NAVAL FINANCIAL REGULATIONS - REG 1
Citation

1. These Regulations may be cited as the Naval Financial Regulations.*1* SEE NOTES TO FIRST ARTICLE OF THIS CHAPTER .

NAVAL FINANCIAL REGULATIONS - REG 2
Repeal

2. (1) The Statutory Rules specified in Schedule 1 are repealed. (2) The repeal effected by subregulation (1) does not affect the previous operation of the repealed Regulations or anything duly done or suffered under the repealed Regulations.

NAVAL FINANCIAL REGULATIONS - REG 4
Interpretation

4. (1) In these Regulations, unless the contrary intention appears: "Australia" includes the Territories; "commanding officer" means the officer in actual command of a ship or naval establishment; "married member" means a member who maintains a home for his dependants whether or not he resides in that home; "member" means a member of the Permanent Naval Forces and includes any member of the Navy rendering continuous full-time service; "officer" means a member who is an officer; "oversea" means outside Australia; "rank" includes acting rank and relative rank; "relative rank" includes acting relative rank; "reserve member" means a member of the Navy other than: (a) a member of the Permanent Naval Forces; or (b) a member of the Navy rendering continuous full-time service; "sailor" means a member other than an officer; "service residence" means a residence: (a) owned or controlled by the Department and provided for the use of a member and his family as a residence; or (b) owned by another Australian Public Service Department and provided, by arrangement between the last-mentioned Department and the Department, for the use of a member and his family as a residence; "ship" or "Australian ship" means a ship or vessel of the Royal Australian Navy; "the Act" means the Naval Defence Act 1910-1964; "the Department" means the Department of Defence and "departmental" has a corresponding meaning; "the Service" means the Navy, and "Service" has a corresponding meaning; (5) In these Regulations, the expressions "child", "de facto spouse" and "dependant" have the same respective meanings as in the Defence Force (Salaries) Regulations. (7) In these Regulations, a reference to the spouse of a member shall be read as including a reference to a de facto spouse of the member.

NAVAL FINANCIAL REGULATIONS - REG 6A
Date on which determinations etc. take effect

6A. (1) In this regulation, "determination, direction or approval" means a determination, direction or approval made or given by the Minister, or the Chief of Naval Staff under a provision of these Regulations. (2) A determination, direction or approval takes effect from the date on which it is made or given or, if it is expressed to take effect from another date specified in it, from that other date. (3) A determination, direction or approval: (a) shall not be expressed to take effect: (i) from a date that is before the date on which the provision of these Regulations under which it is made or given came or comes into operation; or (ii) from a date that is more than 2 years before the date on which it is made or given; and (b) shall not be expressed to take effect from a date before the date on which it was made or given in a case where, if it so took effect: (i) the rights of a person (other than the Commonwealth or an authority of the Commonwealth) existing at the date it is made or given would be affected in a manner prejudicial to that person; or (ii) liabilities would be imposed on a person (other than the Commonwealth or an authority of the Commonwealth) in respect of anything done or omitted to be done before the date it is made or given; and where, in such a determination, direction or approval, provision is made in contravention of this subregulation, that provision is void and of no effect.

NAVAL FINANCIAL REGULATIONS - REG 6B
Delegations

6B. (1) The Minister may, in relation to a matter or a class of matters, by writing under his hand, delegate any of his powers and functions under these Regulations (except this power of delegation). (2) The Chief of Naval Staff may, in relation to a matter or a class of matters, delegate any of his powers and functions under these Regulations (except this power of delegation). (3) A power or function delegated by the Minister or the Chief of Naval Staff under this regulation may be exercised or performed by the delegate in accordance with the instrument of delegation. (4) A delegation under this regulation is revocable at will and does not prevent the exercise of a power or the performance of a function by the Minister or the Chief of Naval Staff, as the case may be. (5) A delegation under this regulation remains in force unless revoked by the Minister or the Chief of Naval Staff, as the case may be.

Payment of allotment after death

88. (1) Where a member dies during a period of special service and an allotment made by the member was in force immediately before his death, an amount per day equal to the amount per day of the allotment may be paid to the person to whom the allotment was payable for such period after his death as the Minister approves. (2) In subregulation (1), "special service" has the same meaning as in the Repatriation (Special Overseas Service) Act 1962-1964.

