REGULATIONS UNDER THE NAVIGATION ACT 1912.*

Amendments of the Navigation (Crew Accommodation) Regulations

Parts.

1. Regulation 2 of the Navigation (Crew Accommodation) Regulations is repealed.

Interpretation.

2. Regulation 3 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from the definition of “ crew accommodation ” in sub-regulation (1) the words “ recreation rooms ” and substituting the words “ recreation rooms and facilities ”;

  • (b) by omitting the definitions of “

     existing ship” and “ new ship ” in sub-regulation (1) and substituting the following definitions:—

    “ ‘ existing ship ’ means a ship the keel of which was laid or the construction of which otherwise commenced before regulation 4a came into operation;

‘ new ship ’ means a ship other than an existing ship;

‘ passenger ship ’ means a ship in respect of which—

(a) a passenger ship safely certificate issued in accordance with the provisions of the International Convention for the Safety of Life at Sea, 1960;

(b) a passenger ship short voyage safety certificate issued in accordance with the provisions of the International Convention for the Safety of Life at Sea, 1960; or

(c) a passenger certificate issued under sub-section 194 (4) of the Act,

is in force;”;

(c) by omitting from the definition of “ Regional Controller ” in sub-regulation (1) the words “ Shipping and ”; and

(d) by inserting, after the definition of “ re-registered ” in sub-regulation (1), the following definitions;—

“ ‘ River Murray ’ includes any tributary of that river and—

(a) any affluent, or effluent creek;

(b) any ana-branch or extension; and

(c) any lake or lagoon,

connected with that river or tributary;

‘ the Act ’ means the Navigation Act 1912;.

Application of Regulations.

3. Regulation 4 of the Navigation (Crew Accommodation) Regulations is amended by inserting, after the word “ ships ”, the words “, other than ships employed exclusively in trading or going between places on the River Murray.”.

Requirements for existing Ships.

4. After regulation 4 of the Navigation (Crew Accommodation) Regulations the following regulation is inserted:—

“ 4a, The requirements to be complied with in respect of the accommodation in existing ships shall, subject to any contrary requirement of these Regulations expressed to apply to an existing ship, be the requirements of these Regulations as in force immediately before the commencement of this regulation.”.

Power to exempt new ships from requirement of Regulations.

5. Regulation 5 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (1) the words “ Part III of ”;

(b) by inserting in sub-regulation (1), after the words “ Committee may ”, the words “, not inconsistently with the provisions of International Labour Organization Conventions No, 92 and No, 133,”; and

(c) by omitting from paragraph (a) of sub-regulation (2) the words “ Part III of ”.

Exemptions from and modifications of requirements in case of existing shies.

6. (1) Regulation & of the Navigation (Crew Accommodation) Regulations is amended—

(a) by inserting in sub-regulation (1), after the words “ The Minister may,”, the words “ not inconsistently with the provisions of international Labour Organization Conventions No, 92 and. No, 133,”:

(b) by omitting from sub-regulation (1) the words “ Part III of ”;

(c) by omitting from sub-regulation (1) the words “ that part ” and substituting the words “ these Regulations ”;

(d) by inserting in sub-regulation (2), after the word “ determine ”, the words “, not inconsistently with the provisions of International Labour Organization Conventions No. 92 and No, 133,”;

(e) by omitting from sub-regulation (2) the words “ Part III of ”;

(f) by omitting from sub-regulation (2) the words “ that Part ” (first occurring) and substituting the words “ these Regulations ”;

  • (g) by omitting from sub-regulation (2) the words “ that Part ” (second occurring) and substituting the words “

     those requirements”;

(h) by omitting from paragraph (a) of sub-regulation (3) the words “ Part III of ”;

(i) by inserting in sub-regulation (3), after the word “ determine ”, the words “, not inconsistently with the provisions of International Labour Organization Conventions No. 92 and No. 133,”;

(j) by omittingfrom sub-regulation (3) the words “ that Part ” (first occurring) and substituting the words “ the requirements of these Regulations ”; and

(k) by omitting from sub-regulation (3) the words “ that Part ” (second occurring) and substituting the words “ those requirements ”.

