Naval Forces Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910.

Retiring age of officers

1. Regulation 102 of the Naval Forces Regulations is amended—

(a) by omitting from the table in sub-regulation (1)

2. (1) In this regulation—

"commencement date" means the date on which these Regulations come into operation;

"former retirement age" means, in relation to an officer, the age for the compulsory retirement of that officer that was applicable immediately before the commencement date.

(2) An officer who holds the rank of Lieutenant Commander or Lieutenant at the commencement date may, prior to attaining that age, elect in writing delivered to the Chief of Naval Staff to retain his former retirement age.

(3) Where an officer elects under sub-regulation (2) to retain his former retirement age, that retirement age shall continue to apply in relation to that officer while he holds the rank of Lieutenant Commander or Lieutenant.
