under the

Amendments of the Naval Financial Regulations
“Division I.—Officers, including Cadet Midshipmen appointed under the Upper Yardman Training Scheme (Regulations 9-27).”
and inserting in their stead the words and figures—
“Division 1.—Officers, including Cadet Midshipmen appointed from within the Naval Service (Regulations 9-27)”.

“(2.) The next succeeding sub-regulation applies to and in relation to an officer, other than an officer on the Special Duties List, who was a man immediately before he was appointed an officer.

“(3.) Subject to sub-regulation (6.) of this regulation, where an amount equal to the sum of—
(
a ) the daily rate of active pay that would, but for this sub-regulation, be applicable under sub-regulation (1.) of this regulation or under sub-regulation (3.) of regulation 29 of these Regulations, as the case may be, to an officer to whom this sub-regulation applies; and(
b ) the daily rate at which surveying pay or submarine pay, if payable, is payable to the officer,
is less than an amount equal to the sum of—
(
c ) the daily rate of active pay that was applicable to the officer on the day immediately before he was appointed an officer; and(
d ) the daily rate at which any allowance, or the daily rates at which any allowances, payable to him under regulation 40, 41 or 77 of these Regulations in respect of that day was or were so payable,
the daily rate of active pay of the officer is a rate equal to that higher sum.
“(4.) The next succeeding sub-regulation applies to and in relation to an officer on the Special Duties List who was a man immediately before he was appointed an officer.
“(5.) Subject to the next succeeding sub-regulation, where an amount equal to the sum of—
(
a ) the daily rate of active pay that would, but for this sub-regulation, be applicable under sub-regulation (1.) of this regulation to an officer to whom this sub-regulation applies; and
(
(
c ) the daily rate of active pay applicable to the officer on the day immediately before he was appointed an officer; and(
d ) the daily rate at which any allowance, or the daily rates at which any allowances, payable to him under regulation 40, 41 or 77 of these Regulations in respect of that day was or were so payable,
the daily rate of active pay of the officer is—
(
e ) if he holds the rank of Sub-lieutenant—(i) if a daily rate equal to the specified amount is equal to a daily rate applicable to an officer holding that rank or exceeds the highest daily rate of active pay applicable to such an officer—a daily rate equal to the specified amount; or
(ii) in any other case—whichever daily rate of active pay applicable to a Sub-lieutenant is higher or next higher than a daily rate equal to the specified amount; or
(
f ) if he holds the rank of Lieutenant—a daily rate equal to the specified amount.
“(6.) Sub-regulations (3.) and (5.) of this regulation apply to and in relation to an officer who was appointed an officer upon or before the first day of March, 1968, as if a reference to an amount equal to the sum of—
(
a ) the daily rate of active pay that was applicable to the officer on the day immediately before he was appointed an officer; and(
b ) the daily rate at which any allowance, or the daily rates at which any allowances, payable to him under regulation 40, 41 or 77 of these Regulations in respect of a day was or were so payable,
were read as a reference to an amount determined by the Naval Board in respect of the officer for the purpose of this sub-regulation having regard to—
(
c ) the daily rate of active pay applicable on the first day of March, 1968, to a man who holds the same rating as the officer held immediately before he was appointed an officer, who is included in the Category of the Branch in which the officer was then included, who held the qualifications that the officer then held and held a number of good conduct badges equal to the number of good conduct badges then held by the officer; and(
d ) the allowances that would have been payable to the officer if, on the first day of March, 1968, he had occupied the position on a complement of a ship or naval establishment that he occupied immediately before he was appointed an officer and the amendment of these Regulations effected by the Statutory Rule by which this sub-regulation was inserted in the Naval Financial Regulations and any determinations made for the purpose of a regulation as so amended had come into operation on the first day of March, 1968.”.
(
a ) by omitting from sub-regulation (1.) the words “to sub-regulation (3a.) of regulation 9 of these Regulations and”; and(
b ) by adding at the end thereof the following sub-regulation:—
“(7.) An officer who is entitled to be paid active pay at the rate provided for by sub-regulation (3.) or (5.) of regulation 9 of these Regulations is not eligible to be paid surveying pay under this regulation.”.
(
a ) by omitting from sub-regulation (1.) the words “to sub-regulations (3.) and (3a.) of regulation 9 of these Regulations and”; and(
b ) by adding at the end thereof the following sub-regulation:—
“(6.) An officer who is entitled to be paid active pay at the rate provided for by sub-regulation (3.) or (5.) of regulation 9 of these Regulations is not eligible to be paid submarine pay under this regulation.”.
