet purposes;
(g) a cabinet suitable for containing toilet requisites;
(h) a book rack;
(i) at least 2 coat-hooks, in addition to coat-hooks fitted in the clothes locker, for each person accommodated in the room;
(j) if iron or concrete flooring beside berths is not covered with approved material, a carpet runner or other suitable material at one side of each berth or tier of berths, as the case may be; and
(k) curtains, blinds or jalousies fitted to each side scuttle.

(2) A clothes locker referred to in paragraph (1) (d) shall-
(a) measure not less than 1.68 metres in height and 0.20 square metre in internal section area;
(b) be fitted with a shelf not less than 230 millimetres below its top; and
(c) contain fittings on which clothes may be hung.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 42.
Furniture, &c., in petty officers' sleeping roomsSub-reg. (1) amended by 1977 No. 31 r. 48
42. (1) Subject to this regulation, sleeping rooms for petty officers shall be provided with the furniture and fittings specified in regulation 41, except that-
(a) a wardrobe shall be provided instead of a clothes locker;
(b) a drinking water bottle and tumbler and a rack suitable for holding them shall be provided in all cases; and
(c) the furniture and fittings shall be of a generally higher standard than those required to be provided by regulation 41.
(2) In addition, each such room shall be provided with a wash-basin of vitreous china or other equally hygienic and durable material, fitted with an efficient and hygienic discharge overside.
(3) Where a petty officer is provided with direct access from his sleeping room to a wash-room, the wash-basin and other toilet fittings required to be provided for his use may be located in the wash-room.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 43.
Furniture, &c., to be of certain materials
43. (1) Lockers, wardrobes, tables, desks, the un-upholstered parts of chairs and settees and like furnishings required by these Regulations to be provided in sleeping rooms shall be constructed of polished or painted hardwood, rustproof metal or other smooth and impervious material not likely to crack, warp or become corroded.
(2) All furniture provided in sleeping rooms shall be so made as to be not likely to harbour vermin.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 43A.

43A. Wardrobes and clothes lockers provided in sleeping accommodation and clothes lockers provided in the hospital accommodation of a ship shall be adequately ventilated.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 44.
Locks to be provided in sleeping rooms
44. (1) Where more than one person is accommodated in a sleeping room forming part of the crew accommodation, drawers, lockers and wardrobes shall be fitted with secure locks or hasps for padlocks.
(2) Where only one person is accommodated in such a sleeping room, at least one drawer, locker or wardrobe shall be fitted with such a lock or hasp.

(3) Doors to sleeping rooms shall be fitted with individual locks capable of adequately securing those doors.

Mess rooms
45. (1) Mess rooms shall be provided for the crew in all ships and shall be located as close as possible to the galley and apart from sleeping accommodation.

(2) In the case of a ship of less than 1000 tons, mess rooms provided for the master, officers and apprentices shall be separate from those provided for ratings.

(3) Subject to sub-regulation (4), in the case of a ship of not less than 1000 tons, separate mess rooms shall be provided for each of the following classes of persons:
(a) the master, officers and apprentices;
(b) ratings of the deck department;

(4) A common mess room may, with the permission of the Minister, be provided for ratings of the deck and engine room departments in the case of a ship of not less than 1000 tons.

(5) The Minister shall not give his permission to the provision of such a common mess room for those ratings unless he is satisfied that the arrangement is preferred by the organization or organizations registered under the Conciliation and Arbitration Act 1904 which, in his opinion, is or are representative of those ratings.
(6) Where a separate mess room is not provided for ratings of the catering department, messing accommodation shall be provided for them in mess rooms provided for other persons.

(7) The floor area of a mess room shall be not less than one square metre per person of the planned seating capacity.

46. (1) A mess room forming part of the crew accommodation shall be provided with sufficient tables to allow a space of not less than 610 millimetres, measured along the edge of the table, for each person likely to use the room at any one time.

(2) The location and arrangement of the tables shall be such as to provide a clear means of access to any table, and where seating accommodation is provided between a table and a bulkhead or the ship's side, the clearance between the table and the bulkhead or ship's side shall not be less than 635 millimetres.

(3) The number of persons to be accommodated along one side of a table shall not exceed 3.

