REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1968*

I THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1968.

Amendments of the Naval Financial Regulations 

Officers eligible for command money.

1. Regulation 19 of the Naval Financial Regulations is amended by inserting after sub-regulation (3.) the following sub-regulations:—

“(3a.) Subject to sub-regulation (3c.) of this regulation, command money is payable to the officer appointed to command a submarine upon its commissioning in respect of a day or two or more consecutive days on which the submarine undergoes sea trials or basin diving before the date on which the submarine is commissioned.

“(3b.) Subject to the next succeeding sub-regulation, command money is payable to the officer appointed in command of a submarine in respect of a day or two or more consecutive days on which the submarine undergoes sea trials or basin diving after it has been commissioned but before it has been accepted by the Commonwealth.

“(3c.) Where an officer is directed to command a submarine on sea trials or basin diving and command money would, but for this sub-regulation, be payable to another officer in respect of that day or those days under either of the last two preceding sub-regulations, command money is, by virtue of this sub-regulation, payable to the officer so directed in respect of that day or those days in place of that other officer.

“(3d.) Where command money is payable to an officer under one of the last three preceding sub-regulations in respect of a day or of two or more consecutive days, the officer is also entitled to be paid command money in respect of the two days immediately preceding that day or the first of those days.”.

Conditions of payment of command money.

2. Regulation 20 of the Naval Financial Regulations is amended by inserting after sub-regulation (1.) the following sub-regulation:—

“(1a.) Command money is payable to an officer appointed in command of a submarine from and including the day that is two days before the day on which the submarine is commissioned or, if it is accepted by the Commonwealth after it has been commissioned, before the day on which it is so accepted.”.

3. Regulation 76 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Aircrewman flying allowances.

“76. Subject to such conditions as the Naval Board determines—

(a) an allowance, called ‘aircrewman flying allowance’, at the rate of Thirty-five cents per day; and

(b) an allowance, called ‘special qualification allowance’, at the rate of Forty cents per day,

are payable to an aircrewman in respect of such period, not being a period in respect of which the allowances provided for by regulation 76b of these Regulations are payable to him, as the Naval Board determines.”.

4. Regulation 76b of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Underwater Control (Air) allowances.

“76b. Subject to such conditions as the Naval Board determines—

(a) an allowance, called ‘flying pay (U.C. (Air) )’, at the rate of Thirty-five cents per day; and

(b) an allowance, called ‘special qualification allowance’, at the rate of Forty cents per day,

are payable, in respect of such period as the Naval Board determines, to a man who is qualified for Underwater Control (Air) duties.”.

5.—(1.) Regulation 108 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Woomera allowance.

“108.—(1.) Subject to this regulation, an allowance, called “Woomera allowance”, is payable to—

(a) a member who is appointed or drafted for service at the Weapons Research Establishment, Woomera; and

(b) a member who, not having been so appointed or drafted, serves at that Establishment for a continuous period exceeding thirty days.

“(2.) Woomera allowance is payable at such rate or rates, for such period and subject to such conditions as the Naval Board determines.

“(3.) The Naval Board may determine different rates of Woomera allowance according to different facts and circumstances specified in the determination.”.

(2.) The first determination made by the Naval Board after the commencement of these Regulations in respect of Woomera allowance may determine rates of that allowance, according to different facts and circumstances specified in the determination, in relation to a period or periods included in the period from and including the twenty-fifth day of June, 1963, to and including the day immediately before the commencement of these Regulations.

(3.) Where the Naval Board has, under the last preceding sub-regulation, determined rates of Woomera allowance in respect of a period, the rate at which Woomera allowance is payable to a member in respect of that period is the appropriate rate so determined or the appropriate rate specified in regulation 108 of the Naval Financial Regulations as in force during that period, whichever is the higher rate.

 

Second Schedule.

6. The Second Schedule to the Naval Financial Regulations is amended by inserting after the words and figures—

“Sub-regulation (3.) of regulation 107.”

the words and figures—

“Sub-regulation (2.) of regulation 108.”.

Application.

7.—(1.) Command money is payable as provided in regulation 19 of the Naval Financial Regulations as amended by these Regulations in relation to any sea trials or basin diving of a submarine that occurred or occur on or after the seventeenth day of November, 1966.

(2.) Command money is payable, as provided in regulation 20 of the Naval Financial Regulations as amended by these Regulations, in respect of the seventeenth day of November, 1966, or any subsequent day.

(3.) Where a member who was not entitled to be paid any allowances under regulation 76 or 76b of the Naval Financial Regulations in respect of the period from and including the eighteenth day of September, 1967 to and including the day immediately before the date of commencement of these Regulations or in respect of a part of that period would have been entitled to be paid allowances in respect of that period or that part of that period under regulation 76 or regulation 76b of the Naval Financial Regulations as amended by these Regulations if those Regulations and the first determination made by the Naval Board for the purpose of each of those Regulations had been in operation during that period, the member is, by virtue of this sub-regulation, entitled to be paid an amount equal to the amount of the allowances that would have been so payable to him.
