REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1968.*
I,
THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the

Amendments of the Naval Financial Regulations
“(7.) Sub-regulations (3.) and (5.) of this regulation apply to and in relation to an officer who was appointed an officer after the first day of March, 1968, but before the sixth day of December, 1968—
(
a ) as if a reference to the daily rate of active pay that was applicable to the officer on the day immediately before he was appointed an officer were read as a reference to the daily rate of active pay that would have been applicable to the officer on that day if the amendments of the Naval Financial Regulations effected by Statutory Rules 1968, No. 152, had come into force on the first day of March, 1968; and(
b ) as if a reference to the daily rate at which any allowance, or the daily rates at which any allowances, payable to him under regulation 40, 41 or 77 of these Regulations in respect of a day was or were so payable were read as a reference to the daily rate at which any such allowance would have been payable to him on the day immediately before he was appointed an officer if the amendments of the Naval Financial Regulations effected by Statutory Rules 1968, No. 152, and the first determinations made by the Naval Board for the purpose of regulations 40 and 41 of the Naval Financial Regulations, had come into force on the first day of March, 1968.

would have been included on that day in the group in which he is to be deemed to have been included on that day for the purposes of sub-regulation (5.) of regulation 34 of Statutory Rules 1968, No. 152.”.

“206a. Where a member who is not in receipt of marriage allowance or who is in receipt of that allowance at less than the full rate visits a place in Australia for the purpose of performing detached duty at that place and the visit involves his absence overnight from his normal place of duty, an allowance, called ‘supplementary travelling allowance’ is, subject to such conditions as the Naval Board approves, payable to the member—
(
a ) in the case of a member who is not in receipt of marriage allowance—at the rate of One dollar seventeen cents per day; or(
b ) in the case of any other member—(i) at a rate equal to the amount by which the rate of marriage allowance payable to the member is less than the sum of the full rate at which marriage allowance is payable and the rate at which separation allowance is payable under these Regulations; or
(ii) at the rate of One dollar seventeen cents per day,
whichever is the lesser rate.”.
“(4.) Regulation 38 of these Regulations applies to and in relation to a man in respect of service to which this regulation applies in like manner, and subject to the like conditions, as it applies to a man of the Permanent Naval Forces in respect of service in those Forces, and as it would apply and have applied if this sub-regulation had cents into operation on the fifth day of December, 1968.”.

(2.) The rates of active pay provided for in the Naval Financial Regulations as amended by these Regulations apply in respect of service on a day in the period from and including the twenty-fifth day of October, 1968, to and including the day immediately before the commencement of these Regulations, other than service of an officer referred to in the next succeeding sub-regulation, of a man to whom the next succeeding regulation applies or of a servicewoman.
(3.) Where—
(
a ) an officer would have been entitled to have been paid active pay in accordance with the provisions of sub-regulation (3.) or (5.) of regulation 9 of the Naval Financial Regulations as amended by StatutoryRules 1968, No. 152, in respect of service on a day in the period from and including the first day of March, 1968 to and including the fourth day of December, 1968 if the amendments of the Naval Financial Regulations effected by that Statutory Rule, any determinations made by the Naval Board for the purpose of sub-regulation (6.) of regulation 9 of the Naval Financial Regulations as so amended and the amendments of regulation 9 of the Naval Financial Regulations effected by regulation 1 of these Regulations had come into operation on the first day of March, 1968; and
(
b ) the rate of active pay that was applicable to the officer on that day under the Naval Financial Regulations as in force on that day was less than the rate of active pay that would have been applicable to the officer if those amendments and determinations had so come into operation and if the other amendments of the Naval Financial Regulations effected by these Regulations had come into operation on the twenty-fifth day of October, 1968,
the rate of active pay applicable to the officer in respect of that day, is, by virtue of this sub-regulation, that higher rate.
(4.) The amendments of the Naval Financial Regulations effected by these Regulations, in so far as they increase any rates of allowances provided for in the Naval Financial Regulations, apply in respect of service on and after the twenty-fifth day of October, 1968.
