REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1968.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council hereby make the following Regulations under the Naval Defence Act 1910-1968.

Amendments of the Naval Financial Regulations 

Officers’ General List— active pay.

1. Regulation 9 of the Naval Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1a.) the words “Sixty-one cents” and inserting in their stead the words “Seventy cents”; and

(b) by omitting from paragraph (b)of that sub-regulation the words “One dollar twenty-one cents” and inserting in their stead the words “One dollar forty cents”.

Medical and Dental Officers— active pay.

2. Regulation 10 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) (he words “Thirteen dollars sixty-nine cents” and inserting in their stead the words “Fifteen dollars eighty-eight cents”.

Chaplains— activepay

3. Regulation 12 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

“12. The daily rate of active pay payable to an officer of the Chaplains’ Branch is the rate specified in relation to his pay seniority in the following table:—

Senior Chaplain’s allowance.

4. Regulation 13 of the Naval Financial Regulations is amended by omitting the words “Forty-six cents” and inserting to their stead the words “Fifty-five cents”.

Consolidated rates of pay.

5. Regulation 15 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (l.) the words “Fifteen thousand four hundred and sixty-nine dollars” and inserting in their stead the words “Sixteen thousand three hundred and ninety-seven dollars”; and

(b)by omitting from sub-regulation (2.) the words “Thirteen thousand and thirty-eight dollars” and inserting in their stead the words “ Thirteen thousand eight hundred and twenty dollars”.

Men—general scale of active pays.

6. Regulation 31 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “or Part V.” and inserting in their stead the words “, Part V., Part VI., Part VII. or Part VIII.”.

Apprentices— active pay and allowances.

7. Regulation 79 of the Naval Financial Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

Marriage allowance.

8. Regulation 80 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “One dollar fifteen cents” and inserting in their stead the words “One dollar twenty-five cents”;

(b) by omitting from paragraphs (b) and (c) of sub-regulation (3.) the words “One dollar seventy cents” and inserting in their stead the words “One dollar eighty cents”;

(c) by omitting from paragraphs (d) and (c)of sub-regulation (3.) the words “Two dollars eighty-five cents” and inserting in their stead the words “Three dollars five cents”;

(d) by omitting from paragraphs (c) and (d)of sub-regulation (5.) the words “One dollar seventy cents” and inserting in their stead the words “One dollar eighty cents”; and

(e) by omitting from paragraphs (e) and (f) of sub-regulation (5.) the words “Two dollars eighty-five cents” and inserting in their stead the words “Three dollars five cents”.

Qualifying allotment for payment of full rate of marriage allowance.

9. Regulation 84 of the Naval Financial Regulations is amended—

(a)by omitting from paragraph (a) of sub-regulation (1.) the words “Two dollars eighty-five cents” and inserting in their stead the words “Three dollars five cents”; and

(b) by omitting from paragraph (b) of that sub-regulation the words “Three dollars fifty-five cents” and inserting in their stead the words “Three dollars seventy-five cents”.

Living out allowance— unmarried members.

10. Regulation 92 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar twenty-two cents” and inserting in their stead the words “One dollar thirty-two cents”.

Retention of lodgings allowance.

11. Regulation 94 of the Naval Financial Regulations is amended by omitting from paragraph (a)of sub-regulation (4.) the words “One dollar twenty-two cents” and inserting in their stead the words “One dollar thirty-two cents”.

Supplementary travelling allowance.

12. Regulation 206a of the Naval Financial Regulations is amended by omitting the words “One dollar twenty-two cents” (wherever occurring) and inserting in their stead the words “One dollar thirty-two cents”.

Servicewomen— raies of active pay.

13. Regulation 253 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) the words “the last preceding sub-regulation” and inserting in their stead the words “sub-regulation (1.) of this regulation”.

The Schedules.

14. The Third, Fifth, Sixth, Seventh, Fifteenth and Sixteenth Schedules to the Naval Financial Regulations are repealed and the following Schedules are respectively inserted in their stead:—

Application.

