STATUTORY RULES 1964, No. 101.(h)

Officers— active pay.

1. Regulation 9 of the Naval Financial Regulations is amended by omitting sub-regulations (1.), (1A.), (1B.), (2.) and (2A.) and inserting their stead the following sub-regulations:—

“(1.) Subject to this regulation and to regulations 10 and 15 of these Regulations, the daily rate of active pay payable to—

(a) an officer of the General List;

(b) an officer of the Special Duties List;

(c) an officer of the Supplementary List;

(d) an officer of the Instructor Branch;

(e) an officer of the Naval Ordnance Design and Inspection Branch;

(f) an officer of the Medical Branch;

(g) an officer of the Dental Branch; or

(h) an officer of the Naval Dockyard Police,

is the rate specified, in relation to his rank and pay seniority, in the Third Schedule to these Regulations.

“(2.) The daily rate of active pay of an officer of the Special Duties List or the Naval Dockyard Police, being an officer who was such an officer on the twenty-fifth day of June, 1964, is—

(a) the daily rate of active pay specified in the Third Schedule to these Regulations in relation to his rank and pay seniority; or

(b) the sum of the daily rate of active pay payable to him on the twenty-fifth day of June, 1964, and Three shillings and fourpence,

whichever is the greater.”.

Officers of the Special Duties List and Naval Dockyard Police—Active pay.

5. Regulation 14 of the Naval Financial Regulations is repealed.

6.—(1.) Regulation 15 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Officers paid consolidated rates of pay.

“15.—(1.) The rate of pay of the First Naval Member of the Naval Board is a consolidated rate of pay of Six thousand one hundred and fifty pounds per year.

“(2.) The rate of pay of a Vice-Admiral appointed as Chairman, Chiefs of Staff Committee, is a consolidated rate of pay of Six thousand four hundred pounds per year.

“(3.) The rate of pay of a Rear-Admiral is a consolidated rate of pay of Five thousand six hundred and twenty-five pounds per year.

“(4.) The rate of pay of a Commodore is a consolidated rate of pay of Four thousand seven hundred and eighty-five pounds per year.

“(5.) An officer referred to in a preceding sub-regulation of this regulation is not eligible to be paid any allowance under this Part, under Division 1 of Part IV. or under Part IX. unless express provision is made for the allowance to be payable to the officer.

“(6.) Subject to such conditions as the Naval Board determines, an officer holding the rank of Captain may be paid at the consolidated rate of pay payable to a Commodore as if he held the rank of Commodore instead of at the rate of active pay payable to a Captain.

 “(7.) Where an officer holding the rank of Captain is entitled to be paid at the consolidated rate of pay payable to a Commodore—

(a) the officer is not eligible to be paid any allowance under this Part, under Division 1 of Part IV. or under Part IX. unless express provision is made for the allowance to be payable to Commodores, to Commodores or Captains or to Captains entitled to be paid at that consolidated rate of pay; and

(b) the officer shall, for the purposes of any provision of these Regulations by virtue of which an allowance may be paid to a Commodore or at a particular rate in the case of a Commodore, be deemed to be a Commodore.”.

(2.) The regulation inserted in the Naval Financial Regulations by the last preceding sub-regulation applies to and in relation to service of a Rear-Admiral on and after the twenty-sixth day of June, 1964.

(3.) The rate of active pay of a Commodore Second Class or of a Captain entitled to be paid at the daily rate of active pay of a Commodore Second Class under sub-regulation (1a.) of regulation 9 of the Naval Financial Regulations as in force immediately before the commencement of these Regulations, in respect of service on a day in the period from and including the twenty-sixth day of June, 1964, to and including the day immediately before the commencement of these Regulations, is increased by an amount equal to the amount by which the sum of—

(a) the active pay payable to him in respect of that day under those Regulations as so in force; and

(b) the allowances (being allowances not payable to a Commodore or to such a Captain, as the case may be) payable to him in respect of that day under the Naval Financial Regulations as amended by these Regulations in their application in relation to service on that day,

is less than Thirteen pounds two shillings and twopence.