NAVAL FINANCIAL REGULATIONS - REG 88A
Compulsory deduction to satisfy maintenance order

88A. (1) Where the Minister is satisfied, after due investigation and the production of such evidence as the Minister requires by the person or by one of the persons in whose favour a maintenance order referred to in this regulation was made: (a) that the maintenance order is in force against a member; (b) that the member is not complying with the terms of the maintenance order; and (c) if the maintenance order provides for the payment of money for or towards the maintenance of a person - that the member has failed to make such other arrangements for the maintenance of that last-mentioned person as the Minister considers to be suitable; the Minister may, by instrument in writing, direct that such reasonable sums as the Minister specifies in the instrument be deducted from the salary and allowances that are or become due to the member in respect of his service and paid, in accordance with the terms of the maintenance order in force against the member, to or for the benefit of the person or persons in whose favour the maintenance order was made. (2) The Minister may, by instrument in writing, vary or revoke a direction given under this regulation or suspend the operation of such a direction for such time as is specified in the instrument. (3) Where a maintenance order in force against a member provides for the payment of sums of money periodically or by instalments, the Minister shall not, under this regulation, direct the deduction from the salary and allowances payable to the member in respect of a pay period of a sum exceeding the sum that the member is required to pay in respect of that pay period under the maintenance order. (4) Where a maintenance order in force against a member provides for the payment of money in a lump sum, the Minister shall not, under this regulation, direct the deduction from the salary and allowances payable to the member in respect of a pay period of a sum exceeding one-half of the salary payable to the member in respect of that pay period. (5) In this regulation, "maintenance order" means an order made by, registered in, or confirmed by, a court in Australia, being an order whereby a person is ordered to pay money, whether in a lump sum or by instalments, or to pay sums of money periodically: (a) for or towards the maintenance of another person or for or towards the expenses attendant upon a woman's confinement; or (b) by way of recoupment of moneys spent in, or provided for, the maintenance of another person or by way of recoupment of the expenses attendant upon a woman's confinement.

Chaplains' equipment allowance

122A. (1) An allowance, called "Chaplains' equipment allowance", is payable to an officer of the Chaplains' Branch, being an officer in the Permanent Naval Forces, to cover the purchase and maintenance of appropriate ecclesiastical vestments and equipment. (2) Chaplains' equipment allowance is payable to an officer of the Chaplains' Branch, as follows: (a) there is payable to the officer on his appointment as a member of the Permanent Naval Forces: (i) in the case of an officer who was, immediately before his appointment, an officer of the Chaplains' Branch in the Australian Naval Reserve and had been paid the amount of $25 to cover the purchase of appropriate ecclesiastical vestments and equipment or the amount of Chaplain's (Reserves) Equipment Allowance referred to in paragraph 4 (a) of Determination 0699, Chaplain's (Reserves) Equipment Allowance, made under section 58B of the Defence Act 1903 - an amount of $100; or (ii) in any other case - an amount of $125; and (b) there is payable to the officer upon the completion of each year of his service in the Permanent Naval Forces an amount of $12.50. (3) For each year or part thereof by which an officer of the Chaplains' Branch fails to complete 4 years' service, he shall repay an amount of $20. (4) Without prejudice to the right of the Commonwealth to recover by other means an amount payable to the Commonwealth under subregulation (3), that amount may be deducted from any salary and allowances that are, or become, payable to the officer in respect of his service. (5) Chaplains' equipment allowance is not payable to an officer of the Chaplains' Branch in respect of his appointment or service on or after 1 September 1984.

NAVAL FINANCIAL REGULATIONS - PART V
PART V - CHARGES AND DEDUCTIONS FROM SALARY AND ALLOWANCES

NAVAL FINANCIAL REGULATIONS - REG 123
Rent for Service residences

123. (1) Where a Service residence is provided for a member, the rental shall be such amount as the Minister directs. (2) Without prejudice to the right of the Commonwealth to recover by other means, the amount of the rental of a Service residence occupied by a member may be deducted from the salary and allowances that are or become payable to him in respect of his service.

