NAVIGATION (COMPASS) REGULATIONS - REG 1
Citation

1. These Regulations may be cited as the Navigation (Compass) Regulations.*1* SEE NOTES TO FIRST ARTICLE OF THIS CHAPTER .

NAVIGATION (COMPASS) REGULATIONS - REG 2
Repeal

2. The Navigation (Compass) Regulations (being Statutory Rules 1927, No. 39, as amended by Statutory Rules 1929, No. 3; 1930, Nos. 16 and 106; and 1931, No. 24) are repealed.

NAVIGATION (COMPASS) REGULATIONS - REG 3
Interpretation

3. (1) In these Regulations, unless the contrary intention appears:
"adjuster of compasses" means a person holding a licence issued under regulation 12, being a licence that has not been cancelled;
"approved person", for the purposes of a regulation in which that expression occurs, means the Authority;
"the Act" means the Navigation Act 1912.


(2) Where a term used in these Regulations is defined in section 187A of the Act for the purposes of Part IV of the Act, that term shall, unless the contrary intention appears, have the same meaning in these Regulations as in that Part of the Act.


(3) A reference in these Regulations to a form by number shall be read as a reference to the form so numbered in Schedule 1.


(4) A reference in these Regulations to Marine Orders is a reference to orders made under the Navigation (Orders) Regulations as in force from time to time.

NAVIGATION (COMPASS) REGULATIONS - REG 4
Application

4. (1) Subject to subregulation (2), these Regulations apply to and in relation to:
(a) ships to which Part II of the Act applies; and
(b) ships surveyed in Australia for the issue of an Australian certificate of survey or equipment.


(2) These Regulations do not apply to or in relation to ships operating on the River Murray.

NAVIGATION (COMPASS) REGULATIONS - REG 7
Examination and adjustment of compasses

7. (1) The compasses of a ship undergoing its first survey to which these Regulations apply shall be examined and, where necessary, adjusted by an adjuster of compasses before the issue of a certificate of survey, a passenger certificate, a certificate of equipment, a passenger ship safety certificate or a cargo ship safety equipment certificate for the ship.


(2) Subject to subregulations (3), (4), (5) and (6), the compasses of a ship, not being a ship to which subregulation (1) applies, to which these Regulations apply shall be examined and, where necessary, adjusted by an adjuster of compasses before the ship first goes to sea from a port in Australia after:
(a) the ship has been laid up for a period of three months or more;
(b) the ship has been surveyed in accordance with the requirements of the Act and of Marine Orders, Part 21 (Equipment - Navigational), as in force from time to time, for the purpose of the issue or renewal of a certificate under Division 2 or Division 2B of Part IV of the Act, other than a cargo ship safety construction certificate, a cargo ship safety radiotelegraphy certificate or a cargo ship safety radiotelephony certificate;
(c) the ship, not being a ship registered in Australia, is licensed to engage in the coasting trade;
(d) the ship, a part of the ship or equipment on the ship has been overhauled, altered or repaired so as, in the opinion of a surveyor, to affect or be likely to affect the accuracy of the compasses of the ship; or
(e) the master of the ship has received a notice under subregulation (3).


(3) Where a surveyor has reasonable ground to believe that the compasses of a ship are or are likely to be unreliable, he shall give notice in writing accordingly to the master of the ship.


(4) Where the compasses of a ship would, but for this subregulation, be required to be examined and, where necessary, adjusted by an adjuster of compasses before the ship first goes to sea from a port in Australia after an event referred to in paragraph (a), (b) or (c) of subregulation (2) and the Authority is satisfied, after report to him by a surveyor, that further adjustment of the compasses of the ship after that event is unnecessary, he may, by writing under his hand, subject to such conditions as he thinks fit, exempt the ship from the requirements of that subregulation in relation to that event.


(5) Where:
(a) the compasses of a ship would, but for this subregulation, be required to be examined and, where necessary, adjusted by an adjuster of compasses before the ship first goes to sea from a port in Australia after an event referred to in paragraph (b) of subregulation (2); and
(b) the surveyor is satisfied from evidence produced by the master of the ship that the compasses of the ship have been properly examined and adjusted during the period of fifteen months immediately preceding the date on which the ship was so surveyed;
the ship is exempt from the requirements of subregulation (2) in relation to that event.


