1970 No. 158

REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1968.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1968.

Amendments of the Naval Financial Regulations 

Consolidated rates of pay.

1. Regulation 7a of the Naval Financial Regulations is amended by omitting from paragraph (b) the figures and word “ (2.) or (3.)” and inserting in their stead the figures and word “ (2.), (3.), (4.) or (5.)”.

Officers’ General List— active pay.

2. Regulation 9 of the Naval Financial Regulations is amended by omitting paragraphs (a), (b)and (c) of sub-regulation (1a.) and inserting in their stead the following paragraphs:—

“ (a) if he has less than ten years’ pay seniority in that rank—Sixty-one cents; or

(b)if he has not less than ten years’ pay seniority in that rank—One dollar twenty-one cents.”.

Medical and denial officers— active pay.

3. Regulation 10 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) the words “Twelve dollars seventy-three cents” and inserting in their stead the words “Thirteen dollars sixty-nine cents”.

4. Regulation 12 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Chaplains— active pay.

“12. The daily rate of active pay payable to an officer of the Chaplain’s Branch is the rate specified in relation to his pay seniority in the following table:—

Consolidated rates of pay.

5. Regulation 15 of the Naval Financial Regulations is amended by inserting after sub-regulation (3.) the following sub-regulations:—

“(4.) The rate at which active pay is payable to a Surgeon Captain or a Surgeon Captain (D) is a consolidated rate of Thirteen thousand three hundred and twenty-three dollars per year.”

(5.) The rate at which active pay is payable to a Surgeon Commander or a Surgeon Commander (D) is a consolidated rate of Twelve thousand three hundred and nineteen dollars per year.”.

Men—general scale of active pay.

6.—(1.) Regulation 31 of the Naval Financial Regulations is amended by omitting from paragraph (b)of sub-regulation (12.) the word and figure “Group 3 “ and inserting in their stead the word and figure “ Group 5”.

(2.) A man who held the rating of Ordinary Seaman or Able Seaman, Second Class, during the period from and including the seventh day of July, 1969, to and including the day immediately before the commencement of these Regulations or during a part of that period is entitled to be paid active pay in respect of that period or that part of that period as if the amendment of regulation 31 of the Naval Financial Regulations effected by the last preceding sub-regulation had come into operation on the seventh day of July, 1969.

7. Regulation 79 of the Naval Financial Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(b)the Third, Fifth, Sixth, Seventh, Fifteenth and Sixteenth Schedules to the Naval Financial Regulations as amended by these Regulations,

apply to and in relation to service in the Permanent Naval Forces, the Naval Emergency Reserve Forces or the Citizen Naval Forces, as the case may be, on and after the eleventh day of September, 1970.

(2.) An officer of the Medical Branch or Dental Branch in receipt of active pay in respect of his service on a day in the period from and including the eleventh day of September, 1970, to and including the day immediately before the commencement of these Regulations, being—

(a) an officer of the Medical Branch who held the rank of Surgeon Lieutenant or Surgeon Lieutenant-Commander on that day; or

(b)an officer of the Dental Branch who held the rank of Surgeon Lieutenant (D) or Surgeon Lieutenant-Commander (D) on that day,

is, by force of this regulation, entitled to be paid active pay in respect of that day at the rate specified in the Fourth Schedule to the Naval Financial Regulations as amended by these Regulations in relation to the rank that he held on that day and his pay seniority in that rank on that day instead of at the rate applicable under the Naval Financial Regulations as in force on that day.

(3.) An officer of the Medical Branch or Dental Branch in receipt of active pay in respect of his service on a day in the period from and including the eighteenth day of December, 1969, to and including the tenth day of September, 1970, being—

(a) an officer of the Medical Branch who held the rank of Surgeon Lieutenant or Surgeon Lieutenant-Commander on that day; or

(b) an officer of the Dental Branch who held the rank of Surgeon Lieutenant (D) or Surgeon Lieutenant-Commander (D) on that day,

is, by force of this sub-regulation, entitled to be paid active pay in respect of that day at the rate specified in the second column or third column, whichever is appropriate, of the following table in relation to the rank that he held on that day and his pay seniority in that rank on that day instead of at the rate provided for in the Naval Financial Regulations as in force on that day.

(4.) Where a member of the Medical Branch or the Dental Branch held during the period from and including the eighteenth day of December, 1969, to and including the day immediately before the commencement of these Regulations or during a part of that period—

(a)in the case of a member of the Medical Branch—the rank of Surgeon Captain or Surgeon-Commander; or

(b)in the case of a member of the Dental Branch—the rank of Surgeon Captain (D) or Surgeon-Commander (D),

the member is entitled to be paid in respect of his service during that period while holding such a rank, as additional active pay, an amount equal to the amount by which the sum of the active pay and allowances paid or payable to him in respect of that service is less than the sum of the active pay and allowances that would have been payable to him in respect of that service if the Naval Financial Regulations as amended by Statutory Rules 1970, No. 134, and these Regulations had been in force throughout that period.

(5.) In calculating the amount of active pay and allowances that would have been payable to a member of the Medical Branch or Dental Branch in respect of service to which the last preceding sub-regulation relates under the Naval Financial Regulations as amended by Statutory Rules 1970, No. 134, and these Regulations, it shall be assumed—

(a)that the amount specified in sub-regulation (4.) of regulation 15 of the Naval Financial Regulations as so amended was—

(i) on the eighteenth day of December, 1969—Eleven thousand nine hundred and sixty dollars; and

(ii) on and after the nineteenth day of December, 1969— Twelve thousand three hundred and nineteen dollars; and

(b)that the amount specified in sub-regulation (5.) of regulation 15 of the Naval Financial Regulations as so amended was—

(i) on the eighteenth day of December, 1969—Twelve thousand nine hundred and thirty-five dollars; and

(ii) on and after the nineteenth day of December, 1969—Thirteen thousand three hundred and twenty-three dollars.