(4) Tables shall be not less than 760 millimetres wide if seats are provided along both sides of the table, and not less than 380 millimetres wide if seats are provided only on one side of the table.
(5) Single chairs shall be provided in each mess room for each person using the room at any one time, and each chair shall be fitted with arm rests unless chairs so fitted are provided in a separate recreation room for the persons using the mess room.
(6) If seating accommodation adjacent to a bulkhead or ship's side is provided, settees may be provided instead of chairs.

(7) Where settees are provided they shall be-
(a) not less than 380 millimetres wide; and
(b) provided with upholstered or padded seats and comfortably shaped backs.
(8) In a mess room provided for the exclusive use of petty officers-
(a) a sideboard shall be provided; and
(b) the seats and backs of seating accommodation fitted against a bulkhead or the ship's side shall be upholstered or padded.

47. (1) Suitable storage for mess utensils shall be provided in or conveniently near to the mess room in which they are used.
(2) The storage provided shall be either-
(a) a general storage locker capable of holding sufficient mess utensils for the persons for whom the mess room is provided; or
(b) an individual storage locker, measuring not less than 380 millimetres by 380 millimetres by 305 millimetres and fitted with a lock or a hasp for a padlock, for each of those persons.
(3) Storage lockers shall be made of stove enamelled steel or hard-faced plywood or other approved material and shall be raised to a sufficient height above the floor to facilitate cleaning.

48A. (1) A water cooler or other water cooling facilities shall be provided on each deck on which sleeping accommodation or a recreation room is situated.
(2) A water cooler or other water cooling facilities provided in accordance with sub-regulation (1) shall be situated in a passage way or other place to which all members of the crew have access.

49. (1) Subject to the provisions of regulation 47, lockers, tables, dressers, sideboards and the un-upholstered parts of chairs and settees required by these Regulations to be provided in mess rooms shall be constructed of polished or painted hardwood, rustproof metal or other smooth and impervious material not likely to crack, warp or become corroded.
(2) All furniture provided in a mess room shall be so made as to resist damp and to be not likely to harbour vermin.

50. (1) Subject to sub-regulation (3), a smoking room fitted with small tables, comfortable chairs and a bookcase shall be provided for the use of the master, officers and apprentices in ships of not less than 2500 tons.

(2) In the case of ships to which sub-regulation (1) does not apply, the mess room provided for the master, officers and apprentices shall be available and furnished for use as a smoking room, unless a separate smoking room is provided for their use.
(3) Where apprentices are provided with a separate room for use as a study, being a room also separate from their sleeping rooms, it is not necessary to provide for them the smoking room accommodation in accordance with the preceding provisions of this regulation.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 51.

51. (1) In all ships, recreation accommodation shall be provided for ratings in a mess room or elsewhere, and shall be conveniently situated and appropriately furnished.
(2) In all ships space shall be provided on an open deck for the use of the crew for the purposes of recreation and shall be adequate in area, insofar as the size of the ship allows, having regard to the number of persons in the crew.

52. (1) In any ship of not less than 2500 tons, separate office accommodation shall be provided for the use of the master of the ship.
(2) In any ship of not less than 2500 tons, a room equipped as office accommodation shall be provided for the use of each of the following groups of officers of the ship:
(a) deck officers;
(b) engine room officers.
(3) Office accommodation provided for the use of the master of a ship in accordance with sub-regulation (1) or a group of officers of the ship in accordance with sub-regulation (2) shall not be combined with a day-room provided for the master, that group of officers or an officer included in that group of officers.

Sanitary accommodation
53. (1) Sanitary accommodation shall be provided for the master and crew on all ships.

(1A) In any ship, the sanitary accommodation provided for female members of the crew shall be separate from that provided for male members of the crew.

(3) In the case of a new ship, one water closet shall be provided for every 5 persons using the sanitary accommodation for whom sanitary accommodation of a kind described in paragraph 16 (7) (e) or (f) has not been provided, and where the total number of those persons is not divisible by 5 without remainder, and the remainder exceeds 2, an additional water closet shall be provided.

(4) In the case of an existing ship, one water closet shall be provided for every 8 persons using the sanitary accommodation for whom separate sanitary accommodation has not been provided, and where the total number of those persons is not divisible by 8 without remainder, and the remainder exceeds 3, an additional water closet shall be provided.

(6) In addition to any sanitary accommodation required to be provided by the preceding sub-regulations of this regulation in a ship, a water closet and a wash-basin shall, in any ship of not less than 1600 tons, be provided adjacent to, and shall be easily reached from, each of the following areas of the ship:
(a) the navigating bridge;
(b) the machinery space or the engine room control centre.