“31.—(1.) Subject to the next five succeeding sub-regulations, the daily rate of active pay of a man who holds the rating of Able Seaman or a higher rating is the rate specified in Part I., Part II., Part III., Part IV. or Part V. (whichever is appropriate) of the Fifth Schedule to these Regulations in relation to the rating that he holds, the group in which he is included, and, if relevant, his pay seniority.
“(2.) A Chief Petty Officer who has not less than four years’ pay seniority is not eligible to be paid at a rate of active pay higher than that payable to a Chief Petty Officer included in the group in which he is included and having less than four years’ pay seniority unless the Naval Board approves his being paid at a higher rate.
“(3.) Where—
(
a ) a man who holds the rating of Petty Officer is included in the Mechanician Category of the Marine Engineering Branch and does not hold an Engineroom Watchkeeping Certificate; and(
b ) immediately before the man became included in that Category, he held the rating of Petty Officer and was included in the Engineering Mechanic Category of the Marine Engineering Branch,
the rate of active pay of the man is a rate equal to his rate of active pay immediately before he became included in the Mechanician Category.
“(4.) The last preceding sub-regulation applies to and in relation to a man who became included in the Mechanician Category of the Marine Engineering Branch before the second day of March, 1968, as if the reference to the rate of active pay of the man immediately before he became included in that Category were read as a reference to the rate of active pay payable on the first day of March, 1968, to a man included in that Category who held the rating of Petty Officer and had the like pay seniority and qualifications as the man had immediately before he became included in that Category.
“(5.) Subject to sub-regulation (7.) of this regulation, where—
(
a ) a man was serving in the Permanent Naval Forces on the twenty-ninth day of February, 1968 (hereinafter called ‘the specified date’);(
b ) the man held on the specified date the rating of Chief Petty Officer or Petty Officer;(
c ) the man holds on a day (hereinafter called ‘the relevant day’) the same rating that he held on the specified date; and(
d ) the prescribed rate in relation to the man for the purpose of this sub-regulation is higher than the rate of active pay that would, but for this sub-regulation, be applicable to the man under these Regulations in respect of the relevant day,
the rate of active pay of the man in respect of the relevant day is that higher rate.
“(6.) Subject to the next succeeding sub-regulation, where—
(
a ) a man was serving in the Permanent Naval Forces on the twenty-ninth day of February, 1968 (hereinafter called ‘the specified date’);(
b ) the man held on the specified date the rating of Leading Seaman or a lower rating;(
c ) the man holds on a day (hereinafter called ‘the relevant day’) the same rating that he held on the specified date; and(
d ) the prescribed rate in relation to the man for the purpose of this sub-regulation is higher than the rate of active pay (including any good conduct increment) that would, but for this sub-regulation, be applicable to the man under these Regulations in respect of the relevant day,
the rate of active pay of the man in respect of the relevant day is the rate ascertained by deducting from the prescribed rate the rate at which good conduct increment (if any) is payable to him.
“(7.) Sub-regulation (5.) or (6.), as the case may be, of this regulation does not apply to or in relation to a man if—
(
a ) a change in the duties to be performed by the man occurred after the twenty-ninth day of February, 1968, and before the commencement of this sub-regulation, being a change effected at his own request; and(
b ) as a result of that change, the man is, on the date of commencement of this sub-regulation, included in a group lower than the group in which he would have been included on that date if the change had not occurred.
“(8.) Sub-regulation (5.) or (6.), as the case may be, of this regulation ceases to apply to a man if, after the commencement of this sub-regulation, the man is, as a result of a change in the duties to be performed by him, being a change effected at his own request, included in a group lower than the group in which he was included immediately before that change.
“(9.) For the purpose of sub-regulation (5.) of this regulation, ‘the prescribed rate’ in relation to a man, is a rate equal to the sum of the rate at which active pay was payable to the man under regulation 31, 32, 33, 34 or 35 of the Naval Financial Regulations immediately before the specified date and the rates at which any allowances that were payable to the man immediately before the specified date under regulations 39, 43, 44, 45, 46, 57 and 60 of these Regulations were so payable.
“(10.) For the purpose of sub-regulation (6.) of this regulation, ‘the prescribed rate’, in relation to a man, means a rate equal to the sum of the rate of active pay that was payable to the man on the specified date and the rate at which any good conduct badge pay that was payable to the man on that date was so payable.
