REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1965.*

advice of the Federal Executive Council, hereby make the following Regulations
under the

Amendments of the Naval Financial Regulations
(
a ) by omitting from paragraph (a ) of sub-regulation (1.) the word “Eight” and inserting in its stead the word “Nine”;(
b ) by omitting from paragraph (b )of that sub-regulation the word “Seventeen” and inserting in its stead the word “Eighteen”; and(
c ) by omitting from paragraph (c ) of that sub-regulation the word “Twenty-five” and inserting in its stead the word “Twenty-seven”.
(2.) The rates of good conduct badge pay specified in regulation 48 of the Naval Financial Regulations as amended by these Regulations apply to and in relation to good conduct badge pay paid or payable in accordance with the Naval Financial Regulations in respect of the fourteenth day of February, 1966, or any subsequent day.

(2.) The rates of living out away from home allowance specified in sub-regulation (1.) of regulation 93 of the Naval Financial Regulations as amended by this regulation apply in relation to living out away from home allowance paid or payable in accordance with the Naval Financial Regulations in respect of the seventh day of March, 1966, or any subsequent day.

(2.) The rates of district allowance specified in sub-regulation (4.) of regulation 107 of the Naval Financial Regulations as amended by these Regulations apply to and in relation to district allowance paid or payable in accordance with the Naval Financial Regulations in respect of the eighteenth day of February, 1966, or any subsequent day.
“117.—(1.) In this regulation—
‘diver’ means an officer or rating, other than an officer or rating who is a clearance diver, who has the qualifications determined by the Naval Board to be the qualifications required by a diver for the purposes of this regulation;
‘clearance diver’ means an officer, or a man of the Seaman Branch, who has the qualifications determined for the purposes of the definition of diver in this regulation and also has the additional qualifications determined by the Naval Board to be the additional qualifications required by a class of clearance divers specified in the table in sub-regulation (4) of this regulation.
“(2.) Subject to such conditions as the Naval Board determines, an allowance, called ‘diving pay’, is payable to a diver or a clearance diver at the appropriate rate provided for in the succeeding sub-regulations of this regulation.
“(3.) The rate of diving pay for a diver, including a supervisory diving officer, is Fifty cents per day.
“(4.) The rate of diving pay for a clearance diver is the rate specified in the following table in relation to the class of clearance divers in which the clearance diver is included:—

(2.) In the next succeeding sub-regulation, references to an officer or man shall be read as references to an officer or man who, during the period commencing on the second day of February, 1966, and ending on the day immediately before the commencement of these Regulations (in the succeeding sub-regulations of this regulation referred to as “the relevant period”) or during a part of the relevant period, had the qualifications required for a diver for the purposes of regulation 117 of the Naval Financial Regulations as in force during the relevant period.
(3.) Where the amount of diving pay paid or payable in respect of the relevant period or a part of that period to an officer or man is less than the amount of diving pay that would have been payable to the officer or man in respect of the relevant period or the part of the relevant period if the regulation inserted in the Naval Financial Regulations by sub-regulation (1.) of this regulation and the first determination made by the Naval Board for the purposes of that sub-regulation had come into operation on the second day of February, 1966, and he had had during the relevant period or the part of the relevant period the qualifications determined by that determination to be the qualifications for a diver for the purposes of the regulation so inserted he is, by virtue of this sub-regulation, entitled to be paid an amount equal to the difference.
(4.) In the succeeding sub-regulations of this regulation, references to an officer or man shall be read as references to an officer or man who, during the relevant period or a part of the relevant period, had the qualifications required for a clearance diver for the purposes of regulation 117 of the Naval Financial Regulations as in force during the relevant period.
(5.) The Naval Board shall determine the class, being a class of clearance divers specified in the table in sub-regulation (4.) of regulation 117 of the Naval Financial Regulations as amended by these Regulations, in which each officer or man is, by virtue of his qualifications as a clearance diver during the relevant period or the part of the relevant period, to be deemed to be included for thepurposes of the next succeeding sub-regulation.
(6.) Where the amount of diving pay paid or payable to an officer or man in respect of the relevant period or a part of the relevant period is less than the amount of diving pay that would have been payable to him if the regulation inserted in the Naval Financial Regulations by sub-regulation (1.) of this regulation and the first determination made by the Naval Board for the purposes of that sub-regulation had come into operation on the second day of February, 1966, and he were included in the class of clearance divers in which he is to be deemed to be included for the purposes of this sub-regulation, he is, by virtue of this sub-regulation, entitled to be paid an amount equal to the difference.

