REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation forthwith.

PART I.

PRELIMINARY.

Citation.

1. These Regulations may be cited as the Naval Financial Regulations.

Repeal.

2. The Naval Financial Regulations (Statutory Rules 1920, No. 248, as amended to present date) are hereby repealed, save as to any right, privilege, obligation, or liability acquired, accrued, or incurred thereunder.

Definitions.

4. In these Regulations, unless the contrary intention appears—

“Naval Board” means the Board of Administration for the Naval Forces.

“Secretary” means the Officer appointed to be Secretary to the Naval Board, or such other official as the Naval Board may authorize to act for him.

“Commanding Officer” means the Officer in actual command of one of H.M.A. Ships or Naval Establishments.

“Officer-in-Charge” means the Officer in charge of a Naval Establishment or Office or District Naval Officer appointed to command a District.

“Director of Navy Accounts” means the Officer appointed to be Director of Navy Accounts in the Office of the Naval Administration, or such person as may be appointed by the Naval Board to perform the duties of the position during his absence.

“Accountant Officer” means the Officer in charge under the Commanding Officer of cash, victualling, and clothing duties.

“Certifying Officer” means the Officer appointed by the Naval Board to certify accounts and approve the payment thereof.

“Accounts Officer” means the Officer responsible for the receipt and payment of Public Moneys in Naval Establishment or Office.

“Executive Officer” means an Officer of the Executive Branch of the Forces.

“Minister” means the Minister of State administering the Naval Defence Act 1910-1918.

PART II.

GENERAL.

5. Officers-in-Charge and Commanding Officers shall be responsible for enforcing due economy on all Officers and others charged with any expenditure of public money, or with the care, use, or expenditure of stores.

6. It is the duty of every member of the Naval Forces to assist in carrying out these Regulations.

7. (1) The King’s Regulations und Admiralty Instructions shall constitute no authority for expenditure in the Royal Australian Navy.

(2) References in these Regulations to the King’s Regulations and Admiralty Instructions refer to the 1913 edition.

8. Commanding Officer and Officers-in-Charge shall not vary any payments provided for under Regulations.

Advances.

9. The Director of Navy Accounts or the Accountant Officer of one of H.M.A. Ships or the Certifying Officer at an Establishment or Office on whose books a member is borne for pay, may authorize any other Certifying Officer to make an advance to such member on account of pay or travelling expenses, provided that the amount advanced does not exceed the total amount due to the member at date of the advance.

 

Disallowances.

10. An Accountant Officer or Certifying Officer shall be liable for the amount of disallowances arising from errors or over issues made by him, in disregard of regulations or in the absence of proper authority.

Charges for use of furniture and mess traps.

11. (1) A charge at the rate of 7½ per cent. per annum shall be made on the value of furniture supplied to an official residence and on the value of a billiard table provided for the use of an Officers’ Mess.

(2) A charge at the rate of 8 per cent. per annum shall be made on the value of mess traps supplied to an official residence.

(3) Similar charges may also be made on the value of furniture and mess traps supplied to Government quarters.

(4) The Minister may waive or vary any of the charges referred to in this regulation.

(5) The percentage charges on furniture and mess traps shall be made on the official valuation. A revaluation may be made at intervals not exceeding five years and also at the time of a change in tenancy.

Rent chargeable for quarters.

12. (1) When any person to receipt of consolidated rates of pay occupies for purpose of residence, the whole or part of a building belonging to or occupied by the Commonwealth, a deduction of 10 per centum from such person’s salary or wages shall be made as rent therefor, except as provided in sub-regulation (2).

(2) The Minister may fix the rent to be charged to any person on a basis other than the foregoing, or may waive altogether the charge for rent.

(3) In calculating for any purpose the rate of salary or wages of such person, the amount so deducted for rent shall be deemed and taken to be part of his salary.

(4) An officer or a man on sea-going rates of pay, in occupation of official married quarters, shall pay such rent for the premises as is approved by the Minister.

(5) The Officer-in-Charge shall be responsible, in all cases, for the abatement from salary or wages of the necessary charges for rent of quarters.

Fuel and light.

13. A person in receipt of consolidated rates of pay, who is in occupation of official quarters, shall not be provided with fuel or light at Government expense, unless the Order in Council appointing such person expressly provides that one or more of such services are to be allowed, or unless the Minister approves of one or mort of such services being supplied.

PART III.

PAY AND ALLOWANCES.

Rates of Pay—Officers (Sea-going).

14. (1) The daily rates of active pay prescribed in regulations 15 to 23 inclusive, the rates of allowances prescribed in regulations 33 to 54, and the rates of deferred pay as prescribed in regulation 56 shall apply, where not otherwise stated, to Officers serving in the Permanent Naval Forces (Sea-going).

(2) Rank or relative rank specified shall be as defined in the King’s Regulations and Admiralty Instructions.

(2) A Probationary Engineer Sub-Lieutenant shall receive pay and allowances as laid down for Engineer Sub-Lieutenants on promotion.

