An Act to amend the Navigation Act, 1901, in consequence of the enactment of the Commercial Vessels Act, 1979. [Assented to, 6th July, 1982,]

Navigation (Commercial Vessels) Amendment.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the "Navigation (Commercial Vessels) Amendment Act, 1979".

(1) (a) Section 1 —

From the matter relating to Division 2 of Part II, omit the matter relating to Divisions 1, 2 and 3.

(b) Section 1—

From the matter relating to Part IV, omit the matter relating to Divisions 1, 2, 3 and 5.

(c) Section 1-

From the matter relating to Division 4 of Part IV, omit "ss. 47-52", insert instead "s. 50".

(d) Section 1-

From the matter relating to Part VII, omit the matter relating to Divisions 2, 2A and 5.

(2) Section 3, definition of "surveyor"—

After the definition of "Superintendent", insert:—

"surveyor" has the same meaning as it has in the

Commercial Vessels Act, 1979;

(3) Section 17—

Omit the section.

(4) (a) Section 20—

Omit "and surveyor".

(b) Section 20—

After "Act" where firstly occurring, insert ", and every
surveyor".

(5) Part IV, Division 1, short heading—

Omit the short heading.

(6) Part IV, Divisions 2, 3 and 5—

Omit the Divisions.

(7) Sections 47, 48, 49—

Omit the sections.

(8) (a) Section 50—

Omit "or has received any material damage affecting her seaworthiness or efficiency either in her hull or in any part of her machinery,".

(b) Section 50—

Omit "or damage".

(9) Sections 51, 52—

Omit the sections.

(10) Part VII, Division 2—

Omit the Division and the short heading thereto.

(11) Part VII, Division 2 A — Omit the Division.

(12) Part VII, Division 5—

Omit the Division.

(13) (a) Section 118 (a )—

Omit "appointed under this Act".

(b) Section 118 (b) —

Omit "if any such surveyor, or person,", insert instead "if a surveyor or a person the subject of a direction under paragraph (a)".

(c) Section 118 (c)—

Omit "one of the said surveyors, or persons appointed by the Superintendent as aforesaid", insert instead "a surveyor or a person the subject of a direction under paragraph (a)".

(14) Section 131—

Omit the section.

(15) Second, Sixth Schedules—

Omit the Schedules.
