NAVIGABLE WATERS AMENDMENT REGULATIONS 1992

Citation

1.     These regulations may be cited as the Navigable Waters Amendment

Regulations 1992.

Commencement

2.      These regulations shall come into operation on 1 July 1992.

Principal regulations

3.     In these regulations the Navigable Waters Regulations* are referred to

as the principal regulations.

Regulation 45B amended

4. Regulation 45B of the principal regulations is amended -

(a) in subregulation (1) by deleting paragraph (b) and substituting the following. _ ph -

(b) the current boat registration label for the vessel the registration number required by subregulation (7), in a manner which makes it clearly visible.

is fixed to the port side of the vessel, next to

and

(b) vessel which identification plate shall include the registration in subregulation (6) (b) by deleting "an identification plate for the

number allotted by the department for the vessel at the time when the vessel was first registered." and substituting the following -

a boat registration label

Regulation 45BAA amended

5. Regulation 45BAA of the principal regulations is amended -

(a) the following paragraph - in subregulation (5) by deleting paragraph (a) and substituting

(a) a boat registration label;

and

(b) card and the certificate of registration referred to in in subregulation (6) by deleting "unless both the identification
following - required for identification of the vessel." and substituting the subregulation (5) are carried upon the vessel and displayed when

unless -

(a)

the current boat registration label for the vessel is fixed to the port side of the vessel in a manner and position which makes it clearly visible; and

(b)

the certificate of registration referred to in subregulation (5) is carried upon the

vessel. ".
Regulation 45D amended

6. Regulation 45D of the principal regulations is amended -

(a) in subregulation (1) (a) -

(i)     by deleting "any members" and substituting the following -

a member "; and

(ii)     by deleting "or identification card"; and

(b) in subregulation (2) -

(i) by deleting ", an identification plate or identification card"
and substituting the following -

or a boat registration label "; and

(ii) by deleting ", identification plate or identification card" and

substituting the following —

or a replacement boat registration label

Regulation 45E amended

7.     Regulation 45E (1) (a) of the principal regulations is amended by

deleting "and the identification plate or identification card".

Regulation 46 amended

8.      Regulation 46 (1) of the principal regulations is amended

(a) by deleting "vessel within the meaning of section 205 of the

Western Australian Marine Act 1948" and substituting the

following —

it

"pleasure vessel" within the meaning of section 98 (1) of the Western Australian Marine Act 1982

and

(b)

by deleting "and the word "ownership" shall be construed accordingly".

Transitional

9. (1) Notwithstanding regulations 4 and 6 of these regulations, regulations 45B and 45D of the principal regulations, as they were immediately before the commencement of these regulations, continue to apply in relation to a vessel registered with the department in the year ending 30 June 1992, until that vessel's registration expires or is renewed.

(2) Notwithstanding regulation 5 of these regulations, regulation 45BAA of the principal regulations, as it was immediately before the commencement of these regulations, continues to apply in relation to a foreign pleasure vessel registered with the department in the year ending 30 June 1992, until that foreign pleasure vessel's registration expires or is renewed.