(6) Where the compasses of a ship, not being a ship registered in Australia, would, but for this subregulation, be required to be examined and, where necessary, adjusted by an adjuster of compasses before the ship first goes to sea from a port in Australia after the ship is licensed to engage in the coasting trade and the compasses of the ship have been adjusted for the Southern Hemisphere before the ship is so licensed, the ship is exempt from the requirements of subregulation (2) in relation to that event.

NAVIGATION (COMPASS) REGULATIONS - REG 10
Adjustment tables and compass certificate

10. (1) On completion of the examination and adjustment of a ship's compasses in accordance with these Regulations, the adjuster of compasses shall immediately forward to an approved person a table of deviations and declaration, in accordance with Form C4, together with a statement of the magnets and soft-iron correctors, with their sizes and positions, used in adjustment.


(2) Where an approved person is satisfied that the ship's compasses have been satisfactorily adjusted, and the deviations ascertained, he shall issue a compass certificate for the ship in accordance with Form C5:
Provided that when, after adjustment, the deviation of the standard compass exceeds 5for any particular compass heading, an approved person shall not issue a compass certificate without the approval of the Authority.

NAVIGATION (COMPASS) REGULATIONS - REG 11
Compass-error register book

11. (1) The master of every ship over 100 tons gross registered tonnage, and to which these Regulations apply, shall keep a compass-error register book, substantially in accordance with Form C6, in which shall be accurately recorded particulars of observations taken, the approximate position of the ship at the time, the different points of the vessel's head and the deviations and errors of the standard compass on those points; also the size and position of the magnets and soft-iron correctors for the standard compass, and the date and nature of any changes at any time made in them or their positions.


(2) Observations for the purpose of ascertaining compass-errors shall be made and recorded as frequently as practicable.


(3) The compass-error register book shall be produced to a surveyor on demand.

NAVIGATION (COMPASS) REGULATIONS - REG 12
Issue of licences to compass adjusters

12. (1) Subject to regulation 14, an approved person may issue a licence in accordance with Form C7 to:
(a) an applicant who holds:
(i) a certificate as Extra Master Class 1 issued under orders
made in pursuance of regulations made under the Act; or
(ii) a certificate recognized for the purposes of the Act as
equivalent to such a certificate;
(b) an applicant who holds:
(i) a certificate as Master Class 1 issued under orders made in
pursuance of regulations made under the Act; or
(ii) a certificate recognized for the purposes of the Act as
equivalent to such a certificate;
and has passed:
(iii) the examination the syllabus and conditions of which are
prescribed by Schedule 2; or
(iv) an examination that is certified by the Authority to be
equivalent to that examination; or
(c) an applicant who possesses any other qualifications and experience that are certified by the Authority as qualifying him to perform the duties of an adjuster of compasses.


(2) A person shall not act as an adjuster of compasses unless he is licensed in accordance with this regulation.

NAVIGATION (COMPASS) REGULATIONS - REG 12A
Examination Fee

12A. A candidate for the examination prescribed by Schedule 2 is not eligible to sit for that examination unless he has paid to the Commonwealth a fee of $191 in respect of that examination.

NAVIGATION (COMPASS) REGULATIONS - REG 13
Cancellation of licence

13. (1) The Authority may at any time cancel any licence issued to an adjuster of compasses.


(1A) The Authority shall not, under subregulation (1), cancel a licence issued to an adjuster of compasses unless it is satisfied that the adjuster is not competent to perform the duties of an adjuster of compasses for the purposes of these Regulations.


(2) A copy of the order, stating the cause of cancellation, shall be delivered to the adjuster of compasses or transmitted by registered post to his last-known address in Australia.


(3) An adjuster of compasses whose licence is cancelled under subregulation (1) shall forthwith deliver up the licence to an approved person.


(4) An adjuster of compasses may appeal to a Court of Marine Inquiry as provided by subsection 356 (2) of the Act against the order.

NAVIGATION (COMPASS) REGULATIONS - REG 14
Application for licence

14. (1) An application for a licence under subregulation 12 (1) shall be in accordance with Form C8.


