REGULATIONS UNDER THE NAVIGATION ACT 1912-1965.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912-1965.

Amendments of the Navigation (Crew Accommodation) Regulations

Parts.

1. Regulation 2 of the Navigation (Crew Accommodation) Regulations is amended by omitting the word and figures “(Regulations 7-10)” and inserting in their stead the word and figures “(Regulations 7-9)”.

2. Part II. of the Navigation (Crew Accommodation) Regulations is repealed and the following Part inserted in its stead:—

“Part II.—Crew Accommodation Committee.

Meetings of Committee.

“7.—(1.) Meetings of the Committee shall be convened by the Chairman or by a member authorized by the Chairman to convene meetings, by notice in writing to each member specifying the time and place of the meeting.

“(2.) At a meeting of the Committee a quorum is constituted by one-half of the members of the Committee or, if there is not an even number of members, by a majority of members.

“(3.) Any question to be decided at a meeting of the Committee shall be decided by a majority of the votes of the members present.

“(4.) The Chairman shall preside at all meetings of the Committee at which he is present and has a casting, as well as a deliberative, vote.

“(5.) If the Chairman or the deputy of the Chairman is not present at a meeting the members present may elect one of their number to preside at the meeting and, subject to the next succeeding sub-regulation, the member so elected has and may exercise and perform, during the absence of the Chairman or the deputy of the Chairman, all the powers and functions of the Chairman.

“(6.) A member elected to preside at a meeting in pursuance of the last preceding sub-regulation does not have a casting vote.

Committee to have seal.

“8.—(1.) The Committee shall have a seal that shall be oval in shape with the words ‘Crew Accommodation Committee’ surrounded by a band bearing the words ‘Commonwealth Navigation Act’, the whole being surmounted by a crown.

“(2.) The Chairman of the Committee or, in relation to orders made by the Committee during the absence of the Chairman, the deputy of the Chairman or the member elected to preside at the meeting of the Committee at which the orders were made, shall cause each order of the Committee to be sealed with the seal of the Committee.

“9. An order purporting to have been signed by the Chairman of the Committee, the deputy of the Chairman or a member elected to preside at a meeting of the Committee and to have been sealed with the seal of the Committee shall be deemed to have been made by the Committee, unless the contrary is shown.”.

Hospital accommodation.

3. Regulation 70 of the Navigation (Crew Accommodation) Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Except in the case of a ship that—

(a) is engaged solely in the coasting trade and is ordinarily on a route where it can, at any time, reach a port within forty-eight hours; or

(b) is a ship in which hospital accommodation is provided in accordance with the Navigation (Hospital Accommodation) Regulations,

hospital accommodation shall be provided for the crew in accordance with these Regulations.”.

4. Regulation 75 of the Navigation (Crew Accommodation) Regulations is repealed.