“(11.) The daily rate of active pay of a man who holds the rating of Recruit is the rate specified in the Fifth Schedule to these Regulations in relation to a man holding the rating of Able Seaman and included in Group 1.
“(12.) The daily rate of active pay of a man who holds the rating of Ordinary Seaman or Able Seaman, Second Class, is—
(
a ) if he has less than six months’ pay seniority—the rate specified in the Fifth Schedule to these Regulations in relation to a man holding the rating of Able Seaman and included in Group 1; or(
b ) in any other case—the rate specified in the Fifth Schedule to these Regulations in relation to a man holding the rating of Able Seaman and included in Group 3.
“(13.) The daily rate of active pay of a man who holds the rating of Junior Recruit or Junior Musician is the rate specified in the Sixth Schedule to these Regulations in relation to his rating and his age.
“32.—(1.) The Naval Board may determine that men—
(
a ) of a particular Branch;(
b ) included in a particular Category of a particular Branch;(
c ) holding a particular rating and included in a particular Category of a particular Branch; or(
d ) having particular qualifications, holding a particular rating and included in a particular Category of a particular Branch,
shall be taken, for the purpose of the last preceding regulation, to be included in a particular group.
“(2.) A determination under the last preceding sub-regulation may be expressed to take effect from the first day of March, 1968, or any subsequent date not earlier than two years before the date on which it is made and, if it is expressed to take effect from any date except the date on which it is made, men of the Permanent Naval Forces are, subject to the next succeeding sub-regulation, entitled to be paid active pay as if it had been made on the date from which it is expressed to take effect and had come into force immediately it had been made.
“(3 ) Paragraph (
“33.—(1.) A Junior Recruit, Junior Musician or man undergoing training under the Topmen’s Training Scheme is entitled to draw only such part of his active pay as his Commanding Officer approves, and the remainder of his active pay shall be held to his credit in his pay account.
“(2.) Subject to sub-regulation (4.) of this regulation, the amount held to the credit of a Junior Recruit or a Junior Musician in accordance with the last preceding sub-regulation may be withdrawn by him from his pay account on or after the day on which he is promoted to the rating of Ordinary Seaman or an equivalent rating.
“(3.) Subject to the next succeeding sub-regulation, the amount held to the credit of a man undergoing training under the Topmen’s Training Scheme may be withdrawn by him from his pay account—
(
a ) in the case of a man who is not selected to enter the College as a Cadet Midshipman upon the completion of his training under that scheme—on or after the day on which he is promoted to the rating of Ordinary Seaman or an equivalent rating or on which he completes his training under that scheme, whichever last occurs; or(
b ) in the case of a man who is selected to enter the College as a Cadet Midshipman—on or after the day on which he is promoted to the rank of Midshipman.
“(4.) Where the services of a member to whose credit an amount is held under sub-regulation (1.) of this regulation are terminated before he would otherwise become entitled to withdraw the amount, the amount shall be paid to the member.
“(5.) In this regulation, references to a man shall be read as references to a man who is not an Apprentice”.
“(2.) Subject to the succeeding sub-regulations of this regulation, the daily rate of active pay of a Constable to whom this regulation applies is Six dollars eight cents”.
(
a ) by omitting sub-regulation (2.) and inserting in its stead the following sub-regulation:—“(2.) Subject to the succeeding sub-regulations of this regulation, the daily rate of active pay of a Sergeant or Constable to whom this regulation applies is the rate specified in the Seventh Schedule to these Regulations in relation to the rating that he holds and his pay seniority.”; and
(
b ) by omitting from sub-regulation (3.) the words “four years’ pay seniority” and inserting in their stead the words “less than six years’ pay seniority”.
“38.—(1.) This regulation applies—
(
(
b ) to a man who holds the rating of Constable in the Naval Dockyard Police and whose rate of active pay, but for this regulation, would not exceed the rate specified in the Fifth Schedule to these Regulations in relation to a man who holds the rating of Leading Seaman and is included in Group 7.
“(2.) Subject to such conditions as the Naval Board determines, the daily rate of active pay of a man to whom this regulation applies may be increased by a good conduct increment of Fourteen cents if he has completed five years’ service and by a further good conduct increment of Fourteen cents if he has completed ten years’ service.
“(3.) In the last preceding sub-regulation, ‘service’ means service of such a kind as the Naval Board determines to be service for the purpose of that sub-regulation.
