REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1966.*
I,
THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the Naval Defence Act 1910-1966.

Amendments
of the Naval Financial Regulations
Diving pay.
1. Regulation
117 of the Naval Financial Regulations is amended by inserting in
sub-regulation (2.), after the word “diver” (first occurring), the words “who
is not eligible for payment of search and rescue diver’s allowance”.
2.—(1.) After regulation
117 of the Naval Financial Regulations the following regulation is inserted:—
Search and rescue diver’s allowance.
“117a. An
allowance, called ‘search and rescue diver’s allowance’, is payable at such
rates and subject to such conditions as the Naval Board determines to a member,
being a member who has the qualifications determined by the Naval Board to be
the qualifications required by a search and rescue diver, in respect of a
period for which the member is drafted for duty as a search and rescue diver.”.
(2.) Subject to sub-regulation (4.) of this
regulation, search and rescue diver’s allowance is payable to a member in
accordance with the regulation inserted in the Naval Financial Regulations by
the last preceding sub-regulation in respect of any period, on or after the
twenty-third day of June, 1967, during which the member was or is drafted for
duty as a search and rescue diver.

For the purpose of payment of search and rescue diver’s allowance in accordance
with the last preceding sub-regulation, the first determination made by the
Naval Board under regulation 117a of
the Naval Financial Regulations as amended by these Regulations has effect as
if it had been made on the twenty-third day of June, 1967.

A member who was drafted for duty as a search and rescue diver during the
period from and including the twenty-third day of June, 1967, to and including
the day immediately before the commencement of these Regulations or during a
part of that period is not entitled to search and rescue diver’s allowance in
respect of a day of that period or that part of that period, as the case may
be, in respect of which he was paid or is entitled to be paid diving pay at the
rate of Fifty cents per day but is, by virtue of this sub-regulation, entitled
to be paid an allowance of Twenty-five cents in respect of that day.
Second Schedule.
3. The Second
Schedule to the Naval Financial Regulations is amended by inserting after the
words and figures—
“Sub-regulation (2.) of
regulation 117.”
the words and figures—
“Regulation 117a.”.
Fourth Schedule.
4. The
Fourth Schedule to the Naval Financial Regulations is repealed and the
following Schedule inserted in its stead:—

6.—(1.) An officer of the
Permanent Naval Forces who, during a period or a part of a period specified in
the second column of the following table in relation to a rank or a rank and
pay seniority specified in the first column of that table held that rank or
that rank and pay seniority is, by virtue of this regulation, entitled to
receive additional pay in respect of that period or that part of that period of
an amount equal to the amount by which the active pay paid or payable to him in
respect of that period or that part of that period under the Naval Financial
Regulations is less than the amount of active pay that would have been payable
to him if he had been entitled to receive active pay at the rate specified in
the third column of that table opposite to that period in the second column
instead of the appropriate rate specified in the Fourth Schedule to the Naval
Financial Regulations.

receive additional pay in respect of that period or that part of that period of
an amount equal to the amount by which the active pay paid or payable to him in
respect of that period or that part of that period under the Naval Financial
Regulations is less than the amount of active pay that would have been payable
to him if he had been entitled to receive active pay at the rate specified in
the third column of that table opposite to that period in the second column
instead of the appropriate rate specified in Part 2 of Table 1 in the
Seventeenth Schedule to the Naval Financial Regulations.

Application.
7.The rates of active pay
provided for in the Naval Financial Regulations as amended by these Regulations
in respect of an officer of the Medical Branch or Dental Branch apply in
respect of service in the Permanent Naval Forces, the Naval Emergency Reserve
Forces or the Citizen Naval Forces, as the case requires, on and after the
seventh day of July, 1967.