(2.) Regulation 201 of the Naval Financial Regulations is further amended—
(
a )by omitting from sub-regulation (2.) the word “Seventeen” and inserting in its stead the word “Twenty-one”; and(
b )by omitting sub-regulation (5a.).
(3.) The rates of travelling allowance specified in sub-regulation (1.) of regulation 201 of the Naval Financial Regulations as amended by sub-regulation (1.) of this regulation apply to and in relation to travelling allowance paid or payable in accordance with the Naval Financial Regulations in respect of the fourteenth day of February, 1966, or any subsequent day.
(4.) The rate of travelling allowance specified in sub-regulation (2.) of regulation 201 of the Naval Financial Regulations as amended by sub-regulation (2.) of this regulation applies toand in relation to travelling allowance paid or payable to a member referred to in that first-mentioned sub-regulation in accordance with the Naval Financial Regulations in respect of the sixteenth day of March, 1966, or any subsequent day.
(
a ) by omitting from sub-regulation (2a.) the word “Where” and inserting in its stead the words “Subject to the next succeeding sub-regulation, where”; and(
b ) by inserting after sub-regulation (2a.) the following sub-regulation:—“(2b.) The last preceding sub-regulation does not apply to or in relation to a member included in a class of members determined by the Naval Board for the purpose of this sub-regulation.”.
(2.) Regulation 203 of the Naval Financial Regulations is further amended by omitting the table in sub-regulation (6.) and inserting in its stead the following table:—

(3.) The rates of allowance specified in sub-regulation (6.) of regulation 203 of the Naval Financial Regulations as amended by the last preceding sub-regulation apply in relation to the allowance to cover incidental expenses payable in accordance with regulation 203 of the Naval Financial Regulations in respect of the fourteenth day of February, 1966, or any subsequent day.
(2.) The rate specified in regulation 253 of the Naval Financial Regulations as amended by the last preceding sub-regulation applies in respect of good conduct increments paid or payable under the Naval Financial Regulations in respect of the fourteenth day of February, 1966, or any subsequent day.
“262ba.—(1.) The daily rate of active pay payable to a member holding the rank of Midshipman (S.L.) is Two dollars and eight cents.
“(2.) Where a member holding the rank of Midshipman (S.L.) is serving in Australia, he may be paid an allowance at such rate and subject to such conditions as the Naval Board determines.”.

“291a. A gratuity is payable to a member of the Citizen Naval Forces who renders, under sub-section (3.) of section 32a of the Act, continuous full time naval service for a period of not less than one year and serves
during the whole of that period in a vacancy in the establishment of the Permanent Naval Forces at the rate of—

c ) if the member is an officer other than a medical or dental officer—One hundred dollars per annum; or(
d ) in any other case—Forty dollars per annum.”.
(2.) Gratuity is payable under regulation 291a. of the Naval Financial Regulations as amended by the last preceding sub-regulation—
(
a ) in the case of a medical officer or a dental officer—in respect of continuous full time naval service rendered as required by that regulation, being service that the officer, on or after the fifteenth day of March, One thousand nine hundred and sixty-six, volunteered to render; and(
b ) in the case of any other member—in respect of continuous full time naval service rendered as so required on or after the ninth day of September, One thousand nine hundred and sixty-five.

(2.) The provisions of sub-regulation (1a.) of regulation 9 of the Naval Financial Regulations apply, by virtue of this sub-regulation, to and in relation to an officer referred to in that sub-regulation in respect of service on the eight day of November, 1965, or any subsequent day.