“(4.) The next succeeding sub-regulation applies to
and in relation to a Chief Petty Officer, a Petty Officer and a man of the
Naval Dockyard Police other than a Constable referred to in paragraph (
“(5.) Subject to the next three succeeding sub-regulations, where a man to whom this sub-regulation applies was in receipt of good conduct badge pay immediately before the commencement of this sub-regulation, the daily rate of active pay of the man may be increased by a good conduct increment—
(
a ) if he held one good conduct badge on the prescribed day—at the rate of Nine cents per day;(
b ) if he held two good conduct badges on the prescribed day—at the rate of Eighteen cents per day; or(
c ) if he held three good conduct badges on the prescribed day—at the rate of Twenty-seven cents per day.
“(6.) Where the daily rate of active pay of a man is increased by reason of—
(
a ) his promotion to a higher rating;(
b ) his inclusion in a higher group;(
c ) his having attained additional pay seniority; or(
d ) an increase in the rate of active pay applicable to men holding the like rating as the man holds, included in the like group as the man is included and having the like pay seniority as the man has,
the rate per day at which good conduct increment is payable to the man under the last preceding sub-regulation is reduced by the amount per day of that increase or, if that amount exceeds the rate per day at which good conduct increment would otherwise be so payable to the man, the man ceases to be entitled to the payment of good conduct increment under that sub-regulation.
“(7.) Where a man had been awarded a good conduct badge for which he was not qualified or was awarded a good conduct badge on or after the twenty-fifth day of October, 1968, the holding of that badge shall be disregarded for the purpose of payment of the increment provided for in sub-regulation (5.) of this regulation.
“(8.) Where a man who is in receipt of the increment provided for in sub-regulation (5.) of this regulation is deprived of a good conduct badge, that sub-regulation applies to and in relation to the man on and after the day on which he is deprived of the badge, as if he had not held that badge on the prescribed day.
“(9.) In this regulation, ‘the prescribed day’ means the day immediately preceding the day on which this sub-regulation came into operation.”.
“39.—(1.) Subject to the next succeeding sub-regulation and to such conditions as the Naval Board determines, an allowance, called ‘special responsibility allowance’, is payable—
(
a ) to a man included in the Cook Category of the Supply and Secretariat Branch who performs or has performed the duties of a position of Cookery Officer;(
b ) to a man who holds the rating of Chief Petty Officer, is included in the Sick Berth Category of the Medical Branch and performs or has performed the duties of a position of Wardmaster Officer;(
c ) to a man who holds the rating of Petty Officer, is included in the Sick Berth Category of the Medical Branch and performs or has performed, for a period exceeding seven days, the duties of a position of Wardmaster Officer in a ship or naval establishment the complement of which provides a position for a Chief Petty Officer included in the Sick Berth Category of that Branch; and(
d ) to a man included in the Writer Category of the Supply and Secretariat Branch who performs or has performed the duties of Captain’s Secretary in a ship or naval establishment the complement of which provides for an officer of that Branch to perform those duties.
“(2.) A man who performs the duties of a position is not entitled to be paid special responsibility allowance under the last preceding sub-regulation if his rate of active pay exceeds the rate of active pay of an officer holding the rank for that position and having less than one year’s pay seniority.
“(3.) Special responsibility allowance is payable—
(
a ) for such period as the Naval Board determines; and(
b ) at the rate of Twenty-five cents per day or, if the amount by which the rate of active pay of an officer holding the rank for the position and having less than one year’s pay seniority exceeds the rate of active pay of the man by less than Twenty-five cents, at a rate per day equal to that amount.
“40. Where a man of the Air Electrical Branch, the Air Engineering Branch, the Electrical Branch or the Marine Engineering Branch who is qualified as a Technical Officer’s Writer performs or has performed the duties of a position of Technical Officer’s Writer in a ship or naval establishment, an allowance, called ‘Technical Officer’s Writer allowance’, is payable to the man, at the rate of Twenty-five cents per day, subject to such conditions as the Naval Board determines and for such period as the Naval Board determines.