(2) Where a ship was, immediately before the commencement of this sub-regulation, exempted from a requirement of the Navigation (Crew Accommodation) Regulations, that exemption shall continue in force as if it were an exemption granted by the Minister under regulation 6 of those Regulations as in force after the commencement of this sub-regulation from the corresponding requirement of those Regulations as so in force and may be varied or revoked by the Minister at any time.

(3) Where the requirements of Part III of the Navigation (Crew Accommodation) Regulations as in force immediately before the commencement of this sub-regulation applied to a ship with modifications determined by the Crew Accommodation Committee under regulation 6 of those Regulations, that determination shall continue in force as if it were made by the Committee after the commencement of this sub-regulation in respect of the requirements of the Navigation (Crew Accommodation) Regulations as in force after the commencement of this sub-regulation until such time as the Committee determines different modifications of those requirements in relation to that ship under regulation 6 of the Navigation (Crew Accommodation) Regulations as in force after the commencement of this sub-regulation.

Meetings of Committees.

7.Regulation 7 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (5) the words “ the next succeeding sub-regulation ” and substituting the word and figure “ sub-regulation (6) ”; and

(b) by omitting from sub-regulation (6) the words “ the last preceding sub-regulation ” and substituting the word and figure “ sub-regulation (5) ”.

Location of crew accommodation.

8. Regulation 12 of the Navigation (Crew Accommodation.) Regulations is amended—

(a) by omitting from sub-regulation (2) the words “ not exceeding five hundred tons ” and substituting the words “ of less than 500 tons ”; and

(b) by omitting from sub-regulation (2) the words “ exceeding two hundred tons ” and substituting the words “ of not less than 200 tons ”.

Protection against weather and sea. &c.

9. Regulation 13 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by inserting in paragraph (e), after the word “ effluvia ”, the words “ (including exhaust gases from any area containing sanitary or lavatory equipment) ”; and

  • (b) by inserting in paragraph (g), after the word “ ports ”, the words “ and the crew accommodation is not ventilated by a temperature-controlled mechanical ventilation system

     ”.

Height of crew accommodation.

10. Regulation 15 of the Navigation (Crew Accommodation) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(2) The height at any point in the crew accommodation, being a point available for free movement, measured from the top surface of the deck or of any

floor covering fixed to the deck to the bottom of any overhead fitting or fixture, shall be not less than 6 feet 6 inches.”.

Construction of bulkheads.

11. Regulation 16 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by inserting in sub-regulation (1), after the word “ suitable ”, the word “ fire-proof ”;

(b) by omitting from paragraph (d) of sub-regulation (7) the word “ or ”;

(c) by omitting paragraph (e) of sub-regulation (7) and substituting the following paragraphs:—

“ (e) sanitary accommodation which may be directly entered from a sleeping room from that sleeping room, being a sleeping room appropriated for the exclusive use of one person, where the sanitary accommodation is appropriated for the exclusive use of the occupant of that sleeping room; or

(f) sanitary accommodation which may be directly entered from each of 2 sleeping rooms from those sleeping rooms, being sleeping rooms each of which is appropriated for the exclusive use of one person, where the sanitary accommodation is appropriated for use only by the occupants of those sleeping rooms.”;

(d) by omitting from sub-regulation (8) the word “ Inside ” and substituting the words “ Subject to sub-regulation (8a), inside ”; and

(e) by inserting, after sub-regulation (8), the following sub-regulation:—

“ (8a) The provisions of sub-regulation (8) do not apply to the side of a bulkhead which forms the wall of any washing accommodation.”.

Lining of sleeping, mess and recreation rooms.

12. After regulation 17 of the Navigation (Crew Accommodation) Regulations the following regulation is inserted:—

“ 17a. Bulkheads enclosing rooms used as sleeping rooms, mess rooms or recreation rooms for the crew of a ship shall be lined on the side of those bulkheads within those rooms.”.

Awnings.

13. Regulation 19 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (1) all words before the word “ shall ” and substituting the words “ Ships other than ships the crew accommodation of which is ventilated by a temperature-controlled mechanical ventilation system, trading regularly to the tropics ”.

Decks and sheathings.

14. Regulation 24 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (3) the words “, to the satisfaction of the Minister,”.

Decks constituting floors.

15. Regulation 25 of the Navigation (Crew Accommodation) Regulations is amended by omitting paragraph (a) of sub-regulation (1) and substituting the following paragraphs:—

“ (a) is impervious to water;

(aa) is capable of reducing the level of noise in the crew accommodation;”.