15.—(1.) The rates of pay and rates of allowances provided for in the Naval Financial Regulations as amended by these Regulations apply in respect of service in the Permanent Naval Forces, the Naval Emergency Reserve Forces or the Citizen Naval Forces, as the case requires, on and after the first day of January, 1971.

(2.) Where, but for this sub-regulation, a member would, by virtue of the application of the amendments of regulation 80 or regulation 84 of the Naval Financial Regulations effected by these Regulations as from the first day of January, 1971, in accordance with the last preceding sub-regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations.

(3.) Where an allotment made by a member was in force in respect of the period from and including the first day of January, 1971, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of One dollar fifteen cents per day but would not entitle him to marriage allowance at the rate of One dollar twenty-five cents per day under the Naval Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and if he does so, marriage allowance is payable to him in accordance with the Naval Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.

Transitional— officers and chaplains.

16.—(1.) Where a male officer of the Naval Forces was in receipt of active pay in respect of service in those Forces at any time during the period from and including the seventeenth day of December, 1970, to and including the thirty-first day of December, 1970, in accordance with—

(a) Division 2 of the Third Schedule to the Naval Financial Regulations;

(b) sub-regulation (1a.) of regulation 9 of the Naval Financial Regulations; or

(c) sub-regulation (2.) of regulation 10 of the Naval Financial Regulations,

the next succeeding sub-regulation applies to that service of the officer.

(2.) Where this sub-regulation applies to any service of a male officer during the period secified in the last preceding sub-regulation, the officer is entitled to be paid in respect of that service, as additional active pay, an amount equal to the amount by which the sum of the active pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to be paid active pay—

(a)in the case of an officer referred to in paragraph (a)of the last preceding sub-regulation—at the rate per day specified, in relation to his rank and pay seniority (if relevant), in the First Schedule to these Regulations;

(b) in the case of an officer referred to in paragraph (b) of the last preceding sub-regulation—

(i) if he had less than ten years’ pay seniority in the rank of lieutenant—at the rate of Nineteen dollars one cent per day; or

(ii) if he had not less than ten years’ pay seniority in that rank— at the rate of Nineteen dollars sixty-seven cents per day; or

(c) in the case of an officer referred to in paragraph (c) of the last preceding sub-regulation—at the rate of Fifteen dollars four cents per day.

(3.) Where a male officer of the Naval Forces was in receipt of active pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (3.) or (5.) of regulation 9 of the Naval Financial Regulations and the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to be paid active pay at the rate per day specified in relation to his rank and pay seniority (if relevant) in the First Schedule to these Regulations exceeds the sum of the active pay paid or payable to him, but for this sub-regulation, in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.

(4.) Where a chaplain of the Naval Forces was in receipt of active pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with regulation 12 of the Naval Financial Regulations, the chaplain is entitled to be paid in respect of that service, as additional active pay, an amount equal to the amount by which the sum of the

active pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to he paid active pay at the rate per day specified, in relation to his pay seniority, in. the Second Schedule to these Regulations.

(5.) Where a female officer of the Naval Forces was in receipt of active pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with—

(a)Table 1 in the Fifteenth Schedule to the Naval Financial Regulations; or

(b)Table 1 in the Sixteenth Schedule to the Naval Financial Regulations, the next succeeding sub-regulation applies to that service of the officer.

(6.) Where this sub-regulation applies to any service of a female officer during the period specified in sub-regulation (1.) of this regulation, the officer is entitled to be paid in respect of that service, as additional active pay, an amount equal to the amount by which the sum of the active pay paid or payable to her, but for this sub-regulation, in respect of that service is less than the sum of the active pay that would have been payable toher in respect of that service if she had been entitled to be paid active pay—

(a)in the case of an officer referred to in paragraph (a)of the last preceding sub-regulation—at the rate per day specified in relation to her rank and pay seniority in the Third Schedule to these Regulations; or

(b)in the case of an officer referred to in paragraph (b)of the last preceding sub-regulation—at the rate per day specified, in relation to her rank, in the Fourth Schedule to these Regulations.

