3. In these Regulations, unless the contrary intention appears -
"member" means a women appointed to or enlisted in a Women's
Service;
"officer" means any member other than an enlisted member;
"servicewoman" means an enlisted member;
"the Act" means the Naval Defence Act 1910-1968;
"Women's Service" means one of the Services specified in
regulation

3A. (1) The Chief of Naval Staff may, by instrument in writing signed by him, delegate to an officer who holds a rank in the Australian Navy not below the rank of Commander any of his powers or functions under these Regulations, other than this power of delegation. (2) A delegation under sub-regulation (1) shall be revocable at will and no delegation shall prevent the exercise of any power or function by the Chief of Naval Staff

Establishment of Women's ServicesSubstituted by 1968 No. 72 r. 3
4. (1) There shall be parts of the Permanent Naval Forces to be known as -
(a) the Royal Australian Naval Nursing Service; and
(b) the Women's Royal Australian Naval Service, respectively.(2) There shall be a part of the Citizen Naval Forces to be known as the Women's Royal Australian Naval Service Reserve.

(3) A male person is not eligible to be appointed to or enlisted in, and a male member of the Navy is not eligible to be transferred to, the Royal Australian Naval Nursing Service, the Women's Royal Australian Naval Service or the Women's Royal Australian Naval Service Reserve.

14. A woman shall be eligible for appointment to, or enlistment in, the Women's Royal Australian Naval Service, if she has -
(a) attained the age of 17 years, but has not attained the age of 40
years; and
(b) passed such medical examination as is approved by the Chief of
Naval Staff:Provided that a woman who has attained the age of 40 years, but has not attained the age of 50 years, may be appointed to, or enlisted in, the Women's Royal Australian Naval Service, if the Chief of Naval Staff certifies that she has special qualifications or that he considers that special circumstances warrant her appointment or enlistment.

15. (1) For the purposes of sub-section 25 (1) of the Act, the prescribed period in relation to service in the Women's Royal Australian Naval Service is a period of 4 or 6 years. Amended by 1976 No. 38 r. 3

Promotion and advancementSub-reg. (1) amended by 1976 No. 38 r. 3
19. (1) An officer of the Women's Royal Australian Naval Service may be promoted to a higher rank, if she is recommended for promotion by the Chief of Naval Staff and a vacancy in that rank exists in the authorized establishment. Amended by 1976 No. 38 r. 3
(2) The Chief of Naval Staff may promote any servicewoman enlisted in the Women's Royal Australian Naval Service to a higher rank, if she is recommended for promotion by her Commanding Officer, or possesses special qualifications for promotion to that rank, and a vacancy in that rank exists in the authorized establishment.

20. (1) The Chief of Naval Staff, the Chief of Naval Personnel, the Director-General of Navy Manpower and the Director-General of Navy Personnel Services are each, in respect of a servicewoman enlisted in the Women's Royal Australian Naval Service, an authority for the purposes of section 30 of the Act. (2) The commanding officer of a naval establishment is an authority for the purposes of section 30 of the Act in the case of a servicewoman under his command.

(3) A commanding officer who is an authority for the purposes of section 30 of the Act by virtue of sub-regulation (2) shall not discharge a servicewoman -
(a) in the case of a servicewoman who holds a rank of Recruit
Wran - for any reason other than the reason referred to in
paragraph
20AA (1) (a) or (c); or
(b) in the case of a servicewoman who holds a rank other than the
rank of Recruit Wran - for any reason other than the reason
referred
to in paragraph 20AA (1) (e).
NAVAL FORCES (WOMEN'S SERVICES) REGULATIONS - REG 20AA

20AA. (1) For the purpose of section 30 of the Act, each of the following reasons is a reason for the discharge of a servicewoman of the Women's Royal Australian Naval Service: (a) that the servicewoman has requested her discharge;
(b) that the servicewoman will, upon being discharged, be
appointed an officer of the Navy;
(c) that the servicewoman cannot be usefully employed in the Navy
because of retrenchment in the Navy;
(d) that the servicewoman is medically unfit;
(e) that an authority specified in regulation 20 is satisfied that the
retention of the servicewoman in the Navy is not in the interest
of the Navy;
(f) that the servicewoman made a false or misleading statement in
connexion with her enlistment in the Navy;
(g) that the servicewoman has not attained the age of 18 years and
her parent or guardian has requested her discharge; and
(h) that the servicewoman has been absent without leave for a
period exceeding 3 months.(2) In this regulation, "medically unfit", in relation to a servicewoman, means physically or mentally incapacitated for the performance of her duty.

21. An officer of the Permanent Naval Forces shall not be transferred to the Women's Royal Australian Naval Service Reserve unless -
(a) she volunteers for service in the Women's Royal Australian
Naval Service Reserve;
(b) she is an officer of the Women's Royal Australian Naval Service
who has had not less than one year's service as such an officer;
and
(c) she has not attained the age of 45 years.

