REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations, under the Naval Defence Act 1910-1918, to come into operation forthwith.

Amendment of Naval Reserve Regulations.

(Statutory Rules 1926, No. 199, as amended to present date.)

(Third Amendment.)

1. Regulation 167 is repealed and the following regulation is inserted in its stead:—

“167. A member of the Naval Reserve called up by Proclamation in time of war or emergency shall receive the ‘on promotion’ rates of pay and allowanced of his corresponding rank or rating in the Permanent Naval Forces (Sea-going): provided that actual mobilized service during war or emergency in a confirmed rank shall count for increase of pay in that rank. Progressive pay shall, in every other case, accrue for service on Sea-going rates of pay only.”

2. Regulation 176 is repealed and the following regulation is inserted in its stead:—

“176. (1) In addition to the retaining fee payable under regulation 174, a District or Sub-District Naval Medical Officer shall be entitled to receive fees for duties performed as shown hereunder:—

(a) Medical examination of candidates for commissions in the Permanent Naval Forces and Citizen Naval Forces.........................................................

(b)Medical or physical examination of recruits for, or for re-engagement in, the Permanent Naval Forces (including Auxiliary Services) and of trainees who are applying for leave of absence or exemption on medical grounds.

(c) Medical examination of recruits for the Citizen Naval Forces, or boys liable for training as Senior Naval Cadets, of members of the Royal Australian Fleet Reserve prior to commencement of drill, and of members of the Auxiliary Services with a view to dental treatment...................................

(d) Medical attendance on members of the Auxiliary Services, members of the Permanent Naval Forces left behind from one of H.M.A. Ships, or sick on leave, members of the R.A.N.R. or members of the crew of a vessel under the control of the Department. Each visit to or from patient............................

(e) Attendance on board H.M.A. Ships, or on board a vessel under the control of the Department.............................................................................

(f)Making arrangements for admission of a patient to hospital and visiting the patient in hospital and making report, per case.........................................

(h)Attendance on Medical Boards and Surveys, and Examination for rating or advancement of the Sick Berth Staff.........................................

(i) Examination or attendance at examination in time of war or national emergency of—

(i) Ranks and ratings of any Naval Reserve Force about to be called out for service;

(ii) Persons about to be enlisted in any Naval Reserve Force; and

(iii) Ranks and ratings while still serving but about to be demobilised or discharged for reasons other than sickness or injury:

Per candidate (provided that the payment in respect on any one day shall not exceed the maximum of 40s.)..................................................................

(j)Attendance at Continuous Training ashore, target or rifle practice, and on other occasions as required—

(2) In special cases not included in the above, the remuneration shall be determined by the Naval Board according to the special circumstances of the case.

(3) Fees payable under the above schedule of charges include the work of rendering any official report made in connexion with such medical attendance or examination and shall be paid monthly.

 

(4) Where, in the opinion of the Director of Naval Medical Services, a District or Sub-District Naval Medical Officer has shown either negligence in carrying out an examination or a careless disregard of the Instructions laid down for the Medical Examination of Recruits for the Royal Australian Navy, the Naval Board may approve of the withholding of the fee for the service prescribed in sub-regulation (1).”