(2) An applicant shall not be granted a licence under subregulation 12 (1) unless his application is accompanied by satisfactory evidence of the applicant's good conduct and character during the period of 12 months immediately preceding the date of his application and, in the case of an applicant referred to in paragraph 12 (1) (a) or (b):
(a) the certificate referred to in that paragraph; and
(b) unless, at any time during the 3 years immediately preceding the date of his application, the applicant held a licence as adjuster of compasses issued under these Regulations:
(i) deviation cards for at least 12 ships, the compasses of which
the applicant has, while holding the qualifications specified in paragraph 12 (1) (a) or (b), assisted in adjusting during the 3 years immediately preceding the date of his application, showing in each case the position of the correctors and endorsed by the adjuster, over the adjuster's signature, to the effect that the applicant assisted in the adjustments; or
(ii) satisfactory evidence that the applicant has, while holding
the qualifications specified in paragraph 12 (1) (a) or (b), practised as a compass adjuster in a Commonwealth country and adjusted the compasses of at least 12 ships during the 3 years immediately preceding the date of his application.

NAVIGATION (COMPASS) REGULATIONS - REG 17
Fees for adjustment of compasses

17. (1) In this regulation:
"office of the Authority", in relation to services in examining, or examining and adjusting, the compasses of a ship, means the office of the Authority, or of the representative of the Authority, at the place where the services are, or are to be, performed;
"services" means services in examining, or examining and adjusting, for the purposes of these Regulations, all the compasses that a ship is provided with in accordance with these Regulations.


(1A) A reference in this regulation to an adjuster of compasses shall be read as a reference to an adjuster of compasses who holds an office in the Authority.


(2) Where an adjuster of compasses performs his services, a fee is payable determined, according to the gross registered tonnage of the ship, in accordance with the following table:

(3) Where, as a result of a request made by the owner, builder, master or agent of a ship, the services of an adjuster of compasses are performed during a period when the office of the Authority is not open for public business, there is payable by virtue of this subregulation, in addition to any other fee payable:
(a) in a case in which such services by the adjuster of compasses during such a period immediately precede, or immediately follow, services by the adjuster of compasses in relation to that ship at a time when the office of the Authority is open for public business - a fee calculated at the rate of $38 for each whole hour or part of an hour falling within that period during which the adjuster of compasses performs those services; or
(b) in any other case - a fee calculated at the rate of $38 for each whole hour or part of an hour falling within that period during which the adjuster of compasses so performs those services, or a fee of $114, whichever is the greater.


(4) Where, as a result of a request made by the owner, agent or master of a ship, an adjuster of compasses is required to attend at a time and place for the purposes of examining, or examining and adjusting, the compasses of the ship (being a time when the office of the Authority is not open for public business) and sets out to commence the examination but the proposed examination does not commence because the owner, agent or master cancels the request, there is payable, in respect of the cancellation, a fee of $118.


(5) Where:
(a) an adjuster of compasses is available at the time and place appointed for the performance of services in relation to a ship and is, for any reason outside his control, compelled to wait for a period in excess of half an hour after that time before he can commence the performance of those services;
(b) an adjuster of compasses is performing services in relation to a ship and, for any reason outside his control, the services are interrupted and he is compelled to wait for a period in excess of half an hour before he can continue those services; or
(c) an adjuster of compasses performing services in relation to a ship is compelled, for any reason outside his control, to wait on the ship after the completion of those services for a period in excess of half an hour;
a fee calculated at the rate of $110 for each whole hour, or part of an hour, of the excess is payable by virtue of this subregulation in respect of those services.


(6) Where, as a result of a request made by the owner, agent or master of a ship, an adjuster of compasses inspects any of the compasses of the ship, otherwise than in the course of examining, or examining and adjusting, for the purposes of these Regulations, all the compasses that the ship is provided with in accordance with these Regulations, there is payable, by the person requesting the inspection, a fee of $183 in respect of that inspection.


(7) Where, as a result of a request made by the owner, agent or master of a ship, an adjuster of compasses attends on the ship for the purpose of performing services in relation to a ship, there is payable, by virtue of this subregulation:
(a) if the services are performed within the limits of a port at which he or another adjuster of compasses is ordinarily stationed - a fee equal to the amount of any travelling expenses necessarily incurred by the adjuster in proceeding to and from the ship for the purpose of performing those services; or


(b) in any other case - a fee equal to the travelling and subsistence expenses which would have been necessarily incurred if the adjuster had travelled from the nearest port or out-port at which an adjuster is stationed to and from the ship for the purpose of performing those services.