(7) The sanitary accommodation required to be provided adjacent to the navigating bridge of a ship in accordance with sub-regulation (6) shall be contained in a separate compartment.

(8) In addition to any sanitary accommodation required to be provided by the preceding sub-regulations of this regulation in a ship, a water closet shall be provided in each of the following:
(a) a bathroom provided for the exclusive use of an officer;

(c) a bathroom provided for the use of ratings.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 54.
Entrance to sanitary accommodation
54. (1) If the means of entry into sanitary accommodation forming part of the crew accommodation is from a passageway leading to other parts of the crew accommodation, a lobby shall be provided at the entrance of the sanitary accommodation or, where a lobby is not practicable, a self-closing door shall be provided.
(2) Doors between the sanitary accommodation and a passageway shall be close fitting and without apertures.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 55.
Situation, &c., of water closets
55. (1) Water closets required by these Regulations to be provided shall be situated close to the sleeping rooms of the persons for whom they are provided.
(2) Where the entrance to a water closet is from an open deck and is not otherwise obscured so as to ensure privacy, the entrance shall, if practicable, be properly screened.

(3) A water closet in a compartment adjacent to and serving a sleeping room or between 2 sleeping rooms accommodating not more than 4 persons may, if the water closet is appropriated solely for the use of those persons, be entered directly from that room or those rooms, but if provided for the use of more than 2 persons it shall be so screened as to ensure privacy.
(4) Where more than one water closet is fitted in a compartment, they shall-
(a) be separated by partitions which may be open at the top and bottom; and
(b) be provided with separate doors.

56. (1) A water closet shall be provided with-
(a) a water closet pedestal of single type with-
(i) a pan of white vitreous china or other suitable material;
(ii) a seat of polished hardwood or other suitable material, with an opening of 100 millimetres at the front;
(iii) a trap with a metal inspection plate; and
(iv) an efficient ventilator connected to the outlet;
(b) an adequate flush of water, which shall be always available and supplied through self-closing non-concussive supply valves with a portable seating in metal which is not likely to become corroded;
(c) a soil pipe not less than 100 millimetres in diameter, so constructed as to facilitate cleaning and minimize the risk of obstruction;
(d) a device for holding toilet paper; and
(e) a handrail or grip.
(2) Except in a ship fitted with sewage tanks, each soil pipe shall have a direct overboard outfall fitted with a storm-valve, unless it is connected to the main sewage outfall by an efficient and hygienic system.

Washing accommodation
57. (1) Washing accommodation shall be provided for the master and crew on all ships.

(2) In the case of a ship of not less than 800 tons but less than 1500 tons-
(a) separate washing accommodation shall be provided for the master and for the chief engineer; and
(b) the washing accommodation provided for officers and apprentices shall be separate from that provided for ratings.

(3) In the case of a ship of not less than 1500 tons-
(a) separate washing accommodation shall be provided for the master and for the chief engineer; and
(b) the washing accommodation provided for each of the following classes of persons shall be separate from that provided for the other classes:
(i) officers and apprentices of the deck department;
(ii) officers of the engine room department;
(iii) ratings of the deck department;
(iv) ratings of the engine room department;
(v) ratings of the catering department.

(4) Subject to sub-regulation (5), washing accommodation shall be situated close to the sleeping accommodation of the persons for whose use it is provided.
(5) Part of the washing accommodation for ratings of the engine room department shall be adjacent to the engine room and stokehold.

(6) Subject to sub-regulation (7), access to washing accommodation shall not be directly obtained from a mess room or sleeping room and shall wherever reasonable and practicable in the circumstances be obtained from a passageway.

(7) Access to washing accommodation may be obtained directly from not more than 2 sleeping rooms accommodating not more than 4 persons in all, if the washing accommodation is appropriated for use solely by the persons accommodated in those sleeping rooms.

(8) In a ship of not less than 5000 tons but less than 15 000 tons, a bathroom shall be provided for the exclusive use of each of not less than 5 of the officers of the ship.

(a) capable of being directly entered from the sleeping room or each of the sleeping rooms appropriated for the use of that rating or those ratings; or

(15) In any ship-
(a) each bathroom provided for the exclusive use of an officer; and
(b) each bathroom provided for the use of ratings,
shall, subject to sub-regulation (17), be provided with a shower and a wash-basin.