Lighting.

16. Regulation 29 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by inserting in sub-regulation (3), after the word “ Minister ”, the words “, or a person authorized by the Minister for the purposes of this sub-regulation,”; and

(b) by inserting in paragraph (a) of sub-regulation (3), after the word “ accommodation ” (second occurring), the word “, galleys ”.

Electric lighting.

17. Regulation 30 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (2) all words after the word “ crew ”;

(b) by inserting, after sub-regulation (2), the following sub-regulations:—

“ (2a) An electric light shall be fitted at the head of each berth, being an electric light—

(a) capable of being switched on and off from the berth;

(b) the direction of the beam of which shall be capable of being adjusted without the use of tools; and

(c) capable of emitting sufficient light to enable a person of normal vision to read in the berth.

“ (2b) Where a desk is provided in the crew accommodation, that desk shall be fitted with an electric light enabling a person of normal vision to read while seated at the desk.”; and

(c) by omitting sub-regulations (4) and (5) and substituting the following sub-regulations:—

“ (4) The electric lighting of a space shall be deemed to provide adequate lighting for the purposes of these Regulations if the lighting complies with the requirements of Australian Standards 1150-1972 as in force at the commencement of this sub-regulation.

“ (5) An electric light fitted at the head of a berth in accordance with sub-regulation (2a) shall, for the purposes of these Regulations, be taken into account for the purposes of determining the illumination of a space comprising sleeping accommodation intended to accommodate one person.

“ (5a) An electric light fitted to a desk in accordance with sub-regulation (2b) shall be taken into account for the purposes of determining the illumination of a space for the purposes of these Regulations.”.

Ventilation.

18. Regulation 31 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting sub-regulations (1) and (2) and substituting the following sub-regulations:—

“ (1) This regulation, applies to—

(a) new ships;

(b) existing ships of not less than 3000 tons: and

(c) existing ships of not less than 1000 tons, being ships trading regularly in or to the tropics.

“ (2) Subject to sub-regulation (2a), the enclosed parts of the crew accommodation of a ship to which this regulation applies shall be ventilated—

(a) in the case of a new ship—by a temperature-controlled mechanical ventilation system; or

(b) in the case of an existing ship—by a mechanical ventilation system,

capable of maintaining the air in those parts in a state of parity adequate for the health and comfort of the crew.

“ (2a) Each of the following enclosed parts of the crew accommodation of a ship to which this regulation applies shall be ventilated by a temperature-controlled mechanical ventilation system or a mechanical ventilation system:—

(a) galleys;

(b) laundries;

(c) change rooms;

(d) storerooms.”;

(b) by omitting paragraph (b) of sub-regulation (3); and

(c) by omitting sub-regulations (7) and (8) and substituting the following sub-regulation:—

“ (7) A ship to which this regulation applies shall carry sufficient spare parts for any temperature-controlled mechanical ventilation system, and for any mechanical ventilation, system installed in the ship.”.

Electric fans.

19. Regulation 33 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting the words “ a ship ” and substituting the words “ an existing ship ”; and

(b) by inserting, after the words “ with a ”, the words “ temperature-controlled or other ”.

Ratings’ sleeping rooms.

20. Regulation 36 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting sub-regulations (1) and (2) and substituting the following sub-regulation:—

“ (1) In the case of a new ship, each rating, not being an apprentice who is under 18 years of age or a deck boy who is under that age, shall be provided with a separate sleeping room.”; and

(b) by omitting from sub-regulation (3) the words “ two apprentices or deck boys ” and substituting the words “ 2 apprentices who are under 18 years of age or 2 deck boys who are under that age ”.

Floor area of sleeping rooms.

21. Regulation 37 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting paragraphs (a), (b) and (c) of sub-regulation (1) and substituting the following paragraphs:—

“ (a) in the case of a ship of less than 400 tons—45 square feet;

(b) in the case of a ship of not less than 400 tons but less than 800 tons—55 square feet; and

(c) in the case of a ship of not less than 800 tons—65 square feet.”;

and

(b) by omitting sub-regulation (2) and substituting the following sub-regulations:—

“ (2) Where 2 deck ratings, 2 engine room ratings or 2 cooks share a sleeping room, the minimum floor area of that room shall be 97.5 square feet.