“41. Where—
(
a ) the duties of a position on the complement of a ship or naval establishment are, in accordance with the organization of the Naval Forces, required to be performed by a man who is a qualified advanced nurse, a qualified dispenser, a qualified hygiene inspector, a qualified laboratory assistant, a qualified masseur, a qualified operating room assistant or a qualified X-ray assistant or who is qualified in naval aviation medicine or underwater medicine; and(
b ) a man included in the Sick Berth Category of the Medical Branch who has the relevant qualifications performs or has performed the duties of the position,
an allowance, called ‘Medical Branch Specialist allowance’, is payable to him subject to such conditions as the Naval Board determines, for such period as the Naval Board determines and at the rate of—
(
c ) if the duties are required to be performed by a man who is a qualified X-ray assistant—One dollar per day;(
d ) if the duties are required to be performed by a man who is a qualified hygiene inspector—Seventy-five cents per day; or(
e ) in any other case—Twenty-five cents per day.”.
“76.—(1.) Subject to such conditions as the Naval Board determines, an allowance, called ‘Aircrewman flying pay’, is payable to a man of the Aircrew Branch, and to a man included in the Aircrewman Category of the Naval Airman Branch, at the rate specified in the following table in relation to the rating that he holds:—

“(2.) Where the Naval Board so approves, a Chief Airman or Chief Observer who is entitled to Aircrewman flying pay under the last preceding sub-regulation may be paid that pay at the rate of One dollar thirty-seven cents per day in lieu of the rate at which it is payable under that sub-regulation.”.
(2.) A man included in the Aircrewman Category of the Naval Airman Branch is entitled to be paid an amount equal to the amount by which the amount of Aircrewman flying pay that was paid or payable to him under regulation 76 of the Naval Financial Regulations as in force immediately before the commencement of these Regulations in respect of the period from and including the first day of March, 1968, to and including the day immediately before the commencement of these Regulations is less than the amount of Aircrewman flying pay that would have been payable to him in respect of that period if the amendment of the Naval Financial Regulations effected by the last preceding sub-regulation had come into operation on the first day of March, 1968.
(3.) A member of the Aircrew Branch is entitled to be paid Aircrewman flying pay as if the amendment of the Naval Financial Regulations effected by sub-regulation (1.) of this regulation had come into force on the first day of March, 1968.
Underwater Control (Air) allowances.
“117.—(1.) In this regulation—
‘diver’ means an officer or man, other than an officer or man who is a clearance diver, who has the qualifications determined by the Naval Board to be the qualifications required by a diver for the purpose of this regulation;
‘clearance diver’ means an officer, or a man of the Seaman Branch, who has the qualifications determined for the purpose of the definition of diver in this regulation and also has the additional qualifications determined by the Naval Board to be the additional qualifications required by a clearance diver.
“(2.) Subject to such conditions as the Naval Board determines, an allowance, called ‘diving pay’, is payable to—
(
a ) a diver who is not eligible for payment of search and rescue diver’s allowance at the rate of Fifty cents per day; and(
b ) an officer who is a clearance diver at the rate of One dollar twenty cents per day.”.
“128. Where the punishment known as ‘Reduction to the Second Class for Conduct’ is imposed on a man for a period, the rates at which active pay and any good conduct increment or allowance payable to him under regulation 38, 39, 40 or 41 of these Regulations are payable to him in respect of the period are rates equal to five-sixths of the rates at which they would otherwise be payable to him.”.
(
a ) by omitting from the definition of “pay” the words “or former member”; and(
b ) by omitting from that definition the words “to the member’s rank or rating” and inserting in their stead the words “, in the case of an officer, to the officer’s rank and pay seniority or, in the case of a man, to the man’s rating and pay seniority and, if relevant, the group in which he is included”.
“253.—(1.) The daily rate of active pay of a servicewoman who holds the rating of Wran or a higher rating is the rate specified in Part I., Part II., Part III., Part IV. or Part V. (whichever is appropriate) of Table 2 in the Fifteenth Schedule to these Regulations in relation to the rating that she holds, the group in which she is included, and, if relevant, her pay seniority.
“(2.) The Naval Board shall determine that servicewomen—
(
a ) of a particular Branch;(
b ) included in a particular Category of a particular Branch; or(
c ) holding a particular rating and included in a particular Category of a particular Branch,
shall be taken, for the purpose of the last preceding sub-regulation, to be included in a particular group.
“(3.) The daily rate of active pay of a servicewoman who holds the rating of Recruit is the rate specified in Table 2 of the Fifteenth Schedule to these Regulations in relation to a servicewoman who holds the rating of Wran and is included in Group 1.
“254.—(1.) Subject to such conditions as the Naval Board determines, the daily rate of active pay of a servicewoman who holds the rating of Leading Wran or a lower rating may be increased by a good conduct increment of Nine cents if she has completed five years’ service in the Women’s Service and by a further good conduct increment of Nine cents if she has completed ten years’ service in that Service.