(17) Where a bathroom is provided for the exclusive use of the occupants of a sleeping room or 2 sleeping rooms, a wash-basin shall be provided in-
(a) the sleeping room or each of the sleeping rooms, as the case requires; or

but need not be provided in each of those rooms.

58. (1) Subject to sub-regulation (5), in a ship of not less than 3500 tons, each of the following classes of crew members shall be provided with change rooms separate from any change rooms provided for another of the following classes of crew members or for crew members not included in one of the following classes of crew members:
(a) engine room officers;
(b) engine room ratings;
(c) deck department ratings.
(2) Each change room provided in a ship in accordance with sub-regulation (1) shall be provided with-
(a) a full-length locker for each officer or rating using the change room;
(b) sufficient hooks for the use of the officers or ratings using the change room, suitably positioned to enable their use for hanging clothing; and
(c) wooden forms or seats.
(3) Each locker provided in accordance with sub-regulation (2) shall contain 3 coat hangers and shall be fitted with-
(a) a hook suitably positioned to enable its use for hanging clothing;
(b) a shelf or shelves suitable for holding headwear, boots and shoes; and
(c) a soap container attached to the inside of the door.
(4) Subject to sub-regulation (5), in a ship of not less than 1600 tons, other than a ship in which each of the members of the following classes of crew members is provided with sanitary accommodation of a kind described in paragraph 16 (7) (e) or (f), each of the following classes of crew members shall be provided with a change room separate from change rooms provided for other classes:
(a) officers of the engine room department;
(b) ratings of the engine room department.
(5) Where a change room is provided for a class of crew members in accordance with sub-regulation (1) a change room shall not be provided for that class of persons in accordance with sub-regulation (4).
(6) A change room provided for engine room officers or ratings in accordance with this regulation shall be located outside, but shall be easily reached from, the engine room.
(7) A change room provided for a class of crew members in accordance with sub-regulation (1) or (4) shall contain a shower and a wash-basin.

59. (1) A wash place shall provide not less than 1.10 square metres of floor space for each shower, wash-basin or wash trough.

(2) The space occupied by showers, wash-basins, wash troughs, seats and lockers shall be included in the measurement of floor space for the purposes of sub-regulation (1).

60. (1) Screening shall be provided to ensure privacy for a shower which is in the same room as a wash-basin or wash trough or another shower unless the room is appropriated for the sole use of one person.
(2) Each shower space shall be provided with a soap holder, a hand rail, a kerb and individual drainage either over the ship's side or to a common outlet.
(3) A mat or grating of non-slipping, hygienic material shall be provided for use with each shower.

61. (1) Each wash-basin, wash trough and shower shall be fitted with an efficient and hygienic discharge system.
(2) Waste pipes shall be fitted in a manner which will minimize the risk of obstruction and facilitate cleaning.

(3) The scupper in a wash place shall be located in the lowest part of the space and shall be not less than 50 millimetres in diameter.

62. (1) Each member of the crew of a ship shall be supplied with not less than 9.1 litres of fresh water each day for washing purposes.

(2) Hot and cold fresh water shall be laid on to all wash-basins, wash troughs and showers fitted in compliance with these Regulations.
(3) A cold salt water supply shall be provided for each wash place for washing down purposes, unless other suitable means for washing down are available.

Flooring to be impervious
63. Floors of wash places, bath rooms, shower recesses, laundries and other compartments where water is used shall-
(a) be covered with rubber-based or other approved impervious material; and
(b) be fitted with a coving around the perimeter of the compartment.

Pipes to be lagged
64. (1) Hot water pipes shall be lagged where necessary for conservation of heat or to ensure the safety of the crew.

(2) The Minister may require that the cold water pipes, or any of them, passing through any part of the crew accommodation shall be lagged to prevent sweating, and if he has so required, the pipes shall be lagged accordingly.

65. (1) Wash troughs and washing machines for washing clothes shall be provided for the crew in accordance with these Regulations.

(4) Subject to sub-regulation (5), one wash trough and one washing machine shall be provided in a laundry or wash place for each 10 members of the crew, other than members of the crew provided with separate laundry facilities, and, where the number of members of the crew in respect of whom wash troughs and washing machines are to be provided in accordance with this regulation is not divisible by 10 without remainder, and the remainder exceeds 4, an additional wash trough and washing machine shall be provided.