(7.) Where a female officer of the Naval Forces was in receipt of active pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (2.) of regulation 252 of the Naval Financial Regulations and the sum of the active pay that would have been payable to her in respect of that service if she had been entitled to be paid active pay at the rate per day specified in relation to her rank and pay seniority in the Third Schedule to these Regulations exceeds the sum of the active pay paid or payable to her, but for this sub-regulation in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.

Transitional— Servicewomen.

17.—(1.) For the purpose of this regulation, each of the following periods is a period to which this regulation applies:—

(a)the period from and including the first day of October, 1969, to and including the eighteenth day of December, 1969;

(b) theperiod from and including the nineteenth day of December, 1969, to and including the thirty-first day of December, 1969;

(c)the period from and including the first day of January, 1970, to and including the tenth day of September, 1970; and

(d)the period from and including the eleventh day of September, 1970, to and including the thirty-first day of December, 1970.

(2.) Where a servicewoman was in receipt of active pay in respect of service in the Naval Forces in a period to which this regulation applies in accordance with Table 2 in the Fifteenth Schedule to the Naval Financial Regulations or sub-regulation (1a.) of regulation 253 of the Naval Financial Regulations and the sum of the active pay that would have been payable to her

in respect of that service if she had been entitled to be paid active pay at the rate per day specified, in relation to her rank and pay seniority (where relevant) and to the group in which she was included—

(a) in the case of the period referred to in paragraph (a) of the last preceding sub-regulation—in the Fifth Schedule to these Regulations;

(b) in the case of the period referred to in paragraph (b) of the last preceding sub-regulation—in the Sixth Schedule to these Regulations;

(c) in the case of the period referred to in paragraph (c) of the last preceding sub-regulation—in the Seventh Schedule to these Regulations; or

(d)in the case of the period referred to in paragraph (d)of the last preceding sub-regulation—in the Eighth Schedule to these Regulations,

exceeds the sum of the active pay paid or payable to her, but for this sub-regulation, in respect of that service, the servicewoman is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.

(3.) Sub-regulation (3.) of regulation 253 of the Naval Financial Regulations applies to the service of a servicewoman in the Permanent Naval Forces during a period to which this regulation applies as if the reference to the rates specified in Table 2 in the Fifteenth Schedule to the Naval Financial Regulations were read as a reference to the rates specified in the Fifth, Sixth, Seventh or Eighth Schedule to these Regulations, whichever is applicable to that period.

(4.) Sub-regulation (4.) of regulation 253 of the Naval Financial Regulations applies to the service of a servicewoman during a period to which this regulation applies as if the reference to the daily rate of active pay specified in Table 2 in the Fifteenth Schedule to the Naval Financial Regulations were read as a reference to the daily rate of active pay specified in the Fifth, Sixth, Seventh or Eighth Schedule to these Regulations, whichever is applicable to that period.

(5.) Where a servicewoman was in receipt of active pay in respect of service in the Citizen Naval Forces at any time during a period to which this regulation applies in accordance with Table 2 in the Sixteenth Schedule to the Naval Financial Regulations, the servicewoman is entitled to be paid in respect of that service, as additional active pay, an amount equal to the amount by which the sum of the active pay paid or payable to her, but for this sub-regulation, in respect of that service is less than the sum of the active pay that would have been payable to her in respect of that service if she had been entitled to be paid active pay—

(a) in the case of the period referred to in paragraph (a) of sub-regulation (1.) of this regulation.—in accordance with the Ninth Schedule to these Regulations;

(b)in the case of the period referred to in paragraph (b)of sub-regulation (1.) of this regulation—in accordance with the Tenth Schedule to these Regulations;

(c) in the case of the period referred to in paragraph (c) of sub-regulation (1.) of this regulation—in accordance with the Eleventh Schedule to these Regulations; or

(d)in the case of the period referred to in paragraph (d)of sub-regulation (1.) of this regulation—in accordance with the Twelfth Schedule to these Regulations.

(6.) In this regulation, “servicewoman” has the same meaning as in Division 1 of Part XIV. of the Naval Financial Regulations.