“(2.) In the last preceding sub-regulation, a reference to service in the Women’s Service shall be read as a reference to service of such a kind as the Naval Board determines to be or to be deemed to be service in the Women’s Service for the purpose of that sub-regulation”.
“(2.) Where an officer who holds a particular rank and has a particular pay seniority renders continuous full time naval service to which this regulation applies, the rate of active pay of the officer in respect of that service is the rate applicable under these Regulations to an officer of the Permanent Naval Forces who holds the like rank and has the like pay seniority.
“(2aa.) Where a man who holds a particular rating, is included in a particular group and has a particular pay seniority renders continuous full time naval service to which this regulation applies, the rate of active pay of the man in respect of that service is the rate applicable under these Regulations to a man of the Permanent Naval Forces who holds the like rank, is included in the like group and has the like pay seniority as the man.
“(2ab.) For the purpose of calculating the rate of active pay of a man under the last preceding sub-regulation, the man shall be taken to be included in the group in which are included men of the Permanent Naval Forces who hold the rating and qualifications that the man holds, who are members of the Branch of which the man is a member and who are included in the Category of that Branch in which the man is included.
“(2ac.) A Chief Petty Officer who is rendering continuous full time naval service to which this regulation applies and has not less than four years’ pay seniority is not eligible to be paid at a rate of active pay higher than that payable to a Chief Petty Officer included in the group in which he is included and having less than four years’ pay seniority unless the Naval Board approves his being paid at a higher rate.”.

Part I.—Allowances payable to a member of the Naval
Emergency Reserve Forces or the Citizen Naval Forces only in respect of

section 32 of the

Part II.—Allowance payable to members of the Naval Emergency Reserve Forces or Citizen Naval Forces only in respect of continuous full time naval service:—
Retention of lodgings allowance.
(2.) This regulation applies to service of a man of the Permanent Naval Forces during the relevant period in respect of which active pay was paid or is payable to him under regulation 31, 32, 33, 34 or 35 of the Naval Financial Regulations as in force during that period.
(3.) The Naval Board may determine, in relation to the Branches, or to the Categories of the Branches, that existed during the relevant period or a part of the relevant period, that men—
(
(
(
(
d ) having particular qualifications, holding a particular rating and included in a particular Category of a particular Branch,
shall, for the purpose of sub-regulation (5.) of this regulation, be deemed to have been included, on each day during the relevant period or on each day during a specified part of that period, in a particular group, being a group specified in the Fifth Schedule to the Naval Financial Regulations as amended by these Regulations.
(4.) Subject to the last preceding sub-regulation, where, on a day in the relevant period—
(
(
(
c ) a man held a particular rating, and was included in a particular Category of a particular Branch; or(
d ) a man held particular qualifications and a particular rating and was included in a particular Category of a particular Branch,
and the man would, by reason of that fact, have been included in a particular group specified in the Fifth Schedule to the Naval Financial Regulations as amended by these Regulations if regulations 31 and 32 of those Regulations as so amended and the first determination made by the Naval Board for the purpose of regulation 32 of those Regulations had been in force on that day, the man shall be deemed to have been included in that group for the purpose of the next succeeding sub-regulation on that day.
(5.) Where the amount of active pay that would have been payable to a man in respect of service to which this regulation applies during the relevant period while holding the rating of Leading Seaman or a lower rating if—
(
a ) regulation 31 of, and the Fifth Schedule to, the Naval Financial Regulations as amended by these Regulations had been in force during that period;(
b ) regulation 38 of the Naval Financial Regulations as so amended and the first determinations made by the Naval Board for the purposes of sub-regulation (2.) and (3.), respectively, of that regulation had come into force on the first day of that period; and(
c ) the man had been included on each day in that period in the group in which he is to be deemed to have been included on that day under the preceding sub-regulations of this regulation,
exceeds the amount of active pay paid or payable to the man in respect of that service under the Naval Financial Regulations as in force in that period when aggregated with the amounts of any prescribed allowances that were paid or are payable to him in respect of that service, the man is entitled to be paid, as active pay, an amount equal to the excess.
(6.) For the purpose of the last preceding sub-regulation—
(
a ) a prescribed allowance means an allowance or pay payable under regulation 39, 41, 43, 44, 45, 46, 48, 49, 50, 51, 57, 59, 60, 61, 63, 64, 65, 66, 68, 69, 71, 72, 76b, 119b or 120 of the Naval Financial Regulations, and(
b ) diving pay payable under regulation 117 of the Naval Financial Regulations to a man who was a clearance diver during the relevant period or a part of that period shall be deemed to be a prescribed allowance.