(8) The fact that a fee is, by virtue of a particular subregulation of this regulation, payable in respect of services shall not be taken to prevent a further fee, or further fees, being payable in respect of those services by virtue of another subregulation, or other subregulations, of this regulation.


(9) Where a fee payable under this regulation in relation to the services of an adjuster of compasses is not paid, the amount of the fee is recoverable from the person who requested those services as a debt due to Australia.

NAVIGATION (COMPASS) REGULATIONS - REG 21
Forms

(2) Where a form contains, by way of note or otherwise, a clear direction or indication of any requirement as to the nature of the information to be furnished or the action, either by way of signing a form of declaration or otherwise, to be taken by the person concerned in the transaction in which the document is used, the requirement so directed or indicated shall be deemed to be prescribed by these Regulations.

Penalties

22. Any contravention of these Regulations for which no other penalty is provided shall be punishable on conviction by a fine not exceeding One hundred dollars.

SCHEDULE 2 Regulation 12
COMPASS DEVIATION EXAMINATION
Candidates shall be examined in the following syllabus by an examiner
appointed under orders made in pursuance of regulations made under the Act.
In order to qualify for a pass, a candidate must obtain not less than 70%
of the total marks allotted to the written section of the examination and
not less than 50% of the marks allotted to each paper; and must satisfy the

WRITTEN SECTION
1. Magnetism and Compass Compensation - one 3-hour paper
(a) Magnetism
(i) Magnetic properties of materials, induction, susceptibility and
permeability. Magnetic effects of electric currents, including
calculations.
(ii) Terrestrial magnetism. Dip, total force, horizontal force and
vertical force. Effects on the deviation of the compass accompanying change
in the values of these elements. Variation.
(iii) Ship's magnetism. Hard and soft iron. Permanent, sub-permanent
and induced magnetism. Components P, Q, R; the rods a, b, c, d, e, f, g, h,
k. The approximate coefficients A, B, C, D, E, and the causes of sextantal
and octantal deviations.
(iv) Heeling error, Lambda, Lambda two and Mu.
(b) Compass Compensation
(i) General principles of compass correction. Methods of finding, and
compensating a compass for, the various components which might cause
deviation, including the effects of heel and trim.
(ii) Compensation by use of the Kelvin deflector. Principle of the
deflector method and information which can be deduced from readings
obtained.
(iii) The siting and lining up of compasses with due regard to the
proximity of magnetic material, electrical devices and other disturbing
influences.
(iv) The theory of degaussing in ships fitted with M coils and compass
compensation by means of B and heeling error coils.
(v)Swinging ship and the analysis of a deviation table. Analysis of a
deviation book of a foreign-going ship to determine causes of irregular
deviations, and suggest measures for their removal.
2. Compass Design and Electricity - one 3-hour paper
(a) Compass Design
(i) Size and relative position of compass needle.
(ii) Location of soft-iron correctors, and permanent magnets, with
reference to each other and to the compass needles with due regard to
standard binnacles of all types, overhead compasses, and pole compasses,
and the probable effects if conventional limits are not complied with.
(iii) Relative position of lubber line, card, pivot, and gimbal axes.
(iv) Types of quadrantal correctors; their advantages and
disadvantages.
(v) Detection of errors in instruments.
(b) Electricity
(i) Electrical currents and their production. Simple cells of the
primary and secondary types, including the effects of polarization.
(ii) Electromotive force, resistance and current.
(iii) Ohm's law. Kirchhoff's law. Lenz's law. Faraday's law.
(iv) Solenoids and electro-magnets. The effects of magnetic fields of
all descriptions on the compass needle.
(v) Elementary principles of dynamos and motors.
(vi) Electric lighting and cluster lights.
ORAL AND PRACTICAL SECTION
1. Compensation and adjustment of compasses. Demonstrations on Beall's
compass deviascope or instructional binnacle.
2. Answer any questions based on the syllabus for this examination.