“ (2a) Where 2 stewards share a sleeping room, the minimum floor area of that room shall be 91 square feet.

“ (2b) Where 3 stewards share a sleeping room, the minimum floor area of that room shall be 117 square feet..

“ (2c) Where 4 stewards share a sleeping room, the minimum floor area of that room shall be 143 square feet.

“ (2d) Where a separate sitting room or day room is not appropriated for the exclusive use of an officer, the minimum floor area of the sleeping room of that officer shall be 81 square feet.”.

Berths.

22. Regulation 38 of the Navigation (Crew Accommodation) Regulations isamended by omitting from sub-regulation (10) the words “ six feet three inches by two feet three inches ” and substituting the words “ 6 feet 6 inches by 2 feet 7.5 inches ”.

Furniture. &c., inofficers’ sleeping rooms.

23. Regulation 39 of She Navigation (Crew Accommodation) Regulations is amended by omitting from paragraph (j) of sub-regulation (1) the words “ shelf or cupboard ” and substituting the word “ cabinet ”.

Furniture, &c., in apprentices Sleeping rooms.

24. Regulation 40 of the Navigation (Crew Accommodation) Regulations is amended by inserting in sub-regulation (1), after the word “ Minister ”, the words “ or a person authorized by the Minister for the purposes of this sub-regulation ”.

Furniture, &c., in ratings sleeping rooms.

25. Regulation 41 of the Navigation (Crew Accommodation) Regulations is amended by omitting from paragraph (a) of sub-regulation (2) the word “ or ” and substituting the word “ and ”.

Ventilation of wardrobes and clothes lockers.

26.After regulation 43 of the Navigation. (Crew Accommodation) Regulations the following regulation is inserted:—

“ 43a. Wardrobes and clothes lockers provided in sleeping accommodation and clothes lockers provided in the hospital accommodation of a ship shall be adequately ventilated.”.

Locks to be provided in sleeping rooms.

27. Regulation 44 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (3) the word “ locks ” and substituting the words “ locks capable of adequately securing those doors ”.

Mess rooms.

28. Regulation 45 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (2) the words “ that does not exceed one thousand tons ” and substituting the words “ of less than 1000 tons ”;

(b)by omitting from sub-regulation (3) the words “ that exceeds one thousand tons ” and substituting the words “ of not less than 1000 tons ”;

(c) by omitting from sub-regulation (4) the words “ that exceeds one thousand tons ” and substituting the words “ of not less than 1000 tons ”; and

(d) by omitting sub-regulation (7) and substituting the following sub-regulation:—

“ (7) The floor area of a mess room shall be not less than 10.76 square feet per person of the planned seating capacity.”.

Dressers, &c., to be provided in mess rooms or pantry.

29. Regulation 48 of the Navigation (Crew Accommodation) Regulations is repealed and the following regulations substituted:—

“ 48. Each of the following shall be fitted, in respect of each mess room on a ship, in the mess room or in a pantry readily accessible from the mess room:—

(a) a dresser;

(b) a sink;

(c) a hot-press;

(d) a hot water boiler;

(e) a refrigerator.

Water cooling facilities.

“ 48a. (1) A water cooler or other water cooling facilities shall be provided on each deck on which sleeping accommodation or a recreation room is situated.

“ (2) A water cooler or other water cooling facilities provided in accordance with sub-regulation (1) shall be situated in a passage way or other place to which all members of the crew have access.”.

Smoking rooms for officers.

30. Regulation 50 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (1) the words “ exceeding two thousand five hundred tons ” and substituting the words “ of not less than 2500 tons ”.

Recreation

31. Regulation 51 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (1) the words “ ships exceeding one thousand tons ” and substituting the words “ all ships ”;

(b) by inserting, after sub-regulation (2), the following sub-regulation:—

“ (2a) Space provided on an open deck in accordance with sub-regulation (2) shall be provided with awnings or sun decks,”;

(c) by omitting from sub-regulation (3) the words “ In ships exceeding five hundred tons ” and substituting the words “ In any ship ”; and

(d) by adding at the end thereof the following sub-regulation:—

“ (4) In any ship of not less than 8000 tons, the following facilities shall be provided for all members of the crew:—

(a) a room in which Sims may be shown or, in areas where reception of television transmissions is possible, television programs may be shown;

(b) a room for hobbies and games;

(c) a swimming pool.”.

