REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1971.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1971.

Amendments of the Naval Forces Regulations 

Parts.

1. Regulation 3 of the Naval Forces Regulations is amended by omitting the words—

“Division 2—Application of the Naval Discipline Act to the Naval Forces (Regulation 8)”,

and substituting the words—

“Division 2—Application of the Naval Discipline Act and the Queen’s Regulations and Admiralty Instructions to the Naval Forces (Regulations 8-9)”.

Heading to Division 2 of Part 1.

2. The heading to Division 2 of Part I of the Naval Forces Regulations is omitted and the following heading substituted:—

“Division 2—Application of the Naval Discipline Act and the Queen’s Regulations and Admiralty Instructions to the Naval Forces”.

Modifications, &c., of the Naval Discipline Act.

3. Regulation 8 of the Naval Forces Regulations is amended by omitting from sub-regulation (1) the words “the Schedule to these Regulations” and substituting the words “Schedule 1”.

4. After regulation 8 of the Naval Forces Regulations the following regulation is inserted in Division 2 of Part I:—

Modifications, &c., of the Queen’s Regulations and Admiralty Instructions.

“9. (1) In this regulation ‘Queen’s Regulations’ means the Queen’s Regulations and Admiralty Instructions in force at the date of commencement of the Naval Defence Act 1964 in their application to and in relation to the Naval Forces and the members of those Forces by virtue of section 34 of the Act.

“(2) The Queen’s Regulations apply to and in relation to the Naval Forces and the members of those Forces as if those Regulations were modified by omitting the provisions referred to in Schedule 2.

“(3) Subject to sub-regulations (4) and (5), in the construction of the Queen’s Regulations as modified in accordance with sub-regulation (2) a reference to—

 (b) a vessel, aircraft or establishment belonging to those Forces; or

(c) a person holding a specified rank or appointment in those Forces,

shall be read as a reference to the corresponding branch of the Defence Force, to a vessel, aircraft or establishment belonging to that corresponding branch or to a person holding a corresponding rank or appointment in that corresponding branch, as the case requires.

“(4) In the construction of the Queen’s Regulations as modified in accordance with sub-regulation (2)—

(a) a reference to the Act shall be read as a reference to the Naval Discipline Act as modified by these Regulations;

(b) a reference to the Admiralty shall be read as a reference to the Naval Board;

(c) a reference to the Commander-in-Chief in Article 1946 shall be read as a reference to the Naval Board; and

(d) clause 5 of Article 1946 shall be read as if the word “, abroad,” were omitted.

“(5) Where a term that is defined in the Naval Discipline Act as modified by these Regulations is used in the Queen’s Regulations as modified in accordance with sub-regulation (2), that term shall have the same meaning in those Regulations as it has in the Naval Discipline Act as modified by these Regulations.”.

5. Regulation 175 of the Naval Forces Regulations is amended by omitting from sub-regulation (2) the words “Second Naval Member of the Naval Board” and substituting the words “Chief of Naval Personnel”.

6. Regulation 180 of the Naval Forces Regulations is amended by omitting from sub-regulation (1) the words “Second Naval Member of the Naval Board” and substituting the words “Chief of Naval Personnel”.

Schedule 1.

7. The Schedule to the Naval Forces Regulations is amended by omitting the words “THE SCHEDULE” and substituting the words “SCHEDULE 1”.

Schedule 2.

8. The Naval Forces Regulations are amended by adding at the end thereof the following Schedule:—