21A. (1) Subject to sub-regulation (2), an officer who is transferred to the Women's Royal Australian Naval Service Reserve holds, upon being so transferred, the rank that she held in the Women's Royal Australian Naval Service immediately before the transfer. (2) Where an officer of the Women's Royal Australian Naval Service Reserve held a rank temporarily immediately before her transfer to that Reserve, the officer holds, upon the transfer, the rank last held by her that was not held temporarily.

21B. For the purposes of section 8 of the Act, a woman is not eligible for appointment as an officer in the Women's Royal Australian Naval Service Reserve unless -
(a) she has served for not less than one year as an officer in the
Women's Royal Australian Naval Service; or
(b) she possesses other qualifications determined by the Chief of
Naval Staff to be sufficient for the performance of the duties of
an officer in the Women's Royal Australian Naval Service
Reserve.and she has not attained the age of 45 years.

21C. (1) Subject to sub-regulation (2), a woman appointed to be an officer in the Women's Royal Australian Naval Service Reserve shall, on appointment, hold a rank not higher than -
(a) in the case of a woman to whom paragraph 21B (a) applies - the
rank that she held when she last served in the Navy or, if she
held a rank temporarily or an honorary rank, the rank last held
by her that was not held temporarily and was not an honorary
rank; or
(b) in the case of a woman to whom paragraph 21B (b) applies -
the rank of Sub-Lieutenant.Amended by 1976 No. 38 r.3
(2) Where a woman appointed to be an officer in the Women's Royal Australian Naval Reserve possesses special professional or technical qualifications that, in the opinion of the Chief of Naval Staff, qualify her to perform the duties of a rank higher than the rank with which she would, but for this sub-regulation, have been appointed, the woman may, if the Chief of Naval Staff so approves, be appointed with a rank higher than the appropriate rank under whichever of the paragraphs of sub-regulation (1) is applicable.

21D. An officer of the Women's Royal Australian Naval Service Reserve is eligible for promotion while she is rendering continuous full time naval service, but not otherwise.

21E. A person is not eligible to enlist in the Women's Royal Australian Naval Service Reserve unless -
(a) she has served in the Women's Royal Australian Naval Service,
the Australian Regular Army or the Permanent Air Force for a
period of not less than one year; and
(b) she has not attained the age of 45 years.

21F. The prescribed period, for the purposes of section 25 of the Act, in the case of enlistment in the Women's Royal Australian Naval Service Reserve, is 5 years.

21G. (1) Where a person has served in the Women's Royal Australian Naval Service before enlisting in the Women's Royal Australian Naval Service Reserve, the person holds, upon enlistment, the rank that she held in the Women's Royal Australian Naval Service immediately before she was discharged from that Service or, if she held a rank temporarily immediately before being so discharged, the rank last held by her that was not held temporarily. (2) Subject to sub-regulation (1), where a person who has served in a prescribed force before enlisting in the Women's Royal Australian Naval Service Reserve held, immediately before she was discharged from that force, a rank specified in an item in the following table (in the second or third column), the person holds, upon enlistment in the Women's Royal Australian Naval Service Reserve, the rank specified in that item (in the first column): ------------------------------------------------------------------------------ --

21H. (1) A servicewoman who has attained the age of 48 years is not eligilbe to be re-engaged for further service in the Women's Royal Australian Naval Service Reserve. Amended by 1976 No. 38 r.3
(2) For the purposes of sub-section 25 (2) of the Act, the period for which a rating of the Women's Royal Australian Naval Service Reserve may volunteer to serve is 2 years.

21J. A servicewoman serving in the Women's Royal Australian Naval Service Reserve is not eligible for promotion to a higher rank unless -
(a) she is rendering continuous full time naval service; and
(b) she is recommended for promotion by her Commanding Officer
or she possesses special qualifications that fit her for the
performance of the duties of the higher rank.

NAVAL FORCES (WOMEN'S SERVICES) REGULATIONS - REG 21L
Voluntary non-continuous serviceInserted by 1968 No. 72 r.4
21L. A member of the Women's Royal Australian Naval Service Reserve may, at any time, voluntarily undertake to render naval service, not being continuous full time naval service, on an occasion or on occasions specified by her, being an occasion or occasions when she would not otherwise be bound to render naval service, and, if that undertaking is accepted, she is bound to render naval service in accordance with the undertaking.

21M. (1) The Chief of Naval Staff, the Chief of Naval Personnel and the Director-General of Navy Manpower are each, in the case of a servicewoman serving in the Women's Royal Australian Naval Service Reserve, a prescribed authority for the purposes of section 30 of the Act. (2) The officer holding the office, or performing the duties of the office, of Director of Naval Reserves and Cadets is, in the case of a servicewoman serving in the Women's Royal Australian Naval Service Reserve who is not rendering continuous full time naval service, a prescribed authority for the purposes of section 30 of the Act.

23. A member under close arrest and awaiting the disposal of a charge against her shall be guarded by female guards unless female guards are unavailable.

26. The Naval Forces Regulations for the time being in force shall, subject to such modifications and adaptations as are expressly provided or necessarily implied by these Regulations, apply to and in relation to any Women's Service and the members thereof.
