Naval Forces Regulations (Amendment) (Cth)

THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice
of the Federal Executive Council, hereby make the following Regulations under
the

(a) by omitting from the column headed “Rear Admiral” in the table in sub-regulation (1) “60” and substituting “57”; and
(b) by omitting from the column headed “Commodore or Captain” in the table in sub-regulation (1) “57” (wherever occurring) and substituting “55”.
“commencement date” means the date on which these Regulations come into operation;
“former retirement age” means, in relation to an officer, the age for the compulsory retirement of that officer that was applicable immediately before the commencement date;
“new retirement age” means, in relation to an officer, the age for the compulsory retirement of that officer that is applicable on the commencement date.

(2) Where before the commencement date an officer has attained an age equal to or greater than his new retirement age, but less than his former retirement age, the age for the compulsory retirement of that officer shall be his former retirement age, unless a greater retirement age becomes applicable to him.
(3) Subject to sub-regulation (4), where on the commencement date the new retirement age of an officer, other than an officer to whom sub-regulation (2) applies, is less than his former retirement age, that officer, at any time before attaining his new retirement age, may elect in writing delivered to the Chief of Naval Staff to serve until attaining his former retirement age.
(4) Where an officer makes an election under sub-regulation (3), the age for the compulsory retirement of that officer shall be his former retirement age, unless a greater retirement age becomes applicable to him.