(5) Wash troughs and washing machines need not be provided in accordance with this regulation where a common laundry under the control of a laundryman is provided.

66. Wash troughs shall-
(a) be made of, or coated with, hygienic and durable material having a smooth and impervious surface not likely to crack, flake or become corroded;

(d) measure not less than 610 millimetres in length, 460 millimetres in width and 380 millimetres in depth.

68. (1) Rooms for drying the crew's clothes shall be separate from sleeping rooms, mess rooms, recreation rooms, offices, store rooms, galleys, pantries and hospital accommodation.
(2) Drying rooms provided for officers shall be separate from those provided for ratings, unless the provision of separate drying rooms is impracticable or unreasonable in the circumstances.
(3) A drying room shall be fitted with sufficient lines or other suitable fittings with sufficient space having regard to the number of persons in the crew and the duration of the voyages on which the ship is intended to be engaged.
(4) The heating of a drying room shall be capable of being controlled independently of the heating of any other space in the ship and the exhaust ventilation of such a room shall, unless it is provided by a trunked mechanical ventilation system, be independent of the ventilation of all other spaces in the ship.

69. (1) Lockers or compartments, equipped with approved means of ventilation, shall be provided for hanging oilskins and working clothes used by the crew.

70. (1) Except in the case of a ship that-
(a) is engaged solely in the coasting trade and is ordinarily on a route where it can, at any time, reach a port within 48 hours; or
(b) is a ship in which hospital accommodation is provided in accordance with the Navigation (Hospital Accommodation) Regulations,
hospital accommodation shall be provided for the crew in accordance with these Regulations.

(2) Where the crew does not exceed 75 persons, the hospital accommodation shall contain not less than 2 berths and where the crew exceeds 75 persons, it shall contain not less than 3 berths.
(3) Hospital accommodation required by these Regulations to be provided shall not at any time be used for a purpose other than for treatment of sick persons.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 71.
Location of hospital accommodation
71. (1) Hospital accommodation shall be situated-
(a) in a position which will ensure the greatest possible quiet and comfort for the patients; and
(b) so that it is readily accessible and that the patients may receive proper medical attention in all weathers.
(2) In the case of a ship which does not carry a qualified medical practitioner, the hospital accommodation shall be situated within easy access of the sleeping accommodation provided for the person in charge of the patients.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 72.
Arrangement of berths, &c., in hospital accommodation
72. (1) Berths in the hospital accommodation shall be arranged in single tier and at least one berth shall be accessible from both sides and the foot.
(2) The berths shall be so arranged as readily to accommodate a stretcher alongside any berth.

Construction and fittings of hospital accommodation
73. (1) The doorway to the hospital accommodation shall be sufficiently wide to allow the free passage of a stretcher.
(2) The floor of the hospital accommodation shall be covered with a rubber based or other approved impervious material and shall be fitted with a covering around its perimeter.

(3) The hospital accommodation shall be fitted with not less than 2 side scuttles-
(a) at least 305 millimetres in diameter; and
(b) fitted with suitable bars or guards.

(4) The minimum standards of-
(a) the heating, lighting and ventilation;
(b) the construction and internal surfaces of bulkheads;
(c) the construction and fittings of berths; and
(d) the floor area and head room,
required by these Regulations in respect of sleeping accommodation for ratings apply also to the hospital accommodation, other than the sanitary block referred to in regulation 74, to be provided for the crew.
(5) A suitable locker, a water bottle and a tumbler shall be provided for each berth in the hospital accommodation and shall be within reach of that berth.

(6) The hospital accommodation shall be provided with the following items of equipment:
(a) a clothes locker;
(b) seats adequate in number, having regard to the number of berths in the accommodation;
(c) a bed pan;
(d) electric bell-pushes so arranged as to be within reach of each berth and communicating with the sleeping accommodation provided for the person in charge of the patients.
(7) A kerosene light or electric battery light shall be provided in the hospital accommodation and shall be kept ready at all times for use in the event of failure of the normal lighting system.

74. (1) A sanitary block comprising a bathroom and a water closet shall be provided for the exclusive use of patients in the hospital accommodation of a ship.

Galleys
76. (1) A ship shall be provided with a galley for the preparation of food for the crew, unless the circumstances are such that no members of the crew are required to mess on board.
(2) The galley shall be situated as near as practicable to the mess rooms provided for the crew and if it is not situated adjacent to a mess room, equipment which will enable food to be served hot in that mess room in all weathers shall be provided.