(3) An allowance for Engineer duties is included in the scale of pay for officers of the Engineering Branch up to Commander’s rank inclusive. The rates prescribed in sub-regulation (1) for the Engineering Branch will be paid continuously while an officer is employed on Engineering duties. A Lieutenant (E) or Lieut.-Commander (E) who reverts to Deck duties shall, whilst employed on such duties, receive pay on the scale of the Executive Branch.

(4) The conditions regarding the commencement of (E) pay for Sub-Lieutenants (E) and Lieutenants (E) shall be as approved by the Naval Board.

(2) An officer of the Medical Branch who has his seniority as Surgeon-Commander ante-dated to the date of his attaining six years seniority as Surgeon Lieutenant-Commander shall not be eligible for increase of pay and allowances until the date of passing the qualifying examination.

(3) A Warrant Officer whose total emoluments as a rating on the date immediately preceding his promotion to Warrant Rank, exceeded the amount to which he would be entitled as a Warrant Officer may, on the approval of the Naval Board, be paid a special rate of pay. Such a case shall be dealt with in accordance with the conditions governing similar cases in the Royal Navy.

(4) The Mechanical Branch (column “A”) shall include the ranks of Warrant Engineer, Commissioned Engineer, Engineer-Lieutenant, Engineer-Lieutenant-Commander, Warrant Mechanician, Commissioned Mechanician, Warrant Shipwright, Commissioned Shipwright, and Shipwright-Lieutenant, Warrant Electrician, Commissioned Electrician, Warrant Ordnance Officer, Commissioned Ordnance Officer, and Officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

(5) The Non-Mechanical Branch (column “B”) shall include the ranks of Gunner, Commissioned Gunner, Gunner (T), Boatswain, Commissioned Boatswain, Signal Boatswain, Commissioned Signal Boatswain, Warrant Telegraphist, Commissioned Telegraphist, Warrant Wardmaster, Commissioned Wardmaster, Warrant Master-at-Arms, Commissioned Master-at-Arms, Warrant Writer, Commissioned Writer, Warrant Supply Officer, Commissioned Supply Officer, Warrant Instructor in Cookery, Commissioned Instructor in Cookery, Head Schoolmaster and Chief Schoolmaster (old system), and Officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

Definitionof service

24. (1) Service in rank on the Active List, for the purpose of increments in pay, shall include all time actually served on full pay in that rank by an Officer on the Active List of the Royal Navy, Royal Australian Navy, or Navy of any of His Majesty’s Dominions.

(2) All previous service in the Royal Navy, Royal Marines, or in the Navy of any of His Majesty’s Dominions shall be allowed to count as if served by a rating in the Royal Australian Navy towards “Service” for seniority, pay, good conduct badges, and allowances. Ratings re-entering the service shall not count their former service towards progressive pay when the period of absence has exceed five years, except in such special cases as may be approved by the Naval Board.

Increments

25. (1) Increments of pay shall be subject to such condition as may be approved by the Naval Board.

(2) In the case of an officer “Provisional” time shall count for increments of pay, but “Acting” time shall not so count. Temporary Acting Warrant Officers will, however, be allowed the same increments of full pay as authorized for confirmed Warrant Officers, R. A. N., of similar rank.

 

(3) Time prior to and in desertion shall, under no circumstances, count as service for purposes of increment, but time served prior to disrating may count towards progressive pay on restoration to rating,

Retention of Old Rates of Pay.

26. Leading Seamen who, on the date these Regulations come into force are in receipt of progressive pay, under special Naval Board authority, although not passed professional examination for Petty Officer, may continue to be paid as such, but progressive pay is not to be paid in such circumstances in any further cases.

Excess Numbers.

27. Officers or ratings in excess of the authorized number of any rank or rating may be carried on the strength, provided there are vacancies in the higher rank or rating and that the total establishment is not exceeded.

Officers of the Royal Navy.

28. (1) Officers of the Royal Navy serving in the Permanent Naval Forces (Sea-going) prior to 1st October, 1922, may elect to receive either the rates of active pay and allowances prescribed for their relative ranks in the Royal Navy or these prescribed in these Regulations. The following Royal Australian Navy allowances shall be payable, at the rates and under the conditions set forth in these Regulations, in lieu of the corresponding Royal Navy allowances, where such Officers elect to receive Royal Navy rates of pay:—

(a) Ration Allowance.

(b) Lodging Allowance.

(c) Travelling Allowance.

(2) Officers of the Royal Navy appointed to the Royal Australian Navy on and after 1st October, 1922, shall receive the rates of Active Pay and Allowances prescribed for their respective ranks in these Regulations.

(3) Deferred pay shall not be credited to Officers of the Royal Navy whether in receipt of Royal Navy or Royal Australian Navy rates of pay.

Half-pay List.

29. Officers placed on the half-pay list shall receive pay at the daily rate of one-half of the active pay prescribed for their rank, but shall not be entitled to deferred pay or allowances of any nature whatsoever.

Officers on the Retired and Emergency Lists.