Office accommodation.

32. Regulation 52 of the Navigation (Crew Accommodation) Regulations is repealed and the following regulations substituted:—

“ 52. (1) In any ship of not less than 2500 tons, separate office accommodation shall be provided for the use of the master of the ship.

“ (2) In any ship of not less than 2500 tons, a room equipped as office accommodation shall be provided for the use of each of the following groups of officers of the ship:—

(a) deck officers;

(b) engine room officers,

“ (3) Office accommodation provided for the use of the master of a ship in accordance with sub-regulation (1) or a group of officers of the ship in accordance with sub-regulation (2) shall not be combined with a day-room provided for the master, that group of officers or an officer included in that group of officers.

Day-rooms.

“ 52a. (1) In any ship of not less than 3000 tons, a separate day-room shall be provided for each of the following officers of the ship:—

(a) the Master;

(b) the Chief Engineer;

(c) the First Mate.

“ (2) A day-room provided for the use of an officer in accordance with sub-regulation (1) shall be adjacent to and shall communicate with, the sleeping room of the officer.”.

Sanitary accommodation.

33.Regulation 53 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by inserting, after sub-regulation (1), the following sub-regulation:—

“ (1a) ln any ship, the sanitary accommodation provided for female members of the crew shall be separate from that provided for male members of the crew.”;

(b) by omitting from sub-regulation (2) the words “ exceeding eight hundred tons ” and substituting the words “ of not less than 800 tons ”;

(c) by omitting from sub-regulation (3) the words “ at least ”;

(d) by omitting from sub-regulation (3) the words “ separate sanitary accommodation ” and substituting the words “ sanitary accommodation of a kind described in paragraph 16 (7) (e) or (f) ”;

(e) by omitting from sub-regulation (4) the words “ at least ”;

(f) by omitting the table in sub-regulation (5) and substituting the following table:—

“ Where the ship is of less than 800 tons....................................................................... 3

Where the ship is of not less than 800 tons but is of less than 3000 tons ..................... 4

Where the ship is of not less than 3000 tons.................................................................. 6 ”

and

(g) by adding at the end thereof the following sub-regulations:—

“ (6) In addition to any sanitary accommodation required to be provided by the preceding sub-regulations of this regulation in a ship, a water closet and a wash basin shall, in any ship of not less than 1500 tons, be provided adjacent to, and shall be easily reached from, each of the following areas of the ship:—

(a) the navigating bridge;

(b) the machinery space or the engine room control centre.

“ (7) The sanitary accommodation required to be provided adjacent to the navigating bridge of a ship in accordance with sub-regulation (6) shall be contained in a separate compartment.

“ (8) In addition to any sanitary accommodation required to be provided by the preceding sub-regulations of this regulation in a ship, a water closet shall be provided in each of the following:—

(a) a bathroom provided for the exclusive use of an officer;

(b) a bathroom provided for the exclusive use of 2 officers;

(c) a bathroom provided for the use of ratings.”.

Washing accommodation.

34. Regulation 57 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (2) the words “ exceeding eight hundred tons but not exceeding one thousand five hundred tons ” and substituting the words “ of not less than 800 tons but less than 1500 tons ”;

(b) by omitting from paragraph (a) of sub-regulation (2) the word “ master ” and substituting the words “ master and for the Chief Engineer ”;

(c) by omitting from sub-regulation (3) the words “ exceeding one thousand five hundred tons ” and substituting the words “ of not less than 1500 tons ”; and

(d) by adding at the end thereof the following sub-regulations:—

“ (8) In a ship of not less than 5000 tons but less than 15 000 tons, a bathroom shall be provided for the exclusive use of each of not less than 5 of the officers of the ship.

“ (9) In a ship of not less than 10 000 tons but less than 15 000 tons, a bathroom shall be provided for the exclusive use of each 2 of the officers of the ship, other than those officers of the ship each of whom has been provided with a bathroom for his exclusive use.

“ (10) In a ship of not less than 15 000 tons, a bathroom shall be provided for the exclusive use of each officer of the ship.

“ (11) In a ship of not less than 25 000 tons, a bathroom shall be provided for each 2 of the ratings of the ship, other than those ratings each of whom has been provided with a bathroom for big exclusive use.

