REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1975.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1975.

Amendments of the Naval Forces Regulations 

Commencement.

1. These Regulations shall come into operation on 9 February 1976.

Schedule 1.

2. (1) Schedule 1 to the Naval Forces Regulations is amended by inserting the following item after item 4:—

“ 4a	29 ..............................	Omit paragraph (b), substitute the following paragraph:—
		“ (b) handles any stolen goods, where the property stolen was public or service property; ”.

"(2) Schedule 1 to the Naval Forces Regulations is amended by inserting the following item after item 30:—

“ 30a	68 ..............................	After sub-section (2) insert the following sub-section—
		“ (2a) Where a person is charged with a civil offence under section 42 of this Act which is an offence against a law of Australia and it is not proved that he committed that offence but is proved that he committed any other civil offence of which, if he had been tried by a civil court for committing the first-mentioned offence, he might have been found guilty, he may be convicted of an offence under the said section 42 in respect of the commission of that other civil offence.”.

(3) Schedule 1 to the Naval Forces Regulations is amended by inserting the following item after item 64:—

“ 64a	129a ..........................	After section 129 insert the following section:—
		“ 129a. No provision of any Imperial Act requiring the fiat or consent of the Attorney-General or the Director of Public Prosecutions in connection with any proceedings shall have effect in connection with proceedings under this Act.”.

3. Division 3 of Part I of the Naval Forces Regulations is repealed and the following Division substituted:—

“ Division 3—Administration

Establishments.

“ 12. (1) Subject to the Defence Act 1903-1975, the Act and any direction by the Minister, the Chief of Naval Staff may determine—

(a) the establishment of the Navy or of any Naval Establishment or ship; and

(b) the ranks to be held by members holding positions on those establishments and the designations to be applied to members holding those positions.

“ (2) The Chief of Naval Staff may specify in a determination under sub-regulation (1) that a position shall ordinarily be occupied by a member included in a class of members specified in the determination.”.

Transitional.

4. An approval given or a determination made by the Naval Board for the purposes of the Naval Forces Regulations and in force immediately before the commencement of these Regulations shall have effect after the commencement of these Regulations as if it had been given or made, as the case requires immediately after the commencement of these Regulations by the Chief of Naval Staff for the purposes of the Naval Forces Regulations as amended by these Regulations.
