REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1971.*

Amendments of the Naval Financial Regulations
1. Regulation 15 of the Naval Financial Regulations is amended—(
a )by omitting from sub-regulation (3.) the words “Fourteen thousand two hundred and fifty-three dollars” and inserting in their stead the words “ Fifteen thousand one hundred and eight dollars”;(
b ) by omitting from sub-regulation (4.) the words “Thirteen thousand three hundred and twenty-three dollars” and inserting in their stead the words “ Fourteen thousand nine hundred and one dollars”; and(
c ) by omitting from sub-regulation (5.) the words “Twelve thousand three hundred and nineteen dollars” and inserting in their stead the words “Thirteen thousand seven hundred and seventy-nine dollars”.
2. Regulation 29 of the Naval Financial Regulations is amended by omitting the table in sub-regulation (3.) and inserting in its stead the following table:—

3. Regulation 80 of the Naval Financial Regulations is amended—(
a )by omitting from paragraph (c ) of sub-regulation (3.) the words “One dollar seventy cents” and inserting in their stead the words “One dollar eighty cents”; and(
b ) by omitting from paragraph (f ) of sub-regulation (5.) the words “One dollar seventy cents” and inserting in their stead the words “One dollar eighty cents”.

4. The Third Schedule to the Naval Financial Regulations is amended by omitting Division 1 and inserting in its stead the following Division:—
Division 1—Officers Entered Direct as University Undergraduates, or Final Year Students Doing Diploma Courses at a Technical College

5. The Fourth Schedule to the Naval Financial Regulations is repealed and the following Schedule is inserted in its stead:—

6. The rates of pay provided for in the Naval Financial Regulations as amended by these Regulations apply in respect of service in the Permanent Naval Forces, the Naval Emergency Reserve Forces or the Citizen Naval Forces, as the case requires—(
a )in the case of a Cadet Midshipman to whom regulation 10 of Statutory Rules 1971, No. 1, applies—on and after the fourteenth day of January, 1971; or(
b )in any other case—on and after the first day of January, 1971.
7. —(1.) Where an officer of the Naval Forces was, by virtue of regulation 9 of Statutory Rules 1970, No. 158, in receipt of active pay in respect of service in those Forces at any time during the period from and including the ninth day of October, 1970, to and including the thirty-first day of December, 1970, in accordance with the Fourth Schedule to the Naval Financial Regulations as amended by those Statutory Rules and the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to be paid active pay at the rate per day specified in relation to his rank and pay seniority in the First Schedule to these Regulations exceeds the sum of the active pay paid or payable to him, but for this, sub-regulation, in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.(2.) Where a member of the Medical Branch or the Dental Branch held during she period referred to in the last preceding sub-regulation or during a part of that period—
(
a )in the case of a member of the Medical Branch—the rank of Surgeon-Captain or Surgeon-Commander; or(
b )in the case of a member of the Dental Branch—the rank of Surgeon-Captain (D) or Surgeon-Commander (D),the member is entitled to be paid in respect of his service during that period while holding such a rank, as additional active pay, an amount equal to the amount by which the sum of the active pay and allowances paid or payable to him in respect of that service is less than the sum of the active pay and allowances that would have been payable to him in respect of that service if the Naval Financial Regulations as amended by Statutory Rules 1970, No. 158. had been in force throughout that period and he had been entitled to be paid active pay at the consolidated rate specified in relation to his rank in the following table instead of at the rate provided for in regulation 15 of the Naval Financial Regulations as so amended:—

(3.) Where the pay account of a Cadet Midshipman was by virtue of regulation 11 of Statutory Rules 1971, No. 1, credited with active pay in respect of his service in the Naval Forces at any time during the period from and including the eighteenth day of December, 1970, to and including the thirty-first day of December, 1970. in accordance with sub-regulation (3.) of regulation 29 of the Naval Financial Regulations as amended by those Statutory Rules and the sum of the active pay that would have been credited to his pay account in respect of that service if the account had been credited with active pay at the rate per day specified in relation to his type of entry and stage of training in the Second Schedule to these Regulations exceeds the sum of the active pay credited or to be credited to his pay account, but for this regulation, in respect of that service, the Cadet Midshipman is entitled—
(
a ) if the accumulated credit of his pay account has become payable to him—to be paid; or(
b )in any other case—to have his pay account credited with,an amount equal to the excess, as additional active pay in respect of that service.
(4.) Where the pay account of a Cadet Midshipman was, by virtue of regulation 10 of Statutory Rules 1971, No. 1, credited with an amount in respect of his service in the Naval Forces at any time during the period from and including the first day of January, 1971, to and including the thirteenth day of January. 1971, that Cadet Midshipman is entitled—
(
a )if the accumulated credit of his pay account has become payable to him—to be paid; or(
b )in any other case—to have his pay account credited with,an amount at the rate of Thirteen cents per day in respect of that service.
(5.) Each of the following periods is a period to which the next succeeding sub-regulation applies:—
(
a ) the period from and including the twenty-fifth day of September, 1970, to and including the seventeenth day of December, 1970; and(
b )the period specified in sub-regulation (3.) of this regulation.(6.) Where an officer of the Naval Forces was in receipt of active pay in respect of service; in those Forces at any time during a period to which this sub-regulation applies in accordance with Division 1 of the Third Schedule to the Naval Financial Regulations and the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to be paid active pay at the rate per day specified in relation to his rank—
(
a )in the case of the period referred to in paragraph (a ) of the last preceding sub-regulation—in the Third Schedule to these Regulations; or(
b )in the case of the period referred to in paragraph (b ) of the last preceding sub-regulation—in the Fourth Schedule to these Regulations,exceeds the sum of the active pay paid or payable to him, but for this sub-regulation, in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.