(5.) Where, but for this sub-regulation, a member would, by virtue of the application of the amendments of regulation 80 or regulation 84 of the Naval Financial Regulations effected by these Regulations as from the twenty-fifth day of October, 1968, in accordance with the last preceding sub-regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations.
(6.) Where an allotment made by a member was in force in respect of the period from and including the twenty-fifth day of October, 1.968, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of One dollar five cents per day but would not entitle him to marriage allowance at the rate of One dollar ten cents per day under the Naval Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and if he does so, marriage allowance is payable to him in accordance with the Naval Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.
(7.)
The Naval Board may, by virtue of this sub-regulation, make a, determination
for the purpose of paragraph (
(2.) A reference in this regulation to the Naval Financial Regulations shall be read as a reference to the Naval Financial Regulations as amended by any Statutory Rules up to and including Statutory Rules 1968, No. 152.
(3.) Sub-regulations (4.) to (7.) (inclusive) of this regulation do not apply to a man in respect of a day in the relevant period unless the man was, on that day—
(
(
b ) in receipt of active pay at a rate ascertained by reference to sub-regulation (3.), (5.) or (6.) of regulation 31 of the Naval Financial Regulations or by reference to the Fifth Schedule or the Seventh Schedule to those Regulations.
(4.) Subject to the succeeding sub-regulations of this regulation, the daily rate of active pay of a man in respect of service on a day in the relevant period is, by virtue of this sub-regulation, increased by Fourteen cents.
(5.) Where a man was in receipt of active pay at a rate ascertained by reference to sub-regulation (3.), (5.) or (6.) of regulation 31 of the Naval Financial Regulations in respect of a day in the relevant period but was not in receipt of good conduct increment under sub-regulation (5.) of regulation 38 of the Naval Financial Regulations in respect of that day, the last preceding sub-regulation does not apply to the man in respect of that day but, if the daily rate of active pay applicable to the man exceeded by less than Fourteen cents the daily rate of active pay that would have been applicable to him if he had not been entitled to be paid active pay at the rate ascertained by reference to that sub-regulation, the daily rate of active pay applicable to the man in respect of that day, is, by virtue of this sub-regulation, increased by an amount ascertained by subtracting from Fourteen cents the amount of that excess.
(6.) Where a man was in receipt of active pay at a rate ascertained by reference to sub-regulation (3.) or (5.) of regulation 31 of the Naval Financial Regulations in respect of a day in the relevant period and was also in receipt of good conduct increment under sub-regulation (5.) of regulation 38 of the Naval Financial Regulations in respect of that day, sub-regulation (4.) of this regulation does not apply to the man in respect of that day but, if the sum of the active pay and good conduct increment paid to him in respect of that day exceeds by less than Fourteen cents an amount equal to the daily rate of active pay that would have been applicable to him if he had not been entitled to be paid active pay at the rate ascertained by reference to that sub-regulation, the daily rate of active pay applicable to the man in respect of that day, is, by virtue of this sub-regulation, increased by an amount ascertained by subtracting from Fourteen cents the amount of that excess.
(7.) Where a man was in receipt of active pay at a rate ascertained by reference to the Fifth Schedule or the Seventh Schedule to the Naval Financial Regulations in respect of a day in the relevant period and was also in receipt of good conduct increment under sub-regulation (5.) of regulation 38 of the Naval Financial Regulations in respect of that day, sub-regulation (4.) of this regulation does not apply to the man in respect of that day but, if the rate at which good conduct increment was paid to him in respect of that day did not exceed Thirteen cents, the daily rate of active pay applicable to the man in respect of that day is, by virtue of this sub-regulation, increased by an amount ascertained by subtracting from Fourteen cents an amount equal to the rate at which good conduct increment was paid to him.
(8.) Subject to the next succeeding sub-regulation, the preceding sub-regulations of this regulation apply to and in relation to a man of the Naval Emergency Reserve Forces or Citizen Naval Forces in respect of a day in the relevant period if the man was rendering continuous full time naval service on that day.
