REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1966.

Amendments of the Naval Financial Regulations.  

Interpretation.

1.Regulation 4 of the Naval Financial Regulations is amended by adding at the end thereof the following sub-regulation:

“(5.) In these Regulations, a reference to a specified year of apprenticeship training or to a specified term of apprenticeship training shall be read as a reference to the training ordinarily provided during that year, or that term, as the case may be, of a course of that apprenticeship training.”.

Special increase in active pay.

2. Regulation 38a of the Naval Financial Regulations is amended by omitting paragraph (d) of sub-regulation (2.) and inserting in its stead the following paragraph:—

(d)an Apprentice who has not commenced the eighth term of his apprenticeship training.”.

Active pay and allowances.

3.Regulation 79 of the Naval Financial Regulations is repealed and the following regulations are inserted in its stead:—

“79.—(1.) The pay account of an Apprentice shall be credited with active pay at the rate specified in relation to the stage of his training and his age in the following table:—

“(2.) From the rate of active pay credited under the last preceding sub-regulation an amount of Twenty-five cents per week during his first year of apprenticeship training and of Fifty cents per week in respect of the period from the commencement of his second year of apprenticeship training to the commencement of the eighth term of his apprenticeship training shall be retained as an accumulating credit in the pay account of the Apprentice.

“(3.) An Apprentice undergoing training under the Topmen’s Training Scheme is entitled to draw only such part of his active pay as his Commanding Officer approves and the remainder of his active pay shall be held to his credit in his pay account.

“(4.) The amount retained under sub-regulation (2.) of this regulation to the credit of an Apprentice (not being an Apprentice who is undergoing training under the Topmen’s Training Scheme) may be withdrawn by him from his pay account on or after the day on which he completes the seventh term of his apprenticeship training or his service is terminated, whichever occurs first.

“(5.) Sub-regulations (4.) and (5.) of regulation 31 of these Regulations apply to and in relation to the amount held to the credit of an Apprentice in his pay account under sub-regulation (3.) of this regulation as if the Apprentice were a man who is not an Apprentice and the amount had been held to his credit in his pay account under that regulation.

Personal expenses allowance.

“79a. An allowance, called “personal expenses allowance”, is payable at the rate of Eight cents per day to an Apprentice who has not commenced the eighth term of his apprenticeship training.

Apprentices allowances.

“79b. Subject to such conditions as the Naval Board determines—

(a)an allowance at the rate of Fifty cents per week is payable to an Apprentice while he holds the designation ‘Apprentice Captain’; and

(b) an allowance at the rate of Twenty-five cents per week is payable to an Apprentice while he holds the designation ‘Apprentice Vice-Captain’.”.

Uniform allowance.

4.Regulation 178 of the Naval Financial Regulations is amended by omitting paragraph (c) and inserting in its stead the following paragraph:

“(c) an Apprentice who has not commenced the eighth term of his apprenticeship training.”.

5.Regulation 180 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Replacement of uniform kit Junior Recruit, Recruit (Junior Musician), Junior Musician and Apprentice.

“180. A man, being a Junior Recruit under the age of seventeen years, a Recruit (Junior Musician) under the age of seventeen years, a Junior Musician under the age of seventeen years, or an Apprentice who has not commenced the eighth term of his apprenticeship training, shall be supplied at the expense of the Department with replacement of such of the articles of uniform kit appropriate to his rating as are rendered unserviceable by fair wear and tear.”.

Second Schedule.

6.The Second Schedule to the Naval Financial Regulations is amended by inserting after the word and figures—

“Regulation 76b.”

the word and figures—

“Regulation 79b.”.

Transitional.

7.—(1.) An Apprentice who commenced the eighth term of his apprenticeship training on or after the sixteenth day of January, 1967, and before the commencement of these Regulations is entitled to be paid an allowance of an amount equal to the amount by which the sum of the active pay and allowances paid or payable to him during the eighth term of his apprenticeship training, or so much of that term as occurred before the commencement of these Regulations, as the case may be, is less than the sum of the active pay and allowances that would have been payable to him if the amendments of the Naval Financial Regulations effected by these Regulations had come into operation on the sixteenth day of January, 1967.

(2.) For the purposes of the last preceding sub-regulation, an amount retained in the pay account of an Apprentice in pursuance of sub-regulation (2.) of regulation 79 of the Naval Financial Regulations shall be deemed to be an amount that was paid to the Apprentice.