NAVAL FINANCIAL REGULATIONS - REG 124
Supply of furniture and mess gear for Service residences and charges therefor

124. (1) Residential furniture and mess gear may be supplied for use in Service residences under such conditions as, subject to this regulation, are approved by the Minister. (2) Except as provided by subregulation (3), an annual charge, at such percentages of the departmental valuation of the articles supplied as the Minister determines, shall be made against the occupant of a Service residence in respect of furniture and mess gear supplied for use in that residence. (3) The Minister may waive payment of a charge referred to in sub-regulation (2), either in whole or in part, if the Minister considers that the circumstances justify such waiver. (4) After the close of each tenancy or after 5 consecutive years' occupation of a Service residence by a tenant, if his tenancy of the residence extends beyond that period, the residential furniture shall be surveyed and re-valued. (5) Where a member occupies a furnished Service residence, he shall be charged in accordance with this regulation for the use of the furniture, whether or not he desires to use it. (6) Without prejudice to the right of the Commonwealth to recover by other means, the amount of a charge payable by a member under this regulation may be deducted from the salary and allowances that are or become payable to him in respect of his service.

NAVAL FINANCIAL REGULATIONS - REG 125
Fuel, light and power

125. A member who is in occupation of a Service residence shall not be provided with fuel, light or power at the expense of the Commonwealth.

NAVAL FINANCIAL REGULATIONS - REG 131
Absentees and deserters - charges against salary

131. Where an absentee or deserter is taken into custody, the amount of the cost of his fare from his place of apprehension to the first ship or naval establishment to which he is brought and in which it is competent for him to be tried for the offence of absence without leave or desertion shall, except in so far as the Chief of Naval Staff otherwise approves, be deducted from the salary and allowances that are or become payable to him in respect of his service.

NAVAL FINANCIAL REGULATIONS - REG 132
Deductions in respect of payment of mess debts

132. The amount necessary to reimburse the Commonwealth for a payment in respect of an member under regulation 20A of the Naval Account Regulations shall be deemed to be a debt due and payable by the member to the Commonwealth and, without prejudice to the right of the Commonwealth to recover the amount by other means, may be deducted, in such instalments as the Minister directs, from the salary and allowances that are or become payable to the member in respect of his service.

NAVAL FINANCIAL REGULATIONS - REG 133
Over-payments during prior service in another arm of the Defence Force

133. (1) This regulation applies to and in relation to a member who, before the commencement of his current period of service in the Navy, had served in any part of the Defence Force for any period after 6 October 1939 and in respect of that previous period of service was paid a sum of money greater than the sum properly payable to him in respect of that service. (2) If the over-payment was caused by an error of the Department by which the over-payment was made, no deduction in respect of that over-payment shall be made from any amount of salary and allowances payable to the member in respect of his service. (3) If the over-payment was caused by an act or omission of the member, an amount equal to the amount of the over-payment may be deducted, in such instalments as the Minister directs, from the salary and allowances that are or become payable to the member in respect of his service.

NAVAL FINANCIAL REGULATIONS - PART VI
PART VI - MISCELLANEOUS PAYMENTS AND SUPPLIES

NAVAL FINANCIAL REGULATIONS - REG 143
Mines, torpedoes and stores - rewards for recovery etc.

143. (1) Where a person who makes a report to a local authority leading to the recovery or salvage of a naval mine, a paravane, a torpedo or stores that are the property of the Department, or assists in such recovery or salvage, the Minister may authorize payment of such amount (if any), by way of reward, as the Minister, having regard to the value of the article recovered or salvaged, and the circumstances of the recovery or salvage, thinks fit. (2) A reward under this regulation is not payable to a member of the Defence Force. (3) In this regulation, "local authority" means an officer, a postmaster or an official in charge of a post office, a justice of the peace, a member of the police force of a State or Territory, a town clerk, a deputy town clerk, a shire secretary, an officer in charge of a lighthouse or a pilot in the service of the Commonwealth or a State.

NAVAL FINANCIAL REGULATIONS - REG 149
Courses of study

149. (4) Where any fees and expenses of or incidental to a member's course of study are payable by the Commonwealth and the member engages, in connexion with that course of study, in civilian employment, the member is liable to pay to the Commonwealth an amount equal to the remuneration received by him in respect of that employment or so much of that remuneration as does not exceed the amount of salary and allowances payable to him in respect of his service during that period, whichever is the less. (5) Without prejudice to the right of the Commonwealth to recover an amount payable by a member to the Commonwealth under subregulation (4) by any other means, that amount may be deducted from the salary and allowances that are or become payable in respect of his service to the member.

Interpretation

232. (1) In this Division, unless the contrary intention appears: "separated", in relation to a member, means where the member lives apart from his spouse for other than Service reasons.