30. (1) An Officer on the Retired or Emergency List called up for duty in time of war or emergency shall receive pay and allowances at the rates prescribed for an Officer of corresponding rank in the Permanent Naval Forces (Sea-going), including Deferred Pay, provided that—

(a) an Officer who has been promoted after being placed on the Emergency List shall receive the full pay and allowances prescribed for the higher rank; and

(b) unemployed time on the Retired or Emergency List shall not count towards increments in full pay governed by seniority.

(2) An Officer on the Emergency List voluntarily re-employed in time of peace in the Permanent Naval Forces (Sea-going) shall receive pay and allowances at the rates prescribed for an Officer of corresponding rank in the Seagoing Forces, provided that—

(a) unemployed time on the Emergency List shall not count towards increments in pay; and

(b) deferred pay shall not be credited.

(3) An Officer on the Emergency List called upon to undergo a course of instruction shall be paid at the rates prescribed for such Officers voluntarily re-employed in peace time.

 

Medical Officers Serving in Civil Hospitals and Undergoing Courses of Study.

31. (1) Pay shall not be made from Naval Funds to Surgeon Lieutenants who, at the time of entry into the Medical Branch, are permitted to serve for a period not exceeding one year in a civil appointment at a recognised civil hospital, but the time so served shall count for purposes of increments in active and deferred pay, if approved by the Naval Board.

(2) Medical Officers undergoing courses of study in approved Medical Schools may be credited with the pay and allowances of their respective ranks in the Permanent Naval Forces (Sea-going).

Appointment as Aide-de-camp.

32. The appointment of an Officer as an Aide-de-camp shall not entitle him to any pay or allowances in respect of the appointment.

ALLOWANCES—GENERAL.

Outfit Gratuities on Entry and Promotion.

33. (1) An Outfit Gratuity may be paid to an Officer on first joining, or on promotion to Officer rank, or on confirmation of appointment, in accordance with the following scale:—

(2) Officers transferred from another branch of the Royal Australian Navy, or from the Royal Navy direct or appointed within twelve months of the date of their retirement from the Royal Navy shall receive no gratuity on transfer or appointment.

Officers discharged within twelve months of entry—Recoveries to be made on monthly basis.

(3) In the event of discharge except by invaliding within twelve months of grant of clothing gratuity, a proportionate part of gratuity for the unexpired period is to be recovered from the Officer concerned, on a monthly basis. Recovery will be made on the basis of one-twelfth for each full month of the unexpired period.

 

Equipment Allowance to officers on the Emergency List.

34. An Officer on the Emergency List voluntarily re-employed in the Permanent Naval Forces (Sea-going) will be granted an Equipment Allowance at a rate prescribed in the subjoined scale, provided that no such Officer shall receive any such allowance if less than three years shall have elapsed between the date of his resignation from the Active List and the date of his re-employment, and that an Officer may be paid equipment allowance only once in any period of five years—

Outfit Gratuity to Officers on the Emergency List.

35. When called up for service in time of war or national emergency, an Officer on the Emergency List shall receive the Outfit Gratuity of £30 under the conditions prescribed in this regulation for Officers appointed for temporary service in the Permanent Naval Forces (Sea-going).

Free issue of Kit.

36. (1) Every rating engaging for more than three years’ service shall, on first entry, be supplied at Government expense with a full uniform kit applicable to his rating.

(2) A rating whose engagement in the Royal Navy expires whilst on loan to the Royal Australian Navy, and who engages for a period in the Royal Australian Navy, Service being continuous, shall not receive any free issue of kit on effecting such engagement.

(3) A former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, who engages in the Royal Australian Navy within six months of discharge, shall not receive any free issue of kit on engagement except in special circumstances, with the approval of the Naval Board.

(4) A former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, who engages in the Royal Australian Navy, after an interval of not less than six months, for a period of more than three years, shall be supplied, on engagement, with the full free kit as approved by the Naval Board.

(5) A person entered from shore for three years or less, including a former rating of the Royal Navy, Royal Australian Navy, or Royal Fleet Reserve, discharged more than six months prior to re-entry, shall receive a gratuity or a free issue of articles of kit not exceeding half the value of a full kit, as may be approved by the Naval Board.

Kit Upkeep Allowance.

37. (1) Kit Upkeep Allowance Shall be granted to ratings as follows:—

Class I.—1s. per diem commencing from date of entry.

Class II.—10d. per diem commencing from date of entry.

Class III.—1s. per diem commencing from date of entry.

(2) Kit Upkeep Allowance shall continue to be credited during periods of detention. In all other cases where deferred pay is not credited, vide sub-regulation 7 of regulation 55, Kit Upkeep Allowance shall also be stopped for the same period.

Ratings on Loan from Royal Navy.

(3) Kit Upkeep Allowance, at the rates prescribed in sub-regulation (1). shall be credited to ratings lent from the Royal Navy, commencing from the date of entry for service in the Royal Australian Navy.

 

Outfit gratuities on Change of Class, of Uniform

38. (1) The following Outfit Gratuities shall be paid, in addition to the Kit Upkeep Allowance, to all ratings, including these lent from the R.N., who are obliged to change their uniform from Class II. to Class I. or Class III., or from Class III. to Class II.:—

In addition to the gratuity payable under the sub-paragraph (a) above a further gratuity of £10 towards the cost of frock coat and sword shall be paid to Master-at-Arms on promotion.

