REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910–1968.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910–1968.

Amendment of the Naval Forces (Papua and New Guinea Division) Regulations

Second, Third and Fifth Schedules.

1. The Second, Third and Fifth Schedules to the Naval Forces (Papua and New Guinea Division) Regulations are repealed and the following Schedules are respectively inserted in their stead:—

Transitional.

2.—(1.) A member in receipt of pay in respect of the relevant period is, by virtue of this regulation, entitled to be paid, as additional pay—

(a) if the member was not in receipt of special allowance under sub-regulation (6.) of regulation 8 of the Naval Forces (Papua and New Guinea Division) Regulations in respect of the relevant period—an amount equal to the amount by which the amount of the pay paid or payable to him in respect of the relevant period is less than the amount of the pay that would have been payable to him in respect of that period if the amendments of the Naval Forces (Papua and New Guinea Division) Regulations effected by the last preceding regulation had come into operation on the twenty-fifth day of June, 1970; or

(b) if the member was in receipt of special allowance under sub-regulation (6.) of regulation 8 of the Naval Forces (Papua and New Guinea Division) Regulations in respect of the relevant period—an amount equal to the amount by which the sum of the amounts paid or payable to him by way of pay and special allowance in respect of the relevant period is less than the sum of the amounts that would have been payable to him by way of pay and special allowance (if any) in respect of that period if—

(i) the amendments of the Naval Forces (Papua and New Guinea Division) Regulations effected by the last preceding regulation had come into operation on the twenty-fifth day of June, 1970; and

(ii) special allowance had been payable in accordance with the rates, for the periods, and subject to the conditions applicable to the payment of that allowance immediately after the commencement of these Regulations.

(2.) A reference in the last preceding sub-regulation to the relevant period shall be read as a reference to the period from and including the twenty-fifth day of June, 1970, to and including the day immediately before the commencement of these Regulations or to any part of that period.
