REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of, Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1934.

Amendments of the Naval Volunteer Reserve Regulations. 

1. Regulation 3 of the Naval Volunteer Reserve Regulations is repealed and the following regulation inserted in its stead:—

Definitions.

“3. In these Regulations, unless the contrary intention appears—

‘authorized depot’ means, in relation to any member, the Naval Reserve Depot approved by the Naval Board as the member’s home depot;

‘boat-owner’ means a member of the Naval Auxiliary Patrol, who has loaned his boat to the Commonwealth and has executed the agreement authorized by the Naval Board relating thereto;

‘Director’ ‘means the officer appointed by the Naval Board to be Director of Naval Reserves and Naval Reserves Mobilization;

‘District Naval Officer’ means the officer appointed to command any State Division of the Naval Forces;

‘full-time service’ means the service of a member of the Naval Auxiliary Patrol, when called out pursuant to a proclamation under section 46 of the Defence Act 1903–1941 and directed to perform continuous full-time war service for the duration of the war;

‘member’ means a member of the Royal Australian Naval Volunteer Reserve;

‘men’ includes all members other than officers;

‘Naval Auxiliary Patrol’ means the Naval Auxiliary Patrol, constituted under these Regulations;

‘non-boat-owner’ means a member of the Naval Auxiliary Patrol, who has not loaned a boat to the Commonwealth.

‘State Squadron’ means the total personnel comprised in the Naval Auxiliary Patrol in the State.

2. After regulation 44 of the Naval Volunteer Reserve Regulations, the following heading and regulation are added:—

Naval Auxiliary Patrol.

45.—(1) In time of war, there shall be a Naval Auxiliary Patrol which shall constitute a section of the Naval Volunteer Reserve and shall consist of persons enlisted in the Naval Volunteer Reserve for service in the Naval Auxiliary Patrol.

(2) The preceding provisions of these Regulations shall, except insofar as they are inconsistent with the provisions of this regulation, apply to and in relation to the Naval Auxiliary Patrol and the members thereof.

(3) Unless ordered to do so by a superior Naval Officer, members of the Naval Auxiliary Patrol shall not assume any Naval command or authority except over other members of the Naval Auxiliary Patrol.

(4) Members of the Naval Auxiliary Patrol shall in all respects (except for the purpose of Departmental records, pay or allowances) be known by their Naval Auxiliary Patrol rank or rating and shall hold relative rank or rating as specified in the following table:—

(5) (a)A non-boat-owner shall be entered in the rating of Cadet, unless he possesses special qualifications, in which case the Naval Board may appoint him to any rank or rating.

(b) A boat-owner on entry may be appointed to such rank or rating as the Naval Board determines.

(c) Promotion and advancement to a higher rank or rating shall be in accordance with such conditions as the Naval Board determines.

(6) (a)A member of the Naval Auxiliary Patrol shall wear, when on duty, such articles of uniform as the Naval Board directs.

(b) A member of the Naval Auxiliary Patrol who has not been directed to perform full-time service shall provide at his own expense such articles of uniform as the Naval Board directs, with the exception of the Cap Badge which shall be supplied at the expense of the Commonwealth.

(c) A member of the Naval Auxiliary Patrol who has been directed to perform full-time service shall—

(i) be paid an outfit gratuity of Twenty pounds towards the cost of uniform referred to in paragraph (a) of this sub-regulation, and

(ii) if a rating be supplied, at the expense of the Commonwealth, on mobilization. with such additional articles of uniform as the Naval Board determines, and be credited with a kit upkeep allowance of 6d. per day.

(7) Each State Squadron of the Naval Auxiliary Patrol may be credited in each financial year with such allowance, not exceeding ten shillings for each member upon the strength of the State Squadron at the 30th April of each year, as the Naval Board determines.”.