Change in class of Uniform consequent, upon transfer in Rating

(2) When a man or boy is transferred, owing to unsuitability for the rating held to another rating involving change in class of uniform, he shall be paid an Outfit Gratuity, as prescribed in sub-paragraphs (c) or (d) above, but the articles in the compulsory kit of his former rating no longer required in the rating to which he is transferred shall be sold. No Outfit Gratuity shall be paid when the transfer in rating is attributable to misconduct.

Members on Loan from Royal Navy not entitled to Gratuity or Free Kit.

(3) Uniform gratuities shall not be payable to Officers and men lent from the Royal Navy, nor will a free kit be issued in such cases, except as provided in sub-regulation (1).

Recoveries from Men Discharged within Two Years of Entry

39. (1) In the event of discharge of men at own request within two years of entry, a charge shall be made against deferred pay of £1 10s. per month in the case of Ratings Classes I. and III., and of £1 5s. per month in the case of Ratings Class II., for each full month of the unexpired portion of two years. A similar charge shall be made in all cases of discharge within two years where deferred pay is not forfeited, except that in the case of men invalided no charge is to be made. In the case of ratings discharged within two years of entry, other than by invaliding, being in debt or having insufficient credit of deferred pay to cover the charge referred to in the foregoing, the kit, or portion thereof, shall be recovered and sold, except such as is necessary to meet immediate requirements. Any balance received for sale of kit shall be paid to the rating.

(2) In the event of the amount of deferred pay and the sum realized from the sale of kit being insufficient to meet the charge to be recovered in accordance with the foregoing, no deduction shall be made from active pay on that account.

Compensation for Losses of Uniform, &c

40. (1) The Naval Board may approve of the payment of compensation to an Officer or man who, being on duty may lose, in action with the enemy, by fire, shipwreck, or other casualty of the Service, any necessary articles of clothing or equipment, or any books, instruments, or tools used in connexion with his duties.

(2) No claim shall be admitted for losses sustained when proceeding on or returning from leave of absence, nor for the loss of money or civilian clothing, the property of the individual.

 

Deserters’ Uniforms.

41. Recovered deserters are not to be treated as new entries. The kit of a deserter if not sold before his recovery may be restored to him. If his kit has been sold, he should be supplied with a reduced kit (as laid down in the Uniform Regulations), to be charged against his pay and allowances.

Issue of Civilian Suit.

42. (1) Ratings about to be discharged from the Sea-going Forces—

(a) Dismissed with disgrace;

(b) Dismissed; and

(c) Services no longer required on account of misconduct, who, at date of discharge, are in debt to the Crown, may be supplied gratuitously with a civilian suit, the cost of which shall not exceed 32s. 6d.

(2) Where the pay account of the rating about to be discharged in the manner stated in the preceding paragraph is in credit, such rating may be supplied with a civilian suit on repayment, the cost of which, not exceeding 32s. 6d., shall be recovered from the pay due on discharge.

Lodging Allowance—Daily Rate.

Lodging allowance payable when residing at home.

(2) In cases where Lodging Allowance is paid owing to quarters not being available and the officer or man resides at his own home, the rates of Lodging Allowance shall be the foregoing rates, less the amount of Married Allowance, if any, drawn.

(3) Lodging Allowance shall not be credited when a member is on leave for periods exceeding four days.

Lodging Allowance—Annual Rate.

44. (1) Officers (Sea-going) of the Royal Australian Navy, who are appointed to positions on shore, and are not provided with accommodation, shall be paid Lodging Allowance at the following rates provided that, where the period of service ashore does not exceed one month, Officers shall be paid the difference between the daily and annual rates of Lodging Allowance prescribed in this sub-regulation:—

(2) Payment of Lodging Allowance at the annual rate shall continue to be made when an Officer proceeds on recreation leave, or on sick leave, provided the Officer is not accommodated in hospital.

 

(3) Payment of Lodging Allowance at the annual rate shall also continue to be made.

(а) for the first seven days whilst an Officer is accommodated in hospital; and

(b) for the first seven days only when temporarily absent from Head-Quarters and travelling allowance is drawn under the conditions prescribed in Sub-regulation (7) of regulation 97.

Provided, always, that the lodgings are retained and paid for during the period.

(4) In calculating Lodging Allowance at the annual rate, the amount payable shall be ascertained by multiplying the annual rate by the number of days in the period of calculation and dividing the result by 365.

(5) Married Allowance shall not be payable concurrently with the annual rate of Lodging Allowance to an officer who resides, or is able to reside, at his own home.

(2) Warrant Officers over sir years’ seniority shall receive the allowance prescribed for Warrant Officers under six years’ seniority up to a maximum of 3s. per diem.

(3) Commissioned Officers from Warrant rank in receipt of “on promotion” rates of pay shall receive 2s. per diem Married Allowance. Commissioned Officers from Warrant rank in receipt of rates of pay prescribed for Commissioned Officers from Warrant rank “after three years’ seniority” and “after six years’ seniority” shall receive 1s. per diem Married Allowance. Married Allowance—Condition of payment.