(4) A part of a galley adjoining a stokehold or other heat-producing space shall be insulated from heat effects.

(5) The floor of a galley shall be covered with a rubber-based or other approved inpervious material and if the Minister so requires in a particular case, a suitable surface shall be laid over the floor covering to avoid the danger of slipping.
(6) The floor of the galley shall be provided with gutters and with scuppers which shall be led overboard or to an enclosed tank served by a mechanically operated suction pump.
(7) The position and number of the gutters shall be such as will ensure the efficient drainage of the floor.

(8) A supply of salt water connected to a tap or other suitable connexion shall be provided in each galley to facilitate the washing down of the floor, unless other suitable means for washing down are available.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 77.
Equipment of galleys
77. (1) A galley shall be provided with such equipment (including cooking ranges, ovens and fire grates) as will enable food in sufficient quantity to be properly and readily prepared for the persons whom the galley is intended to serve, and the cooking utensils to be hygienically cleaned.
(2) The cooking utensils in a galley shall be so arranged as to facilitate the cleaning of the galley.
(3) Cupboards and dressers in a galley shall be constructed of material which is impervious to dirt and moisture and can be easily kept clean and metal parts shall be rust-proof.

(4) Where a cupboard or dresser is not flush with the deck, it shall have a clearance of not less than 255 millimetres above the deck to facilitate cleaning.
(5) Salt water taps shall not be fitted over a sink in a galley.

(2) An efficient system of mechanical exhaust ventilation to draw off fumes from cooking appliances shall be provided in each galley, unless the natural ventilation provided is adequate to ensure that the fumes escape only to the open air.

Dry provision store rooms
80. (1) Dry provision store rooms shall be provided for the storage of dry provisions for the crew, and shall be of sufficient capacity having regard to the maximum period likely to elapse between successive replenishments of stores and to the maximum number of the crew to be carried.
(2) Dry provision store rooms shall-
(a) be enclosed by bulkheads constructed of steel or other approved material; and
(b) be so situated, constructed and ventilated as to avoid deterioration of the stores through heat, draught, condensation or infestation by insects or vermin.
(3) A dry provision store room shall not be situated close to a space in which heat is generated, unless it is adequately insulated against heat.
(4) A dry provision store room shall not be used for the storage of bedding or textiles.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 81.

81. (1) Refrigerating equipment and cold storage rooms shall, subject to sub-regulation (2), be provided and shall be adequate for the storage of perishable provisions for the crew having regard to the period likely to elapse between successive replenishments of stores.

(2) In the case of a ship of less than 500 tons, an approved alternative arrangement for the storage of perishable provisions may be provided instead of that required by sub-regulation (1).
(3) Refrigeration machinery in which methyl chloride is intended to be used shall not be situated in the crew accommodation except in a store room or space appropriated solely to that machinery.

(4) The store room or space in which any such machinery is housed shall-
(a) be so constructed as to be gastight where it abuts upon other parts of the crew accommodation; and
(b) be adequately ventilated by at least 2 ventilators to the open air, one of which shall be fitted with an exhaust fan and shall have its inlet near the bottom of the room or space.
(5) The motor of the electric fan and the electrical connexions to the fan shall be enclosed in a spark-proof case.
(6) Where access to the store room or space is from an open deck, it shall be by means of a hinged door, and where access is from an alleyway or other space frequented by the crew, the door shall be spring-loaded, jointed and reasonably gastight.
(7) Exposed pipes which may contain methyl chloride or other toxic or inflammable gas shall be adequately protected from damage.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 82.
Cleanliness, &c., of crew accommodation
82. (1) The crew accommodation shall be maintained in a clean and habitable condition and all equipment and installations required by these Regulations shall be maintained in good working order.
(2) Every part of the crew accommodation, not being a store room, shall be kept free of stores and other property not belonging to, or provided for the use of, persons for whom that part of the accommodation is appropriated.