(9.) In the application of sub-regulations (1.) to (7.) (inclusive) of this regulation to and in relation to a man of the Naval Emergency Reserve Forces or Citizen Naval Forces by virtue of the last preceding sub-regulation—
(
a ) a reference to a member of the Permanent Naval Forces shall be read as a reference to a member of the Naval Emergency Reserve Forces or Citizen Naval Forces who was rendering continuous full time naval service;(
b ) a reference to active pay at a rate ascertained by reference to a particular sub-regulation or to a particular Schedule shall be read as a reference to active pay at a rate ascertained by reference to that sub-regulation or Schedule by virtue of regulation 264 of the Naval Financial Regulations;(
c ) a reference to good conduct increment under sub-regulation (5.) of regulation 38 of the Naval Financial Regulations shall be read as a reference to good conduct increment under that sub-regulation in its application to members of the Naval Emergency Reserve Forces or the Citizen Naval Forces by virtue of regulation 264 of the Naval Financial Regulations as amended by these Regulations; and(
d ) the man shall, for the purpose of ascertaining the rate of active pay applicable to him on a day, be deemed to have been included on that day in the group (if any) in which he is to be deemed to be included under sub-regulation (3.) of regulation 37 of Statutory Rules 1968, No. 152.
“man” means—
(
(
b ) a man of the Naval Emergency Reserve Forces or Citizen Naval Forces rendering continuous full time naval service;“the relevant period” means the period from and including the twenty-fifth day of October, 1968, to and including the fourth day of December, 1968.
(2.) Where the Naval Board is satisfied that—
(
a ) a man would have been paid active pay in accordance with sub-regulation (3.), (5.) or (6.) of regulation 31 of the Naval Financial Regulations in respect of the relevant period or a part of the relevant period; or(
b ) a man would have been entitled to have been paid active pay at a rate ascertained by reference to the Fifth Schedule or Seventh Schedule to the Naval Financial Regulations, and would also have been entitled to have been paid good conduct increment under sub-regulation (5.) of regulation 38 of those Regulations, in respect of the relevant period or a part of the relevant period,
if the amendments of the Naval Financial Regulations effected by Statutory Rules 1968, No. 152, had come into operation on the first day of March, 1968, the Naval Board shall determine the amount (if any) by which, in its opinion, the sum of the active pay and allowances that would have been payable to the man
in respect of service during the relevant period if those amendments had so come into operation, and the amendments of the Naval Financial Regulations effected by these Regulations had come into operation on the twenty-fifth day of October, 1968, would have exceeded an amount equal to the sum of the active pay and allowances that were paid to the man in respect of the relevant period and so much of any amount paid to the man under regulation 34, 35, 37 or 38 of Statutory Rules 1968, No. 152, as is, in the opinion of the Naval Board, attributable to his service during the relevant period,
(3.) Where the Naval Board determines an amount in respect of a man under the last preceding sub-regulation, an amount equal to that amount is, by virtue of this sub-regulation, payable to the man as active pay.
(4.) Where a determination made by the Naval Board for the purpose of a provision, of the Naval Financial Regulations as amended by Statutory Rules 1968, No. 152, came into operation on or shortly after the fifth day of December, 1968, the Naval Board shall assume, for the purpose of calculating the amount that would have been payable to a man by way of active pay and allowances in respect of the relevant period if the amendments of the Naval Financial Regulations referred to in sub-regulation (2.) of this regulation had come into operation on the respective dates specified in that sub-regulation, that like determinations or like determinations modified in such manner as the Naval Board thinks fit had been in force during the whole of the relevant period or during such parts of the relevant period as the Naval Board determines.
(5.) Where a man would have been entitled to have been paid active pay at a rate ascertained by reference to the Fifth Schedule or Seventh Schedule to the Naval Financial Regulations, and would not have been entitled to have been paid good conduct increment under sub-regulation (5.) of regulation 38 of those Regulations, in respect of the relevant period or a part of the relevant period, if the amendments of the Naval Financial Regulations effected by Statutory Rules 1968, No. 152, had come into operation on the first day of March, 1968, the man is entitled to be paid, as active pay, an amount of Fourteen cents in respect of each day in the relevant period or the part of the relevant period in respect of which he was in receipt of active pay.