(7.) Sub-regulation (5.) of this regulation applies to and in relation to service to which this regulation applies by a man during the relevant period while holding the rating of Chief Petty Officer or Petty Officer as if—
(
a ) the reference in that sub-regulation to the rating of Leading Seaman or a lower rating were read as a reference to the rating of Chief Petty Officer or Petty Officer;(
b ) paragraph (b ) of that sub-regulation had been omitted;(
c ) good conduct badge pay provided for in regulation 48 of the Naval Financial Regulations as in force during the relevant period was not a prescribed allowance for the purpose of that sub-regulation; and(
d ) in a case where the Naval Board determines that this paragraph shall apply to a Chief Petty Officer in respect of the relevant period or a part of that period, the rate of active pay that would have been payable to the Chief Petty Officer under regulation 31 of, and the Fifth Schedule to, the Naval Financial Regulations as amended by these Regulations in respect of service during that period or that part of that period were the appropriate rate specified in the Fifth Schedule in relation to his actual pay seniority in lieu of the rate so specified in relation to a Chief Petty Officer with less than 4 years’ pay seniority.
(8.) The daily rate of active pay of a man in respect of service during the relevant period while holding the rating of Ordinary Seaman or Able Seaman, Second Class, is—
(
a ) in the case of a man with less than six months’ pay seniority—Four dollars fifty-eight cents; and(
b ) in the case of a man with more than six months’ pay seniority—(i) in respect of service before the seventh day of May, 1968—
Four dollars eighty-six cents; or
(ii) in respect of any other case—Five dollars twelve cents,
(2.) This regulation applies to service of a man of the Permanent Naval Forces during the relevant period in respect of which active pay was paid or is payable to him under regulation 36 or 37 of the Naval Financial Regulations as in force during that period.
(3.) Subject to the next succeeding sub-regulation, where the amount of active pay that would have been payable to a Constable in the Naval Dockyard Police in respect of service to which this regulation applies during the relevant period if—
(
a ) regulations 36 and 37 of, and the Seventh Schedule to, the Naval Financial Regulations as amended by these Regulations had been in force during that period; and(
b ) regulation 38 of the Naval Financial Regulations as so amended and the first determinations made by the Naval Board for the purposes of sub-regulations (2.) and (3.), respectively, of that regulation had come into force on the first day of that period,
exceeds an amount equal to the sum of the active pay paid or payable to the Constable in respect of that service under the Naval Financial Regulations as in force in that period and of any good conduct badge pay paid or payable to him in respect of that service, the man is entitled to be paid, as active pay, an amount equal to the excess.
(4.) The last preceding sub-regulation does not apply to or in relation to service of a Constable in the Naval Dockyard Police whose rate of active pay in respect of that service would have exceeded Six dollars eighty-four cents per day if regulations 36 and 37 of, and the Seventh Schedule to, the Naval Financial Regulations as amended by these Regulations had been in force during the relevant period.
(5.) The rates of active pay provided for by regulations 36 and 37 of the Naval Financial Regulations as amended by these Regulations apply to and in relation to the service of Constables referred to in the last preceding sub-regulation, Sergeants, Second Class, and Sergeants, First Class, of the Naval Dockyard Police on or after the first day of March, 1968.
(2.) The Naval Board may determine, in relation to the Branches, or to the Categories of the Branches, that existed during the relevant period or a part of the relevant period, that servicewomen—
(
a ) of a particular Branch;(
b ) included in a particular Category of a particular Branch; or(
c ) holding a particular rating and included in a particular Category of a particular Branch,
shall, for the purpose of sub-regulation (4.) of this regulation, be deemed to have been included, on each day during the relevant period or on each day during a specified part of that period, in a particular group, being a group specified in the Fifteenth Schedule to the Naval Financial Regulations as amended by these Regulations.
(3.) Subject to the last preceding sub-regulation, a servicewoman who was serving in the Women’s Service during the relevant period or a part of that period shall, for the purpose of the next succeeding sub-regulation, be deemed to have been included on each day during that period or that part of that period in the group specified in the Fifteenth Schedule to the Naval Financial Regulations as amended by these Regulations distinguished by the same number as the number that distinguished the group in which she was included on that day under the Naval Financial Regulations as in force on that day.