(5) The conditions as set forth in the following sub-paragraphs shall govern payment of Married Allowance.

(а) In the case of an Officer, an allotment must be declared in favour of his wife of not less than one-third of his active pay (excluding allowances) plus full amount of Married Allowance payable.

(b) In the case of a Chief Petty Officer, Petty Officer, or man an allotment must be declared in favour of his wife of not less than one-half of his active pay (excluding allowances) plus full amount of Married Allowance payable.

(c) For the purposes of determining the amount of monthly allotment to be declared in each case in respect of Married Allowance, a month shall be reckoned as 30 days.

The necessary allotment should commence from the first day of the month following credit of Married Allowance.

(d) Married Allowance may be paid to widowers with children subject to an allotment in favour of a guardian of not less than one-quarter active pay (excluding allowances) plus full amount of Married Allowance payable. If the children are in the care of more than one guardian, a separate allotment in favour of each guardian shall be made, and the total amount of such allotments shall equal or exceed one quarter of active pay (excluding allowances) plus the full amount of Married Allowance.

(e) Married Allowance will be payable irrespective of place of residence of wife, or of guardian in the case of a widower, provided the necessary allotment is made.

(f) Married Allowance may be paid in regard to step-children and adopted children under sixteen years of age, provided that the member claiming the allowance maintains such children and that they are not in receipt of endowment from any other source.

(g) During periods of detention or imprisonment not exceeding 90 days, the allotment should be continued at a rate not less than the amount of Married Allowance which would have been payable to the rating the debt accumulated by such allotment may be recovered in easy instalments, or in the event of discharge communicated to Navy Office for recovery from deferred pay.

(h)The payment of Married Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the allowance as may be considered desirable.

Dependant Allowance.

46. (1) When Married Allowance is not drawn, Dependant Allowance at the rate of 2s. per diem may be paid to—

(i) Commissioned Officers from Warrant rank in receipt of “on promotion” rates of pay.

(ii) Warrant Officers irrespective of the rate of pay received.

(iii) Ratings.

in respect of a dependant residing in Australia requiring support, subject to an allotment of one-half of the active pay (excluding allowances) of the Officer or man, plus the amount of Dependant Allowance credited.

(2) Commissioned Officers from Warrant rank in receipt of pay as Commissioned Officer from Warrant rank “after three years’ seniority” or Commissioned Officer from Warrant rank “after six years’ seniority” may be paid Dependant Allowance under similar conditions at the rate of 1s. per diem only.

 

Funerals—Sea-going personnel

152. (1) An expenditure not exceeding Ten pounds (£10) may be authorized by Commanding Officers for funerals of members of the Permanent Naval Forces (Sea-going) who are buried on shore.

(2) Where it is proved to the satisfaction of the Naval Board that the actual necessary expenses incurred on the burial were in excess of £10, the Naval Board may approve payment of such further sum as maybe considered reasonable.

(3) Where the burial is undertaken by relatives, the Naval Board may approve of re-imbursement of funeral expenses incurred. The sum approved however, shall not exceed the cost which would have been incurred had the funeral been carried out by the Department, and shall be subject to deduction of cost of the coffin and other expenses which may have been incurred by the Department prior to the removal of the body.

(4) The relatives may have the body conveyed, at their own expense, from the place of death to the deceased’s home for burial, or may be issued with two second-class railway warrants, at Government expense, to enable the nearest relative and one other to proceed to and return home from the Naval Funeral.

(5) The procedure to be adopted by Commanding Officers of Ships in which a member of the Permanent Naval Forces (Sea-going) dies whilst the vessel is in a port of the Commonwealth or outside the Commonwealth, in regard to obtaining quotations from local undertakers for the funeral and payment of the undertaker’s account shall be such as the Naval Board may approve from time to time.

Charges for admission to sports grounds.

153. (1) The Naval Board may approve of a charge being made for entrance to sports grounds enclosed in Naval property, subject to such conditions as may be approved.

 

(2) Amounts collected as a result of such charge shall be paid to the credit of a General Fund or Sports Fund, but shall not be used for the advantage of individual members.

Torpedo Efficiency Funds.

154. (1) payment of Torpedo Efficiency Allowances shall be allowed in accordance with the scale set forth in sub-regulation (2) of this regulation in respect of H. M. A. Ships in full commission only.

(2) The scale of payment shall be as follows:–

Per annum.

(i) Light Cruisers.....................................................................................

£10 each

(ii) Flotilla Leaders and Destroyers armed with 21 inch torpedoes........

£3 each

(3) H. M. A. Ships in “Reserve” commission are not eligible for payment of these allowances or for a grant from the Torpedo Efficiency Fund of any other H. M. A. Ship.

(4) The whole of the amount of the allowance shall be credited to a fund to be called the Torpedo Efficiency Fund which shall be utilized to meet minor expenses in the interests of torpedo efficiency generally, such as the provision of small fittings and devices, not included in the usual torpedo equipment of H. M. A. Ships, which would tend to promote efficiency. No portion of the Torpedo Efficiency Fund shall be expended on Prize Money or as an emolument for any person in the Naval Service.

