REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1965.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1901-1965.

Amendments of the Naval Financial REGULATIONS 

1. After regulation 6a of the Naval Financial Regulations the following regulation is inserted:—

Delegations.

“6b.—(1.) The Minister may, in relation to a matter or a class of matters, by writing under his hand, delegate any of his powers and functions under these Regulations (except this power of delegation).

“(2.) The Naval Board may, in relation to a matter or a class of matters, delegate any of the Naval Board’s powers and functions under these Regulations (except this power of delegation).

“(3.) A power or function delegated by the Minister or the Naval Board under this regulation may be exercised or performed by the delegate in accordance with the instrument of delegation.

“(4.) A delegation under this regulation is revocable at will and does not prevent the exercise of a power or the performance of a function by the Minister or the Naval Board, as the case may be.

“(5.) A delegation under this regulation remains in force unless revoked by the Minister or the Naval Board, as the case may be.”.

Medical and dental officers—active pay.

2.Regulation 10 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) the words “Ten dollars and fifty-four cents” and inserting in their stead the words “Ten dollars and seventy-six cents”.

4.Regulation 15 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (3.) the words “Eleven thousand four hundred and eighteen dollars” and inserting in their stead the words “Eleven thousand five hundred and twenty-three dollars”; and

Marriage allowance.

9.Regulation 80 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “Ninety-five cents” and inserting in their stead the words “One dollar and two cents”;

(b)by omitting from sub-regulation (3.) the words “One dollar and fifty cents” (wherever occurring) and inserting in their stead the words “One dollar and fifty-seven cents”; and

(c) by omitting from sub-regulation (5.) the words “One dollar and fifty cents” (wherever occurring) and inserting in their stead the words “One dollar and fifty-seven cents”.

Qualifying allotment for payment of full rate of marriage allowance.

10.Regulation 84 of the Naval Financial Regulations is amended—

(a)by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

“(1.) Except as otherwise expressly provided by this Division, the full rate of marriage allowance is not payable to a member unless the member authorizes payment to his wife, or to an appropriate person approved by the Naval Board, of an allotment at a rate not less than—

(a) Two dollars and fifty-nine cents per day in the case of a member to whom, while living in, separation allowance is not payable; or

(b)Three dollars and twenty-nine cents per day in the case of a member to whom, while living in, separation allowance is payable.

“(1a.) Subject to the next succeeding sub-regulation, the Naval Board may determine—

(a) a rate per day for the purposes of this paragraph; and

(b) a rate per day for the purposes of this paragraph, in relation to a specified class of members.

“(1b.) A class of members shall not be specified in a determination under the last preceding sub-regulation if it includes a member who is not an apprentice, a junior recruit, a recruit junior musician or a junior musician.

“(1c) Where the Naval Board has made a determination for the purposes of sub-regulation (1a.) of this regulation in relation to a class of members, the full rate of marriage allowance is not payable—

(a) to a member included in that class of members to whom, while living in, separation allowance is not payable, unless the member authorizes payment to his wife, or to an appropriate person approved by the Naval Board, of an allotment at a rate not less than the rate determined for the purposes of paragraph (a) of that sub-regulation; or

(b)to such a member to whom, while living in, separation allowance is payable, unless the member authorizes payment to his wife, or to an appropriate person approved by the Naval Board, of an allotment at a rate not less than the rate determined for the purposes of paragraph (b)of that sub-regulation.”;

(b)by omitting from sub-regulation (2.) the words “the last preceding sub-regulation” and inserting in their stead the words “whichever of sub-regulations (1.) and (1c.) of this regulation is applicable”; and

(c) by omitting from sub-regulation (3.) the word “sub-regulation (1.)” and inserting in its stead the words “sub-regulation (1.) or (1c.)”.

Living out allowance—unmarried members.

11.Regulation 92 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and two cents” and inserting in their stead the words “One dollar and nine cents”.

Retention of lodgings allowance.

12.Regulation 94 of the Naval Financial Regulations is amended by omitting from paragraph (a)of sub-regulation (4.) the words “One dollar and two cents” and inserting in their stead the words “One dollar and nine cents”.

Supplementary travelling allowance.

13. Regulation 206a of the Naval Financial Regulations is amended by omitting the words “One dollar and two cents” and inserting in their stead the words “One dollar and nine cents”.

Application.

18.—(1.) The rates of pay and rates of allowances provided for in the Naval Financial Regulations as amended by these Regulations apply in respect of service in the Permanent Naval Forces, the Naval Emergency Reserve Forces or the Citizen Naval Forces, as the case requires, on and after the twenty-second day of July, 1966.

(2.) When the Naval Board has made its first determination for the purposes of sub-regulation (1a.) of regulation 84 of the Naval Financial Regulations as amended by these Regulations, a member referred to in sub-regulation (2.) of regulation 80 of the Naval Financial Regulations, being a member included in a class of members to whom the determination relates, may, if he has not previously made an allotment, make an allotment, at a rate per day not less than the amount applicable in relation to the member by virtue of that determination, to operate on and after the sixteenth day of April, 1966, the day on which the member entered into the Service or the day on which the member was married, whichever is the later date.

(3.) A member who has made an allotment under the last preceding sub-regulation may be paid the full rate of marriage allowance as from the date as from which the allotment operates.

(4.) Where, but for this sub-regulation, a male member would, by virtue of the application of the amendments of regulation 80 or regulation 84 of the Naval Financial Regulations as from the twenty-second day of July, 1966, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations.

(5.) Where an allotment made by a male member was in force in respect of the period from and including the twenty-second day of July, 1966, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of Ninety-five cents per day but would not entitle him to a marriage allowance at the rate of One dollar and two cents per day under the Naval Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and, if he does so, marriage allowance is payable to him in accordance with the Naval Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.
