REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1965.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1965.

Amendments of the Naval Financial Regulations 

Officers’ General List—Active pay.

1.Regulation 9 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “, in the Third Schedule to these Regulations” and inserting in their stead the words “(if any), in Division 1 or Division 2 of the Third Schedule to these Regulations, whichever is applicable”.

2.Regulation 88 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Payment of allotment after death.

“88.—(1.) Where a member dies during a period of special service and an allotment made by the member was in force immediately before his death, an amount per day equal to the amount per day of the allotment may be paid to the person to whom the allotment was payable for such period after his death as the Naval Board approves.

“(2.) In the last preceding sub-regulation, ‘special service’ has the same meaning as in the Repatriation (Special Overseas Service) Act 1962-1964.”.

Members on loan from other naval forces.

3.Regulation 260 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “Royal Navy or of the Royal New Zealand Navy” and inserting in their stead the words “naval forces of a country other than Australia”.

4.Regulation 261 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:— _________________________________________________________________________________

Exchange.

“261. Where—

(a) a member of the Permanent Naval Forces is serving on exchange with the naval forces of a country other than Australia; or

(b)a member of the Naval Forces of a country other than Australia is serving on exchange with the Royal Australian Navy,

in accordance with the terms of an agreement between the Government of the Commonwealth and the Government of that country, the member is not eligible for pay, allowances or other benefits in accordance with these Regulations except to the extent to which that agreement provides for the member to be paid pay or allowances or to receive benefits in accordance with the provisions of these Regulations.”.

Active pay—general provisions.

5.Regulation 267 of the Naval Financial Regulations is amended by omitting sub-regulation (2.) and inserting in its stead the following sub-regulations:—

“(2.) The rate of active pay of an officer in respect of service to which this regulation applies is the rate specified, in relation to the rank that the officer holds, in whichever Part of Table 1 in the Seventeenth Schedule to these Regulations is applicable to the officer.

“(3.) The rate of active pay of a chaplain of the Citizen Naval Forces in respect of service to which this regulation applies is the rate specified in Table 2 in the Seventeenth Schedule to these Regulations.

“(4.) The rate of active pay of a man in respect of service to which this regulation applies is the rate specified in Table 3 in the Seventeenth Schedule to these Regulations in relation to the rating that the man holds and the branch in which the man is included.”.

Active pay—officers.

6. Regulation 272 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) The rate of active pay of an officer in respect of naval service is the rate specified, in relation to the rank that the officer holds, in whichever Part of Table 1 in the Seventeenth Schedule to these Regulations is applicable to the officer.”.

General conditions of service.

7. Regulation 281 of the Naval Financial Regulations is amended by inserting in sub-regulation (2.), after the words “these Regulations”, the words “, and of Parts XI. and XII.,”.

Cadets.

8.Regulation 282 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “of these Regulations” and inserting in their stead the words “, and the provisions of Part XI.,”; and

(b)by omitting from sub-regulation (2.) the words “Parts I. to XV. (inclusive) of these Regulations” and inserting in their stead the words “Parts I. to X. (inclusive) and Parts XII., XIII., XIV. and XV.”.

Seventeenth Schedule.

9. The Seventeenth Schedule to the Naval Financial Regulations is amended by adding at the end of Table 1 the following Part:—

Part 3.—Officers entered direct as University Undergraduates before their appointment to the appropriate branch