(4.) The conditions approved by the Naval Board for the purpose of sub-regulation (1A.) of regulation 9 of the Naval Financial Regulations and in force immediately before the commencement of these Regulations continue in force for the purposes of sub-regulation (7.) of regulation 15 of the Naval Financial Regulations as amended by these Regulations, but may be revoked or amended by the Naval Board.

(5.) An officer entitled to be paid the rate of active pay payable to an officer holding the rank of Commodore Second Class immediately before the commencement of these Regulations is, by virtue of this sub-regulation, after the commencement of this regulation, entitled to be paid at the consolidated rate of pay payable to an officer holding the rank of Commodore while he holds the appointment of Commodore or continues to be entitled to be paid at the consolidated rate of pay payable to a Commodore, as the case may be.

14. After regulation 38 of the Naval Financial Regulations the following regulation is inserted:—

Special increase in active pay.

“38A.—(1.) Subject to the next succeeding sub-regulation, the rate of active pay of a man is, by virtue of this regulation, increased by Four shillings per day.

“(2.) The last preceding sub-regulation does not apply to—

(a) a junior recruit;

(b) a recruit (junior musician);

(c) a junior musician who has not attained the age of eighteen years; or

(d) an apprentice.”.

21.—(1.) Regulation 119 of the Naval Financial Regulations is amended by omitting from sub-regulation (3.) the words “Two shillings and sixpence per day, or One shilling and threepence” and inserting in their stead the words “Three shillings and threepence per day or One shilling and ninepence”.

 (2.) The first determination made by the Naval Board for the purposes of sub-regulation (3.) of regulation 119 of the Naval Financial Regulations as amended by these Regulations takes effect as if it had been made on the twenty-sixth day of June, 1964.

22. Regulation 178 of the Naval Financial Regulations is amended by omitting the word “sixpence” and inserting in its stead the word “ninepence”.

Application.

30.—(1.) Subject to the next succeeding sub-regulation, the amendments of the Naval Financial Regulations effected by regulations 1, 4 and 5, regulations 7 to 20 (inclusive), sub-regulation (1.) of regulation 21, regulation 22 and regulations 24 to 29 (inclusive) of these Regulations apply in relation to service in the Permanent Naval Forces on and after the twenty-sixth day of June, 1964.

(2.) The amendments of the Naval Financial Regulations effected by regulation 27 of these Regulations do not apply in relation to service of an officer of the Medical Branch or the Dental Branch before the commencement of this regulation.

(3.) The rate of active pay that would, but for this sub-regulation, be the rate of active pay for an officer of the Medical Branch or the Dental Branch in respect of service in the Permanent Naval Forces on a day in the period from and including the twenty-sixth day of June, 1964, to and

including the day immediately before the commencement of this regulation is increased by the amount by which the sum of the active pay of the officer in respect of that day under the Naval Financial Regulations as in force on that day and the allowance payable in respect of that day by virtue of regulation 11 of the Naval Financial Regulations as in force on that day is less than that sum would have been if the amendments effected by these Regulations had been in force on that day.

(4.) Where, but for this sub-regulation, a member would, by virtue of the application of the amendments of sub-regulation (3.) or (5.) of regulation 80 of the Naval Financial Regulations as from the twenty-sixth day of June, 1964, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be reduced, as the case may be, until the date of commencement of these Regulations.

(5.) Where an allotment made by a member was in force in respect of the period from and including the twenty-sixth day of June, 1964, to and including the day immediately before the commencement of these Regulations, or in respect of any part of that period, at a rate that entitled him to marriage allowance at the rate of Eight shillings and threepence per day but would not entitle him to marriage allowance at the rate of Nine shillings and sixpence per day under the Naval Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or part of the period, as the case may be, and, if he does so, marriage allowance is payable in accordance with the Naval Financial Regulations as amended by these Regulations as if his increased allotment had been in force during the period or part of the period.