(4.) Subject to the next succeeding sub-regulation, the rates of active pay provided for in regulation 253 of the Naval Financial Regulations as amended by these Regulations apply to and in relation to a servicewoman in the Permanent Naval Forces on a day in the relevant period as if she were included on that day in the group in which she is to be deemed to have been included on that day under the preceding sub-regulations of this regulation.
(5.) The last preceding sub-regulation does not apply to or in relation to service of a servicewoman on a day in the relevant period if the rate of active pay applicable in the case of the servicewoman under regulation 253 of the Naval Financial Regulations as in force on that day is higher than the rate that would be applicable, but for this sub-regulation, in the case of the member by virtue of the last preceding sub-regulation.
“man” means a man enlisted in the Naval Emergency Reserve Forces or in the Citizen Naval Forces and holding the rating of Chief Petty Officer or a lower rating;
“the relevant period” has the same meaning as in regulation 34 of these Regulations.
(2.) Regulations 34, 35 and 38 of these Regulations apply to and in relation to a man who was, during the relevant period or a part of the relevant period, entitled to be paid active pay under sub-regulation (2.) of regulation 264 of the Naval Financial Regulations as if—
(
a ) references to a man of the Permanent Naval Forces were read as references to a man, within the meaning of this regulation, who was so entitled to be paid active pay;(
b ) references to active pay or an allowance paid or payable under a particular regulation were read as references to active pay or an allowance that was paid or is payable under that regulation in its application to the man by virtue of regulation 264 or 265 of the Naval Financial Regulations; and(
c ) the reference in paragraph (c ) of sub-regulation (5.) of regulation 34 of these Regulations to the group in which a man is to be deemed to have been included on a day under the preceding sub-regulationsof that regulation was read as a reference to the group in which the man is to be deemed to have been included on that day under the next succeeding sub-regulation.
(3.) For the purpose of the application of regulation 34 of these Regulations to and in relation to a man by virtue of this regulation, the Naval Board shall determine the group in which a man who was so entitled to active pay under sub-regulation (2.) of regulation 264 of the Naval Financial Regulations during the relevant period or a part of the relevant period is to be deemed to have been included on each day during that period or that part of that period.
(2.) A man of the Permanent Naval Forces who was in receipt of an allowance in respect of the relevant period or a part of the relevant period under regulation 40, 47, 54, 56, 62 or 67 of the Naval Financial Regulations as in force during that period is, by force of this sub-regulation, entitled to be paid an additional allowance in respect of that period or that part of that period at the rate of—
(
a ) where the man was in receipt of an allowance under regulation 40 or 67—Fifteen cents per day; or(
b ) where the man was in receipt of an allowance under regulation 47, 54, 56 or 62—Twenty cents per day.
(3.) The next succeeding sub-regulation applies to a man in respect of the relevant period or a part of the relevant period if the man was, during that period or that part of that period in receipt of Sick Berth Branch Specialist allowance under regulation 53 of the Naval Financial Regulations as in force during the relevant period by virtue of the fact that he was performing the duties in a ship or naval establishment of a position the duties of which were, in accordance with the organization of the Naval Forces, required to be performed by a man of the Sick Berth Branch who was a qualified advanced nurse, a qualified dispenser, a qualified hygiene inspector, a qualified laboratory assistant, a qualified masseur, a qualified operating room assistant or a qualified X-ray assistant or who was qualified in naval aviation medicine.
(4.) A man to whom this regulation applies in respect of the relevant period or a part of the relevant period is entitled to be paid an additional allowance, in respect of that period or that part of that period, at the rate of—
(
a ) if the duties were required to be performed by a man who was a qualified X-ray assistant—Ninety-five cents per day;(
b ) if the duties were required to be performed by a man who was a qualified hygiene inspector—Seventy cents per day; or(
c ) in any other case—Twenty cents per day.
(5.) The Naval Board may determine that the next succeeding sub-regulation applies to and in relation to the duties of a position in respect of the relevant period or a part of the relevant period.
(6.) Subject to the conditions first determined by the Naval Board for the purpose of regulation 41 of the Naval Financial Regulations as amended by these Regulations, where the Naval Board has determined that this sub-regulation applies to and in relation to the duties of a position in respect of a specified period, a man of the Sick Berth Branch who performed the duties of the position during that period or a part of that period and was qualified in underwater medicine at the time when he so performed those duties is entitled to be paid an allowance in respect of that period or that part of that period at the rate of Twenty-five cents per day.