(5) No refund shall be required from the Torpedo Efficiency Fund of any H. M. A. Ship on paying off or on dispersal of a Flotilla, but any amounts remaining on hand shall be communicated to the Officer Commanding H. M. A. Fleet, who may, at his discretion, cause same to be transferred to another Torpedo Efficiency Fund or repaid to the Accountant Officer for payment to Revenue.

Chaplains travelling and lodging allowances.

155. Chaplains’, having no relative rank, Lodging and Travelling Allowances rates shall be—

Chaplains under four years’ seniority, the rate as prescribed for a Lieutenant.

Chaplains of four years’ seniority, the rate as prescribed for a Lieutenant Commander.

Chaplains of eight years’ seniority, the rate as prescribed for a Commander, and

Chaplains of fifteen years’ seniority, the rate as prescribed for a Captain.

Ship’s Fund and Canteen rent.

156. (1) Any amount received from Canteen tenants as rent shall be paid to the General Ship’s Fund, or, in the absence of such Fund, disposed of as the Naval Board may approve.

(2) The Ship’s Fund shall consist of moneys received in the nature of rent from the Canteen tenant.

(3) The Fund is primarily intended to meet the cost of recreation for the Ship’s Company and for benevolent purposes connected with the Ship. The Commanding Officer shall satisfy himself that sufficient allowance is made for these objects, due regard being had to the proportion of the Ship’s Company who are able to participate in any form of recreation.

(4) The administration of this Fund, shall, subject to the provisions of sub-regulation (3) be under the control of the Canteen Committee.

(5) The accumulation of a large surplus in the Ship’s Fund shall not be permitted, and any balance remaining after making allowance for probable current expenses is to be returned to the messes periodically in proportion to the amount of their Canteen bills.

 

(6) All accounts in connexion with the Ship’s Fund, including all subsidiary funds, e.g.. cricket club and rifle club, shall be audited quarterly by officers nominated by the Commanding Officer, who are to be independent of these serving on the Canteen Committee. After each audit, a statement of accounts shall be prepared, submitted for approval by the Commanding Officer, and publically exhibited.

Allowances to witnesses at courts martial and courts of inquiry.

157.—(1) Witnesses who are summoned or ordered to attend at a Court Martial or a Court of Inquiry at the request of the Department or by order may receive remuneration for such attendance as follows:—

(a) For Civilians.—In accordance with the rates payable (in the State in which the Court Martial or Court of Inquiry is held) to witnesses attending the Supreme Court of that State in its criminal jurisdiction.

(b) For Members of Forces not permanently employed.—At the rate of travelling allowance prescribed for the Permanent Force (Sea-going).

(c) For Members of Forces Permanently Employed.—At the usual rate of Travelling Allowance if so entitled.

Courts martial and disciplinary courts.

158. The allowances prescribed in King’s Regulations and Admiralty Instructions shall be paid to the Officiating Deputy Judge Advocate or Clerk of Court and to the Provost-Martial at Courts Martial.

PART XI.

AUTHORITIES FOR EXPENDITURE.

Ministerial approval and delegation of powers.

159. (1) The Minister may approve of any expenditure not covered by these Regulations provided that the necessary Funds have been made available by Parliamentary Appropriation or by the Treasury in anticipation of Parliamentary Appropriation.

(2) The Minister may, by writing under his hand, delegate any of the powers, functions, and authorities conferred upon or vested in him by these Regulations.

(3) Every delegation under this Regulation shall be revocable at will, and no delegation shall prevent the exercise of any power, function, or authority by the Minister.

Authority of Naval Board.

160. (1) In addition to the authorities specifically vested throughout these Regulations, the Naval Board is authorized—

(i) To approve of increments to members of the Permanent Naval Forces where such increments are prescribed by these Regulations and require Naval Board approval, subject to provision being made therefor in the Appropriation Act;

(ii) To approve up to the value of £10,000 in each case of all requisitions for supplies within the Votes on the Estimates;

(iii) To approve up to the value of £10,000 in each case of expenditure under the Division or Subdivisions of any Votes for contingencies, General Services, and for Maintenance of Ships and Vessels and existing Establishments;

(iv) To approve of requisitions on Works and Railways Department for repairs and maintenance, sanitation and water supply, and fittings and furniture, within the Votes on the Estimates.

 

(2) All authorities vested in Directors and Officers-in-Charge by these Regulations may also be exercised, where necessary, by the Naval Board.

(3) The Naval Board may approve of the taking on charge of excess Stores.

(4) In all cases where expenditure is approved by a majority of the Board, such cases shall, unless the majority includes the Finance Member, be referred to the Minister for decision before any liability is incurred.

Authorities of Directors.

161. (1) Directors are authorized to incur expenditure as set forth in the following sub-regulations.