83. (1) Where a particular fitting, furnishing or appliance, or a particular type of fitting, furnishing or appliance, is, by or in pursuance of these Regulations, required to be fitted or carried in a ship, the Minister may, if he is satisfied that another fitting, furnishing or appliance, or another type of fitting, furnishing or appliance, is equivalent or superior in standard to that required by or in pursuance of these Regulations-
(a) permit that other fitting, furnishing or appliance, or type of fitting, furnishing or appliance, to be fitted or carried; or
(b) request the Committee to determine whether that other fitting, furnishing or appliance, or type of fitting, furnishing or appliance, may be fitted or carried.

(2) Where, in pursuance of sub-regulation (1), the Minister has permitted a fitting, furnishing or appliance or type of fitting, furnishing or appliance, to be fitted or carried, or the Committee has determined that a fitting, furnishing or appliance, or type of fitting, furnishing or appliance, may be fitted or carried, that fitting, furnishing or appliance, or type of fitting, furnishing or appliance, may be fitted or carried instead of that required by or in pursuance of these Regulations.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 84.
Sharing of crew accommodation with passengers
84. (1) Subject to this regulation-
(a) no part of the crew accommodation provided in compliance with these Regulations shall be used, or appropriated for use, by passengers; and
(b) a galley or store room provided in compliance with these Regulations shall not be used, or appropriated for use, for the preparation or storage of food for passengers.

(2) The Minister may exempt a ship from the requirements of these Regulations, not being requirements relating to sleeping rooms or office accommodation, to the extent that he is satisfied that accommodation equal or superior in standard to the accommodation required by these Regulations is available for the use or service of the crew in common with passengers.

Weekly inspection of accommodation

85. (1) The master or an officer appointed by him for the purpose shall inspect every part of the crew accommodation at intervals not exceeding 7 days, and shall be accompanied on the inspection by at least one member of the crew.

(2) The master of the ship shall cause to be entered in the ship's official log-book a record of-
(a) the time and date of the inspection;
(b) the names and ranks of the persons making the inspection; and
(c) particulars of any respects in which the crew accommodation or a part of it was found by any of the persons making the inspection not to comply with these Regulations.
Penalty: $100.
NAVIGATION (CREW ACCOMMODATION) REGULATIONS - SECT. 86.

86. (1) The crew accommodation of each ship shall be inspected by a Medical Inspector of Seamen appointed under section 123 of the Act or a person authorized for the purpose by the Minister-
(a) annually; and
(b) whenever-
(i) the ship is registered or re-registered;
(ii) a part of the crew accommodation in the ship undergoes substantial alterations or repairs;
(iii) the number of persons accommodated in a space forming part of the crew accommodation is increased above that for which the space was approved in pursuance of these Regulations;
(iv) a request for an inspection has been made to the Minister, in sufficient time to avoid delay in the sailing of the ship, by or on behalf of the owner of the ship or by an official of an organization of seamen registered under the Conciliation and Arbitration Act 1904; or
(v) a written complaint, alleging that the crew accommodation does not comply with these Regulations and signed by at least 3 members of the crew, has been duly lodged with the superintendent at a Mercantile Marine Office.

(2) A complaint referred to in sub-paragraph (1) (b) (v) shall be deemed not to have been duly lodged unless it is lodged-
(a) as soon as practicable after the arrival of the ship in port; and
(b) at least 24 hours before the ship is due to sail, unless the ship is in port for less than 24 hours.

87. (1) This Division applies to a new ship and to an existing ship.
(2) Where a surveyor is satisfied that each space, other than an open deck, alleyway or stairway, that forms part of the crew accommodation of a ship to which this Division applies complies with the plans in respect of that accommodation submitted under sub-regulation 11 (2) and approved, the surveyor may, for the purposes of this Division, issue a certificate to that effect.

88. (1) A space in respect of which a surveyor has issued a certificate under sub-regulation 87 (2) shall be marked-
(a) with the particulars contained in the certificate, being particulars of-
(i) in relation to a space that is a sleeping room-the maximum number, and description of the class, of the members of the crew who may use that space as sleeping room; or
(ii) in relation to a space that is not a sleeping room-the purpose for which the space may be used and, where the space is for the use of a particular class or group of the members of the crew, a description of that class or group;
(b) in clear characters in a readily visible position on the ship's structure; and
(c) by cutting into the structure or in some other permanent manner.
(2) A space in respect of which a surveyor has issued a certificate under sub-regulation 87 (2) shall not be marked whether inside or outside with a marking that may be taken to indicate that the space may be used-
(a) by persons differing in number or description from the persons; or
(b) for a purpose different from the purpose,
specified in the certificate.