NAVAL FINANCIAL REGULATIONS - REG 240B
Reimbursement of part of fare of child of member travelling overseas

240B. (1) Subregulation (2) applies to and in relation to a member: (a) who is married; (b) who is widowed, or deserted by his spouse, and voluntarily maintains his children; or (c) who is separated or divorced from his spouse, or whose marriage has been annulled, and who has the custody of and voluntarily maintains his children; and who is serving on long term duty in an oversea country. (2) Where passages are provided at the expense of the Commonwealth for a child of a member to whom this subregulation applies between the place where the child is ordinarily residing and the place where the member is serving, the member is, in such circumstances as the Minister determines, liable to reimburse the Commonwealth an amount ascertained in such manner as the Minister determines on account of the cost of those passages. (3) Where a member is liable to reimburse the Commonwealth an amount under subregulation (2), an amount equal to that amount may be deducted from salary and allowances that are or become due to him by the Commonwealth in respect of his service.

PART XI - MEDICAL AND DENTAL TREATMENT

Medical and dental treatment

244. (1) Subject to the succeeding provisions of this regulation, medical and dental treatment of such nature and in such cases as the Minister approves shall, subject to such conditions as the Minister determines, be provided for members of the Navy by or at the expense of the Commonwealth. (3) Where a member of the Navy has been provided with medical treatment or dental treatment at the expense of the Commonwealth under subregulation (1) and the Minister is of opinion: (a) that the member has an enforceable claim against any person for damages in respect of the illness or injury for which the treatment was provided; or (b) that the expense of the treatment should not be borne by the Commonwealth for any other reason; the Minister may, by instrument, require the member to pay to the Commonwealth an amount, fixed by the Minister by that instrument, not exceeding: (c) in respect of medical treatment or dental treatment provided for the member when he was an in-patient at a service or Repatriation hospital in a State referred to in Schedule 2 - an amount calculated in accordance with Schedule 2 in respect of each day on which the member was provided with that treatment; or (d) in respect of any other medical or dental treatment - the expense incurred by the Commonwealth for that treatment. (4) Without prejudice to the right of the Commonwealth to recover by other means an amount payable under subregulation (3) by a member of the Navy to the Commonwealth, that amount may be deducted from the salary and allowances that are or become payable to the member in respect of his service. (5) In subregulation (3), the references to a member of the Navy, other than the first of those references, shall be read as including a reference to a person: (a) who, when he was a member of the Navy, was provided under this regulation with medical treatment or dental treatment at the expense of the Commonwealth; and (b) who has ceased to be a member of the Navy. (6) For the purpose of calculating an amount referred to in paragraph (3) (c), the day on which a member enters a hospital as an in-patient and the day on which he ceases to be an in-patient of the hospital shall be counted together as one day. (7) In this regulation: "dental treatment" includes the provision of advice, treatment or dental supplies and appliances by, or on the authority of, a dental officer or dental practitioner; "medical treatment" includes the provision of advice, treatment or medical supplies or appliances by, or on the authority of, a medical officer or medical practitioner, transport in an ambulance or maintenance and accommodation at a hospital; "Repatriation hospital" means a hospital established, controlled or administered by the Repatriation Commission under the Veterans' Entitlements Act 1986.

NAVAL FINANCIAL REGULATIONS - REG 300
Incorrect credits and overdrawn pay account

300. (1) Where any amount is incorrectly paid or credited to a member, that amount may be deducted from the salary and allowances that are or become payable to the member in respect of his service. (2) Where deductions are made under subregulation (1), or the pay account of a member in receipt of salary is overdrawn, the member shall be permitted to draw from his pay account such amount not being less than 10 cents per day as the Minister approves until that account is in credit.

Medical officer granted leave to study

305. (1) Where leave with pay is granted to a medical officer to undertake a course of study at his own expense and the officer is remunerated for any civil employment associated with the course of study in which he is engaged during the period of that leave, he is liable to pay to the Commonwealth so much of the amount of that remuneration as does not exceed the amount of salary and allowances payable to him in respect of that period. (1A) Where a medical officer engages in employment as a resident medical practitioner at a hospital and the officer is remunerated for that employment, the medical officer is liable to pay to the Commonwealth so much of the amount of that remuneration as does not exceed the amount of salary and allowances payable to him in respect of the period of that employment. (2) Without prejudice to the right of the Commonwealth to recover by other means an amount payable under subregulation (1) or (1A), that amount may be deducted from the salary and allowances that are or become payable to the officer in respect of his service.