(2) The Director of Naval Stores is authorized to approve of expenditure not exceeding £300 in any one case on the following items:—

(а) Naval Sea Stores for equipment and maintenance of H.M.A. Fleet not in excess of stocks authorized to be maintained;

(b) Coal and Oil Fuel for H.M.A. Fleet;

(c) Naval Stores for—

(i) Construction and repair of H.M.A. Ships, and Maintenance of Dockyards and Naval Yards;

(ii) Fleet Auxiliaries;

(iii) Naval Establishments, Naval Barracks, Official Residences, Naval Colleges, Naval Detention Quarters;

(iv) Naval Reserves;

(d) Stores for Central Administration;

(e) Office requisites and stationery subject to the approval of superior authority, where necessary;

(f) Stores in excess of these authorized to be maintained not exceeding £2 in any one case.

(3) The Director of Victualling is authorized to approve of expenditure on victualling stores not exceeding £300 in any one ease.

(4) The Director of Naval Medical Services is authorized to approve of expenditure not exceeding £100 in any one case on medicines and medical stores required for the Naval Medical Service.

(5) The Director or Ordnance, Torpedoes and Mines is authorized to approve of expenditure not exceeding £100 in any one case on Naval Armament Stores.

Authorities of Officers-in-Charge.

162. (1) Officers-in-Charge are authorized to incur expenditure as set forth in the following sub-regulations.

Captain-in-Charge, New South Wales.

(2) Captain-in-Charge, H. M. A. Naval Establishments, New South Wales, is authorized—

(i) To engage skilled or unskilled labour at ruling rates of wages provided such are not less than Award rates, and provided that the work on which such labour is employed has been duly authorized. No person is to be employed at any wage in excess of 15s. per diem, unless the rate is that prescribed by an Award, or has been approved by the Naval Board.

 

(ii) To engage temporary draughtsmen for such limited periods as may be necessary, and to renew such appointments from time to time as requisite, provided that total period shall not exceed twelve months without Naval Board approval, at the rates prescribed in Arbitration Court Awards. The approval of the Naval Board is to be obtained for all increases beyond the rates prescribed in the Awards. The employment of all temporary draughtsmen is to be reported to the Naval Board for confirmation.

(iii) To approve of payment of claims for Overtime and Sunday Pay.

(iv) To approve of Yard demands on the Naval Store Officer for materials for Yard Services and upkeep of Yard Plant and Floating Craft, which the Captain-in-Charge is authorized to put in hand, or for which Naval Board approval has been received.

(v) To approve of special demands from H.M.A. Ships on the Naval Store Officer for stores in excess of quantities allowed by Establishment provided the excess quantities are essential for ordinary services.

(vi) To approve of repairs to Yard Plant Moorings and Floating Craft being carried out, provided the cost of same, including labour and material, does not exceed £100 in any one case. This includes cost of replacements to make good defects, e.g., tools to maintain stocks, but does not include new work.

(vii) To approve of expenditure for Contingencies, e.g., towage, not exceeding £100 in any one case and for all recurring services such as electric supply and telephones.

(viii) To approve of purchases under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Penguin and Depôt Ship for Ships in Reserve.

(ix) To approve, in emergent cases, of expenditure in anticipation of superior authority.

(x) To requisition on the Works and Railways Department for Repair and Maintenance in connexion with H.M.A. Naval Establishments, Sydney, not exceeding £50 in any one case.

Naval Store Officer, Sydney.

(3) The Naval Store Officer, Sydney, is authorized—

(i) To approve of Contract Demands on the Contract Board or the District Contract Board or requisitions for the local purchase of—

(a) Naval Stores which are authorized for local purchase and which are required to replenish authorized stock, which will not be exceeded on receipt of Stores purchased;

(b) Naval Stores which are required for repair and refit of H. M. A. Ships approved by the Naval Board;

(c) Naval Stores for supply to H. M. A. Ships or Shore Establishments in accordance with a demand specially approved by superior authority.

(ii) To approve of requisitions for minor items of Naval Stores not ordinarily kept in stock, not exceeding £5 in value in each case, required for specific Yard Services.

(iii) To approve of Requisitions for all Services in connexion with Naval Stores not exceeding £20 for any particular service in respect of any one shipment.

 

Victualling Store Officer, Sydney.

(4) The Victualling Store Officer, Sydney, is authorized—

(i) To approve Contract Demands on the Contract Board or District Contract Board as necessary or requisitions as applicable for local purchase of—

(a) Victualling Stores which are authorized for local purchase and which are required to replenish authorized Yard Stocks which will not be exceeded on receipt of stores purchased.

(b) Authorized Victualling Stores for supply to H. M. A. Ships, or Shore Establishments not ordinarily kept in stock.

(ii) To approve of Requisitions for minor items of stores not ordinarily kept in stock, and not exceeding £5 in value in each case, required for specific Yard Services.

(iii) To approve of Requisitions for all Services in connexion with Victualling Stores not exceeding £20 for any particular service in respect of any one shipment.

(5) The Deputy Armament Supply Officer, Sydney, is authorized—

To approve of Contract Demands on the Contract Board or the District Contract Board, or requisitions for the local purchase of stores up to £10 in any one order and not exceeding £50 in any one month.

Captain Superintendent of Training.

(6) Captain Superintendent of Training, Flinders Naval Depôt, is authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of Contract Demands or requisitions as applicable for the local purchase of stores (other than Victualling Stores) authorized for local purchase and in accordance with Establishment.

