Navigation (Cargo-Hazards Prevention) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

Commencement

1. These Regulations shall come into operation on I October 1986.

Fees

2. Regulation 8 of the Navigation (Cargo-Hazards Prevention) Regulations is amended—

(a) by omitting from sub-regulation (1) "$86" and substituting "$112";

(b) by omitting sub-regulation (2) and substituting the following sub-regulation:

"(2) Where, as a result of a request made by the owner, builder, master or agent of a ship, a surveyor engages in inspection of the ship when the office of the Department is not open for public

business, there is payable by virtue of this sub-regulation, in addition to any other fee payable—

(a) in a case in which such inspection by the surveyor during such a period immediately precedes, or immediately follows, inspection by the surveyor of that ship at a time when the office of the Department is open for public business—a fee calculated at the rate of $35 for each whole hour or part of an hour falling within that period during which the surveyor so engages in inspection; or

(b) in any other case—a fee calculated at the rate of $35 for each whole hour or part of an hour falling within that period during which the surveyor so engages in inspection, or a fee of $105, whichever is the greater.";

(c) by omitting from sub-regulation (3) all the words after "is payable," and substituting "in respect of the cancellation, a fee of $108."; and

(d) by omitting from sub-regulation (5) all the words after "the rate of" and substituting "$70 for each whole hour, or part of an hour, of the excess is payable by virtue of this sub-regulation in respect of that inspection.".