“ (12) Where a bathroom is provided for the exclusive use of an officer, that bathroom shall be capable of being directly entered from the sleeping room appropriated for the exclusive use of that officer.

“ (13) Where a bathroom is provided for the exclusive use of 2 officers the bathroom shall be capable of being directly entered from each of the sleeping rooms appropriated for the exclusive use of those officers.

“ (14) Where a bathroom is provided for the use of a rating or of 2 ratings, the bathroom shall be—

(a) capable of being directly entered from the sleeping room or each of the sleeping rooms appropriated for the use of that rating or those ratings; or

(b) adjacent to that sleeping room or each of those sleeping rooms.

“ (15) In any ship—

(a) each bathroom provided for the exclusive use of an officer; and

(b) each bathroom provided for the use of ratings,

shall, subject to sub-regulation (17), be provided with a shower and a wash basin.

“ (16) In a ship of not less than 5000 tons, other than a passenger ship, each sleeping room shall, subject to sub-regulation. (17), be provided with a wash basin.

“ (17) Where a bathroom is provided for the exclusive use of the occupants of a sleeping room or 2 sleeping rooms, a wash basin shall be provided in—

(a) the sleeping room or each of the sleeping rooms, as the case requires; or

(b) the bathroom,

but need not be provided in each of those rooms.”.

35. Regulation 58 of the Navigation (Crew Accommodation) Regulations is repealed and the following regulation substituted:—

Change rooms.

“ 58. (1) Subject to sub-regulation (.5), in a ship of not less than 3500 tons, each of the following classes of crew members shall be provided with change rooms separate from any change rooms provided for another of the following classes of crew members or for crew members not included in one of the following classes of crew members:—

(a) engine room officers;

(b) engine room ratings;

(c) deck department ratings.

“ (2) Each change room provided in a ship in accordance with sub-regulation (1) shall be provided with—

(a) a full-length locker for each officer or rating using the change room;

(b) sufficient hooks for the use of the officers or ratings using the change room, suitably positioned to enable their use for hanging clothing and

(c) wooden forms or seats.

“ (3) Each locker provided in accordance with sub-regulation (2) shall contain 3 coat hangers and shall be fitted with—

(a) a hook suitably positioned to enable its use for hanging clothing;

(b) a shelf or shelves suitable for holding headwear, boots and shoes; and

(c) a soap container attached to the inside of the door.

“ (4) Subject to sub-regulation (5) in a ship of not less than 1600 tons, other than a ship in which each of the members of the following classes of crew members is provided with sanitary accommodation of a kind described in paragraph 16 (7) (e) or (f), each of the following classes of crew members shall be provided with a change room separate from change rooms provided for other classes:—

(a) officers of the engine room department:

(b) ratings of the engine room department.

“ (5) Where a change room is provided for a class of crew members in accordance with sub-regulation (1) a change room shall not be provided for that class of persons in, accordance with sub-regulation. (4).

“ (6) A change room provided for engine room officers or ratings in accordance with this regulation shall be located outside, but shall be easily reached from, the engine room.

“ (7) A change room provided for a class of crew members in accordance with sub-regulation (i) or (4) shall contain a shower and a wash basin,”.

Size, and equipment of wash places.

36. Regulation 59 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (1) the words “ bath, shower, wash basin and ” and substituting the words “ shower, wash basin or ”;

(b) by omitting from sub-regulation (2) the word “ baths,”;

(c) by omitting from sub-regulation (3) the words “ bath or ”;

(d) by omitting from sub-regulation (4) the words “ bath or ”;

(e) by omitting from sub-regulation (5) the words “ bath or ”; and

(f) by omitting sub-regulation (6) and substituting the following sub-regulation:—

“ (6) For the purposes of sub-regulations (3), (4) and (5), account shall not be taken of—

(a) washing accommodation provided for the exclusive use of not more than 2 persons; or

(b) the persons for whom that accommodation has been provided.”.

Showers.

37. Regulation 60 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (1) the words “ bath or ” (wherever occurring); and

(b) by omitting sub-regulation (6).

Discharge system in showers. &c.

38. Regulation 61 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (1) the word “, bath ”.

Supply of water to washing accommodation.

