REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

Naval Reserve (National Service) Regulations.

Citation.

1. These Regulations may be cited as the Naval Reserve (National Service) Regulations.

Definition.

2. In these Regulations “November” means a member of the Royal Australian Naval Reserve (National Service).

Service to be rendered in the Royal Australian Naval Reserve (National Service).

3. Persons who are, in accordance with the National Service Act 1951-1953, deemed to have been enlisted in the Citizen Naval Forces shall render the service which they are required to render under that Act in the part of the Citizen Naval Forces known as the Royal Australian Naval Reserve (National Service).

General conditions of service.

4. The conditions of service under which members of the Royal Australian Naval Reserve render service in that Reserve are, subject to these Regulations, the conditions of service of members of the Royal Australian Naval Reserve (National Service).

Liability to serve in any branch.

5. A member shall be liable to serve in any branch of the Royal Australian Naval Reserve (National Service) and shall undergo training in the branch to which he is allotted.

Training of members.

6.—(1.) Subject to this regulation, the service to be rendered by a member under the National Service Act 1951-1953 is—

(a) full-time continuous service in a ship or naval establishment for a period of one hundred and fifty-four days; and

(b)training for a total period of twenty-two days as determined by the Naval Board.

(2.) A member—

(a) who is a student at a university; or

(b) who is apprenticed in a trade and is attending a technical college,

may, with the approval of the Naval Board, render full-time continuous service in two periods each of seventy-seven days.

(3.)Where a member has, before the commencement of these Regulations, rendered full-time service in a ship or naval establishment for a period of, or periods totalling, less than one hundred and fifty-four days, the member shall render further full-time service for the number of days by which the period or the total of the periods is less than one hundred and fifty-four days.

Reporting for further service.

7. A member who is required to render further service shall report for that service as and when directed by the Commanding Officer of the ship or naval establishment to which he is attached.

Administration of Royal Australian Naval Reserve (National Service).

8. The Director of Naval Reserves shall be responsible to the Naval Board for the administration and control of all matters relating to the Royal Australian Naval Reserve (National Service) other than matters of finance and stores.

Port Divisions.

9. The Port Divisions of the Royal Australian Naval Reserve (National Service) shall be the same as those of the Royal Australian Naval Reserve.

Uniforms.

10. The uniforms and badges to be worn by members shall be the same as those worn by members of the Royal Australian Naval Reserve with the addition of a distinguishing badge embodying the letters “R.A.N.R. (N.S.)” which shall be worn by members on the left sleeve two inches above the cuff.

Supply of uniforms.

11.—(1.) Members shall be supplied free of charge with such articles of uniform as the Naval Board approves.

(2.) Articles of uniform so supplied shall remain the property of the Commonwealth and a member shall be responsible for the safe custody and preservation of the articles of uniform which are supplied to him.

(3.) The cost of replacing or repairing an article of uniform which is lost or damaged as a result of the neglect of the member to whom it was supplied shall be paid, subject to an allowance for fair wear and tear of the article since it was supplied to him, by the member.

Members may retain uniforms.

12. A member who completes the service which he is required to render under the National Service Act 1951-1953 shall retain in his possession such articles of uniform as the Naval Board determines.

Uniforms when called out for war service.

13. If the Citizen Naval Forces are called out for war service by proclamation under section 46 of the Defence Act 1903-1953, a member shall, when reporting for duty, bring with him the articles of uniform referred to in the last preceding regulation.

Members to be borne on books.

14. For the purposes of discipline, a member shall, while serving in a ship or naval establishment, be borne on the books of that ship or naval establishment.

Notice of change of address.

15. A member shall, within seven days of changing his place of living, notify the Commanding Officer of the Port Division to which he is attached of that change.

Penalty: Twenty Pounds.

Pay.

16.—(1.) The rate of pay of a member during the period he renders the service referred to in regulation 6 of these Regulations is the rate of pay of a Recruit (Seaman) of the Seaman Branch of the Permanent Naval Forces.

(2.) Subject to the next succeeding sub-regulation, of the amount payable to a member who is not married, payment of the sum of Five shillings for each day on which the member renders service shall be deferred until the member has completed the period of full-time service which he is rendering or until he is discharged from rendering service.

(3.) Where the Commanding Officer of a ship or naval establishment to which a member is attached considers special circumstances exist in relation to the member, he may direct that the sum, of which payment to that member is to be deferred under the last preceding sub-regulation, be reduced to such lesser amount as he thinks reasonable.

Allowances.

17.—(1.) Marriage allowance and separation allowance at the respective rates at which those allowances are payable to members of the Permanent Naval Forces are payable to members while rendering the service referred to in regulation 6 of these Regulations subject to the conditions under which those allowances are payable to members of the Permanent Naval Forces.

(2.) A member shall not be credited with uniform allowance.