(iii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case under Contingencies.

(iv) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six (6) weeks in any financial year without the approval of the Naval Board.

(v) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of H. M. A. S. Cerberus and Tenders.

(vi) To requisition on the Works and Railways Department for Repair and Maintenance in connexion with Flinders Naval Depôt, not exceeding £50 in any one case.

Commanding Officer, Naval College.

(7) Commanding Officer, Royal Australian Naval College, is authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of requisitions as applicable for the local purchase of Stores (other than Victualling Stores) authorized for local purchase and in accordance with Establishment.

(iii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies.

(iv) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six (6) weeks in any financial year without the approval of the Naval Board.

 

(v) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Franklin and Tenders.

(vi) To requisition on the Works and Railways Department for Repair and Maintenance in connexion with R. A. N. College, not exceeding £25 in any one case.

Commanding officer, Boys Training Ship.

(8) Commanding Officer, H.M.A.S. Tingira, is authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies.

(iii) To approve of purchase under established procedure of authorized fresh provisions required for victualling sea-going personnel of H.M.A.S. Tingira.

District Naval Officers.

(9) District Naval Officers are authorized—

(i) To approve of demands upon Naval Store Depôts for Stores allowed by Establishment.

(ii) To approve of Contract Demands or requisitions as applicable for local purchases of other stores and for such stores allowed by Establishment, the local purchase of which may be authorized by the Naval Board.

(iii) To approve of expenditure, other than for Stores, not exceeding £25 in any one case, under Contingencies, in connexion with the R.A.N. Reserve, expenditure incurred by District Naval Officer acting as Local Representative of the Naval Board or Naval Intelligence Officer, care and maintenance of ships and craft under his orders, recruiting for the R.A.N.

(iv) To approve, in emergent cases, of expenditure in anticipation of superior authority.

(v) To requisition on the Works and Railways Department for Repairs and Maintenance in connexion with Buildings under their control not exceeding £25 in any one case.

Naval Representative, London.

(10) Naval Representative, London, is authorized—

(i) To engage, at ruling rates of pay, temporary clerks, draughtsmen, or typists, for such limited periods as may be necessary, and to renew such appointments from time to time as requisite, provided that total period shall not exceed six (6) months without special Naval Board approval. The approval of the Naval Board is to be obtained for all increases beyond ruling rates of pay. Report of the engagement of any temporary clerk, draughtsman, or typist under this authority shall be made forthwith to the Naval Board.

(ii) To approve of demands on the High Commissioner for Stationery and incidentals not exceeding £5 in any one demand, or £25 in any one month. This limit may be exceeded in emergent cases, but covering approval of the Naval Board shall be sought at the earliest possible moment.

(iii) To approve of expenditure under Contingencies (e.g., Rail Fares, Postages, Cablegrams, &c.), not exceeding £10 in any one case. This limit may be exceeded in emergent cases and in regard to travelling expenses and rail fares and freights, but the covering approval of the Naval Board shall be sought at the earliest possible moment.

 

(iv) To approve of payments under Regulations to sea-going personnel borne on books of London Naval Depôt for pay.

Limits for District Naval Officers.

(11) The expenditure to be authorized by District Naval Officers under clauses (ii) and (iii) of sub-regulation (9) must not exceed in the aggregate the following amounts per month in the respective States without the approval of the Naval Board:—

Delegated authorities—Conditions.

163. The authorities delegated in regulations 161 and 162 are subject to compliance with the following provisions, except where otherwise specifically stated:—

(i) That provision made on Estimates will not be exceeded, and the requirements for the remaining period of the financial year will not involve the necessity for applying for additional prevision on any Vote concerned.

(ii) That, except in regard to the Naval Representative in London, certificate has been inserted by the local Certifying Officer that funds are available under his control, or by the Director of Navy Accounts that funds can be made available.

(iii) That the expenditure does not involve any alteration in existing rules or practice.

(iv) That there is nothing irregular in the character of the expenditure.

(v) That the expenditure is not an allowance or payment to any member of the Department except such as is governed by regulations and does not require superior approval.

Naval Works—Performance by Naval Ratings.

164. (1) Each Officer-in-Charge is authorized to carry out the following Naval Works by Naval ratings and employees under Naval supervision:—

(i) Jobbing and urgent minor repairs estimated to cost £2 or less.

(ii) Urgent repairs prescribed in Public Works Regulation 56.

(iii) Maintenance of Stations, Switchboard and Wiring, and other plant in generating stations installed by the Naval Authorities.

(iv) Such works of repairs and maintenance estimated to cost more than £2 as may be delegated specifically by the Minister for Works and Railways:

Provided that works set forth in paragraphs (i), (ii), and (iii) only of sub-regulation (1) shall be carried out at Naval Staff Offices under the supervision of District Naval Officers and Sub-District Naval Officers.

(2) The cost of the works shall be recoverable from the Department of Works and Railways, except that works executed by the Naval authorities as at paragraph (iii) of sub-regulation (1) shall be maintained from Naval Votes.

(3) The above authorities shall be subject to such conditions as may be approved by the Naval Board.