39. Regulation 62 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting sub-regulation. (1) and substituting the following sub-regulation:—

“ (1) Each member of the crew of a ship shall be supplied with not less than 2 gallons of fresh water each day for washing purposes.”; and

(b) by omitting from sub-regulation (2) the words “, showers and baths ” and substituting (he words “ and showers ”.

Laundry facilities.

40. Regulation 65 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting from sub-regulation (I) the word “ troughs ” and substituting the words “ troughs and washing machines ”;

(b) by omitting from sub-regulation (2) the words “ exceeding eight hundred tons ” and substituting the words “ of not less than 800 tons ”;

(c) by omitting from sub-regulation (2) the word “ troughs ” (wherever occurring) and substituting the words “ troughs and washing machines ”;

(d) by omitting from sub-regulation (3) the word “ troughs ” and substituting the words “ troughs and washing machines ”;

and

(e) by omitting sub-regulations (4) and (5) and substituting the following sub-regulations:—

“ (4) Subject to sub-regulation (5), one wash trough and one washing machine shall be provided in a laundry or wash place for each 10 members of the crew, other than members of the crew provided with separate laundry facilities, and where the number of members of the crew in respect of whom wash troughs and washing machines are to be provided in accordance with this regulation is not divisible by 10 without remainder, and the remainder exceeds 4, an additional wash trough and washing machine shall be provided.

“ (5) Wash troughs and washing machines need not be provided in accordance with this regulation where a common laundry under the control of a laundryman is provided.”.

Drying rooms.

41. Regulation 68 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (1) the words “ shall be provided and ”.

42. After regulation 68 of the Navigation (Crew Accommodation) Regulations the following regulations are inserted:—

Irons and drying machines.

“ 68a. Where a common laundry under the control of a laundryman is not provided on a ship, the members of the crew of that ship shall be provided with sufficient facilities of the following kinds to ensure that their clothing is adequately laundered:—

(a) irons and ironing boards;

(b) drying machines or drying rooms.

Equipment in common laundries.

“ 68b. Where a common laundry under the control of a laundryman is provided on a ship, that laundry shall be provided with sufficient facilities of the following kinds to ensure that the clothing of the members of the crew of the ship is adequately laundered:—

(a) irons and ironing boards;

(b) drying machines,

Washing and ironing facilities.

“ 68c. Facilities provided for the crew of a ship in accordance with regulations 65 and 68a shall be located in rooms affording easy access from the sleeping quarters of the crew.”.

Hospital sanitary block.

43. Regulation 74of the Navigation (Crew Accommodation) Regulations is amended by omitting sub-regulations (1) and (2) and substituting the following sub-regulations:—

“ (1) A sanitary block comprising a bathroom and a water closet shall be provided for the exclusive use of patients in the hospital accommodation of a ship.

“ (2) The bathroom shall contain a shower and a wash basin.”.

Galleys.

44. Regulation 76 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting sub-regulation (3); and

(b) by adding at the end of sub-regulation (8) the words “, unless other suitable means for washing down are available ”.

Lighting of galleys.

45. Regulation 78 of the Navigation (Crew Accommodation) Regulations is repealed.

Ventilation of galleys.

46. Regulation 79 of the Navigation (Crew Accommodation) Regulations is amended—

(a) by omitting sub-regulation (1); and

(b) by omitting from sub-regulation (2) the words “ the Minister is satisfied that ”.

Cold storage rooms.

47. Regulation 81 of the Navigation (Crew Accommodation) Regulations is amended by omitting from sub-regulation (2) the words “ not exceeding five hundred tons ” and substituting the words “ of less than 500 tons ”.

49.Notwithstanding the amendments effected by these Regulations—

(a) an approval, authorization, certificate, determination, direction, exemption, licence, permit or requirement given, granted, made, issued or extended under the Navigation (Crew Accommodation) Regulations as in force immediately before the commencement of these Regulations shall, subject to the Navigation (Crew Accommodation) Regulations as amended by these Regulations, continue in force, subject to the conditions, if any, upon which, and for the balance of the period for which, it was given, granted, made, issued or extended as if it had been given, granted, made, issued or extended under the Navigation (Crew Accommodation) Regulations as so amended; and

(b) an application, return or notice made or given under the Navigation (Crew Accommodation) Regulations or a plan submitted to the

Minister for approval in accordance with regulation 11 of the Navigation (Crew Accommodation) Regulations
