Navigation (Coasting Trade) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Navigation Act 1912.

1.   Amendment

1.1   The Navigation (Coasting Trade) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act  1901, s 48.]

2.   Regulation 4 (Interpretation)

2.1   Subregulation 4 (1) (definition of “authorized officer”):

Omit “Department of Transport”, substitute “Department of Workplace Relations and Small Business”.

2.2   Subregulation 4 (1) (definition of “the Secretary”):

Omit “Department of Transport.”, substitute “Department of Workplace Relations and Small Business.”.

3.   Regulation 25 (Permits to unlicensed ships to engage in coasting trade)

3.1   Subparagraph 25 (2) (c) (ii):

Omit “—to the Secretary, Department of Transport, Canberra.”, substitute “—to the Secretary, Department of Workplace Relations and Small Business, Canberra.”.

3.2   Subregulation 25 (4):

Omit the subregulation, substitute:

 “(4)A person who makes an application under subregulation (1) must pay the fee prescribed for the application.

 “(4A) The fee for an application may be paid:

  • (a)

    before the application is lodged; or

  • (b)

    at the time the application is lodged; or

  • (c)

    after the application is lodged.

(4B)An amount that a person is liable to pay under subregulation (4) is recoverable as a debt due to the Commonwealth.”.

3.3   Subparagraph 25 (5) (b) (i):

Omit “$403”, substitute “$200”.

3.4   Subparagraph 25 (5) (b) (ii):

Omit “$806”, substitute “$400”.

3.5   Paragraph 25 (5) (c):

Omit “$2,000”, substitute “$400”.

4.   The First Schedule

4.1   Form 3:

Omit “Minister for Transport” (twice occurring), substitute “Minister for Workplace Relations and Small Business”.

4.2   Form 4:

Omit “Delegate of the Minister for Transport”, substitute “Delegate of the Minister for Workplace Relations and Small Business”.

4.3   Form 7:

Omit “Delegate of the Minister for Transport”, substitute “Delegate of the Minister for Workplace Relations and Small Business”.
