Assented to 21 March 2005

The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Navigation Amendment Act 2005.

2 Commencement

(1)Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendment of the Navigation Act 1912

1After subsection 258(3)

Insert:

(4)An offence against the regulations made by virtue of this section is an indictable offence.

2Subsections 258(5) and (6)

Repeal the subsections.

3Subsection 258A(1)

Omit (1).

4Subsection 258A(1) (penalty)

Repeal the penalty, substitute:

Penalty:Imprisonment for 4 years.

5Subsection 264(2)

Omit a fine not exceeding $20,000 or imprisonment for a period not exceeding 10 years, or both, substitute imprisonment for a period not exceeding 10 years.

6Subsection 265(1) (penalty)

Repeal the penalty, substitute:

Penalty:Imprisonment for 4 years.

7Subsection 265(2) (penalty)

Repeal the penalty, substitute:

Penalty:Imprisonment for 10 years.

8Subsection 265(6) (penalty)

Repeal the penalty, substitute:

Penalty:50 penalty units.
